Kafirkan orang juga satu jenayah syariah...

Baru-baru ini kita digemparkan dengan video ceramah YDP PAS Kawasan Padang Serai Shaharuddin Ibrahim yang telah mengeluarkan kenyataan untuk menanam Ketua Pembangkang Malaysia, Datuk Seri Dr Wan Azizah Wan Ismail di jirat sekiranya beliau tidak menyokong RUU 355 di Parlimen nanti. Kenyataan ini secara langsung cuba untuk mengkafirkan Datuk Seri Wan Azizah jika beliau tidak menyokong RUU 355.

Dalam kuliah tersebut, Shaharudin cuba mengkafirkan Presiden PKR Datin Seri Dr Wan Azizah Ismail dengan berkata jika beliau tidak sempat menyokong usul tersebut dan meninggal dunia, beliau akan ditanam di tanah perkuburan bukan Islam.

“Yang Berhormat Kak Wan, Kak Wan nanti Tan Sri Pandikar tanya ahli-ahli yang berhormat siapa yang menyokong akta 355 sila angkat tangan. Kak Wan, Kak Wan kena angkat tangan. Kalau Kak Wan tak angkat tangan, boleh menyebabkan jatuh (gugur) iman, kalau ditakdirkan lepas tak angkat tangan tu mati, kami tanam jirat (perkuburan bukan Islam)”.

Sedarkah YDP PAS ini bahawa kenyataannya itu merupakan satu jenayah syariah dan boleh disiasat dan didakwa di bawah Seksyen 24 Enakmen Kanun Jenayah Syariah Kedah 1988?

Seksyen 24 menyatakan secara jelas bahawa:

(1) Mana-mana orang yang mengatakan atau mengaitkan melalui kata-kata, sama ada bertutur atau tulisan, atau melalui isyarat, atau melalui gambaran yang boleh dilihat atau melalui apa-apa perbuatan, kegiatan atau kelakuan, atau dengan mengelola, menggalak atau memperaturkan apa-apa kegiatan, atau selainnya dengan apa jua cara, bahawa mana-mana orang yang menganuti Agama Islam, atau orang-orang yang tergolong dalam mana-mana kumpulan, kelas atau perihalan orang-orang yang menganuti Agama Islam :

(i) adalah orang kafir, atau


(ii) telah berhenti menganuti Agama Islam, atau


(iii) tidak patut diterima, atau tidak dapat diterima, sebagai menganuti Agama Islam, atau


(iv) tidak mempercayai, mengikuti, menganuti, atau tergolong dalam Agama Islam,

adalah bersalah atas suatu kesalahan dan boleh, apabila disabitkan, dikenakan hukuman denda tidak melebihi lima ribu ringgit atau dikenakan hukuman penjara selama tempoh tidak melebihi tiga tahun atau kedua-duanya.

Peruntukan undang-undang mengenai takfiri ini bukan sahaja di Kedah, malah hampir kesemua enakmen jenayah syariah negeri mempunyai peruntukan yang serupa. Tujuan peruntukkan ini diwujudkan adalah untuk menghalang sikap takfiri di kalangan umat Islam apabila berlakunya perbezaan pendapat baik dari segi agama atau politik. Malangnya hari ini, YDP PAS ini sanggup mengkafirkan sesama Muslim demi kepentingan politik. Inilah bahayanya jika agama dan politik itu dicampuradukkan sesuka hati tanpa batasan.

Adalah amat ironi apabila PAS yang mahu memartabatkan mahkamah syariah, telah melakukan jenayah syariah dengan mengkafirkan orang. Adakah ini juga salah satu usaha untuk memartabatkan Islam? Lebih mengecewakan, tiada satupun pimpinan utama PAS terutamanya Tuan Guru Haji Hadi Awang yang mahu menyangkal atau menegur sikap YDP PAS ini dalam soal takfiri ini. Masing-masing diam seribu bahasa.

Hal ini bukan kali pertama malah di media sosial begitu banyak kenyataan umat Islam mudah mengkafirkan orang Islam hanya kerana mereka berbeza pendapat. Dalam kita mahu memartabatkan Islam kita lupa akhlak Islam yang dianjurkan oleh Nabi Muhammad S.A.W.

Oleh itu, saya turut menyeru agar Datuk Seri Wan Azizah menggunakan saluran mahkamah syariah sedia ada agar kenyataan ini disiasat supaya sikap ini dapat dibendung daripada menular dalam komuniti umat Islam.

