Anwar Ibrahim again battles dubious sex charges.....

Prosecution appears to be thinly veiled attempt to ruin Malaysian opposition leader’s reputation and political career. There is an uncomfortable pattern to life for Anwar Ibrahim, the charismatic leader of Malaysia’s opposition. In 1998, shortly after he quit the authoritarian government of Mahathir bin Mohamad, he was convicted and jailed on trumped-up sodomy charges.

Six years after that conviction was quashed and he was released from prison – and just as it looked like he and his multi-ethnic coalition might finally oust the long-ruling United National Malays Organization from office – Mr. Anwar finds himself trapped in the most awkward of reruns, once more accused of “consensual intercourse against the order of nature.”

The charges again look to be a thinly veiled attempt to ruin Mr. Anwar’s reputation and sabotage his political career in this Muslim-majority country. The trial to date – dubbed “Sodomy II” in Malaysia’s unsubtle government-controlled press – has produced a succession of lurid headlines about lubricant tubes and stained underwear, while Mr. Anwar and his lawyers have been denied the right even to see the medical records of the man with which he is alleged to have had anal sex.

But instead of letting the scandalous court proceedings force him to the sidelines, the eternally optimistic Mr. Anwar has been using good humour and his ever-present BlackBerry to turn even the most awkward of headlines to his advantage, holding up the charges against him as proof of the absurdity of the system he’s trying to change.

As a lone judge contemplates whether there is evidence to convict Mr. Anwar and sentence him to up to 20 years in prison, as well as a flogging, Mr. Anwar has continued his ferocious assault on a government he derides as repressive and corrupt, blogging from the courtroom and sending cheeky and upbeat 140-character updates to his followers via Twitter.

Sodomy circus turns into sex opera!” reads one of Mr. Anwar’s mid-trial posts, which linked to a video of a lawyer discussing the lurid details of the case. “Courage of conviction. Que sera sera,” was his response to a fellow Twitter user who worried the energetic 63-year-old was headed back to jail.

The odds do seem stacked against Mr. Anwar, a former deputy prime minister who was once considered the rising star of Malaysian politics. But to hear him tell it, his déjà-vu legal ordeal is evidence that Prime Minister Najib Razak and his party are losing their grip on power, and they know it well.

They can’t deal with me politically – either my economic programs or policies. They can’t debate me. So they resort to this ludicrous exercise to demonize me,” he said in an interview at the offices of his People’s Justice Party in western Kuala Lumpur, a confident grin fixed on his narrow, goateed face. “We will win the next election and we will change the courts.

It seems unlikely things will go quite that smoothly. Mr. Anwar’s political career has seen his fortunes change as often and as quickly as the weather in this peninsula thrust between the Indian and Pacific oceans. The leader of a Muslim youth organization during his student days, he shocked his followers by joining UNMO in the early 1980s and taking a succession of cabinet posts in the authoritarian government of Mr. Mahathir, eventually rising to become his powerful finance minister and deputy prime minister.

But the two men never saw eye-to-eye on key issues, and they eventually fell out during the 1997 Asian financial crisis over economic policy and Mr. Anwar’s accusation that cronyism at the top was hurting the country’s economy. Shortly thereafter, Mr. Anwar – frequently held up in the West as an example of a moderate Muslim democrat – was in jail.

Though initially barred from politics upon his release, Mr. Anwar steered the opposition to a surprisingly strong finish in 2008 elections, and – even as the new sodomy charges were being laid –very nearly won the long-sought prime minister’s chair in the aftermath when he called for a vote of non-confidence in Mr. Najib’s government. Mr. Anwar said he had the support of a majority in parliament, including an unspecified number of UMNO defectors, but the vote never happened. Instead, 40 key lawmakers were sent on a government junket to Taiwan during which some were apparently convinced to rethink supporting Mr. Anwar’s bid for power.

The next election, which can be called any time before 2013, is set to be a high-stakes affair in this rapidly developing country of 28 million, which has seen freedom of speech blossom since the 2003 retirement of Mr. Mahathir and the rise of the Internet. Any kind of conviction would keep Mr. Anwar – who heads an improbable coalition that consists of liberal reformers like himself and an Islamist party that seeks to impose Koranic law – on the sidelines for another five years.

Mr. Anwar, a married father of six children, denies the new charges that he had sex with a 25-year-old former aide to Mr. Najib. (The sodomy law, which dates back to the British colonial era, has only been used seven times since independence, with four of those charges being levelled against Mr. Anwar.)

The case recently devolved into further farce when it surfaced that the complainant was having an affair with a member of the prosecution team. Though Judge Mohamad Zabidin Diah acknowledged the affair as fact, he denied Mr. Anwar’s application to have the charges thrown out on that basis.

Mr. Anwar, who counts Al Gore, Nelson Mandela and former Canadian prime minister Paul Martin among his friends, said that while the Malaysian court system would do him no favours, he thinks his case is high-profile enough that the government won’t dare jail him again. “It’s a catch-22 for them. If they put me in jail, they invoke more sympathy, certainly the government will lose … And unlike Mahathir, Najib wants to be seen to be acceptable in the international community.”

Mr. Anwar’s undimmed ambition to be prime minister clearly infuriates his political opponents. Even in retirement, his mentor-turned-nemesis Mr. Mahathir uses his own blog to mock his former protégé and lash back at accusations that the case against Mr. Anwar is trumped up. “Could it be that it was actually the victim of anal rape who decided to tell things as they happened? I would like to say we should wait for the court to decide, but that can take a very long, long time or even never,” Mr. Mahathir wrote recently.

