Tol Plus naik 5% 3 tahun sekali mulai 2016 hingga 2038...


Kadar tol PLUS naik setiap 3 tahun sekali bermula 2016, kata Putrajaya...

Projek Lebuhraya Usahasama Bhd (PLUS) akan menaikkan kadar tol mereka di bawah perjanjian konsesi mereka setiap 3 tahun sebanyak 5% bermula tahun hadapan, kata Timbalan Menteri Kerja Raya Datuk Rosnah Abdul Rashid Shirlin.

Beliau berkata, kenaikan itu akan berterusan sehingga tamat tempoh perjanjian konsesi pada 2018.

Kadar kenaikan tol merupakan sebahagian daripada konsesi tetapi Putrajaya sebelum ini menangguhkan beberapa kali disebabkan pilihan raya.

PLUS dimiliki syarikat milik negara Khazanah Nasional Bhd.

"Berdasarkan perjanjian tambahan konsesi yang ditandatangani pada November 2011, kerajaan dan PLUS bersetuju untuk tidak menaikkan kadar tol selama 5 tahun antara 2011 dan 2015.

"Kenaikan itu hanya akan dilaksanakan pada 2016, kecuali untuk Jambatan Pulau Pinang, yang tidak mengalami kenaikan tol sehingga tamat perjanjian konsesi pada Disember 2018," katanya kepada pemberita di Parlimen, hari ini.

"Kadar kenaikan tol ditetapkan pada kadar 5% setiap 3 tahun dan akan tamat tempoh konsesi pada 2018," katanya, selepas menjawab soalan tambahan di Dewan Rakyat daripada Datuk Ahmad Fauzi  Zahari (BN-Setiawangsa).



Fauzi bertanyakan sekiranya tempoh konsesi dilanjutkan, ia bermakna tidak akan berlaku kenaikan tol sehingga 2018

Kali terakhir perjanjian konsesi PLUS disemak semula adalah pada 2011, di mana syarikat konsesi itu dibenarkan menaikkan tol sebanyak 5% setiap 3 tahun.

Rosnah bagaimanapun berkata, tiada kenaikan tol sejak 2011 sehingga sekarang.

Beliau turut mengesahkan kenaikan kadar tol hanya akan  bermula tahun hadapan.

Dalam pada itu, Rosnah berkata, kerajaan akan mengkaji permohonan PLUS berhubung kenaikan tol dengan mengambil kira indeks harga pengguna dan jumlah trafik yang diperakui oleh juruaudit bertauliah.

"Ini bermakna tidak akan ada kenaikan secara automatik kepada PLUS," katanya. 

Terdahulu, Ahli Parlimen Pokok Sena, daripada PAS, Datuk Mahfuz Omar di lobi Parlimen mengkritik tindakan itu dan berkata, ketika tempoh konsesi PLUS dipanjangkan, kadar tol tidak seharusnya dinaikkan. – tmi

5% toll hike every 3 years starting 2016...

Toll charges at the Projek Lebuhraya Usahasama Bhd (PLUS) will be increased five per cent every three years starting 2016 until the concession period ends December 31, 2038, said Deputy Works Minister Rosnah Abdul Rashid Shirlin.

Rosnah clarified this with reporters after answering a supplementary question in Parliament by Setiawangsa MP Ahmad Fauzi Zahari on whether the extended concession period meant there would be no toll hikes until 2038.

“Based on the PLUS supplementary concession agreement signed in November 2011, the government and PLUS Expressway Bhd (PEB) agreed not to increase toll rates for five years between 2011 and 2015.

“The hike will be implemented in 2016, except for the Penang Bridge, where the toll rate will not be increased until the end of the concession period in December 2038.

“The toll increase is set at 5 per cent every three years until the end of the concession period in 2038,” she said in a written statement today.

Rosnah stressed that the government would review PLUS’ request to increase toll rates by taking into account the Consumer Price Index (CPI) and traffic flow verified by certified auditors.

“This means that there will be no automatic toll hike by PLUS,” Rosnah added.- fmt

Din warns Malay support for UMNO down to 30%...

Umno deputy president Muhyiddin Yassin has warned that Malay support for the nationalist party has dwindled to 30 percent, while 78 percent are unsatisfied with the present state of the economy.

Citing a survey by the Merdeka Center, Muhyiddin said Malay support for Umno over the years has been above 50 percent.

“However, it has of late dwindled, to 30 percent now. Umno has always been at the forefront in terms of gaining Malay support, but this has dwindled.

“Similarly, the (percentage of) people satisfied with the present economic situation is only at 17 percent and there are 78 percent who are not satisfied with the present state.

“The level of Chinese support for the government has also dwindled, from 13 percent in the last general election to only five percent at present. It may be lower in two years.

“This is the reality facing Umno and BN as a result of the present leadership, due to 1MDB. And if not corrected, within two years (in the next general election) Umno may lose,” he said.

Speaking for more than an hour at the Pagoh Umno division gathering yesterday in show of support for him, Muhyiddin expressed hope that the present leadership, be it at the division or supreme council level, would take heed of the survey, as it represents the sentiments of the population.- mk

Kira2 200 cawangan UMNO suruh Najib belah...



Gabungan Ketua Umno Cawangan Malaysia yang mendakwa mewakili kira-kira 200 cawangan Umno, mencabar presiden parti itu, Datuk Seri Najib Abdul Razak supaya mengadakan pemilihan Umno tahun depan.

