Datuk charge is only a 'diversion' from NFC scandal...

The cheating charge against Datuk Shamsubahrin Ismail is an attempt to divert attention away from the National Feedlot Corporation (NFC) scandal, Pakatan Rakyat leaders claimed today.

The opposition pact leaders added that allegations of misappropriating public funds linked to the national cattle farming project remain unanswered.

The case has been linked to minister Datuk Seri Shahrizat Abdul Jalil’s family. Her husband, Datuk Dr Mohamad Salleh Ismail, is the NFC chairman and chief executive while their children help run the business.

Shamsubahrin, 45, was charged at the Sessions Court yesterday with cheating Mohamad Sallehout of RM1.76 million in consultation fees by offering the latter fraudulent advisory services.

“The charge brought against Shamsubahrin Ismail shocks the nation and will go down in Malaysian history as the most ridiculous diversion ever attempted.

“The NFC scandal has reached the temperature that the public demands immediate action to recover all the public money spent and bring those responsible for the misappropriation to be accountable,” PKR chief strategist Rafizi Ramli(left) told The Malaysian Insider.

He pointed out that the evidence disclosed to the public so far had been “compelling” and and that it has not been denied “even once” by the NFC, Shahrizat, or any other Umno leader from the ruling coalition.

“That Umno leadership thinks they can make Malaysians believe that the NFC leadership is a victim of a fraud perpetrated by Shamsubaharin, just proves that Umno has lost the plot.

“By the strength of this evidence alone, in other countries with a functioning rule of law (this) would be sufficient to bring Datuk Seri Shahrizat and her family to justice,” added the PKR leader.

Rafizi said that PKR would pursue the issue and make sure that the people responsible for approving the project and soft loans are brought to justice.

“PKR will make new revelation next week on NFC - if Umno refuses the rule of law to judge those responsible, then let the court of public opinion judges Umno and its leadership for its failure to act on NFC.”

DAP central executive committee (CEC) member Liew Chin Tong said that the charge against Shamsubahrin did not provide any explanation to how federal funds for a cattle project were used to purchase luxury condominiums.

“By charging him it does not mean the original case has gone away.

“Morally, politically something has to be done. Allegations on abuse of funds have to be answered,” he told The Malaysian Insider.

The Bukit Bendera MP said that the government should make public the papers and documents relating to NFCorp’s cattle project, and that complete transparency was the way to solve the debacle.

Police are investigating NFCorp for alleged criminal breach of trust, following accusations by PKR that the company had misused millions in federal funds meant for a cattle feedlot scheme.

The Malaysian Anti-Corruption Commission (MACC) announced last week it would investigate claims that NFCorp had misappropriated government funds, despite previously saying it would not probe the matter.

The MACC later seized a computer CPU and several documents during a raid on NFCorp’s headquarters in Solaris Mont Kiara.

PKR first latched onto the issue after the RM250 million publicly-funded cattle project — run by Mohamad Salleh, husband to federal minister Shahrizat - made it into the pages of this year’s Auditor-General’s Report for failing to meet production targets. The opposition party has since made several revelations relating to the scandal, including NFCorp’s purchase of two multi-million ringgit condominium units in Bangsar and alleged use of project funds to Shahrizat and her family’s personal expenses and trips abroad.

It also claimed there was a transfer of resources to unrelated companies in Singapore, as well as the purchase a Mercedes-Benz CLS350 for RM534,622 and two plots of land in Putrajaya’s Precinct 10 for RM3,363,507.

The latest disclosure by PKR, made last Tuesday, further alleged that some RM10 million had been diverted towards the purchase of a luxury condominium unit in Singapore for Shahrizat’s family.

Shahrizat tried deflecting attention by stating she’s “only the wife” of the national cattle farming project’s chairman and had nothing to do with the NFC.

The senator has faced calls to quit as minister from within Umno, including from influential former prime minister Tun Dr Mahathir Mohamad.

13 held for distributing Anwar leaflets...

NONEThirteen PKR members including its Kelantan information chief were picked up by the police yesterday evening for distributing leaflets on Anwar Ibrahim’s sodomy trial.

The leaflets provide a chronology of the Sodomy II trial and promote the opposition leader’s scheduled ceramah in Machang next week.

Anwar is to give a talk at Machang on Jan 5 as part of his efforts to rally support ahead of the Kuala Lumpur High Court verdict on Jan 9.

Six of the 13 were detained at the Kuala Krai district police station after they were stopped at a police roadblock.

Those detained include Kelantan PKR Youth chief Mohd Azihan Che Saman.

Meanwhile, the remaining seven, including Kelantan PKR information chief Roslan Puteh, were detained at the Tanah Merah district police station.

When contacted by Malaysiakini, Tanah Merah MP Amran Ab Ghani said the seven were arrested while they were distributing the leaflets at the Tanah Merah market.

“They are being investigated under section 4(b) of the Printing Presses and Publications Act. They were sent to the Tanah Merah district police station. I was there at the station to offer support,” he said.

He added that the seven Tanah Merah PKR members could be remanded today.

"I have asked one of my officers to seek further information over the matter.

"I recieved information that they would be detained overnight, from one of those who contacted him last night."

18-stop nationwide tour

Mohd Azihan, meanwhile, told Malaysiakini that he, along with five PKR members from Jeli and Gua Musang, were picked up at a police checkpoint in Kuala Krai.

“We were detained at about 5.30pm for possession of the leaflets and the party’s flag. They seized all our paraphernalia.”

Their statements were recorded at the respective police stations. At press time the fate of the six remains uncertain.

Anwar will be making an 18-stop nationwide tour between Jan 3 and 8 before the Jan 9 court verdict to be delivered by justice Mohamad Zabidin Mohd Diah.

The Pakatan Rakyat leader will tour major towns in eight states - Johor, Malacca, Negri Sembilan, Pahang, Terengganu, Kelantan, Penang, Selangor - as well as Kuala Lumpur.

Dakwat kekal belum tentu PRU telus...

Penggunaan dakwat kekal dalam pilihan raya umum ke-13 nanti bukan jaminan proses pengendalian pilihan raya itu telus, kata Ketua Pembangkang, Datuk Seri Anwar Ibrahim.

“Saya mengalu-alukan keputusan Jawatankuasa Terpilih Parlimen (PSC) semalam yang mengumumkan pindaan ke atas peraturan pilihan raya bagi mewajibkan penggunaan dakwat kekal dalam proses pilihan raya menjelang 1 Februari 2012.

“Perubahan kecil ini tidak seharusnya dilihat sebagai jaminan kepada proses pengendalian pilihan raya yang telus, bebas dan bersih sepenuhnya,” kata Ketua Umum KEADILAN itu dalam satu kenyataan media hari ini.

Ini kerana katanya, banyak lagi perubahan yang perlu dibuat oleh PSC terutamanya melaksanakan lapan tuntutan Gabungan Pilihanraya Bersih dan Adil (Bersih).

“Agensi media awam seperti RTM dan Bernama sewajarnya bersikap lebih adil dalam memberikan liputan untuk semua parti politik dan kempen politik parti-parti pembangkang sewajarnya tidak didiskriminasi menerusi tapisan melampau yang tidak munasabah serta mencabul hak kebebasan bersuara.

“Tempoh masa kempen pilihan raya dilanjutkan dalam memastikan sebaran maklumat sepanjang tempoh berkempen dapat dicapai oleh segenap lapisan rakyat. Tempoh masa berkempen yang terlalu singkat (10 hari), sepertimana Pilihan Raya Negeri Sarawak baru-baru sewajarnya tidak berulang,” tegas Anwar.

Menurut Anwar, pengawasan terhadap komitmen Suruhanjaya Pilihan Raya (SPR) juga perlu dijamin menerusi pengukuhan badan kehakiman yang lebih bebas dan adil.

“Justeru, Pakatan Rakyat komited dan menuntut supaya pihak PSC turut menumpukan penambahbaikan proses pilihan raya ini dengan mengkaji serta menimbang secara menyeluruh kesemua tuntutan yang dikemukakan oleh Bersih dalam menjamin pilihan raya yang bebas, telus dan adil,” katanya.