Despite a near-complete ban on his speaking to the official media, Mr. Anwar appears to be winning the public-relations battle, in part because of his savvy online efforts. A poll conducted by the independent Merdeka Centre for Opinion Research shortly after the new charges were filed found that only 11 per cent of the more than 1,000 respondents believed the new sodomy allegations against Mr. Anwar. Two-thirds said they agreed with the statement that the trial was “a politically motivated action to disrupt Anwar Ibrahim’s political career.” - Mark MacKinnon

UMNO balun RM52 bilion saham bumiputra.........

"Mereka mengapi-apikan pelbagai isu perkauman supaya menutup skandal RM52 bilion.

Persoalan itu lanjutan Datuk Seri Najib Tun Razak, Perdana Menteri merangkap Menteri Kewangan mendedahkan bahawa ekuiti Bumiputera hanya tinggal RM2 bilion sahaja.

Menurut Guan Eng juga, ekuiti Bumiputera mampu meningkat sebanyak 45 peratus melalui Dasar Ekonomi Baru (DEB) sekiranya Umno tidak mengkhianati amanah rakyat, khususnya orang-orang Melayu.- Dzulfikar Mashoor

Chua Soi Lek - Dont give Opposition a try in 13th GE.....

It is wrong for the rakyat to assume that they can give the Opposition “a try” in the next general election because PAS will not give up on its Islamic agenda, said MCA president Datuk Seri Dr Chua Soi Lek.

The present squabble between PAS and DAP over hudud law, he added, should serve as an eye-opener to all Malaysians.

“The rakyat can vote for Pakatan Rakyat, but the Opposition will end up quarrelling after that; and the rakyat will be the ones suffering,” he told a press conference after chairing the MCA presidential council meeting here yesterday.

He was replying to a question whether Pakatan could form the federal government when PAS and DAP kept quarrelling over the hudud law issue.

Felda to pay settlers RM11 million........

After more than 10 years, 354 Felda Kemahang 3 settlers received some Hari Raya cheer today after the Federal Land Development Authority (Felda) was ordered to pay RM11 million for cheating them over the grade of their oil palm fruit. This follows the Federal Court's decision today in refusing a review of Felda's application to challenge a similar Federal Court decision by another panel which before this dismissed Felda's appeal.

More than 150 settlers were present before a packed courtroom to hear the court's final decision. Hundreds more were waiting outside after they braved a nine-hour trip from Kelantan. With today's decision, the settlers are expected to receive between RM25,000 and RM30,000 each. This was the first suit filed by the settlers against the federal agency.

Today's decision has serious repercussions for Felda and the government as it may open the floodgates to further suits. It will also undermine the confidence of the 100,000 settlers in Felda which was formed by second prime minister Abdul Razak Hussein - the father of current PM Najib - to protect their interests and welfare.

Felda counsel Firoz Hussein Ahmad Jamaluddin referred to a string of suits faced by the agency from the settlers. There are other similar suits filed at the Johor Baru High Court and Seremban High Court.

Court of Appeal president Alauddin Mohd Sheriff led a three-member panel in hearing today's application. Justice Alauddin said that in a unanimous decision, that the court did not have jurisdiction to review the earlier decision of the Federal Court. "Hence, this application is dismissed." The other judges are justices Hashim Yusof and Md Raus Sharif.

On Feb 10, a three-member bench of the apex court led by Alauddin granted a stay order after another panel led by Chief Justice Zaki Azmi dismissed Felda's leave application. The Zaki panel had on Jan 19 unanimously ordered Felda to pay RM11 million to the 354 settlers in Felda Kemahang 3. In dismissing Felda's leave application, Zaki said the court was satisfied there was no part in law for the matter to be reviewed by this court.

"Following this, we uphold the findings of the High Court and the Court of Appeal and order Felda to pay the amount owed," Zaki had said.

The settlers named Felda, its area manager Ibrahim Ismail (since deceased) and Felda Palm Industries Sdn Bhd as defendants. They were represented by lawyers Wan Rohimi Wan Daud and Yusfarizal Yusoff.

Foong: Felda cheated settlers

Gopal Sri Ram, who was a member of Zaki panel, in his judgment - the last before his retirement - said the High Court judge had correctly used his discretion to proceed with the trial without the presence of Felda's lawyers and subsequently accepted the evidence of the settlers' witnesses and awarded the damages to the settlers.

"There is material placed before us that shows that the applicants' (Felda) solicitors were aware of the hearing date. In fact, solicitors for the respondents (settlers) took the unusual but cautious step of writing to the applicants' solicitors reminding them of the trial date.

"Despite this, neither counsel nor solicitors for the applicants were present."

On Jan 13, 2008, Kota Baru High Court judge Mohd Azman Husin ordered Felda to pay RM7.8 million plus interest after counsel representing Felda and Felda Palm Industries failed to turn up for the hearing.

On June 26 last year, the appellate court delivered a two-to-one verdict in favour of the settlers, when then justice James Foong noted that Felda, which was supposed to uplift the standard of living of the settlers, had instead cheated them.

Counsel for the settlers, Wan Rohimi Wan Dau, submitted there must be uniformity in judicial policy and if in Opposition Leader Anwar Ibrahim's sodomy case there was no power for review, then the decision by an earlier panel should stand.

The Kemahang 3 settlers had sued Felda in 2002 claiming that the agency had understated the quality of their oil palm fruits during the period from 1996 to 2002 which caused them to suffer losses.

Felda area manager Ibrahim Ismail was alleged to have cheated the settlers on the grade of their palm oil fruit - they were paid a lower grade (17.05 percent of the extraction rate), where else the settlers found it was of a higher grade (23 percent) after they did their own testing. In the suit, they claimed an average rate of 19.5 percent in the extraction rate.

