Who is going bankrupt the nation...gomen or opposition...

The opposition’s promises to reduce oil prices if it were to form a government will only bankrupt the country, Datuk Seri Najib Tun Razak said. The Deputy Prime Minister said it was “just not possible” for the opposition to bring fuel prices down, pointing out that they were only fooling the people with empty promises. He said claims that the opposition would channel Petronas profits into subsidising fuel prices did not make sense as current oil prices were on a record high. “Say, if Petronas makes RM70bil or RM80bil (and) they want to channel it for fuel subsidy. Then where will the government obtain funds for building roads, hospitals and other amenities?” Najib said at the Tuaran Tamu Besar and Cultural Carnival here yesterday.- The Star 31 Dec 2007

Come on...Najib dont let those Oxford brads fool you. The opposition has ruled Kelantan for almost 30 years, have they made Kelantan bankrupt? There are many virgin oilfields offshore Kelantan yet to be tapped, but why is the gomen keeping mum about this? Are they waiting for them(gomen) to be in power and collect the oil royalty?

I feel the gomen is making the country bankrupt with all the extravagance mega corridor projects. Tell me Najib where is the gomen going to find money to fund these lavish mega projects,if not from their very own cash rich,Petronas.

Yes, Petronas made billions yearly and the gomen used a fraction of this money for fuel subsidies. What about the rest? Well, the gomen used Petronas money to bailout ailing crony's and their children companies, organise Monsoon Cup,F1 competition etc, etc. Najib, how about ceasing all these nonsense and used the for money for the benefit of the rakyat?

On Umno secretary-general Radzi Sheikh Ahmad's suggestion that Perlis MB Shahidan Kassim be replaced, its a good idea and for that matter,it should apply to all UMNO's MBs and CMs too.

Btw, all the money spend on firework exhibit to welcome the new year at KLCC,also can be channel to charities rather than putting up such stupid show-off display that benefits no one.

..dont bullshit the rakyat with your UMNO theories.....

cheers.

On another note, the gomen is making a big fuss over events thats happening in Pakistan. At least the gomen of Pakistan practises free election, allows campaign and public rallies. They also announced the election date well ahead and not like our sleepy Pat Lah who is still blur on when its going to happen.

DAP,PKR,sharing the same pillow but having different dreams.....

Both the DAP and PKR (Parti Keadilan Rakyat) have continuously declared that they are "cooperating" and "working together" here to ensure straight fights between the Opposition adn the Barisan Nasional (BN) in the next general election. However, the tussle for seats to contest in the state is far from over.Last week, Penang PKR state chairman Datuk Zahrain Mohamed Hassim was quoted in vernacular newspapers as saying that DAP had agreed to make way for PKR to contest the Bukit Tambun state and Batu Kawan parliamentary seats.Today, DAP state secretary Danny Law Heng Kiang called for a press conference and labelled Zahrain's statements as "false claims". - Sun Dec 26, 2007

Bickering among political parties as the general election draws near make petty headlines in our news media.

Even among the gomen coalition partners thing are not that good as it seems to be. The recent furore raised by the Gerakan youth vice-chief who criticised the gomen for marginalising, oppressing and ignoring the Indian community drew flak from Umno Youth chief Hishamuddin who said his movement should severe ties with Gerakan, which is a BN component. However, some Gerakan leaders also told the UMNO youth chief not to threaten the party. Earlier this year Mohd Ali Rustam had told the People’s Progressive Party (PPP) that it could leave BN if it was not happy with the allocation of seats within the coalition.

While we are trying to unite the opposition parties to take on BN as a potent force in the upcoming general election, the opposition parties on the other hand squabble over petty issues? There should be mutual understanding between both parties, exercise caution, inculcate give and take and not to behave like the hot headed UMNO youth leaders or the Malacca CM or Zainuddin Maidin for that matter. What we need is the opposition parties to reorganised and reengineer themselves so that they will become a more formidable force that eventually find more traction with the electorates.

It will be futile for the opposition parties go solo, contesting in a three or a four corner fight,it is just another sheer waste of time, money and opportunity, for they will never win. When will they learn from past lessons?

With the current mood for change in the air and the failure of Pat Lah's policies who only 'cakap tak serupa bikin',the gomen will be in for a tough fight. This can only happen if the opposition are willing to shed their egos and 'bertolak ansor' for the benefit of the rakyat.

For now,I am really pissed off with the on going tiffs. Even before they talk about forming a formidable opposition, though they are sleeping on the same bed yet they are having different dreams. It gives me goosebumps thinking what will happen if the oppositions are really in power in Penang, will they wrangle as who should become the CM,Exco-members,will they do better than the BN gomen or worst....only time will tell.....

cheers.

Benazir Bhutto Assassinated.......

Pakistani opposition leader Benazir Bhutto was assassinated near the capital, Islamabad, today, just two months after the former premier returned from exile for a political comeback. Witnesses said Ms. Bhutto was fired upon at close range and further injured by the explosion.