Saya menghormati kebebasan PAS untuk membawa RUU 355 ke Parlimen dan mempromosikannya di setiap genap dan ruang di seluruh negara. Namun, apapun yang dilakukan harus ada had dan batasnya jangan sampai ia memburukkan nama agama Islam itu sendiri dengan sikap angkuh dan “holier than thou” mereka.

Sementara itu, Mufti Pulau Pinang Datuk Dr Wan Salim Wan Mohd Noor (pix,atas) mahu supaya umat Islam tidak mengkafirkan sesama Islam berikutan polemik melibatkan rang undang-undang pindaan Akta Mahkamah Syariah 1965 yang bakal dibentangkan di Parlimen pertengahan Oktober kelak.

Beliau melahirkan rasa sedih apabila wujud segelintir agamawan di negara ini yang sewenang-wenang mengkafirkan orang Islam hanya kerana mengambil pendirian tidak bersetuju dengan rang undang-undang tersebut.

“Kita tidak wajar memaksa mana-mana ahli Parlimen menerima RUU355 dengan apa jua cara termasuk mengugut kononnya sesiapa tidak menyokong akan menjejaskan akidah,” tegas beliau dalam satu kenyataan.

Menurut Dr Wan Salim, usul pindaan rang undang-undang tersebut perlu diteliti dari pelbagai aspek perundangan dan dibahaskan demi menghasilkan sebuah undang-undang yang dapat berlaku adil kepada seluruh warga.

“Memang seorang Muslim wajib menerima hukum yang ditetapkan oleh Allah, yang sakral. Tetapi RUU 355 bukan hukum Allah.

“Ini hanya merupakan satu langkah ke arah memperkasa dan memartabatkan Mahkamah Syariah di Malaysia yang akan dibentangkan nanti,” katanya.


Dr Wan Salim berkata, perbahasan dan penelitian perlu dibuat terhadap segala kemungkinan berlakunya kekurangan dan kelemahan tertentu di dalam RUU tersebut yang dan diperbaiki sebelum dijadikan undang-undang.– Roketkini.com

Sejak DOJ (badan keadilan Amerika) mengisytiharkan penemuan yang membabitkan  PM Najib di dalam kasus aktiviti penggubalan wang haram di negara itu hingga Jho Low dan Reza terdakwa dan kini sedang dalam proses kehakiman.

Sejak dari itulah pergerakan Perdana Menteri, Najib Razak selaku Ketua Negara tampak terbatas. Tidak lagi hadir dipersidangan besar dunia, apa lagi kalau lokasinya di Amerika. 

Ini kita perasan, sejak tempat PM Najib Razak (Malaysia) sebagai pengerusi mesyuarat WMD (isu percambahan senjata api) pada bulan Ogos yang lepas di PBB digantikan oleh Timbalannya, Zahid Hamidi. Kenapa TPM Zahid Bukannya PM Najib Razak

Yang juga menjadi tanda tanya pada masyarakat ialah kenapakah PM Najib Razak tidak menziarahi kuburan Allahyarham Datuk Dr Haron Din yang disemadikan di California, Amerika walaupun berpeluang. Apa lagi sebelum itu beliau beriya-iya ingin membawa balik jenazah Allahyarham ke tanah air. Kerana secara kebetulannya persidangan terbesar PBB yang melibatkan 193 negara termasuklah Malaysia sedang berlangsung di New York, Amerika Syarikat.

Tapi tidak dihadiri oleh PM Najib Razak walaupun pada lazimnya sebagai Ketua Negara beliaulah yang sepatutnya pergi. Bukannya Timbalan Perdana Menteri, Zahid Hamidi sebab persidangan yang dikenali sebagai UN General Assembly itu cukup penting yang akan membincangkan isu-isu antarabangsa, meliputi keamanan dan keselamatan.

Zahid having to speak at UNGA is a plan hatched and executed to perfection by the PM's team to kill Zahid's political career and paved the way for Hisham to take over from Najib (who has to leave soon enough)

They enticed Zahid to speak at the biggest forum available so that it will give the most impact. They knew well enough that Zahid will make a fool of himself at the biggest stage available.

Unsurprisingly, Zahid was gullible enough to fall for it thinking that since the PM has his own problems making it untenable for him to be in NY, he should grab this opportunity portray himself as the PM in waiting. 

His team of advisors (most probably from UPM) was also dumb enough not to see this coming. Had they been smart, they would have translated the speech into Malay and had Zahid deliver it in Bahasa Malaysia baku. That would have literally pulled the rug from under the PM's feet. 