Before filing the suit, Minister of International Trade and Industry Mustapa Mohamed had threatened the settlers with eviction. The matter was heard at the Kota Bharu High Court but one of the Felda counsel was not present, resulting in the judge making the decision to award the settlers.

'Cable-connection' to corrupt civil servants........

It is hard to shake the perception that the culture of corruption is synonymous with civil servants in Malaysia. Even the chief secretary to the government, Sidek Hassan, admitted a whopping 41 percent of those of charged with corruption were civil servants. Whether it is cheating on medical certificates or asking for an extra buck to 'close one eye' to an impending traffic summons, the tales are all too familiar.

However, former Anti-Corruption Agency director-general Shafee Yahaya - who was in the civil service for 33 years - says there is more to such claims.

“You have to look at the whole scenario. It depends on the particular ministry or department. Of course it is headed by the director-general. But ultimately, it won't happen if there are no connections or (an) interested party,” he said.

“To say that the civil service or politicians are completely corrupt is not right because, sometimes, it's a combination of both ....

“Sometimes, it is the politician who is corrupt, (and) pressures the civil servants to abet or look the other way and rewards them at the same time. The civil servants sometime risk persecution by saying 'No'.”

Shafee dismissed the notion that corruption is a 'victimless' crime, pointing out that there is always someone who ends up with the short end of the stick in corrupt activities.

“Those who will in the end suffer the most are the poor, the disadvantaged and those who cannot pull strings.

“Corruption comes in various forms, whether it is nepotism, cronyism or simply inflating costs. It will cost the public, (as they) won't get good return of investment. This will lead to a higher cost of living.

“Imagine if a road costs RM10 million to build and, because of corruption, (the bill) comes up to RM30 million. Who will foot the bill?”

Smarter 'big fish'

But Shafee is fully aware of the obstacles in pinning down those involved in corruption.“For a big fish, you need a bigger net. And the bigger fish are smarter,” he said. Recalling cases of overseas transactions, bogus companies, foreign middlemen and sticky extradition processes, he said that methods of corruption are always evolving.

“And it is up to us (the anti-graft agency) to stay a step ahead of them,” he said.

While the Malaysian Anti-Corruption Commission is attempting to do so, Shafee is doubtful if it much can be achieved if it does not have independent prosecutorial powers.

“Without the power to prosecute, only the attorney-general (AG) can give consent to charge someone. Maybe this has to be (re-examined).

“Now there seems to be a split - (the MACC to investigate and the AG's Chambers to charge). They may be a bottleneck.”

Even though Shafee is spending his retirement years in relative bliss, he keeps an interested eye on MACC chief commissioner Abu Kassim Mohamed, who had worked under him as a director. Shafee offered him a word of advice, saying that he should not forget to watch over MACC itself.

“For those who are prone to corruption, he will have to combat this within his own ranks. He has to remember to work without fear or favour because, in the end, he is only answerable to his creator.”

Lingam-gate - Key witnesses receive threats.....

Three key figures linked to the Royal Commission of Inquiry into the Lingam-tape incident today claim that they were recently threatened. Lawyer VK Lingam's former secretary GN Jayanthi claims that she had received several threatening text messages and is worried for her safety.

Her worries are compounded by the death of Lingam's brother V Rajendran after a brawl on Aug 7 and Lingam's driver D Ramachandran as a result of a car accident in May.

During a press conference at Kelana Jaya MP Loh Gwo Burne's office today, Jayanthi revealed that she had received seven such text messages on her phone which used lewd language.

One message read "You stupid. Fat as pig" while another "You are doomed for life".

According to the police report lodged on July 8, the message originated from a phone that had a United Kingdom prefix. She claims that to date, there has been no word from the police.

MP: Too many coincidences

Jayanthi said that following the death of Rajendran and Ramachandra, she is worried that she may be "the next victim". According to Loh, Lingam's younger brother V Thirunama Karasu has also received threats and is now in hiding.

Loh (left) also claims that he had received threats in May and his office had been broken into three times this year alone. He does not discount the possibility that all this was linked to the Lingam tape.

"There are too many coincidences. I don't rule out the possibilities, but I don't want to point fingers. Maybe it is political harassment. I am not sure," he said.

Loh added that after two "unnatural" deaths, he said that he along with Jayanthi and Thirunama were both possible targets. He said that as an MP, he could not go into hiding unlike a civilian and urged the police to take action.

Jayanthi added that she might seek protection from the police.

Accused of improprieties

Loh, Thirunama, Rajendran and Jayanthi had all accused Lingam of improprieties following public outcry over a grainy video allegedly portraying the lawyer speaking about future judicial appointments which later were found to be astonishingly accurate.

Loh is the maker of the video while Thirunama claims that he used to perform odd jobs for Lingam, which he claims includes sending gifts to judges. After Lingam had tried to discredit Thirunama, stating that he was mentally unsound, their younger brother Rajendran came out to defend him.

Jayanthi's role in the inquiry includes dropping a bombshell that she had stayed at Lingam's office between November and early December 1994 to draft a judgment which eventually became a landmark decision. The case in question was Vincent Tan's defamation suit against veteran journalist MGG Pillai. The decision read out by High Court judge Mokhtar Sidin went in Tan's favour. Lingam was Tan's counsel during the case.

Lingam-gate: Challenge to royal panel findings 'unprecedented'.....

Two former chief justices Eusoff Chin and Ahmad Fairuz Sheikh Abdul Halim along with lawyer VK Lingam have obtain leave (permission) from the appellate court to challenge the findings of the royal commission on the 'Lingam-gate' incident. The matter will now revert to the Kuala Lumpur High Court's (Appellate and Special Powers division) to be heard on its merits.

