Tian Chua,Tamrin,Haris,Hishamuddin dan Safwan didakwa bawah Akta Hasutan...

Empat orang pemimpin NGO dan parti pembangkang yang ditahan mengikut Akta Hasutan dalam operasi pada malam tadi hari ini didakwa mengikut akta tersebut.

Keempat-empat individu tersebut adalah aktivis siswa Safwan Anang, pemimpin NGO Asalkan Bukan Umno Haris Ibrahim, aktivis PAS Tamrin Ghafar dan naib presiden PKR Tian Chua.


Kesemuanya mengaku tidak bersalah apabila pendakwaan dijalankan ke atas mereka mengikut Seksyen 4(1)(b) Akta Hasutan.

Mahkamah membenarkan keempat-empat individu tersebut diikat jamin RM5,000 setiap seorang, namun Safwan(pix bawah) enggan diikat jamin.



Seorang lagi aktivis, Hishamuddin Rais yang dikehendaki polis atas dakwaan kesalahan sama, turut menyerah diri di hadapan Mahkamah Sesyen Kuala Lumpur.

Beliau mengaku tidak bersalah apabila pendakwaan dilakukan secara berasingan ke atasnya selepas itu, mengikut undang-undang sama.

Kesemua lima individu berkenaan didakwa melakukan kesalahan tersebut di antara jan 8.55pm hingga 11.15pm pada 13 Mei di Dewan Perhimpunan Cina Kuala Lumpur dan Selangor.


Mereka didakwa menyebut kata-kata menghasut, yang didakwa cenderung membangkitkan rakyat untuk mengubah kerajaan dengan cara yang tidak sah.

Pendakwaan dijalankan oleh timbalan pendakwa raya Mohamad Abazafree Mohd Abbas di hadapan hakim Norsharidah Awang.

Peguam untuk empat tertuduh pertama menyatakan hasrat untuk memohon untuk mengeneppikan pendakwaan tersebut, sama ada di mahkamah sama atau di mahkamah tinggi.

Chua diwakili N Surendran manakala Haris oleh sekumpulan peguam diketuai Gobind Singh Deo.

Pasukan diketuai Ariff Azam pula mewakili Safwan, manaka Tamrin dan Hishamuddin diwakili Murni Hidayah.

Mahkamah menetapkan tarikh 2 Julai untuk mendengar kes tersebut.-malaysiakini

"Suami saya memperjuangkan kebenaran, suami saya bukan pesalah. Semalam kami diserbu oleh 15-20 orang polis di kawasan parking di kediaman. Rasa terkejut diserbu seolah2 penjenayah dan rasa sedih disebabkan beliau didakwa hari ini atas kesalahan yang tidak beliau lakukan masih tak hilang.

Dalam keadaan mengandung, emosi, mental dan fizikal cukup berat menghadapi dugaan sebegini besar. Turun naik mahkamah, berkejar ke sana sini, bekerja, tak hirau masa makan dan berehat, saya tak mampu berdiri sendiri tanpa sokongan. Hasbunallahu wani'mal wakeel.

."Hari ini suami saya sanggup masuk ke dalam penjara dan menolak sebarang jaminan untuk memprotes kezaliman dan kebatilan yang terus berlaku dalam negara hari ini. Dan saya sanggup berkorban dengan menerima keputusan beliau. Semoga kami terus diberikan kekuatan.

Mohon solidariti malam ini jam 8 di hadapan Penjara Sungai Buloh. Jangan biarkan suami saya keseorangan." Isteri Safwan Anang.

Tian Chua,Tamrin,Haris,Hishamuddin and Safwan charged with sedition...

PKR vice-president Tian Chua, Anything But Umno (ABU) chief Haris Ibrahim, PAS' Tamrin Ghafar, veteran acitivist Hishamuddin Rais and student activist Safwan Anang were today charged with allegedly uttering seditious remarks.

NONESafwan (right), Chua, Haris and Tamrin earlier today claimed trial to the charge at the KL Sessions Court. 


They were charged under Section 4(1)(b) of the Sedition Act 1948.

However, Rais, for whom an arrest warrant was issued yesterday on a similar matter, surrendered himself in front of the court house and was later separately charged at the same court. 

He too pleaded not guilty to a similar charge.

All five are alleged to have committed the offence at the Kuala Lumpur and Selangor Chinese Assembly Hall between 8.55pm and 11.15pm on May 13.

Their statements are deemed to be inflammatory and seen as propagating a change in government by illegal means. 

NONEThis is in relation to remarks made during a forum, and similar to a charge faced by student activist Adam Adli Abdul Halim (left).

During the forum, several speakers had urged to people to take to the streets to express unhappiness over an allegedly skewed electoral process 

Although all were allowed today bail, set at RM5,000 each, Safwan refused it as a sign "protest" and is being remanded at the Sungai Buloh prison.

Judge Norsharidah Awang set the hearing for July 2.


Lawyer: Charge pure fiction

Lawyers for first four accused have expressed their intention to apply to strike out the charges, either at the same court or at the High Court.

Counsel N Surendran, who represented Chua, said the government's decision to prosecute the four smacks of selective persecution.

NONE"We will fight this up until the Federal Court," he said, while adding that the allegedly seditious statements made by the four are not actually seditious in nature.

"This is pure fiction spun by the government," he added.

Haris was represented by a team of lawyers led by DAP's Gobind Singh Deo, while lawyer Ariff Azam and team represented Safwan and Tamrin.

Solidariti Anak Muda Malaysia, the pro-opposition student movement, has vowed to hold a vigil outside the Sungai Buloh prison tonight and every night until Safwan changes his mind and decides to allow bail to be posted.- malaysiakini