Lapan tuntutan Bersih adalah agar SPR membersihkan daftar undi, mereformasikan undi pos, gunakan dakwat kekal, akses media yang bebas dan adil, tempoh kempen minimum 21 hari, memperkukuhkan institusi awam, menghentikan rasuah dan politik kotor.

PSC sebelum ini ditubuhkan bagi meneliti sistem pilihan raya akan membentuk rangka kerjanya berdasarkan pada lapan tuntutan Bersih 2.0.

Consider all Bersih demands: Anwar to PSC

Welcoming the decision by the parliamentary select committee (PSC) for electoral reforms to use indelible ink for the next general election, Opposition Leader Anwar Ibrahim reminded that the small step would not guarantee transparent, free and clean election unless the committee evaluates all of Bersih's demands.

In a statement today, Anwar said more must be done to ensure free and fair polls.

Among them, he said, was the existence of fair broadcast media.

"Public media like RTM and Bernama should be fairer in their coverage of the campaigns by all political parties.

"The opposition parties should not be discriminated through excessive censoring and stifling of their freedom of speech,” said the PKR de facto leader.


The Permatang Pauh MP also urged the campaign period to be extended to ensure information could reach the people in time before polling day, adding that there should not be any short campaigning period, such as the 10 days given for the Sarawak elections.

He repeated calls for a free and fair system of judiciary that could keep the Election Commission in check.

Bersih 2.0, a coalition of more than sixty non-governmental organisations, has made eight key demands for the reform of the electoral system. They include a revamp of the controversial postal votes, the use of indelible ink and a minimum campaign period of 21 days.

It also wants a more liberalised mainstream press, reform of public institutions such as police and Attorney General's Chambers, eradication of corruption and vote buying practices, and a stop to "gutter politics".

Karpal denies lodging complaint with CJ...

NONELawyer Karpal Singh has denied lodging any complaint with the Chief Justice Office to investigate the plagiarist judge issue, expressing surprise at the latter’s decision today that the complaint had no merit.

“It is clear from the correspondence exchanged that I had not made a complaint to the chief justice (CJ) for an investigation.

“I am surprised that the chief justice has stated that after an investigation, there is no basis to my complaint which has been dismissed pursuant to section 13(1) of the Judges’ Code of Ethics, 2009,” said the senior lawyer in a statement this afternoon.

Karpal also questioned the CJ for citing the Code of Ethics, 2009 as the alleged act of plagiarism took place in 2000 prior to the code, saying the “code is not retrospective in operation”.

The DAP national chairperson and Bukit Gelugor MP explained that his communications with the CJ’s Office had merely been to respond to the latter’s enquiry on his correspondence with the errant judge on the issue.

He said he initially sent letters dated Aug 22 and Sept 29 to the judge, Abdul Malik Ishak, expressing his intention to move against him in Parliament, which were later forwarded to the CJ and the president of the Court of Appeal because he felt the matter was “of serious concern to the judiciary”.

This prompted the CJ’s office to write to Karpal on Oct 13 asking for specific information about the issue, including case references and contents of the allegedly plagiarised judgement.


The lawyer replied with the reasons for the parliamentary motion and a copy of the motion, but the motion later lapsed.

“By letter dated Dec 7 to the CJ, I indicated that the motion under Article 127 in Parliament had lapsed on Dec 1, and therefore could not be discussed, leaving me no alternative but to seek other measures to resolve the matter,” said Karpal.

Karpal said his latest move was to write an open letter on Dec 27 challenging Abdul Malik to either resign or file a defamation suit against him in seven days, failure being taken as an admission of guilt.

“Abdul Malik has the option to sue me for defamation before the ultimatum I have given him in my open letter expiring on Jan 3. The ball is in his court. Let us see how he deals with it.”

Why no action from law minister?

Earlier today the CJ's Office had announced that they had found "no merit" to Karpal's alleged complaint about the judge.Karpal had earlier called on the said judge to resign over the plagiarism allegations.

According to the lawyer, the errant judge had, plagiarised a former Singapore judge GP Selvam’s judgment as his own, ironically over a case of copyright.Karpal added that the law minister at the time, Rais Yatim, had publicly admitted that he knew about the plagiarism allegations in 2000.

“It is surprising that the minister on his own admission did not take any step to direct a proper investigation despite having had four years to do so! That appears to be the quality of our ministers!” he said.



Karpal nafi buat aduan kepada CJ

Peguam Karpal Singh menafikan telah membuat sebarang aduan kepada Pejabat Ketua Hakim Negara supaya menyiasat isu plagiarisme terhadap seorang hakim, serta menyatakan rasa terkejutnya dengan keputusan siasatan bahawa aduan tersebut tidak mempunyai merit.

"Adalah jelas daripada surat-menyurat bahawa saya tidak membuat aduan kepada Ketua Hakim Negara (CJ) supaya dijalankan siasatan," katanya dalam satu kenyataan hari ini.

Karpal berkata, beliau terkejut bahawa Ketua Hakim Negara menyatakan berdasarkan siasatan yang dijalankan menurut Seksyen 13 (1) Kod Etika Hakim 2009, dakwaan plagiarisme seperti yang dibangkitkan oleh peguam itu tidak mempunyai merit dan aduan tersebut ditolak.

Dalam satu kenyataan petang ini, Karpal juga mempersoalkan Ketua Hakim Negara merujuk kepada Kod Etika Hakim 2009 kerana perbuatan plagiarisme itu berlaku pada tahun 2000, sebelum kod itu diwujudkan, sambil berkata "kod itu tidak retrospektif".

Karpal yang juga pengerusi kebangsaan DAP dan ahli parlimen Bukit Gelugor menjelaskan bahawa komunikasi dengan Pejabat CJ hanyalah semata-mata respon kepada pertanyaan pejabat berkenaan berhubung suratnya kepada hakim berkenaan, berhubung isu tersebut.

Sebelum itu, pegawai khas 1 kepada Ketua Hakim Negara, Che Wan Zaidi Che Wan Ibrahim, dalam satu kenyataaan hari ini, berkata siasatan yang dijalankan oleh Ketua Hakim Negara mendapati dakwaan Karpal itu tidak mempunyai merit dan aduan tersebut ditolak.

Sebelum ini, Karpal menggesa Hakim Mahkamah Rayuan Datuk Hakim Abdul Malik Ishak supaya meletakkan jawatannya berikutan dakwaan plagiarisme.

Pada 4 Oktober lalu, Karpal mengemukakan usul mengikut Perintah-Perintah Tetap 27 yang dibaca bersama dengan 36 (8) dan Perkara 127 perlembagaan persekutuan, yang mahu dibentangkannya di Dewan Rakyat.

Menurut Karpal beliau sendiri telah menulis kepada hakim kanan itu pada 22 Ogos lalu dan memberi beliau masa selama tujuh hari untuk menjawab dakwaan berkenaan.

Karpal kemudiannya menulis sepucuk lagi surat pada 29 September lalu dan memberitahu hakim itu bahawa sekiranya tiada jawapan diberikan beliau akan mengandaikan ia sebagai pengakuan salah laku.

'Lembu kondo' yang balun duit, 'kambing hitam' pula kena dakwa...

NONESeorang ahli peniagaan Datuk Shamsulbahrin Ismail, 45(kanan), hari ini mengaku tidak bersalah atas dua tuduhan menipu pengerusi National Feedlot Corporation, Datuk Seri Mohamad Salleh Ismail.

Shamsulbahrin merekodkan pengakuan itu selepas didakwa di Mahkamah Sesyen Kuala Lumpur hari ini.

Beliau didakwa menipu Mohamad Salleh supaya menyerahkan cek bernilai RM1.755 juta di Solaris Mont Kiara pada 25 November hingga 6 Disember 2011.

Beliau juga didakwa atas tuduhan menjanjikan Mohamad Salleh untuk memberikan “khidmat perundingan” yang diketahuinya tidak boleh ditunaikan, untuk satu jumlah bayaran.


Beliau didakwa melakukan perbuatan di satu restoran di Bukit Tunku, Kuala Lumpur.