Justice Tengku Baharudin Shah Tengku Mahmud, who led a three-member panel at the Court of Appeals, announced the 2 to 1 decision this morning. The other judges were Justices Mohd Hishamudin Mohd Yunus and Zaharah Ibrahim.

Meanwhile, Karpal Singh today criticised the appellate court's decision to allow three individuals to challenge the findings of the royal commission on the 'Lingam-gate'. A three-member Court of Appeals panel, in a 2-1 decision, gives permission to controversial lawyer VK Lingam and two former chief justices to challenge a royal commission which in 2008 recommended investigation by the authorities on six individuals, including the trio, over their role in fixing the appointment of top judges.

Apart from Lingam, the others were former chief justices Eusoff Chin and Ahmad Fairuz Sheikh Abdul Halim, tycoon Vincent Tan, Umno secretary-general and then minister in the Prime Minister's Department Tengku Adnan Tengku Mansor and former premier Dr Mahathir Mohamad.

Karpal said that the High Court was right in its earlier decision not to allow the trio leave to challenge the inquiry findings. He lamented that never before in Malaysia's history has a challenge been mounted on the findings of a royal commission.

"The Court of Appeal was wrong in its decision today to allow the appeal. What the authorities should do is to act on the recommendations and findings, and take action against the individuals involved," he said. With the appellate court decision today, the case has been reverted to the High Court to hear the trio's application.

Authorities sitting on their hands

Karpal noted that the authorities have failed to take the cue from the commission's recommendations. The senior lawyer had previously offered to prosecute Lingam under the Legal Profession Act, but the attorney-general did not take him up on this.

Karpal pointed out that in the Anwar Ibrahim black-eye incident, the authorities had acted on a recommendation by prosecuting former inspector-general of police Abdul Rahim Noor. "This is what should have been done (in Lingam's case)," he added.

On Dec 12, 2008, the Kuala Lumpur High Court had rejected the applications of Lingam, Eusoff, Ahmad Fairuz, Tan and Tengku Adnan to challenge the commission's findings. It ruled that the findings of the royal commission cannot be challenged.

Tan and Tengku Adnan withdrew their application before the appeals were jointly heard yesterday, while Mahathir did not seek a judicial review of the findings in the report.

A surau in Seremban vandalised........

Vandals have splashed red paint on the walls and back door of a new surau in Taman Pulai Impian Temiang, near Seremban.

Negri Sembilan DAP head Anthony Loke tweeted about this earlier today.

When contacted, he said the surau was completed a month ago and has been in use for the last few weeks. However, the compound has yet to be fenced up.

Surau committee members noticed the red paint when they arrived to open the surau for subuh (dawn) prayers before 5.45am today.

“Several broken liquor bottles - believed to be used to contain the red paint - were found within the vicinity,” said Loke.

The committee members lodged a police report soon after. A police investigation team then went to the site to take photographs, secure evidence and take the witness statements..

Loke said he had visited the site with party colleague and Temiang assemblyperson Ng Chin Tsai and Sikamat assemblyperson Aminuddin Harun.

He urged the police to solve the matter as soon as possible, given recent anger over racist remarks elsewhere in the country.

“(This is to)to prevent irresponsible persons from using this issue to pursue their own agenda. If not handled properly, it may spark tension in society,” he cautioned.

Traitors are those who hide the truth........

Lembah Pantai MP Nurul Izzah Anwar has thrown back the penderhaka (traitor) tag at Defence Minister Ahmad Zahid Hamidi, challenging him to come clean with his ministry's spending habits.

She said the real traitors were those who used public funds to pay for high maintenance costs set by anak emas (favoured) companies, and set high prices for projects or equipment purchases to line the pockets of a select few.

"If the defence minister is a true patriot, why did he not support MACC probe into the over RM500 million commission payment to Perimekar Sdn Bhd in the Scorpene submarine purchase?" Nurul Izzah (left) asked in a statement.

Ahmad Zahid's rejection of the MACC investigation came just one day after Speaker Pandikar Amin Mulia revealed in Parliament on June 30 that the Malaysian Anti-Corruption Commission was investigating claims that RM575 million was paid as commission to Abdul Razak Baginda in the procurement of the French Scorpenes.

Yesterday, Ahmad Zahid branded Nurul Izzah as a traitor for saying in an interview with Indonesian publication Kompas, published on Aug 4, that the country's first submarine, the KD Tunku Abdul Rahman, cannot dive. Bernama quoted the defence minister as saying Nurul Izzah's statement had damaged the country's image in the eyes of the world, and he described her criticism of the armed forces as "utterly disgraceful".

The Royal Malaysian Navy also lodged reports at the Hulu Kelang police station on Tuesday against Nurul Izzah and Malay Mail reporter Marhalim Abas over claims of the submarine's inability to dive. Nurul Izzah pointed out that her statement on the submarine was based on Ahmad Zahid's official statement last March that the KD Tunku Abdul Rahman was not allowed to dive due to technical problems.

She pointed out that Ahmad Zahid himself had told Parliament that similar technical problems were faced by many other countries, poking holes in his claim that her statement had threatened national security.

"If information on the dive status of any submarine in the world can be acquired openly, what is the rationale for saying that I am threatening national security?

"I am ready to be investigated by the police and hope it will lead to related issues, especially the deal given to a select company for maintenance of the submarine, and the ongoing investigations by French authorities on the same submarine," Nurul Izzah added.

Anwar defends Guan Eng over sermon row....

PKR de facto leader Anwar Ibrahim said there was no truth to allegations that Penang Chief Minister Lim Guan Eng had engineered the removal of the King's name from the Friday prayers at several state mosques.