Then Zahid's team can welcome Zahid at the airport with banners proclaiming Zahid to be "Bapak Bahasa Melayu" without the rakyat even realising that actually their leader cannot even pronounce "Palestinian" in English properly.

The team which wrote the speech made sure that the sentence structures will be difficult to pronounce even for those conversant in the language. They even threw in a few tongue twisters for impact so much so Zahid can't even pronounce some words correctly.

Now the set is set for Hisham to take over and save the image of the country at the next UNGA. Najib's team is now ready to promote their new saviour fresh from rescuing the country during the MH370 public relations disaster.

The only thing they forgot is that there is one smart alex who was said to have graduated from Oxford and can speak English with a British accent is also waiting in the wings and ready to get into the fray.

Cakap pasai demokrasi salah, tonggek juboq OK pulak...

Hari ini mencatatkan satu lagi sejarah hitam buat negara apabila ahli parlimen Batu Tian Chua, disabitkan bersalah. Mengikut Seksyen 4(1) (b) Akta Hasutan, hakim menyatakan bahawa naib presiden PKR merujuk perkataan “bangkit” dan “turun ke jalan raya” sebagai bersifat menghasut.

Pada 11 Julai 2012 Datuk Seri Najib Razak mengumumkan kerajaan mengambil keputusan untuk menguatkuasakan secara serta-merta semua akta baru dan memansuhkan Akta Hasutan 1948 serta digantikan dengan rang undang-undang yang dikenali sebagai Akta Keharmonian Nasional.

Saya juga pernah membangkitkan - pada 2013 - berkenaan janji perdana menteri memansuhkan akta hasutan.

Sehingga hari ini, terdapat lebih 30 anggota parlimen pembangkang didakwa di bawah Akta Perhimpunan Aman (PAA 2014) dan Akta Hasutan yang turut dibebankan kepada aktivis-aktivis politik dan kartunis.

Pada Oktober 2015, saya telah menulis kepada Kesatuan Antara Parlimen (IPU) untuk mengeluarkan kenyataan berkenaan lapan orang anggota parlimen daripada PKR, sembilan daripada DAP, dua daripada Parti Amanah Negara (AMANAH) dan seorang daripada Parti Sosialis Malaysia (PSM).

Data ini menunjukkan kerajaan BN tetap akan menggunakan dasar-dasar menekan pembangkang dan sesiapa saja yang lantang bersuara mempersoalkan urus tadbir negara.

Minggu lalu Suruhanjaya Pilihan Raya (SPR) mengeluarkan syor-syor dikenal pasti memberikan impak negatif kepada kawasan yang dimenangi oleh pembangkang.

Minggu ini, kita dikejutkan dengan sabitan hukuman kepada Tian Chua yang kononnya menghasut dalam satu forum tiga tahun lalu.



Ingatan mansuh Akta Hasutan

Justeru, keseluruhan keputusan yang diambil kerajaan ini jelas menunjukkan mereka terdesak untuk mengekang suara rakyat dan mana-mana pihak yang dilihat mengancam mereka.

Anggota parlimen daripada pembangkang akan disibukkan dengan isu dan kes mahkamah.

Pada masa sama agensi-agensi kerajaan digunakan untuk menjadi tangan-tangan ghaib menyelamatkan kerajaan.

Menghasut rakyat untuk menegakkan hak bersuara dan demokrasi dalam kes Tian Chua rupa-rupanya satu kesalahan, tetapi menghasut rakyat dengan provokasi dan ancaman huru-hara dalam kes Datuk Jamal Md Yunos dan Ali Tinju (Mohamad Ali Baharom) bukan kesalahan?

Atau saya silap. Kes mereka masih dalam siasatan?

Harus berapa tempang lagi sistem kehakiman dan keadilan negara akan melenyapkan suara rakyat?

Pada 26 September 2016 saya telah memfailkan satu surat pindaan usul di bawah akta 27 (1) menggantikan Akta Hasutan kepada Akta Keharmonian Nasional.

Usul ini adalah juga merupakan satu peringatan kepada janji perdana menteri untuk memansuhkan Akta Hasutan pada 2012.

