Azilah, Sirul bebas dari tuduhan bunuh Altantuya, Siapa bunuh...tak tau...Siapa yang arah bunuh...tak tau...Macam mana dapat bom C4... tak tau...

 

Mahkamah Rayuan hari ini membebaskan anggota Unit Tindakan Khas, Cif Inspektor Azilah Hadri dan Koperal Sirul Azhar Umar, daripada pertuduhan membunuh penterjemah Mongolia, Altantuya Shaariibuu.

Ini berikutan mahkamah dalam keputusan sebulat suara membenarkan rayuan pasangan itu.

Bagaimanapun, pihak pendakwa akan mempunyai peluang untuk merayu di Mahkamah Persekutuan - mahkamah tertinggi di negara ini.

Bagaimanapun, penghakiman itu dibacakan oleh Hakim Datuk Tengku Maimun Tuan Mat yang memutuskan berlaku penyalaharahan yang serius oleh hakim Mahkamah Tinggi.

Ia termasuk tidak memanggil DSP Musa Safri, dan kegagalan untuk mengemukakan diari balai polis yang menyatakan bahawa Azilah (kiri) berada di Bukit Aman pada masa berkenaan.

Seorang lagi anggota panel hakim tersebut ialah Datuk Linton Albert. 


Pada April 2009, Hakim Mahkamah Tinggi Shah Alam, Datuk Zaki Md Yassin telah mensabitkan dua anggota polis itu atas tuduhan bunuh. Manakala penganalisis politik Abdul Razak Baginda dibebaskan daripada tuduhan bersubahat dengan pembunuhan itu.

Azilah diwakili oleh peguam Hazman Ahmad dan J Kuldeep Kumar, manakala peguam Kamarul Hisham Kamaruddin dan Hasnal Rezua Merican mewakili Sirul.

Timbalan Peguamcara Negara 111, Datuk  Tun Abdul Majid Tun Hamzah mengetuai pasukan pendakwaraya yang turut dianggota DPP Manoj Kurup dan Noorin Badaruddin.

Altantuya telah dibunuh di hutan Puncak Alam dekat Shah Alam antara jam 10 malam 19 Oktober dan 1 pagi 20 Oktober 2006.

Menurut peguam, kedua-dua tertuduh mungkin dibebaskan dari penjara Sungai Buloh lewat hari ini.

Dalam mesej teks, Tun Majid berkata mereka akan membuat rayuan terhadap keputusan hari ini. 


Sementara itu, Bernama melaporkan bahawa suasana di mahkamah senyap seketika semasa hakim menyampaikan penghakiman sementara Azilah, 34, dan Sirul Azhar, 39, kelihatan tenang selepas keputusan dibacakan.
  
"Melihat kepada keadaan keseluruhan kes ini, pertimbangan kami ialah kesan kumulatif bukan arahan oleh hakim perbicaraan yang bijaksana itu menjadikan sabitan perayu tidak selamat. Kami sebulat suara membenarkan kedua-dua rayuan ini," kata Hakim Tengku Maimun.
  
Kedua-duanya disabitkan dan dijatuhkan hukuman mati oleh Mahkamah Tinggi pada 2009 kerana membunuh Altantuya, 28, di Mukim Bukit Raja, Shah Alam antara pukul 10 malam, 19 Oktober dan 1 pagi, 20 Oktober 2006.
  
Bekas penganalisis politik Abdul Razak Baginda, 50, yang dituduh bersubahat dengan mereka, dibebaskan oleh Mahkamah Tinggi pada 31 Okt 2008 selepas pihak pendakwaan gagal mewujudkan kes prima facie terhadapnya.
  
Sebagai langkah segera, pihak pendakwa diketuai Peguam Cara II Datuk Tun Abdul Majid Tun Hamzah memberitahu pemberita Pejabat Peguam Negara akan memfailkan rayuan terhadap pembebasan dua anggota polis itu.
  
Dalam penghakiman, mahkamah mengemukakan lapan alasan bagi pembebasan Azilah dan Sirul Azhar.
  