"I have personally monitored the situation and read the text of the sermon which were distributed and (spoken to) my friends in Penang, and it is found that there is no truth to the allegations," said Anwar in a statement today.

Anwar said that the allegations were slander and reflects increasingly desperate attempts by the ruling party Umno to maintain its grip on power. He blamed Umno leaders for again utilising party-owned newspaper Utusan Malaysia for stoking racial tensions and chastised its president Najib Abdul Razak for ignoring the wishes of the public for peace and harmony.

"We are certain that Umno leaders will not stop here. They will come out with more lies to cause disunity amongst the public because they realise that the public are united in wanting change and justice.

Yesterday, Penang Umno chief Ahmad Zahid Hamidi claimed that Guan Eng had swapped the King's name with his own in the Friday sermon last week in several of the state's mosques. Zahid said that no police reports were lodged but insists that there was ample evidence to back his claims.

Deputy Premier Muhyiddin Yassin had urged the authorities to probe the allegations while Umno Youth chief Khairy Jamaluddin has labelled Guan Eng "power crazy" and was attempting to "glorify" himself by using the mosques.

Kit Siang: Apologise now

In a related development, DAP advisor Lim Kit Siang expressed outrage over the Utusan Malaysia article, claiming that the newspaper was working against the federal government theme for National Day. Kit Siang said that while the theme - 1Malaysia: Transforming the nation - was an attempt to bring together the various ethnic groups, Utusan Malaysia's front page report on Guan Eng was an attempt to sow religious discord.

Describing the article as the "most irresponsible act in the history of Malaysian journalism", Kit Siang said that both the newspaper and Zahid must apologise.

Ucapan racis - Mahyuddin minta tubuh pasukan khas......

Guan Eng denies being named in Friday sermon.....

Penang Chief Minister Lim Guan Eng has denied claims by Umno that he had replaced the King's name with his own in the prayer during the Friday sermon at several mosques in the state. Speaking to reporters in Petaling Jaya, Lim said that it was "impossible" that an imam (leader of the congregation) would do such a thing.

He said that his officers had been sent to investigate the matter and found no evidence of Umno's claims.

"If there was really an imam who said this, then there is a real agenda against us. We will find this person and sack him," he said.

"This is an evil lie by Umno to turn the people against us," he added.

Speaking to reporters in Penang today, Penang Umno chairperson Ahmad Zahid Hamidi had claimed that the name-switching had occured last week at several mosques at Tasek Gelugor, Permatang Pauh and Jelutong. This would constitute an insult to the Conference of Rulers, said Zahid after chairing a meeting in Kepala Batas, reported Bernama.

Zahid: Lim should not distribute tithes

Ahmad Zahid said no police report had been made so far but there was sufficient evidence pertaining to the matter. He also questioned the presence of the chief minister at the distribution of tithes, saying the event should by right be performed by a Muslim leader.

"Although the intention of the state government may be to portray him (the chief minister) as a flexible individual, there could be a hidden agenda with a political motive," he said.

Ahmad Zahid said he was also notified of a state constituency service centre which allegedly used the collections from a Ramadan bazaar. He said the collections from a Ramadan bazaar set up on mosque reserve land should be used by the mosque and not for any political activity.

"The Penang government should be more sensitive in the matter of Islamic affairs," he said.

Lim Guan Eng kasi UMNO meroyan lagi......

Lawyer Abdul Razak - 'You had come to 'attack MACC"......

Malaysian Anti-Corruption Commission (MACC) prosecutor Abdul Razak Musa left lawyers and the public gallery alternately bemused and frustrated as he cross-examined a Thai forensics expert at the Teoh Beng Hock inquest today.

At the same time,Thai pathologist Dr Pornthip Rojanasunand stood her ground despite his incessant attacks on her expertise, observations and conclusions on the death of the DAP political aide in July last year.

Her unequivocal responses quickly prompted legal department head Abdul Razak to ask if she had come to “to attack the MACC".

Pornthip calmly said: "I am here to defend the rights of the dead. Not for the Selangor government or anyone."

The forensic expert received so many rounds of applause from those in the public gallery for her comebacks, that an announcement had to be made for those present to maintain decorum.

Pornthip was cross-examined after she told coroner Azmil Muntapha Abas she found no evidence to suggest suicide by Teoh. Abdul Razak railed at her from the onset by raising doubts about her credibility as an expert witness.

"Did you know that the university that you graduated from is not recognised in Malaysia?" he asked, eliciting disgruntled murmurs from the gallery.

To that, Pornthip answered, "But it is in the top five in Asia."

Unsatisfied, Abdul Razak sought to discredit her by claiming that she had "moved the goalposts" because what she said this morning had 'contradicted' her earlier testimony. (Her testimony today was based on observation of a second post-mortem, while her initial conclusions were based on a report on the first post-mortem.)

Pornthip refuted Abdul Razak, saying she had conclusively answered the possibilities raised in her first testimony through scientific evidence obtained in the second autopsy.

"The other doctors made a mistake," she said, noting that there were procedures which should have been made but were not undertaken during the first autopsy.

Absurd questions

Abdul Razak next had the gallery groaning in disbelief when he suggested that Teoh had strangled himself and was "depressive".

Interestingly, when asked by Gobind Singh Deo, who is representing Teoh's family, how someone can strangle himself, the MACC representative went as far as to demonstrate this on himself. If that was not enough, Abdul Razak riled up those in the gallery further by suggesting to Pornthip that her report was "based on her imagination".

In an effort to make his point, he asked if Pornthip has any experience jumping off a building.

Exasperated by the barrage of provocative questions Malik Imtiaz Sarwar - representing Pornthip and the Selangor government - stood up to say: “With questions like these, we would all want to jump off a building.”

