"Kita dah pastikan mereka dihadapkan ke mahkamah. Itu sistem negara yang kita ada dan membawa mereka ke mahkamah dengan dakwaan yang setimpal dan kutuk sekerasnya tindakan sebegini sekiranya didapati salah.
Itu pendirian yang kita boleh lakukan," katanya dalam satu sidang akhbar selepas merasmikan Karnival Kerjaya Pemuda BN di Pusat Dagangan Dunia Putra (PWTC) hari ini.
Beliau berkata demikian ketika ditanya pemberita adakah beliau akan meletakkan jawatan bagi bertanggungjawab terhadap isu tersebut.
Semalam tiga anggota polis dihadapkan ke Mahkamah Sesyen Pulau Pinang atas dakwaan merogol dan melakukan persetubuhan luar tabii ke atas seorang wanita warga Indonesia.
Hishammuddin juga "mengelak" soalan berhubung cadangan penubuhan Suruhanjaya Bebas Salahlaku dan Aduan Polis (IPCMC) dengan mengatakan bahawa tiada formula yang boleh menyelesaikan semua masalah.
Sehubungan itu, Hishammuddin berkata, apa yang penting kini ialah memastikan mereka yang bersalah dibawa ke muka pengadilan dan dikenakan hukuman setimpal.
"Tak ada satu formula yang boleh selesaikan semua masalah . Dan saya tengok yang penting sekarang kita telus dan kita pastikan mereka yang salah dibawa ke muka pengadilan dan hukuman setimpal dikenakan pada mereka.
"Sebab kes sebegini tidak monopoli kepada pihak-pihak tertentu (seperti) polis atau agensi-agensi kerajaan sahaja," katanya.
Selain itu, ketika ditanya adakah penubuhan IPCMC tidak diperlukan, beliau berkata: "Setakat ini saya nak tengok apa yang berlaku di mahkamah dan akan ikuti kes ini secara dekat dan secara peribadi.
"Saya dah jumpa IGP (Ketua Polis Negara) dan DIGP (Timbalan Ketua Polis Negara) dan saya tak benarkan PDRM (Polis Diraja Malaysia) menyembunyikan perkara ini dari orang ramai dan sekiranya ada perkara yang perlu ditimbulkan, bawalah ke mahkamah supaya orang ramai tahu," katanya lagi.
IPCMC merupakan salah satu daripada 125 cadangan pembaikan pasukan polis yang dikemukakan Suruhanjaya Diraja Untuk Mempertingkatkan Operasi dan Pengurusan Polis Diraja Malaysia pada tahun 2005.
Suruhanjaya itu dipengerusikan mantan ketua hakim negara, Tun Mohamed Dzaidin yang mencadangkan IPCMC ditubuhkan sebelum 31 Mei 2007.
Bagaimanapun cadangan penubuhan suruhanjaya itu mendapat bantahan antaranya daripada mantan ketua polis negara, Tan Sri Musa Hassan yang mendakwa IPCMC tidak sepenuhnya adil kepada polis.-malaysiakini

Home minister won't resign over rape case...
Home Minister Hishammuddin Hussein said he would not resign over the alleged rape case in Penang involving three police officers.
"We have already ensured that they are brought to court. What else can we do? This is our country's system," he said during a press conference today.
He was asked to comment on calls for him take responsibility for the issue by tendering his resignation.
Hishammuddin (left) was also evasive when asked whether it is high time to set up the long overdue Independent Police Complaints and Misconduct Commission (IPCMC).
"IPCMC? There is no single formula that would solve all our problems.
"I think what is important now is that we are transparent in ensuring that those who are in the wrong are brought to face justice and given punishment that is proportionate to the crime.
"Such cases should not be the monopoly of certain parties, (whether) the police or government agencies," he said.
When asked if this means the IPCMC is not necessary, the home minister again ducked the question.
Instead, he said he was following the developments of the rape case "closely and personally" and has already instructed the police to bring any such cases to court, instead of attempting to hide it.
"If there is any matter that needs to be raised, bring it to court so that the public would know that such actions - if convicted - are despicable and unforgivable," he said.
Outrage in Indonesia
When asked whether he would brief Indonesia on the rape issue, Hishammuddin said such allegations are a challenge to bilateral relations and hopes that bringing the police officers to court would help ease tensions.
Yesterday, policemen, corporal Nik Sin Mat Lazim, constable Syahiran Romly and constable Remmy Anak Dana were charged at a Sessions Court with rape and forced oral sex of an Indonesian restaurant worker.
The alleged offences were committed on Nov 9 at a police station in Prai.
The incident stirred up outrage both at home as well as in Indonesia, where NGO Migrant Care has accused the Malaysian authorities of not being serious in handling the case.
The IPCMC was a key recommendation of a Royal Commission of Inquiry report in 2005, which also slammed the police force as being corrupt and abusive.
In January 2006, former prime minister Abdullah Ahmad Badawi announced that the IPCMC would be set up “soon”.
However the idea - one of 125 listedin the report - was shot down after strong objection from the very body the IPCMC aimed to monitor, the police, led by then inspector-general of police Mohd Bakri Omar.
As a result a watered-down Special Complaints Commission was implemented instead.
No decision yet to bar Scorpene lawyers
“However, I have asked for a detailed report and if there are objection, there should be strong reasons for it.
Separately,
Hishammuddin was also asked whether French lawyers William Bourdon and
Joseph Breham would be barred from entering Malaysia.
He said the Immigration Department and the police have yet to provide him with the latest update on the matter.

“Therefore I leave it to the relevant agencies and authorities, based
on existing precedents. I ask all parties that no matter what the
decision, don’t politicise this.”
The
two lawyers are due to arrive on Wednesday to brief lawmakers on the
Scorpene judicial inquiry in France on Opposition Leader Anwar Ibrahim’s invitation.

Jakarta NGO deplores M'sia's lack of sensitivity...
An Indonesian non-governmental organisation today condemned Malaysian authorities for lack of sensitivity in handling the rape case of an Indonesian restaurant worker allegedly by three police officers at the Prai police barracks.
Migrant Care, representing various female workers, in a statement deplored the court granting bail of RM25,000 each for the three police officers charged with rape and performing oral sex.
"The granting of bail shows the lack of seriousness by Malaysian authorities to act on crimes committed by persons who should have upheld the law.
"It also proves that the diplomatic Memorandum of Protest delivered by the Indonesian ambassador to Kuala Lumpur as well the protest note by the Indonesian Foreign Affairs Ministry do not have the desired effect," it said in the statement.
Recall Indonesian ambassador
Migrant Care called on the Indonesian government to embark on a more assertive role.
"This includes recalling its Indonesian ambassador to Malaysia and asking the Malaysian ambassador to Indonesia to leave the republic.
"Furthermore, it urges Indonesian president Susilo Bambang Yudhoyono to openly protest Prime Minister Najib Abdul Razak's handling of the rape cases against Indonesian migrant domestic workers at the upcoming Asean Summit," it said.
The three-day Asean Summit will be held in Cambodia beginning tomorrow and it will be attended by US President Barack Obama.
Yesterday, it was reported that the three accused Nik Sin Mat Lazim, 33, Syahiran Romly, 21, and Remmy Anak Dana, 25, were charged at the Butterworth Sessions Court with raping and had her perform unnatural sex.
They were charged under Section 376 and 377C of the Penal Code with each carrying a maximum 20 years' jail term and whipping if convicted.
It was also reported that DPPs Suhaimi Ibrahim and Nurashikin Mokhtar had objected to the request for bail.- malaysiakini