Lelaki yang memiliki beberapa syarikat termasuk perkhidmatan limosin itu direman polis dan diserahkan kepada SPRM pada 22 Disember.

Mohamad Salleh telah menafikan kaitan keluarga antara "Datuk" berkenaan dengan dirinya dan juga isterinya, menteri pembangunan wanita dan keluarda Datuk Seri Shahrizat Abdul Jalil.



'Datuk' charged with cheating Sharizat Jalil's hubby.

A man who claimed to be a 'datuk' today pleaded not guilty to cheating the director of National Feedlot Corporation of almost RM2 million in consultation fees.

Shamsulbahrin Ismail, 45(above pic-smiling), is charged with two counts of cheating under Section 420 of the Penal Code at the Kuala Lumpur Sessions Court.

Shamsulbahrin is charged with cheating NFC director Mohamad Salleh Ismail into handing over cheques worth RM1.755 million at Solaris Mont Kiara on Nov 25 to Dec 6, 2011.


He is also charged with cheating by promising Mohamad Salleh "consultancy services" which he knew he could not deliver, in order to charge a fee, at a restaurant in Bukit Tunku, Kuala Lumpur.

Shamsulbahrin, who was dressed in a blue striped shirt and a blazer, appeared calm.

He was first arrested on Dec 22 for attempting to bribe police investigating officers in the NFC probe, and had his remand extended several times this week.

Shamsulbahrin, who owns several companies including a limousine service outlet, was under police remand and handed over to the Malaysian Anti-Corruption Commission on Dec 22. If found guilty, Shamsulbahrin faces a jail term between one and 10 years.

The NFC fiasco hogged national attention following the 2010 Auditor-General’s Report saying that NFC had failed to comply with the objectives of its formation after a soft loan of RM250 million was given by the government.

Agong dipohon untuk pecat Jamil Khir jika tidak minta maaf...

Gerakan anti-rasuah Parti Keadilan Rakyat (PKR), Jingga 13 hari ini akan meminta Yang di-Pertuan Agong memecat Datuk Seri Jamil Khir Baharom(kiri) dari pentadbiran negara sekiranya menteri yang bertanggungjawab dalam hal ehwal Islam itu tidak meminta maaf berhubung dakwaan penyalahgunaan wang zakat.

In a statement today, its secretary Saifuddin Shafi Muhamad said that if they do not do so the NGO will raise the matter with the Agong.

“We urge Jamil Khir (right) and the two Federal Territories Islamic Department officers to apologise within 48 hours, or we will take the issue to the Agong, who is head of Islam in the nation,” he said.

He added that the act of abusing tithe funds disqualifies the minister from being in charge of Islamic affairs.


“The minister and the other two officers should resign if they are people with dignity and morals,” he said.

Jingga 13 had this morning lodged a report with the Malaysian Anti Corruption Commission at its Shah Alam office on the matter.

“We hope a detailed investigation is carried out by the MACC,” he said.

Last week, an Audit Department report revealed that Jamil Kir, Federal Territories Islamic Department director Che Mat Che Ali and the department’s chief prosecutor Shamsuddin Hussain’s legal fees were paid by using tithe funds.

The trio were called as respondents in the qazaf case involving Permatang Pauh MP Anwar Ibrahim.

The report, however, stated that the RM63,650 was repaid when the Federal Territories Islamic Council (MAIWP) received a RM700,000 grant in June 2010, as general resources allocation from the government.

Several quarters have responded to this by saying that this does not absolve the trio from wrongdoing as there have been previous convictions against those who abused tithe funds, even though the amount taken was refunded.


MAIWP yesterday justified paying for the trio’s legal fees as they are civil servants.

Menteri UMNO milik rumah mewah tapi bayar peguam dengan wang zakat...

Menteri hal ehwal Agama, Datuk Seri Jamil Baharom mampu memiliki rumah mewah tetapi menggunakan wang zakat untuk membayar kos guaman peribadi, kata Penolong Setiausaha Angkatan Muda Keadilan (AMK), Mohd Saifullah Mohd Zulkifli.

“Mengapa perlu guna wang zakat, sebagai menteri saya berkeyakinan Datuk Seri Jamil mampu membayar kos guaman itu guna wang sendiri tanpa perlu mengusik walau sesen pun wang zakat.

“Buktinya, beliau mampu pula selenggara rumah mewahnya seperti yang didedahkan sebelum ini,” katanya kepada Keadilandaily.com Menurutnya, jika seorang menteri yang bertanggungjawab terhadap agama Islam tidak amanah, apatah lagi membabitkan menteri lain seperti skandal National Feedlot Corporation (NFC) yang dimiliki keluarga Datuk Seri Shahrizat Abdul Jalil.

“Kalau sampai tahap wang zakat pun diseleweng menteri agama Umno, jadi apa nak hairan kalau wang (projek) lembu RM250 juta turut diseleweng syarikat keluarga Ketua Wanita Umno,” soalnya.

Laporan Audit Negara 2010 baru-baru ini mengesahkan RM63,650 dikeluarkan dari dana zakat Majlis Agama Islam Wilayah Persekutuan (MAIWP) untuk mendahulukan bayaran khidmat guaman Jamil Khir dan Kos guaman itu bersabit kes tuntutan qazaf ketua pembangkang Datuk Seri Anwar Ibrahim yang menamakan Jamil; pengarah Jabatan Agama Islam Wilayah Persekutuan, Datuk Che Mat Che Ali dan ketua pendakwanya, Shamsuddin Hussain sebagai responden

Meskipun dikembalikan semula, namun tindakan menggunakan wang zakat itu dikecam keras pelbagai pihak, sedangkan pada masa sama Jamil Khir mampu mempamerkan kehidupan mewah beliau.

Suara Keadilan September lalu menyiarkan gambar kediaman mewah Jamil Khir yang baru diubahsuai dan dianggarkan menelan kos jutaan ringgit di Taman Batu Muda, Batu Caves, Selangor.

Pimpinan KEADILAN turut mempersoalkan bagaimana menteri yang baru dilantik tiga tahun oleh Perdana Menteri itu, mampu memiliki kediaman mewah dalam masa singkat.

jingga 13 on singapore trip 291211 12Saying that it will leave no stone unturned, PKR-linked NGO Jingga 13 made the trip down to Singapore to prove to Malaysians that the luxury condominium owned by cabinet minister Shahrizat Abdul Jalil’s family is as luxurious as it was made out to be.

“We were shooed off when we tried to take a photograph from the front, so we tried going through the back and was berated by a security guard from another building, who said photographs are not allowed as it is private property,” said Jingga 13 leader Fariz Musa.

Braving zealous security guards, it took seven of the Jingga 13 members three attempts to get into the compounds of Orchard Scotts on Anthony Road. They finally succeeded by tailing residents when the guards were not looking.

What they found inside was something “worth the RM9.9 million paid by Shahrizat’s family”, said Fariz at a press conference at PKR headquarters in Tropicana today.

The result was a two-minute, 20-second video which featured Fariz taking viewers on a tour of the common area, including the swimming pool, bathroom and toilet.

“This is just the common bathroom, and it already has a spa (a small pool, believed to be a jacuzzi). Imagine how it is like in the actual condominium units,” he told reporters during the screening of the video.


Earlier this month, PKR revealed that Shahrizat’s husband, Mohamad Salleh Ismail, and two of their children jointly owned a RM9.9 million condominium unit in downtown Singapore.

The family of the women, family and community development minister are under fire for alleged misappropriation of RM250 million government loan for their company National Feedlot Corporation.

PKR, however, could not show proof that the condominium was paid using NFC funds, except for the fact that funds were transferred from NFC to the family’s Singapore-based companies.

The group, who paid for the Dec 23 to 24 trip out of their own pockets, also visited a upmarket restaurant owned by the family, known as Meatworks, in Orchard Mall.

Fariz, who decried the exchange rate between Singapore dollars and the ringgit, added the group did not order anything because they were “afraid”.

“There were no halal signs, and liquor was sold at the premises,” he said, adding that they managed to stall the waiter, by saying that they were still waiting for friends.

The group also shot a two-minute video of the restaurant, showing the empty seats and the hallway which they claim is also rented by Meatworks.