Benazir Bhutto, a two-time former prime minister, had just addressed a campaign rally for next month's parliamentary elections when a suicide bomber blew himself up outside the venue, killing her and at least 10 other people. There were unconfirmed reports that the attacker had also opened fire on her with a weapon before the explosion.

Bhutto, educated at Oxford and Harvard, became the first female prime minister of a Muslim country when she took the helm in Pakistan in 1988 at the age of 35. Her father, also a Pakistani prime minister, was also hanged, in 1979. She served a total of six years in office before being dismissed in 1996 amid widespread charges of corruption against herself and her husband. Since then she has lived abroad.

Recalling how she stood by his father's grave, Benazir Bhutto once wrote: "At that moment I pledged to myself that I would not rest until democracy had returned to Pakistan." She had repeatedly accused President Musharraf of being dictator and had been campaigning with fierce criticisms of what she said was his autocratic rule, vowing her Pakistan People's Party would deliver democracy.

In early 2007, her associates said that talks had begun with the country's current ruler, Gen. Pervez Musharraf, for a power-sharing arrangement after presidential elections in October.

The killing will deepen the political crisis in Pakistan, where Islamic militants have vowed to disrupt the vote and Musharraf's opponents -- including Bhutto -- accused him of planning to rig the result.

Mob run wild in Penang on Christmas Eve 2007.....

Someone posted to me the above video clip about police in Penang, trying to arrest someone who sprayed their patrol car. While trying to arrest them the mob starts to spray the police with something and throw cans at the officer and patrol car.

Take a bet those involved will in be in for a big suprise!!

Whats this old man up to,after all Lingam is still his lawyer......

Mahathir Mohamad said that he was interviewed by the Anti-Corruption Agency (ACA) in relation to the Lingam video clip. The Lingam video clip, exposed by opposition party PKR, showed lawyer VK Lingam in a telephone conversation brokering the appointments of ‘friendly’ judges supposedly with the then Chief Justice Ahmad Fairuz Sheikh Abdul Halim who retired recently.

Mahathir said he would abide by orders to appear before the commission. He said,“If I am required to testify, the law requires that I testify. I cannot say no,” he said. But,did he went to court when he was asked to do so in Anwar's case?

Do you all believe this guy, who still got the guts to say,“I don’t know whether Lingam said it or not. I have not seen the tape. What I saw was on TV, TV3. That’s all. I don’t know. I didn’t hear him mentioning Tengku Adnan or me,”

Firstly, I dont swallow whatever this guy says, its just bullshit..., after all the fervour about Lingam making news on the net, dont tell me that he is blind? This guy surfs the net everyday. Its true that nobody saw the tape except for the few PKR leaders, while TV hardly showed any details on the video clip. Mahathir must have seen and read the script accompanying the Lingam video clip. Why is he still trying to to defend the two penyanggak- Lingam and Adnan, I dont understand. Probably,Lingam is still his lawyer.....

Secondly,I am wondering whether this guy still got the balls to appear and testify with commission? Now he is unable to demand the court to furnish him the questions that they gonna ask. Remember, in the Anwar case, this arrogant old man,who was then the PM refused to appear in court to testify and the court dared not issue a warrant to either summon him or arrest him for failing to do so.

Mahathir 'sudah lupa' kot. I think he should just go back to Aloq Setaq and tanam jagong. Mahathir and Pat Lah sama saja... 2x5 and 5x2....

Wukuf in the plain of Arafat & celebrating Eid al- Adhaa....

Muslims performing Hajj will be in Arafat on Tuesday, 9 Dhul-Hijjah 1428(December 18), and shall be celebrating ‘Eid al-Adhaa' on Wednesday, 10 Dhul-Hijjah 1428(December 19).

The annual hajj is obligatory on every muslim adult at least once in a lifetime if he/she has the resources to go to Mecca. The days appointed are the 8th,9th and 10th of Zulhijjah and two days after that. During these days the muslim devote themselves totally to the rememberance of Allah. Till the 10th of Zulhijjah they are dressed in a simple unstitched body sheet and give up all bodily care of themselves and concentrate on Allah. On the 10th day,Eidul Adha, animals are sacrificed in the name of Allah,in memory of the total submission of Abraham and Ismail to the will of Allah.
The most important ritual of Hajj takes place in the plain of Arafat, 10 miles/16km from the Kaaba in Makkah. This is Wukuf, when the pilgrims spend the best part of a night and a day standing in prayer on the Arafat plain. Here they also meditate and hear sermons, according to the command of the Prophet. The 'standing' at Arafat (Wukuf) is the focal point of the Hajj. The Prophet ordered that all Muslims must journey there in an orderly and peaceful manner, to assemble by noon. Between midday and sunset the massed pilgrims stand at Arafat in joint prayer and meditation before walking from Arafat to the hill of Muzdalifah at sunset. At Muzdalifah, the pilgrims join in the evening prayers, before gathering the pebbles with which they will ritually stone the 'satans' at Mina on the following day.