Mewakili mereka, Ketua Cawangan Kampung Railway, Mohd Said Midon berkata, cabaran itu adalah sebahagian daripada agenda mereka, selain mendesak Najib berundur daripada memimpin parti itu.

Jun lalu, Najib mengumumkan pemilihan parti itu yang sepatutnya berlangsung tahun depan, ditangguhkan selama 18 bulan untuk mengukuhkan parti.

“Kalau dia (Najib) bijak, buat pemilihan pada (perhimpunan agung Umno) 2016, itu yang terpenting sebelum menghadapi pilihan raya.

“Sekarang ini desakan kita ialah untuk Najib undur dan adakan pemilihan parti pada 2016 untuk jalankan pemutihan seperti parti PAS buat, kerana macam itulah akan kembalinya keyakinan Umno itu sendiri dan juga orang ramai,” katanya.

Mohd Said menegaskan demikian dalam sidang media di majlis 'Mendemokrasikan Umno' lewat malam tadi yang menurutnya dihadiri ketua-ketua cawangan dari seluruh negara.

Mohd Said berkata, pemilihan parti perlu diadakan sebagai proses pemutihan di dalam parti bagi memastikan Umno terus kekal relevan.

Bagaimanapun, ketua-ketua cawangan yang terlibat malam tadi tidak akan menolak sekiranya di dalam pemilihan akan datang, Najib terus dipilih untuk kekal memimpin Umno.

“Itu kuasa Alalh dan kami terima (jika Najib menang dalam pemilihan), tetapi pemilihan itu mestilah dijalankan dengan cara baik dan jujur. Dia bertanding dan menang, kami terima, tetapi dengan syarat kena berubahlah, jangan terus jadi macam ini (merosakkan kepercayaan akar umbi dengan tindakan yang tidak relevan).



“Kalau tak berubah, PRU14 nanti akan menghancurkan,” kata Mohd Said lagi.

Dalam perkembangan yang sama, Ketua Umno Cawangan Bandar Puteri, Mohd Shukor Mustaffa berkata ahli Umno berada di dalam keadaan kecewa.

Sebelum ini, Ahli Majlis Tertinggi Umno, Datuk Seri Ismail Sabri Yaakob dilaporkan mendakwa kumpulan yang menentang Najib sebagai mereka yang kecewa.

“Saya nak jawab, sebenarnya memang kami kecewa... yang teramat sangat kalau boleh nak menangis. Sebab apa, tangan kita yang memangkah ini dan amanah yang kita bagi pada pemimpin ini tidak dapat dilaksanakan, kami amat kecewa,” jelas Mohd Shukor mengulas kenyataan Ismail itu.

Susulan itu, Gabungan Ketua Umno Cawangan Malaysia ini berkata bahawa mereka akan tetap mempertahankan Umno dan terus berjuang bagi memastikan parti itu berada pada landasan perjuangan yang asal.

Malah, kumpulan itu tidak menolak dan akan mendukung penuh kepimpinan Timbalan Presiden Umno, Tan Sri Muhyiddin Yassin sekiranya beliau menggantikan Najib sebagai presiden.

“Kami akan sokong, sebab itu memang tradisi kami, ikut hirarki parti... tiada masalah jika sesiapa pun yang ganti presiden,” kata Ketua Umno Cawangan Taman T.K.K, Kamarul Azman Habibur Rahman.

Turut hadir di dalam perjumpaan tertutup tersebut ialah bekas ketua Wanita Umno Bahagian Gopeng, Datuk Hamidah Osman yang baru dipecat dari parti itu atas alasan lantang mengkritik kepimpinan Umno dan melanggar disiplin parti. - mk

Lawyer Americk Singh Sidhu has dismissed a police description of his client Charles Morais as “a coward” by giving a reminder of another time when a sworn statement was made with explosive allegations about the Altantuya Shaariibuu murder.

“Charles is not a coward. Charles is not stupid […] if the IGP remembers what happened to P Balasubramaniam,” said Americk, who also represented Bala at the time.

Bala, a private investigator, had linked Najib Razak, then deputy prime minister, to the Altantuya case but later recanted and fled into hiding in India. He returned in 2013 and vowed to expose the truth but died of a heart attack weeks later.

This morning the Inspector-General of Police said Charles Morais was “a coward” for having left the country the same night after producing a sworn statement at a press conference, alleging a high-level conspiracy in the murder of his brother Kevin Morais, a government prosecutor.

Kevin has been linked to a draft criminal charge that was purportedly to be issued against the prime minister, Najib Razak, in the investigations concerning 1Malaysia Development Bhd.

Americk said Charles Morais had been in Malaysia for two months to arrange for a second post-mortem on Kevin’s body but another brother had claimed the body from the mortuary and there was no longer any reason for Charles to be here.

“He (Charles) is a businessman. He’s been here for two months, he has businesses to run in America. So how can the IGP criticise him for leaving? He’s been here long enough,” Americk said, according to Malaysiakini.

Richard Morais, younger brother to Charles and Kevin, had claimed Kevin’s remains on Monday after more than two months.