NFC a symbol of misappropriation


“We will blast out these videos in Facebook and other sites to show... the misappropriation and criminal breach of trust by Shahrizat’s family, including the land purchases, condominiums, Mercedes Benz cars and overseas trips,” he said.

Jingga 13 had previously lodged a report with the Malaysian Anti-Corruption Commission on two plots of land in Putrajaya, allegedly bought by the family using NFC funds.

Also present at the press conference was Ampang MP Zuraida Kamaruddin, who said the NFC fiasco will be go down as a “landmark case” in Malaysian political history.

“We will continue to unearth evidence to turn this case as a symbol in the next general election, so people will realise how dirty the BN government is and how they misappropriate the rakyat’s money,” she said.

Ku Li - Mahathir tu bukanlah cerdik sangat pun...

Tengku Razaleigh Hamzah meramalkan dalam pilihanraya umum ke 13 yang akan datang ini United Malay National Party (UMNO) akan menerima kekalahan lagi.

Dari pemerhatian beliau pengundi bukan Melayu semakin menjauhkan dari Barisan Nasional atau lebih tepat lagi lari dari UMNO.

Beliau dakwa ada kemungkinan Barisan Nasional dan juga Pakatan Rakyat tidak memiliki majoriti yang meyakinkan. Bila terjadi sedemikian, negara kita mungkin menghadapi krisis.

Menurut Ku Li, hampir 90% peratus pengundi China bersedia untuk mengundi Pakatan Rakyat. Ada pengundi India yang telah kembali menyokong Barisan Nasional, tetapi majoriti masih bersama Pakatan Rakyat. Pengundi Melayu pula kini terbahagi kepada dua.

Ku Li, ahli parlimen Gua Musang semenjak 1974 dan juga bekas Menteri Kewangan Malaysia, menganggap pentabiran dibawah pimpinan Datuk Seri Najib Razak ini amat lemah dan tidak memahami krisis ekonomi global yang sedang melanda dunia sekarang.

Mengikut Ku Li pentabiran sekarang ini selalu berdulak-dalik - flip flop - apabila mengajukan sesuatu dasar. Dasar sorong tarik ini terjadi kerana banyak dasar-dasar ini tidak difikirkan secara masak terlebih dahulu.

"Mereka tidak peduli satu apa pun... tetapi mereka tidak ingin masuk penjara," Ku Li memberi kesimpulan terhadap pentabiran Najib Razak.

Ku Li, seorang bekas penuntut Malay College Kuala Kangsar (MCKK), berkata demikian dalam satu makan tengah hari bersama beberapa orang murid tua MCKK minggu lalu.


Mengenai isu hak royalti minyak, Ku Li dengan tegas menerangkan bahawa perjanjian antara Petronas dengan negeri-negeri jelas disebutkan hak royalti dan tidak ada fasal yang menyebut wang ehsan.

Malah Ku Li amat berbangga kerana beliau sebagai Pengerusi Petronas 1974 telah bertanggung jawab membuat butiran perjanjian minyak ini atas arahan Tun Abdul Razak.

"Walaupun perjanjian ini dalam bahasa hukum-hakam tetapi amat jelas Petronas wajib memberi 5% kepada negeri dimana minyak ditemui."

Krisis tuntutan Kelantan terhadap royalti minyak ini hanya boleh diselesaikan jika Malaysia memiliki apa yang Ku Li namakan sebagai Mahkamah Perlembagaan atau Constitutional Court.

Beliau berpendapat telah sampai masa Malaysia mewujudkan Mahkamah Perlembagaan khusus untuk menyelesaikan isu yang berkaitan dengan perlembagaan seperti kedudukan Raja Raja Melayu, hak kebebasan rakyat , pilihanraya yang bebas atau tuntutan royalti minyak.

Kecekapan Ku Li ini sebagai pakar ekonomi dan Menteri Keewangan terbukti pada tahun 1979 apabila beliau telah berjaya mengambil alih kembali harta tanah Guthrie dalam apa yang dikenali sebagai 'the dawn raids'. Ketika itu Ku Li dilihat sebagai nasionalis ekonomi yang berjaya mengambil kembali harta negara yang telah dijarah oleh penjajah.

Mengikut lajenda politik Malaysia, Ku Li sepatut telah menang dalam pemilihan Presiden UMNO dalam tahun 1987 tetapi malangnya ketika pengiraan undi berjalan tetiba bilik menjadi gelap dan lampu leterik telah terpadam. Mahathir Muhamad telah berjaya menewaskan Ku Li dengan 43 undi apabila lampu terpasang kembali.

Ku Li tidak menimbulkan hal ini malah pertanyaan mengenai ' kes lampu padam' ini hanya akan dijawab dengan senyuman yang panjang. Ku Li enggan melintasi dilurah yang sama.

"Mahathir ini bukanlah cerdik sangat. Dia selalu menjalankan dasar 'ad hoc'. Selalu mencuri idea dan pandangan orang lain dan mengakui sebagai haknya," dakwa beliau.

"Dia curi-lah. Saya selalu melihat dia 'playing to the gallery'," kata Ku Li, menerangkan pandangan dan pengalaman beliau yang terkumpul selama 5 tahun bersama Mahathir Muhamad sebagai menteri.

Bila ditanya tentang Anwar Ibrahim Ku Li menerangkan bahawa dia hanya mengetahui Anwar sebagai aktivis belia. Walau pun mereka berdua belajar di Malay College tetapi mereka agak jauh bertelingah zaman.

Mengikut surah Ku Li, kali pertama secara rasmi dia dengar nama Anwar ialah dari Putera Muhamad anak kepada Raja Feisal dari Saudi Arabia. Ketika itu Ku Li sedang menjawat Pengerusi Bank Islam OIC. Putera Raja ini bertanya kepada Ku Li apakah patut Anwar Ibrahim dan ABIM ini dibantu oleh dana Yayasan Feisal.

"Sekarang Anwar sedang menjadi dilema kepada Najib. Ini mengikut lojik yang kita lihat. Saya yakin Anwar akan masuk penjara. Kalau Anwar bebas UMNO akan habis. Tidak dapat tidak Anwar akan dipenjara."

Ku Li merumuskan bahawa pentabiran pimpinan Najib Razak kebelakangan ini bukan sahaja lemah malah dalam huru hara. Mengikut pandangan Ku Li , Najib Razak sebagai Presiden UMNO terlepas peluang yang amat besar di Perhimpunan Agong UMNO yang baru berlangsung. Ketika mata dan telinga seluruh negara berpusat memandang ke PWTC, Najib tidak melakukan apa-apa terhadap Shahrizat.

"Shahrizat sepatutnya dibuang. Termasuk beberapa orang menteri yang nama mereka telah busuk ditelinga orang ramai. Tetapi Najib senyap membisu," katanya.

Apakah peranan yang masih boleh dimainkan oleh Putera raja dari Kelantan ini masih belum jelas. Ku Li dibesarkan di Istana dan dididik di Malay College — seharusnya menjadi kimia terbaik untuk memimpin negara ini. Ku Li dilihat sebagai sebagai ahli politik yang tidak membawa beban 'kerpai buruk'. Tetapi Ku Li juga adalah sosok yang berkontradiksi.

Ku Li tidak akan memboceng motosikal untuk berkempen jika jalan raya berasak asak. Ku Li juga tidak akan mengambil 'loud hailer' untuk menggumpulkan massa. Jauh sekali Ku Li untuk turun memasang poster atau memasang khemah atau turun berdemo.

Dah guna duit zakat,Jamil Khir buat dont know saja...

Parti Keadilan Rakyat (PKR) mencabar Menteri di Jabatan Perdana Menteri, Datuk Jamil Khir Baharom memberikan penjelasan berhubung salah guna wang zakat Majlis Agama Islam Wilayah Persekutuan (MAIWP) seperti yang dilaporkan dalam Laporan Audit Negara 2010.

Pengarah Komunikasi PKR, Nik Nazmi Nik Ahmad dalam kenyataannya berkata, Jamil Khir(kiri) tidak sepatutnya diam membisu dan segera menjawab persoalan ini yang pastinya menimbulkan kegusaran di kalangan umat Islam negara ini.