Kita nantikan pelunasan pemansuhan akta yang bakal memberi cek kosong kepada BN untuk terus menindas rakyat menerusi dasar-dasar menekan tanpa suara wakil rakyat pembangkang sebagai penimbang tara. - Nurul Izaah, mk

Gerard Lourdesamy - How can these words be seditious? ‘Turun ke jalan’ and ‘bangkit’ can refer to taking to the streets to protest against the government which is permitted under the Peaceful Assembly Act 2012. The accused did not say “turun ke jalan dan gulingkan kerajaan”. The former CM of Malacca can accuse the Raja Muda of Selangor of being a murtad and get away with a fine. Does this mean that Umno politicians are above the law? The attorney-general (AG) should explain these double standards in decisions to prosecute. To accuse a Muslim of being a murtad without a shred of proof is not only a grave sin in Islam but clearly seditious since it has the tendency to encourage disloyalty and disdain for the future ruler of Selangor. The law is increasingly becoming an ass in Malaysia.

Ferdtan - The judge had found that the words used by Tian Chua as seditious, then we might as well ban such words from Malaysian dictionary from being used. That would save the courts’ time to judge on cases that would serve ‘real’ justice, instead of making such decisions on political cases that are seen to benefit the ruling government. The words, 'bangkit' (rise up) and 'turun ke jalan raya' (take to the streets), from now onward should not be spoken and written. Period. Comedy? Malaysians just don’t know whether to laugh or to cry. Even if those words are in different contexts, completely non-political, it is still not-advisable; the reason is that the people in-charge of enforcement agencies are often seen to lack in language proficiency - especially English.

Aziz Kader - I am not a law graduate but funny how could the words 'bangkit' (rise up) and 'turun ke jalan raya' become sedition? Unless 'bangkit' (rise up) and 'turun ke jalan raya' if the phrase continues to mention kill or harm someone, only then can it be classified as sedition. If the phrase continues to fight for justice against regime, how could that be sedition?


DOJ aware of at least US$3.5b stolen.Auditor report (Najib declared ‘Secret’) assessed US$7b stolen. Key person directly charged is Jho Low. Low is Najib's personal ‘advisor’ at 1MDB.

Malaysia dah jadi negara polis kot...

Adakah Malaysia sudah menjadi negara polis apabila pihak polis tidak boleh ditegur sehingga Ketua Polis Negara (KPN) Tan Sri Khalid Abu Bakar dengan angkuhnya memberi amaran kepada Ahli Parlimen Kulai, Teo Nie Ching, supaya tutup mulut hanya kerana bertanya mengapa siasatan lambat dibuat?

Tindakan KPN memberi amaran terhadap Teo Nie Ching, semata-mata kerana wakil rakyat tersebut mendesak polis menjalankan siasatan segera berhubung satu dakwaan ugutan terhadap pemimpin Bersih 2.0, membuktikan kebebasan bersuara yang sudah pun terhad di Malaysia kini semakin terhakis.

Teo Nie Ching hanya menjalankan tugasnya sebagai Ahli Parlimen yang menuntut keadilan dilaksanakan berikutan ugutan oleh ketua kumpulan Baju Merah, Mohd Ali Baharom yang mengancam nyawa Pengerusi Bersih 2.0. Maria Chin Abdullah. Teo Nie Ching membuat kenyataan beliau kerana mendapati pihak polis belum berbuat apa-apa selepas ugutan tersebut dibuat secara terbuka.

Semata-mata menyuarakan pandangannya, Teo Nie Ching diberi amaran keras agar tidak mencampuri urusan polis serta tidak mempolitikkan isu tersebut. Saya tidak faham apa yang tidak boleh dicampuri dan apa yang dikatakan dipolitikkan. Ahli Parlimen adalah wakil kepada rakyat dan beliau berhak bersuara. Apakah Ahli Parlimen hanya perlu membisu apabila melihat ugutan, ancaman dan hal-hal jenayah berlaku di depan mata?

Begitu juga dengan kes Ahli Parlimen Jelutong, Jeff Ooi, yang terlibat dalam isu tweet tentang kematian Mursyidul Am PAS, Datuk Dr Haron Din. Saya sendiri telah membuat teguran terhadap tweet Jeff Ooi sebagai tidak sensitif dan melahirkan perassan kesal kepada keluarga Allahyarham.

Namun, apabila KPN mengeluarkan kenyataan bahawa Jeff Ooi “mulut gatal” dan menuntut agar Jeff Ooi menyerah diri atau menghadapi tindakan polis, ia menggambarkan seolah-olah berlaku jenayah besar. Apakah tweet yang “tidak sensitif” atau seorang yang “mulut gatal” sudah menjadi jenayah besar di Malaysia? KPN juga dilaporkan mengatakan bahawa Jeff Ooi akan disiasat di bawah Seksyen 298 Kanun Keseksaan yang berkaitan dengan sesuatu yang menimbulkan kebencian atau berniat jahat untuk menjejaskan keharmonian.