Police have said Charles was being investigated under Section 124L of the Penal Code for attempted sabotage, to which Americk said: “Why are they (the police) going after the whistleblower again? Why don’t they investigate what Charles has said in his statutory declaration. Don’t you think that is the first thing they should be doing?” - fmt

Wartawan Veteran, Datuk A. Kadir Jasin mendakwa, kepimpinan UMNO telah tersesat apabila menjadikan Perhimpunan Agung UMNO (PAU) seolah-olah mesyuarat Kabinet.

Katanya, perkara itu berlaku apabila mereka gagal membezakan antara parti dan kerajaan.

Malah, perkara sama yang turut berlaku apabila mereka juga tidak dapat membezakan antara Presiden UMNO dengan Perdana Menteri.

Deal to buy 1MDB power division removes one millstone from Najib’s neck.

What price will Malaysia pay as the embattled 1Malaysia Development Bhd, the state-backed investment fund, sells power plants to China General Nuclear Power Corporation?

Or, for that matter, China’s promise to buy lots of Malaysian government bonds to prop up the ringgit when its weakness has become a major political liability for Prime Minister Najib Razak?  The currency has lost more than 20 percent of its value in the past year.

1MDB announced on Nov. 23 that it will sell its power assets to CGNPC for RM9.83 billion (US$2.3 billion at current exchange rates).  CGNPC will assume all gross debt and cash of the 1MDB entity, Edra Global Energy Bhd. and its subsidiaries. The transaction is expected to be completed in February according to the statement.

1MDB has become a millstone around the prime minister’s neck, with at least four domestic investigations going as well as probes in the United States, Singapore, the UK and other countries, and with a semi-public dressing down by the President of the United States over the imprisonment of opposition leader Anwar Ibrahim. Najib serves as chief financial advisor to the fund.

Najib knows he must bury the 1MDB scandal, in which an unknown amount of its US$11 billion in debt appears to be unfunded, as deeply as he can and then hope to call an election while the opposition is even more divided than the Barisan Nasional, the ruling national coalition led by the United Malays National Organization, the party he heads.

The only way to do that is to sell off 1MDB assets and get debt down to levels which might look tolerable. Anyone who pays over-the-odds for assets in such circumstances, as GNPC appears to be doing will expect a return. In the case of a major Chinese state enterprise, this will undoubtedly be measured in political more than commercial terms.

Malaysian leaders are forever proclaiming themselves Malay nationalists, stirring communal frictions in the process. But the reality is that money so often speaks louder than words. Having become used to receiving checks for doing nothing in the name of the New Economic Policy and wealth re-distribution, the UMNO leaders are easy prey for those who combine a political agenda with large bags of cash. The Ali-Baba syndrome, in which ethnic Chinese provide capital and labor and Malays the political entrée while acting as figureheads and doing very little, is alive and well at state as well as enterprise level.

Nor is this new. It is worth recalling that over the course of a century the British took control of the entire Malay Peninsula except for the Pattani Sultanate (which wanted to get out from under Thai control but failed) without firing a shot.

The only resistance came briefly in 1875 when Malay chiefs in Perak had an arrogant British Resident (a kind of pro-consul) assassinated. In retaliation, the British executed three Malays and exiled the Sultan. After that all the Sultans stayed in line.

 Indeed, it has been the constant minor wars between states and dynastic disputes within them which caused the British, originally content to occupy only Penang, Singapore and Melaka for trading purposes, gradually to involve themselves in governing the country as a whole.

Likewise it was the Sultans as much as the British who, in pursuit of revenues, allowed the entry of tens of thousands of Chinese to grow crops and mine tin – this was before the import of Indian labor by the British for their rubber plantations.

Looking at the sorry state of Malay politics, the greed of ruling party operatives, the hypocrisy of so much of the religious talk, the precarious position of Sabah and Sarawak in the federation, and the unease of the non-Malay communities, it is not difficult to imagine that over time China will exploit these situations to gradually establish itself as the “protector” of Malaysia, just as the British became, through a mix of pressure and commercial opportunity, progressively to become the “protector” of the nine sultanates which still comprise most of the peninsula.

It has long been noted that Malaysia has been fearful of offending China despite the latter’s claim on a vast and lucrative strip of the South China Sea, believed to contain fossil fuel assets, on the doorstep of the East Malaysia states of Sabah and Sarawak. Despite a weak squawk over the past month over China’s claims to hegemony over the area, Putrajaya has shown scant solidarity with Vietnam and the Philippines.

Beijing knows better than anyone the hollowness of Malay nationalism other than as a means of extracting rent from non-Malay communities. And scandals like 1MDB look to provide an ideal opportunity to pursue its long term goal of South China Sea hegemony. - asia sentinel

Nurul Izzah, Tian Chua dilarang ke Sabah...

Persidangan Dewan Undangan Negeri (DUN) Sabah hari ini meluluskan usul khas melarang dua Naib Presiden PKR iaitu Nurul Izzah Anwar dan Tian Chua daripada memasuki negeri itu.

Usul dibentangkan Timbalan Ketua Menteri, Datuk Raymond Tan Shu Kiah itu disokong oleh Ketua Menteri, Datuk Seri Musa Aman dan diluluskan selepas hampir dua jam dibahaskan oleh anggota dewan pada persidangan itu.

Sebanyak 47 Ahli Dewan Undangan Negeri (ADUN) Sabah menyokong usul khas di bawah Peraturan Tetap 31 (3) manakala tiga ADUN berkecuali.