Hakim Tengku Maimun berkata mahkamah mendapati Hakim Mahkamah Tinggi Datuk Mohd Zaki Md Yasin tidak membuat sebarang dapatan mengenai sama ada pihak pendakwa telah membuktikan mengenai kewujudan perancangan awal oleh dua anggota polis itu untuk melakukan pembunuhan dan pembunuhan itu dilakukan rentetan daripada perancangan awal itu.
  
"Dalam penghakiman kami, ketiadaan dapatan sebegitu oleh hakim perbicaraan yang bijaksana mengenai ramuan niat bersama yang membawa kepada penyalaharahan dengan cara tanpa arahan," katanya.
  
Mengenai log panggilan dan ramalan liputan, beliau berkata mahkamah mendapati keterangan oleh tiga saksi daripada beberapa syarikat telekomunikasi telah membawa kepada isu kebolehpercayaan dan ketepatan log panggilan dan ramalan liputan.-malaysiakini

Pembebasan Azilah dan Sirul Sudah Dijangka, Beri 'Motivasi' Kepada Pihak Tertentu Untuk Terus Membunuh

Sememangnya dari awal kes pembunuhan Altantuya menyaksikan perbicaraan melibatkan Azilah dan Sirul ditangguh dan ditangguh sehingga selepas pilihanraya untuk memberi laluan Barisan Nasional menang PRU tersebut. Kemenangan ini membolehkan kedua-dua 'pak sanggup' ini dibebaskan, hari ini.

Perihal ini sudah disebut dan Solidariti Anak Muda Malaysia (SAMM) sudah menjangka keputusan mahkamah Rayuan yang membebaskan anggota Unit Tindakan Khas, Cif Inspektor Azilah Hadri dan Koperal Sirul Azhar Umar, daripada pertuduhan membunuh penterjemah Mongolia, Altantuya Shaariibuu.

Apabila BN kekal, rakyat bukan sahaja tidak mengetahui apakah motif pembunuhan dan siapa yang arah pembunuhan Altantuya, malah pembunuhnya juga dibebaskan.

Walaupun dalam kes yang berprofile tinggi, walaupun sudah mengaku melakukan pembunuhan malah menyebut diri sebagai 'kambing hitam' kerana menjadi pembunuh upahan, namun akhirnya dibebaskan. Apakah ia satu keputusan menang-menang demi saling melindungi? Lihatlah bagaimana keadilan tidak berada di tempatnya, tetapi berada di tangan pemerintah.

Keputusan ini juga seharusnya memberikan 'motivasi' besar kepada pihak tertentu untuk terus menjalankan kerja 'black-ops' dengan jaminan dibebas sekiranya tertangkap dan dibicarakan. Pihak tertentu termasuk kemungkinan melibatkan anggota polis yang mengikut telunjuk atasan mampu berbuat apa sahaja kerja jahat, pasti akhirnya terlepas hukuman dan dibebaskan. Maka tidak hairanlah jika selepas ini lebih banyak kes pembunuh upahan. Konspirasi akhirnya berjaya apabila si pembunuh, individu yang mengarah pembunuhan, orang tengah, semuanya selamat. Rekod imigresen Altantuya terus hilang, bersama rekod bahan letupan yang diseludup keluar.

Pendedahan mengenai kematian tragis Altantuya telah di buat oleh SAMM dan banyak pihak lain khususnya apabila melibatkan skandal penyelewengan pembelian kapal selam Scorpene. che'GuBard sebelum ini pernah menulis dan menerbitkan sebuah buku yang bertajuk 'Siapa Arah Bunuh Altantuya'. Buku tersebut telah menyebabkan che'GuBard ditahan sebanyak enam kali dan rumah che'GuBard beberapa kali digeledah, namun tiada dakwaan terhadap che'GuBard. Malah ketika buku ini dilancarkan, rumah che'GuBard dibaling dengan bom botol.

Justeru itu, apakah konklusi paling tepat mengenai pembunuhan altantuya? Negara hari ini menjadi kartun apabila membayangkan 'sebenarnya' Altantuya membunuh dirinya sendiri, kemudian bangun dan meletupkan pula dirinya menggunakan bom C4 demi menghilangkan bukti.