Abdul Razak also got his facts muddled, prompting Pornthip to repeatedly ask him to "remind (himself) of her report" and to "read the report". But the lawyer was adamant, claiming he had "spent three days reading" the 11-page report. His mix-ups led to representatives of the Bar Council and coroner Azmil Muntapha Abas to step in, to correct him.

Glaringly, the lawyer quizzed Pornthip on why she said Teoh was dead when he fell off Level 14, (where the MACC office is located in Plaza Masalam) but alive when he hit the landing on Level 5.

"I accept that he was alive. I never said that he was dead," said Pornthip who has offered her services on a pro bono basis.

Visibly amused, the coroner stepped in to clarify that issue was whether Teoh was conscious or otherwise, not if he was dead or alive. This was to no avail as Abdul Razak remained bewildered. He then puzzled the court when he stated, "If (Teoh) was unconscious, his body would be heavier."

Retorted the pathologist: "There would be no difference. Scientifically, how could weight loss happen according to consciousness?" Tired of explaining to Abdul Razak, who accused her of having "already made up her mind (against suicide)", Pornthip finally answered that she disagrees with his comments.

The court's amusement turned into frustration towards the end of Abdul Razak's line of questioning. Members of the public sighed loudly when he finally wrapped up - and one even bellowed "Thank you!".

Abdul Razak later left the court complex in a huff, slamming shut his car door when questioned by reporters. As his driver moved the car forward, it 'nudged' a Teoh supporter twice, as he tried to prevent the vehicle from leaving. However, Ho Mun Chong - a DAP member who has attended every inquest hearing - was not injured. - Aidila Razak

Pornthip: Investigator didn't follow protocol on 'note'.....

Thai pathologist Dr Pornthip Rojanasunand today testified that, in the event of a crime scene investigation, any notes found should be immediately sent for forensic examination. Questioned during the inquest into the death of DAP political aide Teoh Beng Hock, she said this is the “protocol for investigations into death, especially for suicide”.

In answering lawyer Gobind Singh Deo, acting on behalf of Teoh's family, Pornthip drew from 25 years of experience as a forensic crime scene investigator. She said notes at the scene of a death investigation can prove scientifically if a homicide had occurred, as the identity of the person who leaves the note is verifiable through DNA testing (through saliva on the envelope), and finger- and palm-printing.

Last week, the inquest had been postponed when it was revealed that the Attorney-General's Chambers had in its possession a note said to be Teoh's 'final testament'. This had been found two months after his death on July 16 last year. Teoh, 30, was found dead on the fifth floor service landing of Plaza Masalam in Shah Alam. He had been questioned all night as a witness at the Selangor Malaysian Anti-Corruption Commission office located on the 14th floor of the building.

'Note circulated on Internet a prank'

Speaking to reporters later, Gobind said the family and their lawyers have yet to decide what to do about the note, which has not been tendered for evidence. “We need time to do the groundwork to certify the fact before we decide,” he said.

The family has engaged a handwriting expert to ascertain the veracity of the note. However, according to Teoh's sister Lee Lan, the handwriting does not resemble her brother's. Lee Lan, who has seen the note which the attorney-general had kept for about a year, also said it is not the four-part note currently circulating on the Internet.

“That is a prank,” she said.

She expressed her disappointment over the attorney-general's handling of the matter.

Why didn't the AG let us know? Instead Umno members knew (about the note) and even lodged a police report. Why should they know more than us?

What if the murderer and the murder weapon emerged after a year? Would the rakyat still believe the AG?”

'Exhumation worth it'

Lee Lan also thanked Pornthip for testifying that Teoh did not commit suicide.

“She came here for justice and she has done her job," said Lee Lan.

“From the second autopsy report we at least know that the exhumation was worth it. It was not a waste."

However, she slammed MACC prosecution head Abdul Razak Musa for “harassing” Pornthip during cross-examination.

“I am really sorry that Malaysia has a lawyer like this,” she said.

Lawyer Malik Imtiaz Sarwar, who is representing the Selangor government, said Abdul Razak's tactics were “embarrassing”.

“I'm not sure why he had to stoop to that level,” he said, referring to the often absurd questions and remarks directed to Pornthip during cross-examination today.

Dr Pornthip is sure it was not suicide.......

Renowned Thai pathologist Dr Pornthip Rojanasunand is testifying at the Teoh Beng Hock inquest, to share her findings after observing the second post-mortem procedure last November Pornthip, who had previously claimed that the DAP political aide's death was 80 percent homicide and 20 percent suicide, caused a stir when she entered the courtroom. Teoh's supporters in the packed gallery began applauding.

Activists have been rallying the public to attend the inquest in Shah Alam to show support for Teoh, and to express displeasure at the Attorney-General's Chambers over its handling of the 'mystery note'. Amidon Anan, former police forensic chief (Crime Scene Investigation Unit), is also in the gallery. He is observing the inquest in his personal capacity.

9.30am:
Coroner Azmil Munthapa Abas kicks off proceedings by calling Pornthip as the first witness. She is questioned by Malek Imtiaz Sarwar, who represents her and the Selangor government. He takes her through her report and photos based on the second post-mortem.

9.55am:
Pornthip says she found deep haemorrhage on Teoh's neck reaching to the muscle. The area affected is larger than if there had been manual strangulation, as the force was more than that exerted by a physical grip on the neck. But based on reviews she had done on 34-35 fall-from-height cases previously, none had that sort of wound. She thinks it's not possible that the bruise was caused by impact with the ground.

10am: Pornthip also rules out the possibility that the bruise was caused by fracture of the spine. She maintains her observation that it was a pre-fall injury with "more force and more weight" than caused by manual strangulation. She concedes she has no experience on neck holds. She says it could be that "someone put something heavy on Teoh's neck or pressed his head on something".

