Bekas menteri Datuk Zaid Ibrahim (gambar) hari ini berkata, lima orang ahli dalam SPRM bertanggungjawab dalam menutup fail tersebut mungkin mempunyai campurtangan secara langsung untuk melakukan sedemikian, menimbulkan persoalan sama ada terdapat percubaan melindungi jenayah tersebut melibatkan dua orang polis komando yang bakal menghadapi hukuman mati dan penyiasat persendirian itu hidup dalam buangan.
Peguam yang kemudiannya menjadi ahli politik itu dalam blognya hari ini mengatakan Peguam Negara dan SPRM menolak untuk menyiasat dakwaan penyiasat persendirian P Balasubramaniam, yang mendapat maklumat dari Abdul Razak Baginda yang telah didakwa telah bersama dengan peniaga permaidani Deepak Jaikishan.
Beliau berkata Balasubramaniam — yang dikenali sebagai PI Bala — membuat kenyataan bersumpah kedua dengan membatalkan akuan bersumpah pertama sehari sebelumnya, bahawa polis telah menekan saksi utama untuk melindungi pemimpin utama politik, termasuk perdana menteri Datuk Seri Najib Razak dalam skandal pembunuhan ini.
"Dalam akuan bersumpah kedua (yang) telah disediakan oleh peguam yang dikenali tetapi beliau (sendiri) tidak kenal. Deepak menamakan nama peguam ini dalam temuramah di Harakah.
"Jika siasatan ini diteliti lebih lanjut, kita akan dapat melihat bahawa peguam yang sama juga menjadi ahli panel operasi SPRM," kata Zaid yang merupakan menteri de-facto undang-undang ketika pentadbiran Tun Abdullah Ahmad Badawi.
Bagaimanapun, beliau tidak menamakan peguam tersebut.
"Panel inilah yang menentukan tidak ada bukti untuk menyiasat dakwaan yang dilakukan oleh Bala atau Deepak," kata Zaid.
Peguam Americk Singh Sidhu, yang mewakili penyiasat persendirian itu yang kini menyembunyikan diri, memberitahu The Malaysian Insider, ketika berhubung dengan Balasubramaniam, beliau tidak pernah mendedahkan identiti peguam kerana tidak menyedari pekerjaan individu terbabit. Bagaimanapun, beliau menyatakan identiti peguam tersebut boleh didapati di laman web SPRM, yangm menyenaraikan lapan orang sebagai ahli panel operasi semakan.

Dakwaan Zaid bermula dari kenyataan aktivis politik, Haris Ibrahim, yang semalam berkata beliau akan melobi Majlis Peguam untuk mendedahkan identiti peguam senior yang menurut beliau menulis akuan bersumpah kedua Balasubramaniam.
Haris, yang tidak lagi menjadi peguam, berkata beliau akan memfailkan permohonan kepada majlis tersebut, untuk mendedahkan peguam senior yang telah "kesalahan serius" dengan mereka-reka akuan bersumpah tanpa berbincang dengan Balasubramaniam.
"Terdapat banyak bukti untuk Majlis Peguam untuk menyiasat perkara ini, jika pandangan Majlis Peguam sama seperti saya dan peguam-peguam lain, mereka akan menyiasat dan menyelesaikan perkara ini," kata Haris yang dihubungi The Malaysian Insider.
Haris menjelaskan bahawa pada masa lalu, identiti peguam dibelakang akuan bersumpah kedua tersebut kekal "misteri", tetapi telah didedahkan oleh Deepak sendiri, ketika temurama bersama lidah rasmi PAS, Harakah.
Dalam temuramah tersebut, yang telah dirakamkan dan dimuatnaik oleh Harakah dalam ruangan TVPAS di Youtube, peniaga permaidani itu telah menyebut nama peguam tersebut dalam menerangkan penglibatan beliau dalam akuan bersumpah kedua Bala, tetapi pada minit 14:39 klip tersebut, nama itu telah dipadamkan.
"Adakah ramai orang mengenali identiti peguam ini? Deepak, PAS TV, dan pastinya editor-editor mereka. Kita mungkin boleh menyiasat dan mendedahkan individu ini," kata Haris lagi.
Dalam blog aktivis tersebut Jumaat lalu, Haris telah menerangkan niatnya kepada Majlis Peguam dan mengugut akan mendedahkan nama peguam terbabit jika permintaannya tidak ditunaikan selepas 14 hari.
Beliau berkata, beliau mengetahui identiti peguam yang bergelar "Tan Sri" dari tiga sumber bebas dan boleh dipercayai, dan tidak teragak-agak untuk mendedahkannya jika perlu.
Akuan bersumpah kedua Balasubramaniam dikeluarkan sehari selepas yang pertama pada 3 Julai, 2008, berkenaan dengan pembunuhan Altantuya pada tahun 2006, dimana dua orang polis komando elit telah didapati bersalah dan menghadapi hukuman mati.
Dalam sidang medianya yang kemudian, Balasubramaniam, ditemani oleh peguam M. Arulampalam telah menarik balik akuan bersumpah pertamanya, yang mengatakan beliau dipaksa untuk menandatanganinya.
Beliau kemudian membuat akuan bersumpah kedua, yang kemudiannya didakwa beliau pada 2009 dilakukan oleh peguam lain tanpa persetujuannya.

limelight in the latest expose by carpet trader Deepak Jaikishan on what
allegedly took place over former private-eye P Balasubramaniam's second
statutory declaration (SD) saga.
This was revealed in a series of explosive revelations by Deepak (left), who claimed to be personally involved in the "flipping" of PI Bala who had just signed an SD earlier linking Prime Minister Najib Abdul Razak with murdered Mongolian national Altantuya Shaariibuu.
The lawyer's name was supposedly mentioned by Deepak in a video interview with PAS organ Harakah which was posted on YouTube, with the name edited out.
In the interview, the businessperson had related how the senior lawyer had drafted and prepared the document along with the latter’s son, though only his son came to see the other parties involved at a hotel in Kuala Lumpur where the former PI was allegedly “kept”.
The senior lawyer was fingered, though not named, by human rights activist Harris Ibrahim on his blog post three days ago.
The latter has proceeded to lodge a report with the Malaysian Bar earlier today.
Harris, in his letter to the Bar, "formally put this matter before the Bar Council and to ask that an investigation be launched forthwith: to identify the solicitor(s) concerned; and ascertain if there was any impropriety in the preparation of SD2".
Bar Council president Lim Chee Wee is expected to issue an official statement tomorrow.