"Jawapan Ketua Audit Negara November lalu mengesahkan Menteri di Jabatan Perdana Menteri Datuk Jamil Khir Baharom, Pengarah Jabatan Agama Islam Wilayah Persekutuan Datuk Che Mat Che Ali dan Shamsuddin Hussain Ketua Pendakwa Syarie Wilayah Persekutuan menggunakan RM63,650 daripada wang zakat untuk membiayai kos guamannya mengadapi kes permohonan qazaf Datuk Seri Anwar Ibrahim," katanya.


Sebelum ini, Ahli Parlimen Machang, Saifuddin Nasution telah membangkitkan perkara ini di Parlimen dan dibawa ke Jawatankuasa Kira-Kira Wang Negara.
Ketua Audit memaklumkan, bahawa pada 11 Januari 2010 MAIWP menerima bil berjumlah RM63,000 daripada peguam Tetuan Zainul Rijal Talha dan Amir kerana mewakili ketiga-tiga mereka di atas bagi kes permohonan qazaf Anwar.

Che Mat telah meluluskan bayaran RM31,500 daripada peruntukan am pada 28 Januari 2010. Namun memandangkan geran kerajaan masih lagi belum diterima, bayaran dibuat menggunakan peruntukan zakat pada 9 Februari 2010.

MAIWP membuat pembayaran baki kos guaman RM32,150 pada 29 April 2010 menggunakan peruntukan zakat. MAIWP telah menerima geran kerajaan pada 22 Jun 2010 sebanyak RM700,000.

Namun MAIWP hanya membuat pembayaran semula daripada peruntukan am kepada wang zakat pada Disember 2010.


Beliau turut mempersoalkan, adakah begitu mudah untuk MAIWP menggunakan wang zakat yang dibayar umat Islam bagi asnaf-asnaf yang khusus untuk perbelanjaan lain?

Datuk Mat Zain Ibrahim, bekas Ketua Jabatan Siasatan Jenayah Kuala Lumpur di dalm surat terbukanya kepada Ketua Polis Negara hari ini telah membangkitkan dwi-standard kes ini dengan kes membabitkan bekas imam di Kulaijaya, Johor, Redzuan Mohd Said yang didapati menyelewengkan RM19,510 kutipan zakat antara Ogos dan September tahun ini.


"Redzuan yang kemudiannya memulangkan wang tersebut telah dihukum empat tahun penjara dan tiga sebatan atas kesalahnnya.

Adakah wujud perbezaan antara seorang amil zakat biasa yang melakukan kesalahan dengan seorang Menteri dan Ketua Pengarah JAWI?," katanya.

Jamil Khir must answer zakat abuse claim...

Minister in Charge of Islamic Affairs Jamil Khir Baharom has been urged to explain the alleged misuse of Federal Territory Islamic Council’s (MAIWP) zakat (tithe) funds for legal payments.

In a statement today, PKR information chief Nik Nazmi Nik Mat said the funds, which are supposed to be used for the poor, cannot be used for other purposes.

“Jamil Khir (above-left) should not remain silent on this issue and swiftly respond to the allegations which is definitely causing unease among Muslims,” said Nik Nazmi.

Referring to an open letter by former Kuala Lumpur CID director Mat Zain Ibrahim today, Nik Nazmi pointed out that there had been a precedent where abuse of zakat funds resulted in a jail term.

Mat Zain wrote to the Inspector-General of Police Ismail Omar to point out that a former imam in Kulaijaya, Johor, was given a four-year jail sentence coupled with three lashes of the cane.

The former imam was found guilty of abusing RM19,510 from zakat funds, but was punished despite returning the money.


In the case of MAIWP, the funds were used as advance legal payments for Jamil Khir, Federal Territory Islamic Department director Che Mat Che Ali(above-right) and its chief prosecutor Shamsuddin Hussain.

Scholars urged to speak up

The Audit Department had confirmed that the RM63,650 in funds were used to pay lawyers in June 2010 to represent the trio over a case brought by Anwar Ibrahim at the Syariah Court.

However, the department states that MAIWP was reimbursed after the council obtained a RM700,000 grant the same month, as its general resources allocation from the government.

In view of the sentence on the former imam from Kulaijaya, Nik Nazmi said that there should be no double standards in law enforcement.

“Is there a difference between a normal person and a minister?” he asked.

Meanwhile, Federal Territories PAS Youth has urged all religious scholars to condemn the wrongful use of zakat funds in order to protect the zakat institution.

“For us, the issue on whether the money was eventually returned does not arise.

The crux of the matter that needs to be answered is whether the funds can be used for personal use by government officials,” said Federal Territories PAS Youth deputy chief Mohd Suhaimi Abdul Aziz. Mohd Suhaimi said Jamil Khir should rightfully set a proper example and manage the zakat funds properly.

Datuk Mat Zain had written and published, not one single person within the government dare to act against him. Not the AG, not the IGP and not a single Minister. I would ask – why is this so? And the only logical answer that I can think of is that what all has been revealed by Datuk Mat Zain is true and cannot be challenged. Indeed, Datuk Mat Zain is a lone crusader for good against evil.

Being a colleague of Jamil Khir while I was in the military service, I am ashamed at what he did, if the allegation is proven to be true. I simply cannot accept a person like him with strong religious credentials and a ‘pendakwah’ to have done the unthinkable; an act that is sacrileges. He not only shamed the Armed Forces from where he was trained and served, but more importantly to desecrate the office that he now holds i.e. Minister in the PM Department in charge of Islamic religious affairs.

Prof.Aziz Bari weighing option the possibility of entering politics...

NONEWith things looking uncertain for law professor Abdul Aziz Bari, the constitutional law expert from Universiti Islam Antarabangsa (UIA) is weighing his options, including the possibility of entering politics.

Abdul Aziz told Malaysiakini that he has received several offers from the Pakatan Rakyat coalition.

“I have received offers from PAS, PKR and DAP to contest in the coming general election but nothing is concrete yet,” he said.

The don, who hails from Sabak Bernam, was reported to be eyeing the MP seat held by Abdul Rahman Bakri, according to some media reports.

Abdul Rahman, formerly the Sungai Tawar assemblyperson, was charged with nine counts of making false claims in 2009 and he is due to enter his defence in June.

Abdul Aziz, who is now suspended from UIA with pay, views the chances of himself remaining in the university, where he had taught for 22 years, as slim.

NONEThe 53-year-old said the university’s administrators have yet to respond to his reply to their show-cause letter, as to whether they are closing the case or intend to continue with the disciplinary action.

“It has been two months since I wrote my reply to the show-cause letter,” he said.

Abdul Aziz is facing the action following his remarks on the functions and rights of the sultan as the head of Islamic affairs.

Third disciplinary action

The professor is no stranger to controversy as three years ago, he was also issued a show-cause letter over his statement likening Malaysia to Zimbabwe.

The second occasion was when he agreed to accept an appointment from the Selangor Pakatan Rakyat government over the appointment of its new state secretary.
NONE“This is the third time I have been issued a show-cause letter, resulting in me facing the question of whether I can continue. Under the present circumstances, it is tough for me to continue, where I feel pressured and also the institution is not recognising academic freedom to voice one’s views.”

“It is difficult for us to give inputs to society by giving comments. Maybe this is the best time to leave this institution,” he told Malaysiakini in an interview last week.

Abdul Aziz opined that UIA’s actions against him meant that he should not communicate with society as an academician.

“Hence, I have to find other alternatives. Certainly, politics is something new,” he said.

“I received offers to enter politics prior to 2008, but at that time I was not interested. There was a political ticket for me to contest, but there was no seat then. However, I do not see myself as a candidate or a suitable character in politics.”

‘I won’t deviate from academics’

Abdul Aziz said he has not seriously considered his options on whether to continue as an academician or to enter politics.NONE

“I feel I need a flexible kind of job. I have not given serious thought of what I am going to do next. However, whatever it is, I will not deviate from what I am doing now, like being involved with consultancy work, writing, or doing research and also being a member of a consultancy body,” said the law professor.

He realises that there are limitations when one enters politics, as one would have to abide by party rules and policies on particular issues.