The tenth day of Dhul Hijjah-is the 'Day of Sacrifice'. Sacrifices begin after the Eid prayers in the morning. After the sacrifice, pilgrims perform Tawaf Ifada, the ceremonial hair-cutting or head shaving. The pilgrim then emerges from the consecrated state of ihram which he entered on reaching miqat at the outset of his pilgrimage. On this day Muslims around the world share the happiness the pilgrims feel and join them by performing identical, individual sacrifices in a worldwide celebration of Aidil-Adha. Two or three more days -the Ayyam at-tashriq- will be required for the pilgrim to complete his Jamarat, and once this rite has been completed the pilgrim returns to Makkah to perform a farewell Tawaf of the Kaabah.

Terkinja-kinja best giler menari macam hantu

"Attorney-General Abdul Gani Patail today dropped the attempted murder charge against 31 Hindraf supporters who were alleged to have gathered illegally and caused severe injury to a policeman at the Batu Caves temple in the early hours of Nov 25." However further charges of causing mischief and illegal assembly against 26 of them remained.- Malaysiakini

Its only fair, now, if Pat Lah can do the same for Azman, Suwandi and 18 others during the Batu Buruk incidence on 8 September 2007.

Masalah saham Maika masih menghantui Samy Velu kemana saja dia pergi.

cheers.

Keegoan Lingam dan bagaimana dia memperkudakan orang-orang kuat UMNO.....

Lingam : Actually I told Tengku Adnan to inform PM, PM to call you for a meeting. But I will organise this so that Tengku Adnan will call you directly. And then I got your number, I will tell him to call you directly to for you to meet PM lah.

Lingam : I will do this, I will get er… Tengku Adnan to arrange for PM to call you and Tan Sri Vincent Tan for PM to call. You know why, actually, I am very grateful to Tan Sri Vincent Tan....
Lingam : ....you talk to PM again tomorrow morning to put Datuk Ahmad Fairuz to CJM.

Lingam : Yes… I will also get Tan Sri to remind PM to put a Tan Sri ship this year lah. You know, this will elevate you, you know.

Lingam : Oh, yes, yes, yes, yes. Ah. Steve Shim got so fast, Tan Sri Chong waited for a whole year to get Tan Sriship.

Kata orang kalau nak dapatkan gelaran Datuk, hulur saja RM 100,000 maka dapatlah gelaran datuk. Pecacai-pecacai UMNO nak letak muka kat mana?

Lingam : So Dzaiddin really wants to go…Don’t worry. Dzaiddin recommended Malik Ahmad to be Chief Judge of Malaya. But we went and “cut” “cut” cut” cut” I and Tengku Adnan and Vincent told PM. I stop him for now, because he is anti-PM. We put Fairuz in. And we put…I told you three months ago he became CJM [Chief Justice Malaya]. He said “Don’t believe.” Then he got it. He rang up to thank me.

Lingam : Knowing the law doesn’t give you the winning formula, you must also kow tow to the emperor.

Lingam : I want you do it in 6 months. `Datuk Seri, Don’t worry, I will get it done.’ He paid double the price to get all of them. A big loss lah. Then Solomon Island and Fiji and all, he said, Vincent go and invest there, he went and bought…[inaudible] the government factory [inaudible] you do this project a bit and cover up your loss. PM will do what he want to do to cover your backside.

Lingam : Don’t ask… because Vincent has taken me to PM’s residence… the house … [inaudible]… Anwar’s case… the lawyers…Wee Cheong … [inaudible]. But I cannot go and talk to PM just like that and say promote this and that…

Lingam
: ....but when PM calls me on Anwar’s case, I can tell him… he’ll listen…But if I go promote so and so, that means I got interest. So, I don’t do that. I use Vincent and Tengku, go and do that. I don’t f*** them up. They go and do that. But I tell you this lah. Don’t tell in front of people, of course.

Lingam : Even the son’s case, I do everything. I talk to the father…Talk until he agreed. But if it is a big crisis that affects him, ….I can talk, he will listen.

Kesimpulan;

cheers.

Lingam Video Clip - Full & Transcript.....

Anwar Ibrahim released the full 14-minute recording of the VK Lingam video clip, and revealed that he has more evidence to back up claims of judicial indecorum.

Full Transcript :

(View the full video on the right window of your screen.)

(Parts are slightly inaudible. This transcript may not be entirely accurate.)

Lingam
: The CJ (Chief Justice - judiciary’s No 1 post) said his relative is now the Agong, so he wants to stay on to 68, so, Tengku Adnan said - I told Tengku Adnan, yesterday I had a meeting with him - he said PM is already very angry with him … and … he said no problem, he is going to make you acting err… confirm your position as PCA (President of Court of Appeal – judiciary’s No 2), working very hard, and then get Tan Sri Mokhtar as CJM (Chief Judge of Malaya – judiciary’s No 3).

Ah, so we just keep it confidential. I am working very hard on it. Then there is a letter, according to Tengku - I am going to see him tomorrow - there is a letter sent to … ah … CJ - I mean Tan Sri Dzaiddin - that Datuk Heliliah, …er Datuk Ramli and Datuk Maarop be made judges, and he rejected that Dr Andrew Chew and apa itu Zainudin Ismail lah because Zainuddin Ismail who condemned your appointment and Tan Sri Mohtar’s appointment.