Disamping itu, tindakan oleh KPN bersifat double-standard. Persoalannya, mengapa tindakan polis dan layanan yang sama tidak dikenakan terhadap Ahli Parlimen Langkawi, Datuk Nawawi Ahmad? Apa yang Datuk Nawawi lakukan jauh lebih teruk. Nawawi telah mengaitkan identiti “Malaysian Official 1” atau MO1 yang dituduh terlibat dalam pencurian dana 1MDB oleh Jabatan Kehakiman Amerika Syarikat (DOJ), dengan Yang di-Pertuan Agong.

Yang di-Pertuan Agong adalah Raja dan Ketua Negara Malaysia yang tidak boleh dihina, dituduh atau dipermain-mainkan. Ia adalah jaminan Perlembagaan Persekutuan. Tetapi martabat dan peranannya YDPA telah dihina sebagai MO1 yang terlibat dalam skandal 1MDB. Skandal 1MDB terjijik yang mencuri wang rakyat Malaysia sehingga kerajaan Amerika Syarikat ingin merampas aset USD1 Billion milikan pegawai 1MDB. Namun, tiada sebarang tindakan terhadap Ahli Parlimen UMNO itu yang lebih teruk daripada “mulut gatal”!

Bukankah ini pilih kasih atau double standard?

Malah, apabila pemimpin DAP, Karpal Singh, meninggal dunia pada April 2014, bekas pemimpin Perkasa, Zulkifli Noordin telah menulis tweet: “Dalam keadaan kemelut kerajaan PAS Kelantan mahu melaksanakan hudud dengan bantuan Umno, Allah telah matikan Karpal yang menjadi penentang utama pelaksanaannya!”

Tetapi tidak ada sebarang tindakan dikenakan terhadap penulis tweet tersebut. Inilah yang menjadikan pelaksanaan dan penguatkuasaan undang-undang di Malaysia semakin tidak adil kerana berlakunya double standard yang jelas lagi terang. – Roketkini.com

Over last weekend, the newspapers reported two horrific stories about rape, both involving underaged girls.

In one case, we were told that four teenage boys had gang-raped a 13-year-old girl, in a hut, in an oil-palm plantation in Kampung Manong, Ayer Hitam.

When some villagers came upon the group, two boys fled on a motorcycle, leaving behind two teenage boys, aged 14 and 15, with the victim. They tried to hide behind a tree, but were eventually caught by the villagers. The victim's father has since made a report at the Ayer Hitam police station. 

The boys were caught around 2 pm on Thursday, 15 September. Did this incident happen during the short school break between Hari Raya Haji and Malaysia Day? Did the parents know the whereabouts of their daughter? Did the girl know the boys? Had she been led there under false pretences and was she a willing victim?

The second story is about a Sarawakian man, and it echoes the story of the 78-year-old Austrian called Fritzl, who enslaved his daughter, Elisabeth for 24 years, in Amstetten, before she was rescued. Fritzl was jailed for life in 2009 for rape, incest, enslavement, neglect, and murdering one of his children.

A 16-year old Sarawakian had travelled from Lundu in Sarawak to visit her father, in Kuala Lumpur, because she wanted to lodge with him, whilst she received further education in the city. The 38-year-old man lived in a flat in Chow Kit Road.

She was raped on the night she arrived. Over the following few weeks, he repeatedly raped her, attacked her with a hammer, and partially strangled her or threatened her with a knife, to force her to have sex with him, and to warn her to keep silent about his evil deeds.

The sad thing is that the girl arrived in KL on 26 August and her neighbours did not hear her screams for two weeks. They immediately alerted her mother, in Lundu, who lodged a police report on 8 September.

The father, who sold religious text books for a living, was caught. When the girl was rescued, she was bruised and cut, and rushed to hug a policewoman,  who was part of the rescue team.

The victim's father denied that he had forced his daughter to have sex with him, and claimed that he "hugged his daughter to cure her of her home-sickness."

Why did it take the police another week to rescue the victim? The mother must have given the girl's address to them, when she made the report.

So, why was there a delay? This poor girl's ordeal could have been over more quickly.

The girl was working at a nearby shop, which was close to the Chow Kit police station, to help support herself. Having been beaten and physically hurt, she was so traumatised and fearful of her life, that she failed to lodge a police report.

The two stories of rape, over the weekend, should make officials at the relevant ministries revise their plans to introduce sex education only for boys.

What is the point of only giving sex education to boys? Girls need sex education just as much as boys.

They need to know that if they are raped, they must report it, and not suffer in silence.