Abdul Aziz said he has not joined any political party as yet, and that this would not be a problem for him.

“I recognise that there are barriers or limits everywhere. However, in the academia, we have to think of the repercussions of making a statement, as you need to explain to the university or employer.

“If I become a consultant or a fellow in an independent body, I can only touch on matters that are agreed upon,” he said.

Najib Takut Shahrizat Dedah Skandal Pemimpin Lain...

Keengganan Perdana Menteri, Datuk Seri Najib Razak untuk mengambil sebarang tindakan kepada Menteri Pembangunan Wanita, Keluarga dan Masyarakat, Datuk Seri Shahrizat Jalil boleh menimbulkan pelbagai persepsi berhubung penyelewengan NFC membabitkan wang rakyat yang diamanahkan kepada kerajaan Pusat.

Adun Taman Medan, Haniza Mohamed Talha berkata tidak ada sebab munasabah untuk Najib melengah-lengahkan tindakan sedangkan pelbagai pihak termasuk pemimpin Umno sendiri menggesa Shahrizat berbuat demikian.

"Apakah Najib takut bertindak disebabkan bimbang Shahrizat mendedahkan pelbagai lagi penyelewengan lain yang dilakukan oleh pemimpin-pemimpin Umno lain termasuk keluarga Najib sendiri sekiranya beliau dipecat?.

"Apakah juga disebabkan ada pemimpin lain yang turut terlibat, Kalau tidak mengapa Najib masih membisu" kata beliau mencabar Najib bertindak menjawab segala persepsi yang ada bagi membersihkan imej kerajaan dimata rakyat.

"Sepatutnya sebagai Perdana Menteri, beliau seharusnya mendepani masalah ini kerana beliau adalah ketuanya," tegas Haniza yang juga Timabalan Speaker Dun Selangor.

Melihat kepada kepincangan yang dicetuskan oleh Shahrizat (gambar), Haniza menzahirkan rasa kecewa kerana tidakannya itu bukan sahaja mengkhianati wang rakyat, malah turut mengaibkan kaum wanita.

"Ia amat memalukan sebagai seorang ketua wanita dari satu organisasi yang besar pada masa yang sama mewakili kaum melayu terbabit dalam salah laku seperti ini," katanya.

"Ini adalah pertama kali pemimpin wanita negara melakukan kesalahan secara terang-terangan," jelas Hanzia ketika dihubungi TVSelangor.

Katanya di negara-negara maju seperti Amerika Syarikat pemimpin yang terlibat dengan skandal akan segera meletak jawatan sebagai tanda bertanggungjawab.

Haniza berkata ini tidak mungkin akan berlaku dalam kepimpinan Umno-BN.

Mengulas lanjut, Haniza berkata penyelewengan tersebut adalah dilema hebat dalam kepimpinan Umno kerana apa jua tindakan yang bakal diambil tetap akan menerima hukuman dan kritikan daripada rakyat.

"'Luah mati emak, telan mati bapak' bagaimana cara sekalipun, Umno tidak akan terlepas daripada diadili oleh rakyat dan tidakan mereka itu akan dilihat sebagai sebuah janji yang telah mengkhianati rakyat, " kata beliau

PKR sebelum ini mendakwa sejumlah RM250 juta dana awam diberikan kepada syarikat berkenaan yang dikaitkan dengan suami Menteri Pembangunan, Wanita dan Keluarga Datuk Seri Shahrizat Abdul Jalil.

Bagaimanapun wang itu didakwa telah disalahguna sehingga projek tersebut dikatakan dalam 'kucar-kacir' seperti dirumuskan dalam Laporan Ketua Audit Negara 2010.

PKR kemudiannya mendedahkan wang tersebut digunakan oleh NFC bagi membeli dua buah unit kondominium mewah di Bangsar bernilai RM13.8 juta.

Selain itu, PKR turut mendakwa sejumlah RM5 juta pula dibelanja untuk membeli kereta Mercedes Benz dan tanah di Putrajaya serta RM588,585 disalurkan kepada syarikat-syarikat milik keluarga menteri itu.

Selain PKR, Jawatankuasa Kira-kira Wang Negara (PAC) juga berpendapat siasatan awal mendapati beberapa kelemahan yang berlaku pada awal perancangan dan juga perlaksanaan.

Pilihan raya umum Mac depan...

PAS menjangkakan pilihan raya umum ke 13 akan diadakan Mac tahun depan dan mahu semua peringkat parti membuat persiapan terbaik.

"Kali ini saya agak yakin berbanding dengan tarikh-tarikh sebelum ini," kata ahli politik veteran PAS yang juga Setiausaha Agungnya, Datuk Mustafa Ali(kiri). Beliau berkata demikian dalam satu majlis makan malam dekat sini baru-baru ini.

Beliau membuat andaian itu berdasarkan laporan media dan ramalan awal tentang status ekonomi negara.

"Bagi saya, Umno akan timbang dua perkara kali ini sebelum mengadakan pilihan raya iaitu keadaan dalam Pakatan Rakyat yang sedang diserang.

"Satu lagi, kedudukan ekonomi yang dijangka bermasalah tahun depan ekoran krisis ekonomi dunia khasnya di Amerika dan Eropah.

"Sebelum Malaysia terasa kesannya, baik buat pilihan raya dulu," kata Mustafa dalam ucapannya itu.


Sehubungan itu, beliau meminta semua organisasi dalam PAS membuat persiapan yang terbaik untuk menghadapi pilihan raya kali ini.

"Najib sudah isytiharkan, ini adalah ibu kepada segala peperangan (mother of the batle), yang tidak pernah dirasai BN sebelum ini, jadi kita mesti membuat persiapan terbaik," katanya.

Mustafa bersetuju, ramai pemimpin dan Umno sangat terpengaruh dengan teori R.A.H.M.A.N yang menghasilkan Datuk Seri Najib perdana menteri di kalangan Umno yang terakhir.

Teori R.A.H.M.A.N adalah teori berdasarkan turutan perdana menteri Malaysia dari Tunku Abdul Rahman, Tun Razak, Tun Husein, Tun Dr Mahathir, Tun Abdullah dan kini Datuk Seri Najib.


Sehubungan itu, Mustafa meminta semua ahli PAS memberikan fokus sepenuhnya untuk memenangi pilihan raya kali ini khasnya di Terengganu. Bagi beliau, Umno Terengganu sudah terlalu kekeringan idea dalam menghadapi PAS sehingga terpaksa menimbulkan kembali isu yang sudah berlangsung puluhan tahun lalu iaitu isu kafir mengkafir dan sembahyang dua iman.

Ia dibangkitkan dalam satu titah Tuanku Sultan Terengganu di sebuah masjid baru-baru ini yang antara lain kesal kerana masih ada pihak yang tidak bersembahyang di masjid kawasan masing-masing. Namun isu ini dijawab dengan mudah oleh penduduk kariah masjid Pengadang Baru dekat sini.

Masjid Pengadang Baru adalah masjid kerajaan negeri tetapi jawatankuasa dan imannya dikuasai oleh pemimpin PAS tempatan. Ekoran itu, ramai pemimpin Umno tempatan tidak sembahyang termasuk sembahyang Jumaat di masjid itu. Antaranya adalah Pengerusi JKKK Pengadang Baru yang sembahyang di masjid lain iaitu Masjid Kubang Durian.

Ekoran itu, Mustafa merumuskan Umno sudah kekeringan idea untuk melawan PAS. Oleh itu, pilihan raya ini disifatkan beliau sebagai masa terbaik untuk PAS merampas kembali Terengganu. Dalam pada itu juga, Mustafa Ali mengingatkan jentera parti agar tidak mengharapkan masalah ‘dalaman’ Umno dan Barisan Nasional (BN) untuk menang pilihan raya.

Justeru itu, kata beliau PAS perlu mempunyai kekuatan sendiri bagi menarik sokongan pengundi dan rakyat seluruhnya. Menurutnya, meski pun Umno-BN menghadapi banyak masalah termasuk isu perbalahan dalaman parti itu tetapi bukan jaminan kepada PAS pada pilihan raya akan datang.