And then you also, it seems, wrote a letter for the remaining … confirmed as judges. As per our memo, I discussed with Tun Eusoff Chin and we sent the same memo to PM. I just want to get a copy letter that this has been done.

And then Tan Sri Dzaiddin said he is going to recommend six people for the Court of Appeal, but until today the letter hasn’t come to PM. He never discussed, but neither he has sent the letter to PM. He has not sent. So, I know it is under the constitution, for judges all, that is your job, Datuk, to send, but we don’t want to make it an issue now.

Ah, okay. Actually I told Tengku Adnan to inform PM, PM to call you for a meeting. But I will organise this so that Tengku Adnan will call you directly. And then I got your number, I will tell him to call you directly to for you to meet PM lah. Ah… So should be okay, then ar… correct, correct, it is very important that the key players must be there.

Correct, correct, correct. Correct, correct. You know that the same problem that Tun Eusoff Chin had. He tried to do all this and yet he has run out of soldiers. He couldn’t do it because many were from the other camp. Last time was unfortunate because Tun Daim was doing everything sabotaging, you know lah…

Otherwise how are things with you - everything is okay? No, don’t worry. You know sometimes Tan Sri Vincent said that half the time we are talking about judiciary rather than doing the work. But if I don’t do this part, my work will be useless. Ha! Ha! Ha!

Ah, yes. Correct, correct, correct, correct, correct. Right, right, right. Correct. Ah. Ah. Right! Susah. You see he has now asked for six Court of Appeal judges, so that he can put his men before he retires.

Correct, correct, correct, ah, and then, ah, ah, correct, correct, correct, correct, correct.

Ah, never mind, I will do this, I will get er… Tengku Adnan to arrange for PM to call you and Tan Sri Vincent Tan for PM to call. You know why, actually, I am very grateful to Tan Sri Vincent Tan, You know why? I brainwashed him so much I even quarreled with him.

One day I went to Vincent Tan’s house, I fired him at night in his house. I said bloody hell, if you don’t do this who will do it? All these people, Tun Eusoff Chin, Datuk Ahmad Fairuz, Tan Sri Zainal all fought for …that. Then he called Tengku Adnan. Tengku Adnan he said, saya bukan Perdana Menteri Malaysia lah, you know. If the old man doesn’t want to listen to me, go to hell.

He quarreled with me. I said never mind, never mind, Tan Sri, you talk to PM again tomorrow morning to put Datuk Ahmad Fairuz to CJM. So next day morning he went and he called me back 9.30 that he said PM has already agreed. So I said never mind, we hope for the best. So I said no harm trying, the worst that it can happen is you lose.

Being the old man, he is 76 years old, he gets whispers everywhere, and then you don’t whisper, he get taken away by the other side. But, now the PM is very alert because every time he gets letters from Tan Sri Dzaiddin, he calls Tengku Adnan, he says discuss with Vincent, come and discuss. And…

Yes, yes, ya. Correct, correct. Ya, but you see although I know PM, but my views … I am a lawyer in practice… my views are… I go through them, I go through them lah.

Ah. Ah. Ah. Ah.

And then Dzaiddin will go and tell them you went and saw PM and make a big issue out of it. Oh ya, I think so, I think so.

Okay, fine, fine, fine, fine. Okay. Okay. Okay. Okay. Okay. Right, okay, okay. Ah. Ah. Correct, correct.

Now I heard Raja Aziz, Raja Aziz ah, two weeks ago spoke to my lawyer Thayalan, and another lawyer Anad, in the High Court - they have a case with each other. So, Thayalan and Anad asked Raja Aziz, how is Tan Sri Wan Adnan?

He said he is on his way down. But you know what is the shocking thing he said? Datuk Fairuz became CJM. He overruled everybody, in three months time, he is going to be PCA, and six months time, he is going to be CJ. He said I can’t take this shock. He told lah. Ha!

It seems ah that they are going to organise a campaign … they are going to organise a campaign to run you down. But you just keep quiet - don’t say anything. Don’t … even the press ask, you said I leave it to God, that’s all. Don’t say. I really like your message. You said I work very hard, what can I do? I leave it to God. That’s the best answer, Datuk, that you can ever give. Ah.

Yes… I will also get Tan Sri to remind PM to put a Tan Sri ship this year lah. You know, this will elevate you, you know.

Oh, yes, yes, yes, yes. Ah. Steve Shim got so fast, Tan Sri Chong waited for a whole year to get Tan Sriship.

Ah. My God, that’s why, ah. Correct, correct, correct, correct, ya, ya, ya, ya, right, right, right, correct, correct.

Don’t worry, we organise this. And if Tan Sri Vincent and Tengku Adnan want to meet you privately, they will, I will call you. We organise a private arrangement, in a very neutral place.

No, don’t worry, Datuk, I know how much you suffered for Tun Eusoff Chin. And Tun said Datuk Ahmad Fairuz 110 percent loyalty. We want to make sure our friends are there for the sake of PM and for the sake of the country. Not for our own interest, not for our own interest. We want to make sure the country comes out well.

