Menurut beliau, perjanjian yang dimeterai adalah di antara Kerajaan Malaysia dan NFCorp dan sebarang tindakan undang-undang sivil seperti saman akan hanya melibatkan NFCorp.
Sedangkan katanya, penyelewengan dan pembelian aset mewah yang tidak ada kena mengena dengan projek fidlot kebangsaan banyak berlaku di dalam syarikat-syarikat yang dimiliki sepenuhnya oleh keluarga Datuk Seri Shahrizat Jalil, bukannya NFCorp.
Syarikat-syarikat tersebut katanya secara undang-undang tidak mempunyai apa-apa tanggungjawab atau obligasi kepada kerajaan atau pun perjanjian dana awam RM250 juta kerana ia hanya melibatkan NFCorp, maka ia tidak boleh disaman.
"NFCorp tidak mempunyai aset yang besar dan mengalami kerugian sejak ia beroperasi.
"Jika Kerajaan Persekutuan berjaya sekali pun di dalam tindakan saman sivilnya, NFCorp boleh sahaja diisytiharkan muflis tetapi tidak masih mampu membayar kembali RM250 juta yang dipinjam," tegasnya.
Ketua Audit Negara dalam Laporan Audit 2011 menyatakan beberapa langkah yang dipertimbangkan oleh Kerajaan Persekutuan terhadap NFC berikutan kegagalannya memenuhi syarat perjanjian yang ditandatangani dan prestasi projek yang tidak dicapai.
Salah satu langkah yang dipertimbangkan adalah mengambil tindakan undang-undang sivil terhadap NFC.
Oleh sebab itulah katanya, Kerajaan Persekutuan perlu mengenakan “jaminan peribadi” (personal guarantee) terhadap Shahrizat dan keluarganya agar semua harta mereka termasuk hartanah mewah yang dibeli melalui syarikat-syarikat milik keluarga mereka tetapi menggunakan dana dari NFCorp, boleh disita bagi mendapatkan kembali RM250 juta dana awam yang diselewengkan.
Pada masa yang sama, beliau turut mendesak Peguam Negara dan Bank Negara Malaysia mengambil tindakan di bawah Akta Anti Pengubahan Wang (Anti Money Laundering Act, AMLA) seperti yang pernah disyorkan sebelum ini, agar sebarang aset Shahrizat dan keluarganya boleh dibekukan dan disita.- harakahdaily
Rafizi: Suing NFC won't bring the money back...
The government is not likely to get its money back from the National Feedlot Corporation (NFC) even if it wins a legal suit against the latter, PKR director of strategy Rafizi Ramli said today.
This was because much of the NFC funds have been transferred to companies owned by its directors, who all come from one family, Rafizi said in a statement.
NFC
is not asset rich and can later declare itself bankrupt if unable to
return the loan to the govenrment, thereby leaving the government with
no recourse, he said. The government also has no say in the sister-companies, such as the National Meat and Livestock Company, which purchased luxury condominiums, since it only has a stake in NFC.
Instead, Rafizi said, the government should seek a personal guarantee from the NFC chairperson and directors, who are family-members of former minister Shahrizat Abdul Jalil.
'No seriousness in recouping loan'
"PKR had earlier on urged the government to impose a personal guarantee on Shahrizat and her family so that all their assets... can be seized to recoup the soft loan that was abused," Rafizi said.
This included the luxury real estate properties purchased through the family-owned companies, "using NFC funds".
Rafizi was commenting on the Auditor-General's Report 2011 which notes that the government is mulling civil action against the company and to take back the soft loan disboursed to it.
“Several
discussions have taken place between the Finance Ministry, Agriculture
and Agro-based Industry Ministry and the Attorney-General's Chambers
(AGC) to study the appropriate action that the government can take ..,”
the Auditor-General's Report 2011 reads. It also states that the direction of the National Feedlot Centre project is “still under review” by the Finance Ministry and AGC, but that no decision has yet been made.
The feedlot centre project had first been highlighted in the Auditor-General's Report 2010 as having fallen short of its targets.
He said that taking civil action also showed that the government was "not serious" about recouping the grant.
"(It) shows Prime Minister Najib Abdul Razak's attitude on the matter, that he is merely delaying taking action against NFC with the hope that the BN will win the next general election and the issue can be erased," he said.
The government gave NFC a soft loan of RM250 million to enable it to set up a feedlot centre, but only part of the loan has been disbursed.- malaysiakini