Bagaimanapun, lima ADUN pembangkang iaitu daripada PKR dan DAP keluar dewan sebelum pengundian.

Ketika membentangkan usul itu, Tan mahu pihak berkuasa kerajaan mengharamkan kemasukan Nurul Izzah dan Tian Chua ke Sabah selain harus disiasat dan dikenakan tindakan undang-undang yang sewajarnya.

"Sementara pihak yang mempunyai kaitan dengan insiden pencerobohan di Lahad Datu, Sabah, Jacel H Kiram atau sesiapa sahaja yang mempunyai hubungan dengan mereka diharamkan masuk ke Malaysia," katanya.

Pada 9 Nov lepas tersebar gambar Nurul Izzah bertemu Jacel yang merupakan anak perempuan kepada bekas ketua pengganas kumpulan bersenjata Sulu, Jamalul Kiram III.

Tan berkata tindakan Nurul Izzah, yang juga anggota Parlimen Lembah Pantai, bertemu Jacel yang ada kaitan dengan pencerobohan di Tanduo, Lahad Datu, adalah suatu perbuatan yang tidak boleh dimaafkan.

Pada Februari 2013, kumpulan penceroboh dari selatan Filipina memasuki perairan negara menggunakan bot pancung dan berkumpul secara berperingkat di Felda Sahabat 17, Kampung Tanduo, Lahad Datu, yang mana insiden itu telah mengorbankan banyak nyawa termasuk anggota pasukan keselamatan.

Tan berkata pemergian Nurul Izzah bersama anggota Parlimen Batu, Tian Chua menemui Jacel menjadikan rakyat bertambah sangsi dan curiga bahawa mereka telah diperalatkan oleh anasir yang menggugat keselamatan dan kedaulatan negara.

Tan menegaskan keselamatan dan kedaulatan adalah isu yang menyentuh hati dan jiwa raga rakyat Sabah dan apabila ada sesiapa sahaja yang cuba berdamping dan bermesra dengan musuh ia adalah pengkhianatan terhadap kedaulatan negara.

Sementara itu, Musa berkata tindakan Nurul Izzah dan Tian Chua, bukan sahaja menghina rakyat Sabah, tetapi sengaja memandang rendah pengorbanan pasukan keselamatan yang berjuang dan menggadai nyawa demi mempertahankan keselamatan Sabah.

Beliau menegaskan bahawa semua cadangan dan pandangan disuarakan pada persidangan kali ini akan diteliti dan dipertimbangkan bagi mengambil tindakan yang sewajarnya.

"Ini termasuk tindakan menggunakan kuasa yang ada dan Akta Imigresen bagi menghalang pihak terbabit (Nurul Izzah dan Tian Chua) daripada memasuki negeri ini walau dari pintu mana sekali pun kerana dikhuatiri mendatangkan kemudaratan kepada keselamatan Sabah," katanya. - mk

Nurul, Tian Chua barred from entering Sabah...

PKR vice presidents Nurul Izzah Anwar and Tian Chua have been barred from entering Sabah.

The decision came after the Sabah State Legislative Assembly (DUN) approved the special motion, under Standing Order 31 (3).

A total of 47 state assemblymen voted in support of the motion in the poll, which was conducted after the session ended.

Three other assemblymen abstained from voting, Wilfred Bumburing (Independent-Tamparuli), Edwin Bosi (DAP-Kepayan) and Dr Jeffrey Kitingan (STAR-Bingkor).

The motion was tabled by Deputy Chief Minister and Minister of Industrial Development, Raymond Tan Shu Kiah, who asked the authorities to bar Nurul Izzah and Tian Chua from entering Sabah.

Raymond also proposed that an investigation be conducted into the duo’s meeting with the daughter of the Sulu Sultan, Jacel Kiram, in the Philippines recently. - fmt

Adik lelaki Timbalan Pendakwa Raya Anthony Kevin Morais yang mati dibunuh, Charles Suresh Morais, mendakwa bahawa beliau memiliki pen drive yang diberi oleh abangnya sebelum beliau menghilangkan diri.

"Ia kini selamat di Amerika Syarikat bersama seseorang yang diarah mendedahkan kandungannya kepada umum sekiranya sesuatu yang tidak diingini berlaku kepada saya berhubung akuan sumpah berkanun ini.

"Kandungan pen drive itu dengan jelas dan tanpa ragu-ragu mendedahkan bahawa Kevin telah diarahkan melakukan sesuatu sebelum kematiannya yang dikaitkan dengan seseorang personaliti yang berkuasa di Malaysia," kata Charles dalam akuan sumpah berkanun hari ini.

Charles berkata demikian pada di sidang media di pejabat peguamnya Americk Sidhu, di Kuala Lumpur, hari ini.

Katanya, Kevin sebelum dilaporkan hilang sedang dalam proses menyiapkan kertas pertuduhan itu, ketika bertugas di Jabatan Peguam Negara.

Beliau juga mendakwa bahawa adiknya, Datuk Richard Morais, juga bersekongkol dengan ‘seseorang’ yang mengawal “permainan” yang membabitkan pembunuhan Kevin.

Dakwanya, atas alasan itu, Richard menuntut jasad Kevin daripada rumah mayat pada hari yang sama beliau memfailkan permohonan kepada mahkamah untuk membuat bedah siasat kali kedua.