Well, you suffered so much, so much you have done - for the election petition, Wee Choo Keong, everything. How much, nobody would have done all these.

Yes, you know. Ah. Good lah. You don’t worry. I am constantly working on this. I…

Ya, ya, don’t worry, don’t worry. We work hard on this er Datuk. And if Tan Sri Vincent and Tengku want to see you, I will organise it in a confidential place.

Okay, Datuk, all the very best. God bless you and your family.

Okay. Thank you, thank you. Bye-bye, bye-bye.

[Off Camera Voice]: Who is that Dato?

Lingam: Chief Justice Malaya.

[Off Camera Voice]: Who is that?

Lingam: Dato Ahmad Fairuz

[Off camera voice]: Oh Ahmad Fairuz.

Lingam: I put him up there. Don’t tell this, please. I cannot tell this to Manjit. And he is acting President Court of Appeals Number 2 post. He is next Chief Justice. He always says “I leave it to you.”

[Off Camera Voice]: I thought you were very close to Tun Eusoff Chin, Datuk?

Lingam: He is Eusoff Chin’s man, Eusoff Chin retired. But Dzaiddin hates Eusoff Chin, you understand? Ah..

[Off Camera Voice]: Because you know I…I…I..as far as I know you are very…

Lingam: Eusoff Chin and I are extremely close. Because you know…Yeah. Eusoff Chin in power, I can straight and get in Pom! Pom! Pom! Pom! But now Dzaiddin is there. So Dzaiddin is attacking our cases. That means what? James Kumar is aligned to Dzaiddin. But Dzaiddin is retiring in 15th of September. He is finished.

[Off camera voice]: Next year?

Lingam: So Dzaiddin really wants to go…Don’t worry. And all that. He now acting PCA because Wan Adnan is sick. Right? This. Apart from law knowledge you need kow tow. Please understand that. You need to know the emperor. Knowing the law doesn’t give you the winning formula, you must also kow tow to the emperor. Correct or not? So now I am working very hard. So he agreed to meet Vincent Tan and PM and…what you call Tengku Adnan.

[Off camera voice]: Do you think Vincent has an interest over PM?

Lingam: You don’t know about the history. Businesswise may not be successful. Robert Kuok is very brilliant. Lim Goh Tong is very rich. Vincent Tan, you know what PM say? He went to Averton he went to Langkawi. He said bincang. I want you to build a hotel here. His wife pulled him away. [Inaudible] He said Dato Seri I will think about it. The wife pulled him away. There is another [inaudible] cannot get a bank loan. Vincent there. Vincent, can you build a hotel? Ready for next Air show?

I want you do it in 6 months.

[Off camera voice]: Vincent is very close to him.

Lingam: That’s right. Don’t ask… because Vincent has taken me to PM’s residence… the house … [inaudible]… Anwar’s case… the lawyers…Wee Cheong … [inaudible]. But I cannot go and talk to PM just like that and say promote this and that…

Because ah, he knows… I am a… but when PM calls me on Anwar’s case, I can tell him… he’ll listen…But if I go promote so and so, that means I got interest. So, I don’t do that. I use Vincent and Tengku, go and do that. I don’t f*** them up. They go and do that. But I tell you this lah. Don’t tell in front of people, of course. Life, one thing go confidential wrong is dangerous. Ah. Never, never say…You should… never. Even though to PM. You should never say. I don’t know. I always say “I don’t know.” That’s all.

[Off camera voice]: Everybody… I think many people know. Even the son case, everything I talk the father, …. Talk until he agreed.

Lingam: You know me [inaudible]. But I never talk about it. Even the son’s case, I do everything. I talk to the father…Talk until he agreed. But if it is a big crisis that affects him, ….I can talk, he will listen. But if I want to favour somebody, that I cannot guarantee. Because my interest is not his interest. You know what I mean. Tomorrow invest your interest involving your father, I can come say this this this, you will listen. But tomorrow I appeal for me, you are not obliged to listen. Because you are a politician, PM. Politician is what is your interest, not what is my interest. But if I am giving advise on your interest, you will listen. On my interest, you will not. You must be careful about this.

[Off camera voice]: Datuk, I need to ask you this question.

Lingam: Ask me. Ask me.

[Off camera voice]: For a while now…

Lingam: Because we can talk behind these people.

[Off camera voice]… Actually, I think, you know, Daim has more equity interest in Berjaya than Vincent Tan, isn’t that true?

Lingam: Let me tell you something … [inaudible] was bought by Daim … [inaudible]. Later on he did some deals where Daim supposed to help him. One or two he helped. Supposed to give him some money. Didn’t give. Part was paid, part not paid. Later on Daim called up and he got paid.

cheers.

Haidar,Pat Lah’s prodigal son returns.....

Finally the gomen has setup the 'Commission of Enquiry' to look into the Lingam Video Clip, under the Commissions of Enquiry Act 1950 (Act 119) with immediate effect. It’s headed by former chief judge of Malaya Haidar Mohamed Noor and the other members of the commission are former chief judge of Sabah and Sarawak Steve Shim, former Court of Appeal judge Mahadev Shankar, former solicitor-general Zaitun Zawiyah Puteh and historian and Suhakam commissioner Khoo Kay Kim. PM Deparment's Legal Affairs Division head Abdullah Sani Hamid will act as the commission secretary. They have three months or till mid-March to investigate and summit their findings.