Referring to the first autopsy report, she cannot exclude that Teoh was unconscious before falling, as the report shows cerebral edema. It shows that Teoh experienced hypoxia, where brain does not receive oxygen, for at least 5 minutes. Hypoxia is due to a blocked vein, artery or trachea.

10.10 am: Pornthip disagrees wtih Dr Peter Vaneziz that the mark on the neck was due to fracture of the chin. She says a chin fracture area is small and haemorrhage does continue to the chest. Also there are no blood vessels on the chin to cause excessive bleeding.

10.20am: She says there was no fracture to the wrist, which would have been the case if someone protects themselves from a fall with their hands. There was a fracture and external wound above one ankle, but none at the base of the skull. So she disagrees with Vaneziz that Teoh had landed on his feet and that he was concious when he fell.

10.30am: Pornthip says the anal tear and injury to the buttocks was caused by the fall and not by beating as she had previously thought.

10.43am: She maintains her opinion about the pre-fall injury, but cannot confirm that Teoh was concious during the fall, She declines to go into the percentage of her certainty on the cause of death, because she has had to base this on a report. But she is sure it was not suicide.

10.45am: Malik completes his examination. Gobind Singh Deo, who is representing Teoh's family, begins questioning the witness.

10.55am: Pornthip says that, in her experience as a crime scene investigator and forensic scientist, any note found should be tested for DNA, fingerprints and palm prints immediately, and then be subjected to handwriting analysis. "This is protocol." But such notes have very little impact on investigation because these are emotional in nature. As such, she prefers to rely on science. That said, it would be important for police, "especially the crime scene investigator", to examine the note.

11.00am: MACC prosecution head Abdul Razak Musa begins cross- examining Pornthip, to establish her credentials as an expert witness. He suggests that her testimony is based on her imagination. Pornthip refutes this, saying it is based on her work.

Razak notes that she is not qualified as a forensic expert in Malaysia as the university from which she graduated is not recognised in Malaysia. Pornthip replies that the university is one of the top five in Thailand - some in the public gallery applaud.

11.15am: Razak puts it to Pornthip that Teoh strangled himself. He says that the other four doctors had found no such evidence of strangulation.

Gobind stands up and asks Razak to demonstrate how one can strangle himself. Razak makes an attempt, to laughter from the gallery.

11.20am: Razak points out that Pornthip has made multiple mistakes in her first hypothesis - today, for example, she has said there was no anal penetration and that what she had earlier described as 'drag marks' could be 'sliding marks'. "I put it to you that you come here to attack the MACC," he says. He points out several more 'mistakes' which Pornthip continues to refute, saying that she has supported her report with scientific evidence.

Razak: You said 80 percent homicide.

Pornthip: I have explain it. You have to accept....

Razak: When you testified that it was 80 percent homicide, it was reported in all our media. Pornthip repeatedly urges Razak to read her report, but he says: "I spent three days reading." There are more murmurs from the crowd, which appears perturbed with the aggressive line of questioning. Razak then asks whether her earlier reference to a blunt object was to a chair or something else.

Pornthip: I'm questioning whether you are a lawyer.

Razak: Maybe I'm younger than you, but I've served as a lawyer for 24 years. The public jeers, with a 'wah'.

11.35am: Razak asks her how Teoh could be dead on the 14th floor (where the Selangor MACC office is located in Plaza Masalm, Shah Alam) but alive on the ground. Razak sounds muddled, causing coroner Azmil Muntapha Abas to chuckle. Azmil explains to Razak that what Pornthip meant was that Teoh was likely unconscious during the fall and not dead.

Razak: From Level 14 - 99 feet above ground - he was unconscious, so his body would be heavier.

Pornthip: No difference. Scientifically how could there be weight-loss according to consciousness? Razak also asks if she has experience jumping off a building as she has testified that the body was found further from the building than in the usual case of suicide by jumping.

11.50am: Malik stands up to say that Razak is trying to put words into Pornthip's mouth. "The way he is asking questions makes us want to jump off ourselves!"

12 noon: Razak puts it to Pornthip that her opinion is different from that of the other four doctors who were present during the second autopsy.

Razak: One against four....

Pornthip: You have to respect the judge (coroner) who will make the decision.

Razak: We work on majority. There were loud groans from the gallery.

12.05pm: Razak completes cross-examination to an audible sigh of relief from the gallery. Government-appointed lawyer Tan Hock Chuan starts his cross-examination.

12.10pm: To a question, Pornthip differs with court appointed pathologist Dr Shahidan Md Noor's testimony that the injury to Teoh's neck was consistent with a fall.

12.15pm: The coroner starts questioning Pornthip to clarify her testimony.

12.25pm: The coroner's court releases Pornthip as a witness.

12.30pm: The court adjourns to Sept 1.

Dr Pornthip Rojanasunand is in town.....

Thai pathologist Dr Pornthip Rojanasunand, who has been engaged by the Selangor government in relation to the Teoh Beng Hock inquest, arrived this afternoon under a veil of secrecy and tight security provided by the state. Pornthip arrived at the Kuala Lumpur International Airport about 12.30pm. She is due to testify when the inquest resumes tomorrow in Shah Alam.

Asked what had prompted her decision to attend the inquest and how long she would be in Malaysia, Pornthip declined comment. Tricia Yeoh, research officer at the Selangor menteri besar's office, met her on arrival together with nine other Selangor officials and five police personnel. They escorted her out of the VIP lounge at KLIA.