Charles mendakwa, inilah puncanya kenapa Richard mengambil mayat Kevin daripada rumah mayat pada hari yang sama dia (Charles) memfailkan permohonan kepada mahkamah untuk membuat post-mortem ke-2.

Charles yang kelihatan sedang marah, melontarkan kritikan kepada Jabatan Peguam Negara yang didakwa mempermainkannya.

"Mereka (Jabatan Peguam Negara) pada awalnya bersetuju dengan post mortem ke-2 tetapi membuat pusingan U, dan meminta saya mendapatkan perintah mahkamah," katanya.

Charles juga membuat 18 muka surat akuan bersumpah tentang hubungan adik beradik Morais dan beberapa perbincangan yang dia lakukan dengan adiknya, Kevin, menjelang pembunuhannya.

Sementara itu, dakwaan draf kertas pertuduhan ke atas terhadap Perdana Menteri Datuk Seri Najib Razak yang didedahkan oleh laman web Sarawak Report mempunyai singkatan tandatangan (initials) Timbalan Pendakwa Raya Anthony Kevin Morias, kata adiknya.

Dalam akuan sumpah berkanun (SD) hari ini, Charles Suresh Morais berkata ketika melihat dua halaman kertas pertuduhan di laman web itu pada 30 Julai, beliau mengenali singkatan 'AKM' iaitu ringkasan tandatangan abangnya di satu daripada kertas itu.

"Selepas melihat draf ini sekali lagi, saya dapati bahawa satu daripadanya telah dipinda dan mempunyai tandatangan singkatnya.

"Selepas meneliti kertas pertuduhan itu secara terperinci, saya dapati ada tandatangan abang saya, Kevin bersebelahan pindaan itu. Saya biasa dengan tandatangan dan singkatan yang digunakannya," kata Charles dalam dalam SD.

Peguam Negara Tan Sri Mohd Apandi Ali sebelum ini menolak draf kertas pertuduhan itu yang didakwa sebagai palsu.

Charles dalam akuan bersumpahnya berkata beliau sentiasa berhubungan dengan Kevin, termasuk membuat dua atau tiga panggilan telefon sebulan dan saling bertukar e-mel.

Beliau juga mendakwa bahawa dua hingga tiga bulan sebelum pembunuhan Kevin pada September lalu, abangnya meberitahu bahawa beliau sedang mengendalikan kes yang melibatkan Perdana Menteri Datuk Seri Najib Razak dan isterinya Datin Seri Rosmah Mansor.

Dalam SD itu, adiknya itu juga mendakwa bahawa Kevin yang telah dipinjamkan kepada Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) menyifatkan pasangan itu sebagai 'kurang memberangsangkan'.

“Katanya perbualan telefonnya mungkin diintip dan berhati-hati dengan apa yang saya katakan. katakan. Itulah sebabnya sebahagian besar perbualan kami biasanya dalam bahasa Malayalam,” katanya.

The alleged draft charge sheet against Prime Minister Najib Abdul Razak released by whistleblower site Sarawak Report had carried the initials of the late deputy public prosecutor Anthony Kevin Morias, claimed his brother.

In a statutory declaration (SD) today, Charles Suresh Morais said when he saw the charge sheet that appeared on the website on July 30, he recognised his brother's initials.

“After having looked at the (two-page) draft charge sheet once again, I noticed that one of them was amended and initialled.

“After studying that particular charge sheet in detail, I noticed that the initial next to the amendment made was that of my brother, Kevin. I am familiar with his signature and his initials,” he said in the SD.


Attorney-general Mohd Apandi Ali had previously dismissed the alleged draft charge sheet as false.

Charles said in his statutory declaration that he always kept in touch with Kevin, including making two or three phone calls a month and constant email correspondence.

He also claimed that two to three months ago before Kevin's murder in September, he said the deputy public prosecutor told him that he had been working on a case involving Prime Minister Najib Abdul Razak and his wife Rosmah Mansor.

Charles, in drawing up a statutory declaration dated Wednesday 25 November on the need for a second post-mortem, claims that “Kevin knew something was going to happen to him. He flew to London on 3 August 2015 and drew up a Will leaving his apartment in London to a dear friend.”

Why leave the apartment to a friend when it had always been his intention to retire to London and live in that apartment? asked Charles. “I have a pen drive sent to me by Kevin by courier before he died. It’s in safe custody in the US. The contents will be released should anything happen to me.” 

“The contents of the pen drive reveal the investigations that Kevin had been tasked with before his death. They implicate certain personalities.”

In the SD, the younger brother also claimed that Kevin, who was seconded to the Malaysian Anti-Corruption Commission (MACC), had described the pair in an unfavourable light.

“He told me his phone might be tapped and to be careful what I said. That is why half our conversations were usually in Malayalam,” he said.

The MACC has been investigating the RM2.6 billion political donation and RM42 million from SRC International which were deposited into the prime minister’s personal accounts.

In the SD, Charles said he later approached Rewcastle-Brown about the charge sheet and it was revealed the document was sent from an e-mail called "jibby@anonymousspeech.com".

Charles said he was convinced that the e-mail came from Kevin.

He said the name "jibby" refers to the babysitter who had cared for both Kevin and Charles.

"Kevin was working directly under the attorney-general at that time and would have been privy to the type of information as appeared in the draft charge sheets.” 