Meanwhile Haidar and Mahadev Shankar were from the earlier three member panel. The toothless panel of inquiry headed by Haidar had nothing on their table and ended up by submitting reports based what they gathered from the IGP, AG and ACA. In the end each panel members submitted their report independently. What a sheer waste of public money. However, though media reports indicated all three panelists supported the formation of a Royal Commission some inside source told me that only two panelist suggested the formation of Royal Commission, while Haider wanted the case to be closed. Haidar feared that the Royal Commission will expose more skeletons in the cupboard and he could likely be one of them.

Haidar Mohamed Noor's role in the 1988 judicial crisis which saw the arbitrary and unconstitutional sacking of Salleh Abas as Lord President and two Supreme Court judges renders him as untrustworthy of such an appointment.

The 2nd term of reference states "to enquire and identify the speaker, the person he was speaking to in the video clip and the persons mentioned in the conversation” . Haidar’s name was mentioned in the video clip.

How in the hell do you think he is going to deal with that? Is he taking leave when his name comes out or he just going to plug his ears as nothing happens? Or,he can go in with a preconceived idea that all along this video clip was nothing more but a fake cooked up by some frustrated people.

At least Abdul Rashid had openly declared that he's an ardent fan of the gomen and in a recent speech,he declared that “there is only one regime in this country that is capable of running” the nation, and that Malaysia would be “in trouble” if he was in disagreement with BN. With the amendment bill passed, Abdul Rashid is going to do his best so as not to hurt or be in any disagreement with the BN gomen.

How Haidar Mohamed Noor going to do his piece in this Lingamgate scandal inquiry is anyone's guess. Let’s wait and see.... Again, a black eye on the judiciary!

Sure enough, with this new development, coupled with Bersih,Hindraf public rallies and a series of corruption scandals bruising the gomen, thus, compelling Pat Lah to reschedule his general election date, reportedly set for the last week of December to a later date, probably during the mid-March 2008 school holidays. By then the Royal Commission would have done their work, but sure enough it will be before April 14,2008. You guys should knows why........

cheers.

Bersih’s Memo.......

The Bersih’s Memo..........

Bersih urges the Parliament of Malaysia, which consists of His Majesty the Yang diPertuan Agong, Dewan Rakyat and Dewan Negara to reject the proposed bill to amend Article 114 of the Federal Constitution, which will effect in Tan Sri Abdul Rashid Abdul Rahman’s extension as the Election Commission (EC) Chairperson up to one-and-a-half years.

Bersih stresses that Tan Sri Abdul Rashid, whose service is continuously marred with recurring electoral frauds and manipulations, is not fit for the job and must go immediately. All parliamentarians must therefore vote against this Constitutional Amendment Bill so obviously being rushed through to keep him the job is an insult to both the Constitution and Parliament.

1. In principle, Bersih has no objection to the extension of the retirement age from 65 to 66 years for all members of the EC. The removal of an EC is constitutionally stipulated to be done in the same manner as a Federal Court judge, whose retirement age has been increased from 65 to 66 years, such synchronisation is not objectionable.

2. The Constitutional Bill, if passed through both chambers of the Parliament and consented by HM the Yang diPertuan Agong by this December 31, will however become a back-door extension for Tan Sri Abdul Rashid whose birthday falls on the same day. In other words, Tan Sri Abdul Rashid has to retire if Article 114 of the Federal Constitution is not amended in time. On the other hand, if the amendment is passed, Tan Sri Abdul Rashid may stay on effectively till June 2009 with the conventional half-year extension after retirement. In other words, this will ensure that Tan Sri Abdul Rashid oversees the next elections.

3. The Constitutional Bill, hastily tabled for first reading in Dewan Rakyat on November 20, 2007 and scheduled for second reading on December 11, 2007, is therefore a “Save Rashid” Amendment. Such a “Save Rashid” Amendment, by reducing the Federal Constitution to a tool to serve the interests of one individual especially one unfit for the job, is an insult and assault to constitutional democracy.

4. Article 114(2) stipulates “the importance of securing an Election Commission which enjoys public confidence”, which Tan Sri Abdul Rashid has clearly failed. Here is a non-exhaustive list of 10 failures and scandals in the electoral process under his service in and leadership of the EC:

4.1 The electoral rolls is contaminated with the names of the dead, non-citizens, multiple registrations and the under-aged, allowing election outcomes to be determined by phantoms rather than citizens. In 2001, Justice Datuk Muhammad Kamil Awang nullified the election result of Likas state constituency in Sabah on the grounds that the 1998 state electoral roll was illegal as phantom voters, including non-citizens, had cast their votes on polling day.

