Ghani, Musa, Lingam & Khir Toyo cleared but Khalid got case.......

Inspector-General of Police Tan Sri Musa Hassan and Attorney-General Tan Sri Gani Patail were cleared of fabricating evidence in the Datuk Seri Anwar Ibrahim “black eye” incident of a decade ago. Minister in the Prime Minister’s Department Datuk Seri Nazri Aziz told the Dewan Rakyat Wednesday that the two were cleared of any wrong-doing after a two-month investigation conducted by the Malaysian Anti-Corruption Commission (MACC).

oth Abdul Gani and Musa of tampering with evidence in an investigation into an alleged beating he received from then IGP Abdul Rahim Noor while in police custody in 1998.

“Since this case is sensitive and of high profile, the MACC had suggested a three-person independent panel be appointed as deputy public prosecutors to look into the case,” Nazri in response to a question by Gobind Singh Deo (DAP-Puchong).

The three independent panel were made up of former Federal Court judges and a Court of Appeal judge -- Datuk Abdul Kadir Sulaiman, Datuk Wira Mohd Noor Ahmad and Datuk Mohd Noor Abdullah.

In reply to Gobind’s supplementary question on when the decision was made, Nazri said that the case was investigated on July 2 last year and was completed two months after that.

“Since we need to consider several things, we took a bit more time to announce the decision so that it does not create doubt among people,” he said adding that that was why he decided to reply on Wednesday.

In reply to DAP adviser Lim Kit Siang’s question on who was the discenting voice, Nazri said he could not give the information and majority decision obviously means a 2-1 decision. He added that the decision for the IGP was 3-0.

This result was actually announced by the MACC Chief Commissioner Datuk Seri Ahmad Said Hamdan in an interview with Sunday Star on March 1. He also spoke about the Lingam video case findings and Khir Toyo's corruption case. All CLEARED!

Here are excerpts of the interview...........

Q: What is the finding on Datuk Seri Anwar Ibrahim’s report against the Attorney-General and IGP (that they fixed him with the sodomy and corruption charges)?

Ahmad Said : We know this is very sensitive and we know this will be blasted by people if we didn’t handle it properly so we requested from Solicitor-General that he appoints three independent persons under the Criminal Procedure Code. Two were former federal court judges. They read the investigation papers independently and each of them independently found that the allegation made by Anwar is baseless. They did not sit down together or discuss it and they did not meet. They did it independent of each other. No officers from the A-G’s office were involved in that decision-making process. None. I guarantee you. We went to the extent of appointing independent persons. But how to make the public believe the findings? Do you think when we release this information, the public will accept it? What more do you want us to do?

Q: What about the Lingam videotape case? People say MACC is so quick to investigate Tan Sri Khalid but so slow on the Lingam case.

Ahmad Said : We have finished investigating that a long time ago. It’s easy to charge people rather than not charge them especially when the Royal Commission (of Inquiry on the V.K Lingam videoclip) said there was a case.

But now the most important weakness in the case is that the crucial witness refuses to co-operate. That’s why when there is an Operations Review Committee, we can explain to them what’s the reason and why we cannot charge. It is not that we don’t want to charge. But he just doesn’t want to co-operate. Of course, one can’t threaten him because if you do and bring him to court and he says he’s been threatened, then his statement cannot be accepted. We have to follow the legal system.

Is there a confirmation in the Royal Commission report that Lingam gave or accepted bribes? No. Yes, there was a video clip but we are going by the legal issue on offences that we cover - our area is corruption. Did Lingam abuse his power?

What power did he have? You must have power to abuse power. He does not have any official status or any official post so he didn’t abuse his power. We have submitted the case to the AG - on two investigations there is no case and on two others we have submitted our recommendation.

Q: There have been many reports on former Selangor Mentri Besar Datuk Seri Khir Toyo but till today there is no charge? Even yesterday there were 20 more reports made against him?

Ahmad Said : He was cleared. There was no evidence against him. This was a long ago, not during my time. As for the reports lodged against him yesterday, those are actually the same old reports being repeated. Those cases have already been closed. If the evidence given is the same as before, there is no reason for us to re-open the case. We can re-open the case only if they produce new evidence.

Q: There has a report lodged against Datuk Seri Najib Tun Razak implying that he had a hand in giving out bribes purportedly amounting RM50mil to get the assemblymen to cross and make the Pakatan Rakyat-led Perak state government to fall? Will MACC act on this report?

Ahmad Said : Yes and we will act promptly. We got no mercy on anybody. That’s why we hope the public will understand the role of the commission to become the voice of society to ensure that the commission performs its duty according to the law based on justice and the rule of law.

Just imagine, Lingam video case is a clear cut case,the commission found those involved guilty. He says the crucial witness refuses to co-operate. Dont want to cooperate charged him! but you(Ahmad Said) got no balls to do it.

In Khir Toyo's case, there were 20 corruption charges against him. Its ridiculous that none sticked! Can you all believe this wayang? On Najib's bribe report, do you all think MACC got the balls to do it? Ha..ha..ha!!!

Now we can see the sequence of events clearly, all cases pertaining to Khir Toyo, Lingam, Ghani Patail & Musa Hassan cleared and Anwar's sodomy II case was hastily transferred to High court before Najib 'ascends the thrown' on April Fool's day. All well scripted.

In the 1960s P Ramlee had already envsioned UMNO as a "sarkis", so a "sarkis" it is...........