Delving into the details on the need for a second post-mortem, Charles disclosed that his lawyer had been in touch with the Victorian Institute of Forensic Medicine in Melbourne, Australia and received confirmation that a Professor Stephen Cordner was prepared to fly to Kuala Lumpur to perform a second post-mortem on Kevin’s remains. 

“However, I received information in the evening, November 23, that Richard had claimed Kevin’s body at 11.30 am that very same day and removed it from the Hospital KL mortuary,” said Charles in the statutory declaration.

He added that his lawyer had prepared an Originating Summons and an Affidavit-in–Support which were filed in Court on November 23 to get the Court’s permission to perform a second post-mortem. “I was informed that the Attorney- General’s Chambers would not object.”

The “probable” cause of Kevin’s death has been indicated in the post-mortem report, according to Charles, as “asphyxiation (suffocation). - mk/fmt

Rafizi challenges NFC to reveal board, AGM minutes...




Pandan MP Rafizi Ramli today challenged National Feedlot Corporation (NFC) to reveal whether or not the controversial firm had given a retrospective approval for the purchase of two luxury condominiums in 2009.

This follows NFC executive chairperson Mohamad Salleh Ismail saying yesterday that an AGM was held to allow the NFC board to transfer funds to the National Meat and Livestock Corporation (NMLC) for the property purchase.

Salleh said the transfer was approved on Dec 23, 2009. However, Rafizi claims the funds to purchase the condo was paid on Dec 2 directly to the property developer.

"When the four money transfers to pay for the condominium were made, that is on Dec 2, 2009, NMLC was still a company that had no relation to NFC.

"As such I dare NFC to reveal all the minutes from the board of directors meeting and the AGM [...] let the public see for themselves how the decision to make NMLC a subsidiary was made later, after the funds were transferred without prior approval," Rafizi said at a press conference at the Parliament lobby today.

Salleh, who is Wanita Umno chief Shahrizat Abdul Jalil's husband, was acquitted yesterday after the attorney-general's chambers withdrew four charges against him involving company funds.

He was accused of misappropriating RM9,758,140 through four NFC cheques to fund part of the purchase of two condominiums at One Menerung complex in Kuala Lumpur.

He was also accused of transferring RM40 million through an NFC cheque into the account of National Meat & Livestock Corporation Sdn Bhd, a company which he and one of his children owned, between May 6 and Nov 16, 2009.- mk




Gomen setuju dana NFC digunakan untuk beli kondo...

Maka sahlah mengambil dana rakyat yang diperuntukkan kepada petani miskin untuk membela lembu dan digunakan membeli kondo mewah itu tidak salah. Ada muslihatnya saya ingat. Nak tahu bagaimana?

Saya tidak sedikit pun terkejut dengan keputusan mahkamah yang mendapati Dato’ Seri Salleh Ismail, Pengerusi Eksekutif National Feedlot Corporation (NFC) tidak bersalah dalam satu pertuduhan pecah amanah menggunakan dana NFC sebanyak RM9,758,140 untuk membeli 2 unit kondominium mewah di One Menerong, Bangsar.

Saya akan menunggu perincian perbicaraan sebelum boleh membuat komen lanjut tetapi saya boleh mengagak tertuduh mengemukakan bukti bahawa pembelian tersebut telah diluluskan mengikut prosedur dan peraturan syarikat. Atas sebab itu, oleh kerana pembelian kondo tersebut telah diluluskan maka tidak berlaku sebarang pecah amanah.

Jika ini yang berlaku di dalam perbicaraan, ia memberi makna berikut:

1. Kelulusan itu diberikan sama ada di dalam mesyuarat Lembaga Pengarah atau Mesyuarat Agung Tahunan (Annual General Meeting) yang dihadiri oleh wakil-wakil kerajaan sebagai mewakili Kerajaan Malaysia yang mempunyai saham istimewa di dalam NFC;

2. Wakil-wakil kerajaan di dalam Lembaga Pengarah hanya boleh memberi kelulusan pembelian kondominium tersebut dengan persetujuan dan arahan dari pegawai atasan kerajaan iaitu Menteri atau Ketua Setiausaha Kementerian;

3. Pentadbiran Dato’ Seri Najib Tun Razak telah meluluskan supaya NFC boleh menggunakan dana yang diberikan untuk penternakan lembu bagi tujuan membeli kondominium.

Dengan keputusan mahkamah ini, secara langsung pentadbiran Dato’ Seri Najib Tun Razak memberi mesej bahawa ia tidak sedikit pun peduli dengan kemarahan rakyat mengenai skandal NFC ini yang menyebabkan Ketua Wanita Umno, Dato’ Seri Shahrizat Jalil terpaksa meletakkan jawatan.

Jika sebelum ini skandal NFC hanya terpalit kepada keluarga Dato’ Seri Shahrizat Jalil, keputusan hari ini mengesahkan bahawa skandal NFC ini bukan sahaja melibatkan keluarga bekas menteri itu tetapi keseluruhan Umno kerana pimpinan Umno di dalam kerajaan memberi izin dana NFC digunakan untuk membeli kondominium.