4.2 The government responded to the Likas verdict by changing the Election Act so that election outcome can no longer be challenged on the grounds of electoral roll validity. All EC wrongdoings are now protected. In a manner amounting to contempt of court, Tan Sri Abdul Rashid attacked Justice Datuk Muhammad Kamil Awang on December 4, 2007, alleging that the judge took it out on the government because he was ‘frustrated with certain things’.

4.3 Voters are transferred from one constituency to another to secure victory for the ruling coalition. In October 2007, EC secretary Datuk Kamaruzaman Mohd Noor blamed some assistant registration officers for cases that happened before 16 July, 2002. If found guilty under the Election Offences Act 1954, those officers shall be liable for imprisonment up to two years, fine up to RM 5,000 or both. However, no names have been disclosed and no police reports lodged.

4.4 Such transfer or implantation of voters continues to happen after 2002. The latest case is the increase of 8,463 voters within three months at Ipoh Timor constituency which the Parliamentary Opposition Leader Mr Lim Kit Siang won with a margin of 9,774 votes in 2004.

4.5 The extent of irregularities and fraudulent registrations, seen particularly in the Ijok by-election on 28 April 2007, is shocking:

- Over 50 dead voters were still on the electoral roll and 12 of them, all of them Malays from the Jaya Setia polling district, rose up from their graves to cast their votes on polling day.

-Three Chinese voters at Pekan Ijok had their votes stolen by impostors, who had turned up earlier at the polling station.

- As many as 23 voters were registered without national identity cards.

- As many as 32 voters aged between 100 and 132 years old were still listed on the electoral rolls.

4.6 In the 2004 general elections, the use of three different versions of the electoral roll led to a breakdown and chaos in polling in at least 17 parliamentary constituencies in Selangor and three in Kuala Lumpur. EC then ordered an illegal extension of polling for two extra hours in some of these constituencies. No EC officers have been prosecuted or penalized for the chaos.

4.7 Also in the 2004 general elections, provisional results showed that 98% of the registered voters collected parliamentary ballots in Kuala Terengganu, but 10,254 ballots were not returned. Tan Sri Abdul Rashid offered an absurd explanation that KT voters had the hobby of collecting ballot papers. The final result published on the Gazette saw the reduction of turnout rate to 84% and the missing ballots to 240, with no explanation offered for this changes.

4.8 For years, elections have seen high number of missing ballots in many constituencies. Top on the list for four elections from 1990 and 2004 was the Lumut constituency, which saw the extent of unreturned ballots soaring from 2,763 in 1982 to 8,176 in 1999. Had these missing ballots found their ways to polling stations in other constituencies, they would have overturned outcomes in many marginal seats. Blaming it on the weakness of postal voting registration, Tan Sri Abdul Rashid has failed to end this phenomenon so damaging to the credibility of the EC and electoral process.

4.9 Mal-apportionment and gerrymandering of constituencies have gone from bad to worse with the 2002 constituency re-delineation exercise. In 2004, BN won an unprecedented 91% parliamentary majority with a mere 64% popular votes. This effectively means that one vote for BN was equivalent for 3 votes for DAP, 8 votes for PAS and 26 votes for Keadilan. Tan Sri Abdul Rashid has made a mockery of the “one person, one vote” principle.

4.10 Ultimately, Tan Sri Abdul Rashid is unfit to chair the EC for he lacks the most fundamental quality: the moral courage and the commitment to act independently, guided only by the Constitution and the best interest of Malaysia’s democracy.

In 2003, he conceded that EC’s ability to carry out its task independently has been hampered by the government. In November 2007, he indirectly admitted that the election date was set by the Prime Minister. On December 8, 2007, he inappropriately said that the ruling coalition is the only regime capable of running the country.

5. On the grounds that Tan Sri Abdul Rashid is unfit to chair EC and his retirement on this December 31 in the best interest of the nation, BERSIH urges all parliamentarians to vote against the Constitutional Amendment Bill.

Sad to say that the amendment bill was passed with absolute majority the BN has in Parliament. The amendment bill will have to be passed by the Dewan Negara which we expect will be a quick one. The next stage is when the Agong gives his royal assent. EC chairperson,Abdul Rashid retires on 31st Dec 2007,will the Agong withhold giving his royal assent till after he retires?

That Abdul Rashit guy has to go. Daulat Tuanku!!

cheers.

Pat Lah should consult Tun Musa Hitam on peaceful assembly....

Aniza Damis speaks to Tun Musa Hitam

Some of the excerpts below.....

Aniza Damis(AD): Is the right to peaceful assembly an absolute right?

Musa Hitam(MH): No. Nothing is an absolute right in this world.

AD: Why is it that we have never experimented with peaceful assembly?

MH: During the time I was with Suhakam, I tried my very best to get organised demonstrations accepted, organised in the sense that all parties assume responsibility together.People must apply for permits, but the application is not for the purpose of restricting demonstrations.Once approved, you need to comply with certain very strict procedures. You must be responsible for orderliness by appointing a list of marshals to be identified and identifiable. You must ensure cleanliness. Certain sites or routes must be determined. All this is so that there is accountability and responsibility. Traffic and regular police will be there to ensure orderliness. At the same time, they must also make known that there will be riot police at hand, in case anything goes wrong.