Perkataan ‘dedak’ yang dipopularkan mantan Perdana Menteri, Tun Dr Mahathir Mohamad dan sering dikaitkan dengan Datuk Seri Najib Razak telah menjadi satu konsep untuk menjelaskan bagaimana sokongan terhadap Perdana Menteri kini itu digembleng demi kepentingan politik peribadi dan kelangsungan partinya, UMNO.

“UMNO bukan UMNO lagi, UMNO sudah jadi parti Najib,” demikian keluh Mahathir yang sering kita dengar dalam ucapannya di mana-mana.

Ia selalu dipadankan dengan kenyataan bahawa pemimpin UMNO kini telah disumbat dedak sehingga penuh mulut, mata dan telinga sehingga tidak boleh melihat dengan hati nurani yang bersih dan menilai perbuatan jahat dan terkutuk Najib yang menjarah hasil kekayaan negara dan rakyat.

Namun, seperti mana kiamat akan tiba perlahan-lahan tapi pasti, seperti itu juga kedudukan Najib dalam pentadbiran negara. Dedak akan habis, dan Najib akan kehabisan cara.

Seperti biasa, tanpa segan silu, beliau dengan kuasa yang ada ditangan akan menggunakan segala instrumen negara, memanipulasi dan melacurkan segala jenis retorik untuk mengaut sokongan yang semakin menghilang.

Justeru, adalah tidak ganjil untuk kita melihat Suruhanjaya Pilihan Raya (SPR) (sekali lagi) diperkudakan Najib untuk diarah seperti anak kecil untuk melukis semula peta kawasan pilihan raya di peringkat negeri mahupun nasional.

Ia dilakukan semata-mata demi mengembalikan majoriti dua pertiga yang tidak mampu digapai Barisan Nasional pada Pilihan Raya Umum ke-13 yang lalu.

Malah, adalah pelik dan ajaib sekiranya Najib tidak mempertimbangkan muslihat itu.

Hasilnya, sebagai contoh, kawasan seperti Petaling Jaya Utara (yang akan diperkenalkan semula sebagai Damansara) mempunyai 150,439 pengundi dengan peningkatan 76.2 peratus berbanding PRU-13.

Malah, polarisasi kaum dilihat kian ketara dalam cadangan persempadanan semula yang dikemukakan SPR pada Rabu minggu lalu itu.



Pihak pembangkang mendakwa, terdapat lambakan beberapa kaum di beberapa kawasan Parlimen mahupun Dewan Undangan Negeri (DUN). Jelas sekali, Najib meneruskan legasi ‘pecah dan perintah’ yang pernah dibawa penjajah British suatu ketika dahulu.

Lalu, timbul pula persoalan, bagaimana proses dan pusingan pencabulan institusi negara ini dapat dihentikan serta merta, dan diganti dengan sistem yang benar-benar mencerminkan amalan demokrasi dan Perlembagaan Persekutuan?

Ia harus dipertanyakan kepada pihak Pakatan Harapan, kerana kita sedia maklum bahawa taktik ‘gerrymandering’ ini telah dipatahkan pada dua pilihan raya umum yang lalu.

‘Senjata makan tuan’ harus menjadi konsep taktik serang balas parti-parti pembangkang termasuk Parti Pribumi Bersatu Malaysia (Bersatu) yang perlu dirangka dengan penuh halus dan jitu demi memusnahkan cita-cita Najib untuk terus berkuasa.

Ia sekaligus menjadikan hasrat rakyat untuk melihat Najib dibawa ke muka pengadilan, dapat direalisasikan.

Di peringkat akar umbi, rakyat khususnya, selain menjadi tanggungjawab untuk mengundi menjatuhkan regim, harus menunjukkan kesepaduan bersama pertubuhan masyarakat sivil, seperti Gabungan Pilihan raya Bersih dan Adil (BERSIH) yang mengutuk sekeras-kerasnya cadangan persempadanan semula SPR itu.

Menyokong BERSIH sama seperti menyokong hak demokrasi ditegakkan dengan maknanya yang murni.

Dan dengan cara ini – kesepakatan pakatan pembangkang (tanpa PAS pastinya) dan kuasa rakyat – pasti akan meruntuhkan tembok ‘dedak’ atau apa pun juga yang telah menjadi penghalang kepada semangat untuk menghidupkan kembali prinsip demokrasi di negara ini. – Roketkini.com

Planning to vote in GE-14? Your area might not even exist anymore...