“Kita (PAS) tidak boleh bergantung dengan isu Umno dan Barisan Nasional ‘berbalah’ (krisis) tetapi kena ada kekuatan kita sendiri,” tegasnya.

Mustafa mahu jentera PAS di semua peringkat bekerja kuat bagi menambah serta memperkukuhkan daftar pemilihnya. Menurutnya, senario politik hari ini menunjukkan gelombang bukan Melayu Islam agak kuat menyokong PAS dan Pakatan Rakyat.

Prepare for March polls

PAS secretary general Mustafa Ali said the much-anticipated 13th general election would be held in March next year.

Speaking at a dinner event in Terengganu last weekend, the veteran PAS leader said he was confident with his prediction, saying domestic politics and global economic forecast were taken into account.

“To me, UMNO will look at two factors before calling for an election. Firstly, that Pakatan Rakyat is under attack, and secondly, the gloomy economic outlook for next year in the wake of the economic crisis in the US and Europe,” said Mustafa.

“So before Malaysia is hit, it would be better to have election first.”

Mustafa urged all PAS members to fully prepare for the polls, described r ecently by prime minister Najib Razak as ‘mother of all battles’.

'RAHMAN'

On the 'RAHMAN' theory, Mustafa remarked that many UMNO members and leaders believed in the prophecy, which places Najib as UMNO's last prime minister before its downfall.

The 'RAHMAN' prophecy is so named to represent each of Malaysia's prime ministers: Abdul Rahman (R), Abdul Razak (A), Hussein Onn (H), Mahathir Mohamad (M), Abdullah Badawi (A) and Najib (N). Prior to Anwar Ibrahim's sacking and jailing, it was often argued that he would be the next prime minister after Mahathir, in conforming with the acronym.

On the prospect of PAS returning to power in Terengganu, Mustafa said it could be a reality if members gave their full attention.


“Terengganu UMNO has run out of ideas to face PAS, so they had been recycling some decades-old issues. This is the best time for PAS to snatch Terengganu back,” he added.

Wrong for Minister and 2 senior officers of MAIWP to use 'wang zakat'...

It is wrong for a minister and two senior officers of the Federal Territory Islamic Council (MAIWP) to use tithe funds as advance payment for their legal fees although the money was returned eight months later from a federal grant.

Former senior police office, Mat Zain Ibrahim in a hard hitting letter today to the Inspector-General of Police Ismail Omar, Prime Minister Najib Abdul Razak and Home Minister Hishammuddin Hussein, remarked that it was not only a criminal offence but also a “big sin” in Islam to use it.

Mat Zain, the former Kuala Lumpur CID chief, said under Section 403 of the Penal Code for the dishonest misappropriation of property, he said anyone using the funds for his own can be punished with imprisonment of between six months and five years’ jail, and is also liable to be caned.

“Even using the money for one day is considered misappropriation of property and punishable under this section. In the case of the minister Jamil Khir Baharom, MAIWP director Che Mat Che Ali and chief prosecuting officer Shamsudin Hussain, had used the money in April 2010 and paying back in December 2010.”

Mat Zain cited section 409A of the Penal Code, which states there is no defence for offences under sections 403 to 409, to show that the property was openly appropriated and duly recorded.

‘No one can indemnify them’

He pointed out that the evidence obtained can be used against them for misappropriation of funds.

“In other words, although the open usage of tithe money is recorded in MAIWP’s accounts, it is still an offence and it cannot be used for their defence. The records provide concrete evidence of criminal offence and the audit report is prima facie evidence in this case.

“Paying back every sen is not a good reason to clean oneself of the crime or a mitigation to escape punishment,” he said.

On Thursday, it was reported that the audit department report confirmed that RM63,650 was withdrawn from MAIWP to settle in advance legal costs for Jamil Khir, and the other. The money was paid eight months later.


The report claimed that tithe money was used to bear the legal costs of the council following Anwar Ibrahim’s qazaf application, as they are its officers and it is permitted.

Citing Section 409B of the same code, a person found in violation of Section 403 and 404, shall be deemed to have acted dishonestly until the three are proven otherwise.

“With this, I would argue without hesitation that Jamil Khir, Che Mat and Shamsudin had committed offences under Section 403 and can be charged and punished under the same section.

“If they are not charged it is a different matter. No party may indemnify their criminal liability for their alleged acts,” he added.

‘New found powers’

On an Islamic perspective, Mat Zain said they should have been well versed that using tithe funds unless permitted under the religion is considered haram (forbidden) and a big sin.

Referring to a working paper on the distribution of tithe funds by Professor Hailani Muji Tahir on June 2009, two months before Jamil Khir took his oath as a minister in charge of religious affairs, Mat Zain said that it was a blessing and that the working paper served as a reminder.

“There is a possibility that Jamil Khir may have been buoyed with his new found powers of appointment which he may interpret had absolved him of a major sin.

“Whatever the reasons, misappropriation of tithe money is an offence under the Penal Code. In the Quran, it states abusing tithe funds is forbidden and a big sin like others including consuming alcohol beverages, committing adultery, rape, sodomy or falsifying oath,” he added.

He said Jamil Khir was willing to use tithe money so as to protect something related to a case involving complainant Mohd Saiful Bukhari Azlan.


“Why did they use the tithe which is supposed to be given to the poor and the orphans. Is this what you mean as upholding Islam?” he asked.

Dilema Najib kalau Anwar dipenjara...

Ketua Pembangkang, Datuk Seri Anwar Ibrahim, sewaktu menyampaikan ucapan di Kongres PKR ke-8, di Johor Bharu, November lalu menyeru supaya gerakan reformasi bagi membebaskan negara dari cengkaman Umno/BN perlu terus digerakkan walaupun beliau akan di penjara.

Manakala tarikh 9 Januari tahun depan akan menjadi satu detik bersejarah yang akan menentukan sama ada Ketua Umum PKR itu ke penjara atau tidak.
Keputusan tersebut bukan sahaja dinantikan oleh seluruh rakyat Malaysia malah turut dinantikan oleh seluruh media antarabangsa.

Dikalangan media antarabangsa akan melihat isu yang dibabitkan ke atas Anwar merupakan 'kaedah tradisi'yang dilakukan oleh seluruh pemerintah di dunia untuk menyingkirkan musuh politik mereka.

Kalau Anwar Dibebas...

Membebaskan Anwar dari hukuman penjara akan memberikan persepsi bahawa segala konspirasi untuk menfitnah dan mengaibkan beliau selama ini telah gagal.

Di mata rakyat pula, pembebasan Anwar akan memperjelaskan lagi bahawa Anwar tidak bersalah. Di masa yang sama rakyat akan mengutuk pelbagai 'adegan' samaada pertuduhan yang disabitkan dengan Saiful Bukhari Azlan atau filem prono yang dikaitkan dengan 'skuad' trio Datuk 'T'.

Kesimpulannya, Pembebasan bukan hanya sekadar kemenangan besar terhadap personaliti Anwar sahaja malah kepimpinan serta parti yang beliau wakili turut mendapat kemenangan saikologi.


Atau dalam lain perkataan, seluruh
rakyat akan percaya bahawa segala tindak tanduk selama ini adalah perancangan yang sengaja di atur oleh pemimpin-pemimpin Umno/BN untuk mengenakan Anwar.

Namun perencanaan tersebut ternyata membenarkan lagi tanggapan rakyat bahawa rentetan fitnah tersebut sengaja dilakukan oleh kerajaan pimpinan Najib.
Maka tokoh yang akan menjadi bahan telunjuk seluruh rakyat adalah Perdana Menteri, Datuk Seri Najib Razak.

Sebagai Perdana Menteri dan pemimpin tertinggi negara pula, penolakan rakyat terhadap beliau merupakan pantang larang yang amat mencarik adat seorang pemimpin.


Justeru, diatas fakta inilah juga mungkin Anwar membuat kenyataan bahawa beliau akan di penjara walau dalam apa situasi kebenaran pun.


Dilema Najib

Najib paling takut dilebel sebagai pemimpin terakhir dalam pemerintahan yang lebih 54 tahun diterajui Umno.