AD: The system right now is, if you want to assemble, you have to apply for a police permit.

MH: And almost automatically it’s refused. So, you stop there.

AD: So, if it’s refused, the assembly is illegal?

MH: Yes, it’s illegal.

AD: Some people feel there is a biased allocation of permits.

MH: There are biased allocations, in so far as the applicants are concerned. In so far as the government is concerned, they say they are not biased. But therein lies the problem.Again, we’re back to where we started. If you have a focused examination of the situation, the ways and means, and formed a methodology or systematic approach, maybe it might work.

AD: Is the use of force justified in dispersing peaceful people?

MH: If you had rules and regulations which include an investigation into a situation where violence takes place, immediately Suhakam, or whoever, must start an inquiry. Then the blame game can go there. Not here, in the newspapers or the blogs.

AD: In an illegal rally, is it justified to use force?

MH: No, not by anybody. The police will tell me, in many cases it is true, that they are provoked. But, like in the Maldives, they (anarchists) love to see the police. They have a target because, as the police, you represent the government. So, you take action, and then there’s a reaction.

AD: Is Malaysia ready for peaceful assemblies?

MH: Yes! Come on, we have been independent for 50 years. In the old days, after the demonstrations by the Indians, there would have been retaliation immediately.

AD: Do you think the concept of the right to freedom of expression in Malaysia is a middle class idea?

MH: No. What about those people in Baling? They were not middle class. They were poor smallholders. You cannot dismiss people. We should not recognise them in order to arrest them. That’s negative. The right to peaceful assembly is enshrined in our democratic institution. That right also gives the right to the government to refuse.

'Spring-cleaning' in Pat Lah's sunny Malaysia.....

A series of massive public rallies that were abruptly stopped by the police and FRU for not having police permits had gravely dented Pat Lah's image as a PM who wants the rakyat to work with him rather than work for him.

A rally was organized by a group of lawyers and NGOs proceeding with a march to mark International Human Rights Day on Sunday. However, in one swift move police had arrested eight people, including five lawyers. The arrests came after a failed attempt by the organizers of the march to negotiate with the police to allow them to finish their march at their intended spot.

Bersih's rally for a fair and clean election was held last month.Bersih felt that the Election Commission is bias and used unfair tactics to manipulate the electoral roll, allow double voting, encouraged money politics, gerrymandering, the use of postal votes, mass media control and others, that allowed the gomen to win in every election since merdeka.

The Hindu Rights Action Force (Hindraf) had their rally two weeks ago and was to deliver a petition to the British High Commission. Earlier Hindraf, had filed a US$4 trillion lawsuit in the UK against the British government for bringing Indians to Malaysia as apprenticed labourers and "exploiting" them during the colonial days. The suit sought a declaration that the rights of the Indian community were ignored when Malaya gained independence in 1957, resulting in what they claimed to be discriminate and marginalized to this day.

In another related move Tian Chua a PKR stalwart was arrested outside human rights organization Suaram’s office in Johor Baru by a police team from Kuala Lumpur.

Meanwhile a PAS Vice President, Mohd.Sabu was detained at his daughter wedding ceremony. The past weeks also saw many opposition members and Hindraf followers were arrested and charged in court.

Bersih wants the government to withdraw the Constitutional Amendment Bill scheduled to be tabled on that day which, if passed, will see the Abdul Rashid, the current EC chairman’s tenure being extended by a year, to the new age limit of 66. This act of scourge and suppression is solely seemed to deter Bersih's next planned rally - at Parliament house this Tuesday.

Whats more disturbing is that police have used excessive force in all the rallies. The actions of the police reinforced the popular view that the police, like other institutions of the gomen, are not neutral. Instead of being the protector of the ordinary rakyat, the police, now, appear to be serving the people in power.

The gomen has downplayed these issues, by putting the blame on the opposition for all the mishaps instead. The gomen has even gone to the extension of telling Malaysians that foreign terrorist groups were involved in these rallies. Mahathir used similar tactics by arresting key opposition leaders under the Internal Security Act (ISA) and the shutting down of newspapers deemed to be unfriendly to the gomen. This time around Pat Lah has threatened to do the same.

The rallies of recent weeks, coupled with the Lingam video tape crisis,Zaki Tun Azmi's ascension to the Federal court, the ever increasing corruption issues facing the gomen has force the gomen to delay the widely expected general election further.

How fair and democratic can our election be when the EC chairman, Abdul Rashid had openly admitted by saying,” A lot of people are anxious to determine the type of regime that is going to handle Malaysia in the coming years. They are always talking about regimes. I never talk about regimes. There is only one regime in this country that is capable of running (the country)”

Pat Lah must be a very happy man with Rashid's confession and see no reason why his tenure should not to be extended. This little bit of admission by Rashid too, demonstrates what the oppositions has being saying all along that the EC is not an independent body as it seems to be. Sure enough the gomen and EC are more like "merpati dua sejoli".....

Meanwhile, are events in the past weeks be construed as Pat Lah's spring-cleaning act and probably be seen as a prelude to the coming general election? Judge for yourself............

cheers.