So…. the General Elections are a-comin’ just around the horizon in 2018, unless you believe the bisik-bisik cerita that it might be a lot earlier – like middle of next year. But whichever the case, nothing much will change for us regular voters – we head to the polling station, queue up and play spot-the-foreign-voter, mark our favorite candidate an——- wait, why isn’t my area here anymore???! 

Yup, a bunch of Opposition MPs have recently pointed out that their areas (proper word: “Constituencies”) have suddenly disappeared, as if someone spilt a very big vat of leftover indelible ink from GE 13 over the entire town.

Shiok sendiri jokes aside, this is actually a pretty serious matter since even BN component parties MCA and Gerakan are really unhappy about it. 

But first, here are some of the changes that you can expect come GE14: 

Seputeh (DAP) has been renamed to Sri Petaling 
Kelana Jaya (PKR) renamed to Subang 
Serdang (DAP) renamed to Bangi 
Petaling Jaya Utara (DAP) renamed to Damansara 

In total, 12 parliamentary seats and 34 constituencies are looking to have their names changed. Not just that, 128 out of the 222 Parliamentary constituencies will have their boundaries redrawn. 

Don’t worry if this doesn’t make sense, we’ll explain what this is (and how it might be a bad thing) below. It’s part of something called a “Redelineation Exercise” – where voters get moved around


SPR move

In regards to the name change, Thomas Fann of Bersih 2.0’s Delineation Action and Research Team tells us that it’s not that big a deal. 

“The name change may be annoying for some affected voters but on its own it doesn’t have any impact. The major issue is [improper redrawing of the boundaries]” – Thomas Fann 

In a pretty little nutshell, “Redelineation” or sometimes called “Delimitation” is the Election Commission (EC)’s ability to redraw the boundaries of a constituency, meaning it can be made bigger or smaller depending on certain criteria that they need to fulfill, usually to ensure that voters are properly represented and able to vote conveniently. 

As a super-simple example, think of it as rearing cows and goats separately on a piece of land… You may have have initially split the land evenly for each animal, but if the cows are breeding faster than the goats, then you’ll have to make more space for the cows. So the most logical thing to do is to move the fence to “eat” into the goat’s space (aka delineation):

Of course, it isn’t as simple when it comes to doing this for voters. 

The Federal Constitution basically lays out a whole bunch of guidelines that the EC has to abide to during a delineation exercise – such as making sure a constituency doesn’t land between two different states, and giving a 30-day buffer for people to object to their decision before finalizing it. This is because.

If done wrong, delineation can directly affect the results of an election without you knowing!

The logic is pretty straightforward… In the image above, say JAR A has 80 yellow beans and 20 black beans while JAR B has 10 yellow and 40 black. If Yellow Party wants a majority number of beans in both jars, all they have to do is to move 40 yellow beans from JAR A to JAR B. That way, you’d end up with a 40/20 majority in JAR A and a 50/40 majority in JAR B. Sure, JAR B might be overflowing at this point but, hey, objective achieved!

In terms of what’s actually happening with the recent delineation, Petaling Jaya Utara (renamed to Damansara) had their boundary redrawn so that it went from 85,000 voters in 2013 to over 150,000 voters today. On the other hand, 50,000 voters were moved out of Subang, reducing the number to 73,000.

Like magic, right? This is called Gerrymandering, which we explained in a previous article… But if you support the party then no issue la right? After all, you vote for them because you believe that they are the best people to represent your interests, kan? 

Well, not really because your votes may be “wasted” and it causes a whole lotta other problems later!

Well, the major thing that becomes obvious is that if the boundaries are drawn in such a way that favors a particular party, then your precious vote – that symbol of democracy that you’re so proud of exercising – is essentially meaningless. For example, IF (we said IF) the existing 85,000 voters in Petaling Jaya Utara were gonna vote for Opposition, and the majority of the 65,000 voters added in this current delineation were also Opposition supporters, then it means that their votes would be worth less because – 85,000 or 150,000 votes – it still translates to only one seat in parliament. 

But it doesn’t end there, because improper delineation (whether parliament or state constituencies) causes various problems for people living in these areas AFTER the elections, such as:

1. Your housing area becomes separated! 

One of the no-no things prevented by the Federal Constitution, which is that a delineation cannot separate families and communities. However some communities have found themselves under two different parliamentary constituencies, such as in Subang Jaya, where the boundary cuts across a neighborhood – leaving half of them under Hannah Yeoh (DAP, Subang Jaya) while their neighbors across the street are under Nik Nazmi (PKR, Seri Setia). 