Court frees Azilah and Sirul of Altantuya murder charge...

The Court of Appeal today freed Special Action Unit officers Chief Inspector Azilah Hadri and Corporal Sirul Azhar Umar of the charge of murdering Mongolian translator Altantuya Shaariibuu.

However, the prosecution has the opportunity to appeal with the Federal Court - the country's highest court.


As soon as the court's decision was read, the two accused said: "Thank you, your lordships."

While justice Md Apandi Ali led the three-member bench, justice Tengku Maimun Tuan Mat read out the judgment, which ruled there were serious misdirections by the High Court judge.


The misdirections included the failure to call Prime Minister Najib Abdul Razak's former aide de camp DSP Musa Safri and the failure to take into consideration the police station's diary, which stated that Azilah was at Bukit Aman at the time of the incident.

The other judges were justices Linton Albert and Tengku Maimon Tuan Mat.

Alibi not taken into consideration
 

Shah Alam High Court judge Md Zaki Yassin on April 2009 convicted the two of murder but acquitted Najib’s close confidante, political analyst Abdul Razak Baginda (below), of abetting the murder.

abdul razak baginda altantuya mongolian case 040607 leadIn today's judgement, justice Tengku Maimun said the court did not find anywhere in the High Court's judgment about whether it had considered the alibi and the inconsistency in the telephone call logs of the accused.

"These include the police station’s diary, which states that Azilah was at Bukit Aman and not at the crime scene.

"The learned trial judge had misdirected himself by way of non-direction in failing to consider the station’s diary and in failing to make a finding whether the defence had cast a reasonable doubt in the prosecution's case," she said.

On the call logs, she said the court found inconsistencies in the testimonies of the telephone company's witnesses, which had put an issue on the accuracy of the calls in question and the coverage protection.

“In our judgment, it is essential for the trial judge to address his mind to the challenge raised by the defence on whether there was in fact alteration or tampering of the data and whether the authenticity of the data was questionable or otherwise.

"Regrettably, the judge failed to do so and this amounts to serious misdirection rendering the exhibits (the call logs) unsafe to be relied upon," she said.

Inconsistency in police testimonies
 

The court also ruled that there were inconsistencies in the testimonies of the police’s prosecution witness leading to the discovery of the crime scene, where the High Court judge did not examine the credibility and did not address the defence’s contention.

altantuya trial 160707 azilah"This has raised a doubt on the accuracy of the section 27 statements and whether the discovery was made exclusively as a result of the information supplied by the two appellants (the two accused) and not from other sources," said Tengku Maimun.

On the possession of explosives, Tengku Maimun said the High Court judge should have made a further finding to connect the explosives to the two accused.

"By not making any findings on possession by the appellants of the explosives used in the commission of the murder, the learned trial judge had failed to address his mind on this missing link, resulting in yet another misdirection," she said.

The defence had argued that the type of explosives used in the murder was not kept in the police armoury.


Tengku Maimum also ruled that the non-calling of Musa (Najib's aide de camp) was essential.

"This is to unfold the narrative upon which the prosecution's case is based on.

"The failure of the prosecution to call or offer Musa for cross-examination in the circumstances of the evidence as a whole would have triggered adverse inference under section 114 (g) of the Evidence Act 1950 against the prosecution," she said.

The Court of Appeal also found that justice Md Zaki (High court) had failed to establish whether there was common intention.

"We find the judge made no findings on whether the prosecution had established that there was a pre-arranged plan by the appellants to commit murder and that murder was committed pursuant to the pre-arranged plan.

"In our judgment, the absence of such findings by the learned trial judge on the ingredient of common intention amounted to a misdirection by way of non-direction," Tengku Maimun ruled.


Blood-stained slippers and spent bullet

On the issue of the blood-stained slippers (allegedly Altantuya’s) found in Sirul's car, the court ruled there was no nexus between the slippers and Sirul and the prosecution had not closed the gap.

