KPF - Keahlian Isa Samad digantung...

 Hakim Mahkamah Tinggi Kuala Lumpur hari ini memberi kebenaran kepada lima orang peneroka Felda Jengka, Pahang untuk mencabar keputusan Panel Pertikaian Suruhanjaya Koperasi Malaysia yang memutuskan mengekalkan keanggotaan Tan Sri Mohd Isa Abdul Samad sebagai ahli Koperasi Permodalan Felda Malaysia Berhad ( KPF )  meskipun Panel tersebut juga memutuskan keanggotaan Isa Samad adalah bercanggah dengan undang-undang kecil KPF.

Hakim Tuan Abang Iskandar Abang Hashim juga membenarkan permohonan lima peneroka tersebut bagi mendapatkan perintah penggantungan sementara ( interim stay ) bagi menggantung status keahlian dan juga pemilihan Isa Samad sebagai anggota Lembaga KPF atau Pengerusi KPF bagi tujuan pengesahan Mesyuarat Agong perwakilan KPF yang akan diadakan esok .
 

Mahkamah juga menggantung  pelantikan Isa Samad sebagai ahli atau Pengerusi Lembaga KPF sehingga Mahkamah memutuskan kes semakan kehakiman lima peneroka tersebut.

Lima orang peneroka dari Felda Jengka yang juga ahli berdaftar KPF telah melalui firma peguam Tetuan Mohamed Hanipa & Associates memfailkan semakan kehakiman bagi mendapatkan antara lain perintah deklarasi bahawa keputusan Panel tersebut yang diberikan pada 23 Mei 2012 yang memutuskan keanggotaan Isa Samad sebagai ahli KPF adalah kekal meskipun beliau tidak layak menjadi ahli KPF adalah keputusan yang tidak sah dan terbatal.

Mereka juga memohon perintah certiorari bagi membatalkan keputusan tersebut dan perintah mandamus bagi mengarahkan KPF membatalkan keahlian Isa Samad di dalam KPF.

Pendengaran permohonan kebenaran semakan kehakiman didengar petang tadi di mana pihak Peguam Negara melalui peguam kanan persekutuan, Encik Shamsul Bol Hasan telah membantah permohonan lima peneroka tersebut . Di dalam bantahannya peguam negara antara lain berhujah bahawa lima orang peneroka tersebut tiada locus standi bagi mencabar keputusan Panel tersebut dan kes ini , menurut Shamsul, bukanlah kes yang melibatkan undang-undang awam (public law).

Peguam lima peneroka tersebut iaitu Encik Mohamed Hanipa Maidin berhujah kelima-lima peneroka tersebut adalah pihak yang terjejas dengan keputusan Panel kerana mereka adalah antara peneroka yang membawa kes ini untuk diputuskan oleh Panel maka sudah tentu mereka mereka mempunyai locus standi.

Hanipa juga berhujah jika Mahkmah tidak campurtangan di dalam kes ini maka keputusan Panel yang membenarkan orang yang tidak layak menjadi ahli KPF memegang jawatan di dalam KPF akan memberikan impak besar kepada KPF dan sekaligus kepentingan ahli ahli KPF seperti lima peneroka tersebut juga akan terjejas .

Dalam hujahnya Hanipa juga menyatakan keputusan Panel tersebut adalah tidak munasabah dan juga tidak logik kerana meskipun Panel bersetuju Isa Samad tidak layak jadi ahli KPF namun keahliannya dikekalkan.

Hanipa memberi analogi keputusan Panel tersebut samalah seperti hakim mengatakan perkahwinan seorang lelaki dan perempuan adalah tidak sah dan terbatal tapi dalam masa yang sama hakim menyatakan status mereka sebagai  suami dan isteri adalah kekal.
 

Dengan keputusan hari ini dipercayai percubaan Isa Samad untuk hadir Mesyuarat Agung KPF esok dan dilantik sebagai ahli Lembaga atau Pengerusi KPF tidak akan berjaya.- harakahdaily

Court puts freeze on Mohd Isa's KPF membership...

The High Court in Kuala Lumpur has put a temporary freeze on Mohd Isa Abdul Samad's appointment as chairperson of Felda Settlers' Cooperative Bhd (KPF) and his membership in the cooperative. 

Judge Abang Iskandar Abang Hashim said there was merit to the leave sought by four Federal Land Development Authority (Felda) settlers challenging Isa's membership and chairing of KPF.

Justice Abang Iskandar also rejected all preliminary objections raised by senior federal counsel Shamsul Bolhassan, the settlers' lawyer Mohamed Hanipa Maidin told reporters.

isa samad interview 150509As such, the decision in chambers today allows an interim stay on  Isa's KPF membership and his position as chairperson.


"So there is a meeting for the KPF AGM tomorrow and Mohd Isa can't attend it," Hanipa told reporters after emerging from the chambers.

The application for judicial review was filed last Friday by Felda Jengka settlers Abdul Talib Ali, Abdul Mubin Abdul Rahman, Abdul Razak Mohammad and Muhamad Nor Atan.


The Malaysia Cooperative Societies Commission (MCCC), its dispute panel and KPF were named as respondents.


The settlers are challenging the MCCC decision that Isa's appointment to KPF's board is intact despite irregularities. They want the May 23 decision to be declared void and for an order of certiorari overruling it to be issued.

In addition, they are seeking an order of mandamus to compel KPF to cancel Isa's appointment as chairperson. The four are seeking general, aggravated and exemplary damages.


The MCCC has admitted that Isa's appointment violated KPF's by-laws, which require him to be either a settler or a member of a settler's family, and to have been a cooperative member for at least two years before being eligible to be appointed to the board.

Domestic Trade, Cooperatives, and Consumer Affairs Minister Ismail Sabri Yaakob (right) had also weighed in, saying he had used his powers as a minister to exempt KPF from following the by-law in order to allow Isa’s appointment as chairperson.


Hanipa said among the objections raised by federal counsel Shamsul were that the MCCC decision did not affect the settlers, that they had no locus standi to challenge the decision and that the issue was not a matter of public law.

Foreigners to benefit more from FGVH...


PAS president Abdul Hadi Awang today accused Umno of betraying the interests of Malays because the Felda Global Ventures Holding (FGVH) a significant portion of shares are distribute to foreigners.

In a press release today, Hadi pointed out that Felda settlers and staff were only allocated 2.5 percent and 3 percent of the shares respectively.

“However, foreign companies will control up to 20 percent of the shares under FGVH. It is (therefore) possible that foreigners will own Felda assets after the shares are sold,” said Hadi.

Hadi also said that the problem was not just over the distribution of shares, but also the loss of national land which was a betrayal of the nation.

“This is a betrayal of the Malay race, and PAS appeals to all Malaysians to replace Umno with Pakatan Rakyat immediately,” said Hadi.

“Furthermore, this state of affairs is being conducted by a person whose involvement in corruption is admitted by his party,” added Hadi, in reference to Felda chairperson Mohd Isa Samad who was once suspended by Umno on corruption charges.

The FGV prospectus was launched on June 1st, involving more than 40,000ha of Malay reserve land.

However, the listing has been criticised by many parties, including PKR director of strategy Rafizi Ramli who claimed that the land will be held by companies which are not fully bumiputera owned.