Ini bukan hanya akan memburukkan keturunan beliau malah selur
uh anggota parti akan menuding jari meletakkan kesalahan terhadap beliau sekiranya gagal meneruskan kesinambungan Umno selama ini.

Pengalaman Tun Abdullah Badawi ekoran prestasi buruk BN dalam Pilihan Raya Umum (PRU) 2008 lalu sehingga memaksa beliau melepas jawatan sebagai perdana menteri mungkin masih segar dalam ingatan Najib.

Justeru mengulangi kesilapan Abdullah tidak ubah seperti memasang jerangkap samar untuk mengorbankan diri sendiri.

Kalau Anwar dipenjara ...

Berdasarkan pandangan penganalisa politik dan peramal media dalam maupun luar negara, ramai menyatakan Anwar akan di penjara walau apa pun keadaannya.

Pandangan tersebut bukan berkhilaf kepada kekuatan yang akan membawa kemenangan Anwar memimpin jentera pilihanraya PR ketika menghadapi kempen pilihanraya Umum (PRU) sekiranya beliau bebas. Namun Mungkin juga Najib melihat melepasi persepsi tersebut.

Najib juga sedar sama ada Anwar di penjara atau tidak gerakan kebangkitan rakyat akan tetap berlaku. Kemenangan terbesar pembangkang dalam PRU ke-10 pada 1999 dimana PAS memenangi 32 kerusi parlimen dan DAP 10 kerusi semuanya berkisar kepada isu kebangkitan rakyat kerana simpati dengan Anwar yang dipenjara oleh Dr Mahathir.

Persoalannya apakah dengan sekali lagi membawa Anwar ke penjara akan mengujudkan memontum kebangkitan rakyat yang sama setelah pelbagai isu moral ditimpakan dikepala Anwar dengan pelbagai 'bukti' seperti kes Saiful dan gambar prono.

Apakah dengan menggunakan media-media milik Umno bagi memburukkan imej dan kredibiliti Anwar sudah memadai untuk rakyat mempercayainya lalu menolak Anwar dan PR dalam PRU ke-13 nanti?.

Apakah juga dengan isu liwat dan sex bersama pelacur yang disensaikan dengan penuh bergaya sebelum ini berjaya mempengaruhi rakyat untuk membenci Anwar serta PR yang diterajui beliau?.

Di atas hukum realiti, memenjarakan Anwar akan menambahkan lagi koleksi isu PR untuk kempen menjelang PRU nanti. Apakah dengan membawa kembali Anwar ke Sungai Buluh akan membolehkan isu NFC yang teruk membelenggu Najib dapat di alih kepada isu penganiayaan pada Anwar.

Di peringkat antarabangsa pula, Najib akan menerima pelbagai tekanan berhubung amalan demokrasi dibawah pimpinan beliau sekiranya ketua pembangkang itu dipenjarakan.

Pilihanraya dan sistem dua parti

Gesaan bekas Perdana Menteri Tun Dr Mahathir Mohamad sebelum ini supaya Najib mengadakan PRU pada saat akhir penggal (March 2013) bukan sekadar masej bagi mengelak negeri-negeri PR mengadakan pilihanraya berasingan.

Tetapi disebabkan Dr Mahathir mungkin telah berjaya menghidu sesuatu yang kurang enak berhubung pencapaian BN untuk memenangi PRU 13 nanti. Perlu di ingat Dr Mahathir adalah seorang yang sangat berpengalaman dalam menghadapi PRU setelah lebih 22 tahun memerintah negara.

Manakala bagi Najib pula, inilah kali pertama beliau akan berhadapan detik paling mencabar dalam kerjaya kepimpinan beliau sebagai pemimpin tertinggi negara. Apa pun zaman Dr Mahathir dan era Najib situasinya agak berbeza. Era Mahathir pembangkang terdiri dari pelbagai parti politik tetapi zaman Najib negara sedang bergerak ke arah sistem dua parti.

Sistem dua parti akan memberi peluang yang lebih besar kepada rakyat untuk menukar dan menggantikan kerajaan. Ini bermaksud sekiranya kerajaan semasa tidak berjaya membantu dan menolong rakyat, rakyat mampu menukarkannya pada pilihanraya akan datang. Ini disebabkan hanya ada dua parti sahaja yang bertanding, pembangkang dan kerajaan.

Faktor ini jugalah yang merungsingkan Najib dan Dr Mahathir. Mood rakyat untuk menukar kerajaan setelah Umno/BN memerintah lebih 54 tahun telah bergema sejak bermulanya era reformasi jalanan pada 1988. Sepuluh tahun kemudian, tsunami politik melanda negara. Enam negeri termasuk wilayah persekutuan jatuh ketangan pembangkang.

Survival BN

PRU ke-13 menyaksikan 70 peratus pengundi berdaftar adalah pengundi muda berusia 21 - 40 tahun. Kebanyakan mereka adalah generasi Media Baru yang majoritinya cenderung kepada pembangkang. Manakala selebihnya terdiri dari pengundi atas pagar yang tidak terpengaruh dengan sentimen perjuangan masa lampau serta pengaruh ras dan agama.


Secara langsung generasi ini adalah penentu kerajaan selepas PRU 13.

Kebimbangan besar Najib bukan sekadar untuk mempertahankan Putrajaya semata-mata malah beban yang akan ditanggung selepas kejatuhan Umno/BN selepas lebih 54 tahun menguasai negara lebih memeritkan.

Sebagai sebuah kerajaan baru, Pakatan Rakyat (PR) setentunya akan memastikan segala penyelewengan wang negara dibongkar untuk mengembalikan maruah negara. Secara tidak langsung segala kepincangan yang berlaku selama 54 tahun Umno/BN memerintah akan diketahui rakyat.

Media Baru

Entah apa anginnya, tiba-tiba pada tahun ini Najib membina facebook dan twitternya. Mungkin diatas sebab baru menyedari pengaruh media baru yang ternyata lebih berkesan dari media milik Umno.

Tapi semua sedia maklum, yang updatenya mungkin sekali sekala Najib tetapi selebihnya agen-agen APCO atau agen-agen penasihat media beliau yang dibayar berjuta-juta ringgit.

Perlu disedari juga BN mempunyai 26 saluran media termasuk radio dan media cetak. Ini tidak termasuk lapan saluran tv di seluruh negara. Apakah saluran media ini masih belum cukup untuk menyebarkan propoganda BN?.

Rakyat menolak media-media ini disebabkan terlalu banyak 'mengampu' dan 'over propoganda' sehingga rakyat jelek untuk menatap media-media kerajaan.

Dalam konteks media baru ini, Pembangkang memang jauh lebih 'advance' jika dibandingkan dengan keselesaan Najib dan BN sebelum ini.

Dengan pelbagai sekatan maklumat dan media yang dilakukan oleh BN kepada pembangkang selama ini telah menjadikan pembangkang lebih maju menggunakan media baru dalam berkomunikasi bagi menyebar maklumat kepada masyarakat awam.

Maka tidak hairanlah pelbagai usaha dilakukan oleh Kementerian Penerangan, komunikasi dan Kebudayaan untuk menyekat pelbagai saluran maklumat untuk disebar kepada rakyat. Ini tidak termasuk pelbagai akta seperti akta penerbitan dan mesin cetak yang semuanya berkisar kepada usaha membelenggu saluran maklumat sampai kepada rakyat.

Begitu juga baru-baru ini kerajaan mahu menubuhkan Majlis Perundiang Media bertujuan memantau bahan-bahan berita di internet.

Kedudukan Malaysia pula jatuh 10 anak tangga kepada 141 dalam Indeks Kebebasan Akhbar Dunia 2010 iaitu yang terendah dalam tempoh sembilan tahun dari senarai 178 negara.

Persoalannya apakah dengan memenjarakan Anwar akan menghalang rakyat dari mendapat maklumat berhubung pelbagai penyelewengan dan salah guna kuasa BN selama ini.

Mungkin juga Najib ada alasan dan jawapannya yang tersendiri bagi memastikan survival politik dan masa depan parti pimpinannya disaat rakyat sedang menolak Umno/BN dari terus menguasai negara. - Mat Zahari Ali