Saya mengingatkan pimpinan Umno supaya jangan terlalu ghairah berselindung di sebalik alasan pembelian atau perbelanjaan yang tidak munasabah mematuhi prosedur untuk lari dari tindakan undang-undang (seperti mana juga alasan yang digunakan di dalam skandal YaPEIM) kerana rakyat menilai kewajaran perbelanjaan itu berlaku; bukan semata-mata sama ada ia telah diluluskan oleh Lembaga Pengarah atau tidak.
Keputusan pada hari ini dan sangkaan saya bahawa wakil kerajaan telah membenarkan pembelian ini (jika benar) mengesahkan bahawa pentadbiran Dato’ Seri Najib Tun Razak tidak ada iltizam untuk memerangi penyelewengan atau rasuah.

Putrajaya’s backdated condo approval might have saved NFCorp boss...

Putrajaya had given a retrospective approval for the purchase of two condominiums by the National Feedlot Corporation (NFCorp) for RM9.75 million, PKR secretary-general Rafizi Ramli said today.

In a press conference at the Parliament lobby, he said this might have led to the acquittal of NFCorp chairman Datuk Seri Mohammad Salleh Ismail on two counts of criminal breach of trust by the High Court earlier today.

"I was informed by sources back in June that the government had given a retrospective approval," Rafizi said.

NFCorp only have two shareholders – one is a company controlled by Salleh and his family, and the other being a golden share for the Malaysian government.

"So an annual general meeting (AGM) to approve the purchase could have done between Salleh, his family, and just a couple of government representatives."

Rafizi said with the new developments, the buck of the scandal, which got a RM250 million soft loan from the government, could no longer be with the family of Salleh and his wife, Wanita Umno chief Datuk Seri Shahrizat Abdul Jalil.

"Umno is involved because the Umno leadership gave permission for NFCorp to use its funds to buy condominiums."

Rafizi also said being acquitted on a procedural ground did not make the NFCorp controversy clean.

"Just because it is right by procedure, it does not mean it is morally right.

"I want to remind those in Umno not to be so anxious in hiding behind the excuse that it is an above board transaction because the people are evaluating the rationale behind such purchases."

Rafizi also said that this was proof that the administration of Prime Minister Datuk Seri Najib Razak did not have the intent to fight wastage or corruption. – tmi

81 cawangan UMNO Johor mahu Najib letak jawatan...



Sebanyak 81 orang ketua cawangan dari lapan bahagian Umno Johor hari ini mendesak presiden parti, Datuk Seri Najib Razak meletakkan jawatan.

Menurut jurucakap kumpulan itu, Ketua Umno cawangan Bandar Pulai Jaya 2, Zairuddin Hamid, beliau tuntutan itu dibuat kerana Najib banyak melakukan kerosakan pada parti.

"Presiden Umno perlu letak jawatan kerana banyak kerosakan yang dilakukan.

"Jangan rosakkan lagi Umno. Lakukanlah pemilihan parti dengan segera. Ia perlu dijalankan dan tak perlu ditangguhkan," katanya.

Beliau berkata demikian dalam sidang media di Pusat Sukan Skudai, Johor Bharu, pada malam tadi.

Umno di Johor mempunyai 26 bahagian.

Walaupun pada malam ini hanya lapan bahagian sahaja yang hadir memberi sokongan, namun Zaharuddin berkata beliau percaya majoriti anggota Umno di negeri itu turut bersependapat dengan mereka.

"Saya percaya majoriti bersama dengan kita. Malam ini hanya lapan sahaja yang hadir kerana faktor jarak dan tempat," katanya.

Ketika ditanya sama ada pihaknya merancang untuk mengadakan sebarang gerakan untuk memberi tekanan agar Najib meletakkan jawatan sebagai presiden parti, Zaharuddin berkata ia masih pada peringkat perbincangan.

Bagaimanapun beliau percaya akan lebih banyak cawangan parti itu di seluruh negara yang akan mengadakan sidang media menggesa Najib berundur.

"Perkara itu di peringkat perbincangan. Mula-mula kita kena ada sesuatu yang utuh dan baru bertindakan balas. Insya Allah itu akan dibincangkan," katanya lagi.

Bulan lalu, seramai 13 ketua cawangan Umno sekitar Telok Kemang mendesak Najib meletak jawatan.

Pada Rabu lalu pula sekumpulan pemimpin akar umbi Umno yang mendakwa mewakili 20 cawangan parti itu di Sepang turut menggesa agar perdana menteri melepaskan jawatan. - mk

81 Johor Umno branch chiefs want Najib out...

Pressure continues to pile of Umno president Najib Abdul Razak with 81 more branch chiefs from eight Johor Umno divisions calling for his resignation.

The group’s spokesperson, Bandar Pulai Jaya 2 branch chief Zairuddin Hamid urged Najib to resign for damaging the party.

“The Umno president needs to step down because he has caused a lot of damage.

“Stop damaging Umno. Hold party elections immediately. It must not be postponed any longer,” he said at a press conference at the Skudai Sports Centre in Johor Bahru.

The Johor branch chiefs join others from five other states who have expressed distate for Najib's leadership, amid allegations of corruption.

Najib, who is also prime minister, denied using public funds for private gains.

Zaharuddin said he is confident that the eight divisions represented tonight represent the majority view of the southern state's 26 Umno divisions.

"I believe the majority are with us. Only eight divisions are presented tonight, perhaps because of location (of this press conference)," he said.

Johor is among the largest states in Malaysia, and is the birth place of Umno.

It is also home turf of deputy president Muhyiddin Yassin, who was sacked as deputy prime minister following his criticism on 1MDB in July.