There were questions about the blood-stained slippers as they were not Sirul's size and it was not ascertained who owned it.

altantuya and son 050309On the issue of a spent bullet found in Sirul's car, again the court found that there was a gap in the prosecution's case and the High Court judge had failed to direct his mind to the matter.

"It is our judgment the cumulative effect of the non-directions by the judge rendered the conviction unsafe. 


"We unanimously allow both appeals. Conviction and sentence are set aside. The appellants are acquitted and discharged," said Tengku Maimun. 

Azilah was represented by Hazman Ahmad and J Kuldeep Kumar, while Kamarul Hisham Kamaruddin and Hasnal Rezua Merican appeared for Sirul.

Deputy solicitor-general III Tun Abdul Majid Tun Hamzah led a team of prosecutors that comprised  DPP's Manoj Kurup and Noorin Badaruddin.

Altantuya (above) was murdered in the forest of Puncak Alam near Shah Alam between 10pm on Oct 19 and 1am on Oct 20, 2006.

According to the accuseds' lawyers, the two should be released from prison later today.

 So, who killed Altantuya? And why...

Seven years on, no one has paid the price for the death of Altantuya Shaariibuu. And no one knows why the pretty Mongolian was killed one night in October 2006.

But today's Court of Appeal decision does not close the file on her mysterious murder.

Instead, the ruling to acquit former chief inspector Azilah Hadri and former corporal Sirul Azhar Umar raises more questions than ever.

 Who killed her? Why?
 

She was shot dead and C4 explosives were allegedly used to blow her to bits but both police commandos said they had no access to the explosives. So what happened? Were there others involved?

She came into the country but there were no immigration records with her name. Did she use another passport? Can the authorities explain this?

Some of these questions could have been answered if the likes of DSP Musa Safri had been called to give evidence.

The prosecution did not call him and the appeal court today allowed the appeal because material witnesses were not called to testify, including Musa.

Musa would have been able to say what sort of help political analyst Abdul Razak Baginda had asked of him to fend off Altantuya.

The interpreter had become Abdul Razak's lover but later hounded him. He had to hire private investigator P. Balasubramaniam to keep watch on her. When Altantuya turned up that fateful night on October 19, 2006, the policemen took her away and that was the last time she was seen alive.




What followed rocked Malaysia's political establishment. Abdul Razak was held in connection with the murder and both police commandos Azilah and Sirul were later charged for Altantuya's murder.

Their connection to each other was simply Musa, who was aide-de-camp to then deputy prime minister and defence minister Datuk Seri Najib Razak.

Now prime minister, Najib has denied any links to the case although Abdul Razak was closely associated with him. Will today's ruling provide closure for him too?

Will it also provide closure for Abdul Razak, who was the first to be acquitted of conspiring to kill Altantuya? He had admitted to fending her off but not asking for her death.

Interestingly, the prosecution never appealed his acquittal.

But the prosecution has said it would appeal today's ruling that freed Azilah and Sirul, both of whom were hooded and shielded from public view during their 159-day murder trial.

That again raises more questions. And endless possibilities.-malaysian insider

So what happens next? Why didn’t the police immediately, outside the court, re-arrest them for manslaughter instead of first degree murder in this case? It would be open-and-shut case as in the police report Sirul confessed that they were paid between RM50,000 to RM100,000 to kill Altantuya. The police frequently in the past were always ready to re-arrest suspects (not to their liking?) when freed by the judge outside the door of the courts?

YF - Isn't this expected since the very beginning? These lawless folks are saying when you die of strangling means you cekik sendiri, when you fall of a building means you commit suicide, when you get c4ed you did it voluntarily. This is the world's best justice system so dont play play.

Headhunters - After this they may say its Anwar Ibrahim who was the murderer! They will also say Anwar sodomised Altantuya and then killed her and then C-4 her body. To support their claim, they will make it headline news for weeks until Malaysians especially the blind supporters of UMNO/BN believe it. Then they will arrest, detain and charge Anwar and force him to give his DNA or simply steal it from him and then put him on trial.......surprise? well thats their slogan to be officially launch soon: "Endless Opportunities!"