2. The person you voted for cannot take care of you

Many constituencies are separated based on natural boundaries (like islands) and socio-economic needs. The problems happen when liberties are taken with the boundaries and drawn in a way that doesn’t make sense. For example, Pulau Ketam shares the same representatives with people from mainland Klang – which is not even on the coastline! So where should the representative be based, on the island or the mainland? Either way, one side loses out. 

And when you consider again that Petaling Jaya Utara now has almost double the amount of voters, it also means that the municipal council, state representatives, and MP also have double the amount of people to take care of! 

3. Instead of talking to one person to get something done, you need to talk to three. 

Generally, when there’s a problem within a community (like bad roads or broken street lamps), you’d reach out to your state representative (ADUN) within your constituency so that he or she can sort it out with the local municipality council (Majlis Bandaraya). However, if boundaries aren’t properly drawn out, you may end up with 2 or more Majlis Bandaraya within one constituency, and each Majlis may have different rules and regulations that they follow. So when there’s a problem, your poor ADUN will have to deal with two or three different Majlis, taking more time and effort than it normally should.

Unfortunately, what we can’t tell you is whether your constituency has been gerrymandered or not, since the EC aren’t required to justify their reasons for redrawing each boundary. This is an issue with ethics and transparency that we’ll have to address another time, but for now, Thomas has a pretty easy way of finding out for yourself:

“If you find the name of your voting constituencies doesn’t make sense to you, it could be an indication that you are in a gerrymandered constituency. For example, my constituency is P161 Pulai even though I live near to JB centre. To me Pulai is a rural area far from where I stay.” – Thomas Fann, head of DART. 

Also, while the EC announced their delineation results in newspapers, websites, and (mostly) in the local majlis bandaraya offices, we have to point out that their site is still undergoing some security issues:

The EC has denied that they’re up to any hanky-panky but if you disagree with their decisions, there’s some good news… 

You can still do something about it NOW – but time is running out!

Following the rules of the Federal Constitution, one thing the rakyat can do to stop their constituency from being messed around with is to get at least 100 people to sign a petition and have at least one representative to speak to the EC. The only catch here is that everyone who signs MUST be a voter in that constituency – meaning that you can’t sign a petition in Petaling Jaya Utara Damansara if you’re registered to vote in Kelana Jaya Subang. 

And you only have 30 days to do it – the deadline for all petitions and objections is October 14th 2016.

Expensive Medicines : Ripping Off The People...

There is a company that imports medicines from India and sells it to Government hospitals.  India is now a major pharmaceutical power in the world and it manufactures high quality drugs but very cheaply.  

This particular company buys the drugs in India at a cost of about RM10.00 per pack.  They say that if they can sell their imported medicine directly to the Government hospitals, they will charge the Government about RM15.00 per pack - which means they slap on a 50% mark-up to cover transportation, expenses and of course some profit for them.  

But the drug is actually sold to the Government hospitals for RM45.

Here is how it happens.  The importing company cannot sell the drugs directly to the Government.  
They must go through P***niaga which we all know is a Dumbno company.  

Its Directors include U*M boss, A---d P----s S--in, failed outsourcing guru Azman Y---a and Dumbno henchman Raja N--g C--k.  But even here the company cannot sell the drugs directly to P----niaga at RM15.

They first have to sell their drugs to yet another crony company which is "connected" to P----niaga.  So the crony intermediary buys the drugs first at RM15.00 and then sells it to P----niaga at a mark up of say RM30.00.  

This is how cronies do business.  It’s called "rent-seeking", no need to sweat or take risks, just collect, collect, collect!  They pretend that this is NEP.  

The interesting thing is this is just a paper transaction.  They may not even take physical possession of the drugs.  They may just tell the importing company to deliver the drugs directly to P-----niaga.  They just bill P----niaga and cream off the difference.

Now kawan-kawan, this has been going on for donkey years since P-----niaga was set up in the 1990s.  Then P-----niaga finally sells the drug to the Government hospitals for RM45.00 a pack.  And who pays for all this creaming off?  

It is you and me, Encik Taxpayer and the ordinary folks.  Who are the suckers?  Haramkah duit ini?  It's called STEALING from the RAKYAT and this is just ONE example of their normal rasuah Dumbno's business deal.  

This is now otherwise known as GOVERNMENT’s STEALING TECHNIQUE.
   
And to add salt to the wound; the generic version is sold to the government at a cost more expensive than the original !  

For example Rocephine for meningitis.  Happened when I was in the government.  

Sent big protest letter as I didn’t want to take risks with patients' lives in serious infections like this.  

Reply was : inform if any adverse reactions occur with the generic drug.