Najib's cousin and party vice president Hishammuddin Hussein is also a Johor Umno leader.

Asked of the next step in pressuring Najib to resign, Zaharuddin said it is still in planning stages.

He believes more Umno branches nationwide will come forward against Najib.

Last month 13 Umno branches in Telok Kemang, Negri Sembilan started a trend by calling for the party president's resignation.

This was followed by representatives of 20 branches in Sepang, Selangor and dozens more from five states over the weekend. - mk


Obama to Najib: Release Anwar...

 I have heard from five people, both Malaysians and Americans and all in a position to know, that during his meeting with Najib Abdul Razak on Nov 20, US President Barack Obama called on the Malaysian prime minister to release former opposition leader Anwar Ibrahim from prison.

The request reportedly was made on humanitarian grounds, because of Anwar’s deteriorating health. But the US government position that Anwar’s trial was flawed and politically-motivated, and that Anwar is a political prisoner, is a matter of record.

One person told me that Najib’s response was that he had to follow Malaysia’s legal system. To me, it is ironic that Najib wants to hide behind Malaysia’s legal system, because he certainly has had no hesitation to use and abuse it for his own political ends.

And it’s not just against the opposition anymore. Now he’s going after critics in his own party, as well as investigators who have gotten too close to the truth.

A lot has happened since the famous golf game last December. Starting with Anwar’s conviction in February, there was that major front page expose in the New York Times, detailing all the allegations of corruption surrounding Najib and his family.

Sarawak Report started exposing more and more documents about 1MDB and the missing billions. The 1MDB reporting was all very complicated and convoluted, because the paper trails were hard to follow. But then The Wall Street Journal published an article that everyone could understand. A sum of US$700 million (RM2.6 billion) had allegedly ended up in Najib’s personal bank account, and for weeks he could not explain how it got there.

And then, just like magic, most of that money allegedly went overseas again - but no one knows where, and Najib isn’t talking. Everyone could understand that story - you don’t need an MBA in international finance. Then New York Times reported that Najib and his family were under investigation by the Federal Bureau of Investigation (FBI) under the Kleptocracy Asset Recovery Initiative. What a name!

As for human rights and democracy, Najib’s crackdown on the opposition has been reported widely in the Western press. Human Rights Watch recently put out a 151-page report on the “climate of fear” that Najib has created. Unprecedented - 151 pages! Then there was that United Nations group that recently called for Anwar’s release.

Obama is a lawyer. He now understands that the evidence is overwhelming and that Najib is not the man he thought he was. As I have said before, Obama is not the only world leader who believed Najib’s rhetoric of reform. But put it all together, and with all the news this year, it reached the point where Obama finally recognised the reality about both Malaysia and Najib.



Change in stand

Last February we launched the White House petition on ‘We, the People’, which called for making Anwar’s release from prison a priority for US foreign policy. That has now happened.

But that is not thanks to me or the petition, it is thanks to the great investigative reporting in the world press, on Malaysian websites, and on Sarawak Report. Especially, it is thanks to the courage of so many Malaysians who refuse to be intimidated by the heavy hand and threats of Malaysia’s home minister and inspector-general of police (IGP).

I agree totally with what Obama told the civil society leaders whom he just met in Kuala Lumpur on Saturday. America has many interests in Malaysia - and not just the Trans-Pacific Partnership Agreement (TPPA). It includes our longstanding trade and investment ties, military and foreign policy cooperation, and working together on so many issues like refugees, counter-narcotics, counter-terrorism, and the environment. But I am glad that human rights and democracy are once again on the list of our priorities in Malaysia.

I have been critical of Obama’s hands-off stance on human rights in Malaysia over the past few years. But now I have to say thank you. Not only did he discuss these matters with Najib, he is the first president to actually call for Anwar’s release from prison since Anwar was first jailed in 1998. Neither Bill Clinton nor George W Bush ever went that far.

I hope that this more visible and active US effort will continue, but not just to secure Anwar’s freedom. We need to be even more vocal in Malaysia and around the world in addressing human rights, political freedom, and religious and racial discrimination. Free and fair elections are essential to change. Corruption, the abuse of the legal system, and special treatment for government-linked companies (GLCs) hurt American companies trying to do business in Malaysia as much as it hurts Malaysian companies.

America needs to stand clearly on the side of those Malaysians who are seeking the changes that will lead to a brighter future for Malaysia. The current trajectory - with more and more Malaysians themselves starting to refer to their own country as a “failed” or “failing” state - should be of concern to everyone, and not just Malaysians.

This needs to be a coordinated international effort, working with the UN, human rights NGOs, and like-minded governments from around the world. It should not be just America alone, for the reasons that Obama described in his talk at Taylor’s University to the young Southeast Asian leaders. America should not be seen as the “nanny state”, lecturing others and ignoring its own shortcomings.

Malaysia, Najib, and the ruling party need the international equivalent of a “family intervention”, sort of a “Friends of Malaysia” grouping, where out of concern and love you try to break through the pattern of denial and help the person - or in this case, the country - get the “treatment” it needs before it destroys itself.

Finally, I am confident that there will always be courageous Malaysians who will continue to struggle for true democracy and political freedom, against the growing authoritarianism in their country. I hope their numbers will grow. For in the end, while the outside world can be supportive, only the Malaysian people can bring change.