Security detail hired

Lawyer Malik Imtiaz Sarwar, who represents Pornthip and the Selangor government at the inquest, told Malaysiakini via SMS that the state had kept Pornthip's arrival quiet for security reasons. The Selangor government is believed to have hired its own security detail to protect Pornthip. This was prompted by worry over allegations she had made during her visit last November, that someone had been tailing her after the second post-mortem.

In April, Pornthip had decided against appearing at the inquest following “advice” from her employer - the Thai Justice Ministry - to cancel the trip due to “political pressure” from the Malaysian government. Last October, Pornthip had said that, based on observation of the first post mortem, there was an 80 percent chance that Teoh's death was the result of homicide. Her controversial findings prompted a second autopsy last November.

Pornthip, along with Dr Peter Vanezis, a British pathologist hired by the Malaysian Anti-Corruption Commission (MACC), were present as observers. Vanezis and government pathologist Dr Shahidan Md Noor, who performed the second post-mortem, have since testified at the inquest. All that remains is for Pornthip to present her findings. Shahidan had ruled out strangulation as the cause of death, while Vanezis stated that Teoh was conscious when he fell but stopped short of saying that it was suicide.

Following the revelation last week of a note purportedly written by Teoh, allegedly discovered only two months after his death, Pornthip's testimony has become even more critical to the inquest. The note has been described by the print media as a 'suicide note', but Teoh's family members have disputed the authenticity of the document.

Teoh was found dead on July 16 last year at Plaza Masalam, after being questioned overnight by the MACC as a witness in a case involving an exco's alleged misuse of Selangor government allocations.

"We won't back down" MCA tells UMNO.......

Umno and MCA appear to be on collision course following the latter's refusal to back down on 13 resolutions passed during the Chinese Economic Congress on Saturday.

“The resolutions are not only related to the Chinese community but also the future of the country's economic development,” MCA president Dr Chua Soi Lek said in a statement today. Chua said MCA is responsible for reflecting the wishes of the Chinese community, including matters arising from globalisation.

“Otherwise, not only will MCA lose the Chinese community's support, but it will not be able to justify its political existence,” he said.

He argued that the MCA leadership strongly believes that the party's struggle is reasonable and legitimate.

“MCA will not be afraid of sharing similar views with DAP in terms of the benefitting the (Chinese) community and (will not) run away from making a stand,” he said.

Chua said this in response to Umno vice-president Hishammuddin Hussein's statement yesterday, urging MCA not to forsake the interest of the BN coalition in its actions and words. Hishammuddin's comments follow similar condemnation by Umno supreme council colleague Shahidan Kassim on Facebook and Perkasa chief Ibrahim Ali's fiery press conference yesterday.

In particular, Ibrahim was irked by the congress' demand for a reduction in the 30 percent bumiputera equity target and Prime Minister Najib Abdul Razak's statement welcoming wider Chinese involvement in economic development.

Commenting on Hishammuddin's statement, Chua said it shows that some BN leaders have failed to learn lessons from the March 2008 general election and the public demand for
reform. He said the new MCA leadership is committed to providing this change in order to regain the people's support and trust.

“If some Barisan Nasional leaders continue to live in their own world, they will certainly push MCA to its doom and it will not bring the ruling coalition any good.

“MCA respects the view of ... Hishammuddin but he cannot blame MCA for deviating from the objectives and struggles of BN simply because MCA has a different voice from him or other component party leaders.”

MCA's unwavering loyalty to BN

In a separate statement, MCA vice-president Chor Chee Heung said the party has never questioned the special position of the Malays as outlined under Article 153 of the federal constitution. He described the New Economic Policy as having noble objectives but said the affirmative action policy has been abused, as CIMB Group chief executive officer Nazir Abdul Razak has conceded.

While affirmative action is necessary, Chor said this must be based on need and merit, rather than race, in line with globalisation. The MCA's position on the economy does not mean that it is being disloyal to BN's cause, he pointed out.

What!! the AG is bonking around too?..........

In response to RPK's latest article,steadyaku47 wrote the following piece...........

Alamak now even the Attorney General is Bonking! Well as they say…Monkey see, Monkey do. If the Chief Justice was caught out illegally having a tryst overseas…well Golok is in Thailand and can be considered overseas lah…then why not the Attorney General. And again as an extension of the Monkey See Monkey do…why not the Attorney General’s DPP and Saiful! Apa macham ni? Niamah!

I can just picture Najib having to reassure Rosmah that he is not the Monkey See Monkey Do type. Not that it will do any good because nudge nudge wink wink say no more….Rosmah knows Najib better then a Monkey can climb a tree! But once she cools down they would be discussing what to do with the AG – because like they are beholden to the IGP Najib and Rosmah are also beholden to the AG…there is that word ‘beholden’ again!

Same as Najib was beholden to Mahathir. There are so many ‘beholden’ people in Barisan Nasional that it would be easy to find them in that entire BN crowd. Just like finding a Dato’ in a crowd…just throw a pebble into the crowd and you will hit a Dato’. In UMNO you do the same thing and you will hit someone who is beholden to somebody!

By now Najib will be calling Mahathir to see if the old man has any idea what to do. I would think that by then end of this crisis, Mahathir’s son might be a full Minister!

For now let us think a while about what the AG will say esok! He can deny that there is an elephant in the room. He can say “I will not dignify RPK’s accusation with a comment”…or he can "RESIGN!"...and of course let us see what the religious department will do...and PDRM too!

Do they go looking for the AG or will he go to them...or whoever he has to go to when you are caught having sex outside marriage. It is simply not the done thing in Islam! As the Chinese say..."Die Standing!" - Hussein abdul Hamid

Bagaimana mereka berjaya melalui DEB?

Jho(kanan) selalu kelihatan bersama PM Najib.
