Imam baling kasut dilontar ke dalam penjara...

Naib Presiden PKR, N Surendran menganggap hukuman setahun penjara yang dijatuhkan oleh Mahkamah Persekutuan bagi kesalahan menghina mahkamah ke atas imam yang membaling selipar itu, sebagai keterlaluan dan tidak sesuai.

Semalam, Mahkamah Persekutuan menjatuhkan hukuman penjara setahun ke atas Hoslan Hussin atas kesalahan menghina mahkamah berikutan tindakan imam itu melemparkan seliparnya ke arah panel hakim.

Dalam mempertahankan Hoslan  (kanan), Surendran berkata
dalam satu kenyataan bahawa Mahkamah Persekutuan tidak mengambilkira persekitaran yang timbul daripada kes itu dan telah gagal untuk mengimbangkan keadilan dengan belas kasihan.

Menurutnya, imam Hoslan tidak diwakili peguam dan sangat emosi ketika dia melakukan perbuatan tersebut.

Dia juga, tegas Surendran, adalah seorang bapa yang bergelut untuk membesarkan tujuh orang anaknya dan kesnya telah tertangguh sejak tahun 1999.

"Teguran keras atau denda sudah mencukupi dalam kes ini," katanya.

Menurut Surendran (bawah) yang merupakan seorang peguam, mahkamah perlu memelihara maruahnya dengan kekuatan autoriti moral, bukan dengan memenjarakan orang.

Beliau menggesa badan kehakiman melihat pada diri mereka ketika keyakinan orang ramai merosot kerana persepsi bahawa hakim-hakim tidak bebas dan telah gagal melindungi hak asasi rakyat Malaysia.

"Kekurangan keyakinan dan rasa hormat ini boleh membawa kepada berulangnya kejadian seperti kes membaling selipar," katanya.- malaysiakini

Jail term for shoe-throwing imam 'excessive'

PKR vice-president N Surendran(left) has lashed out at the Federal Court’s decision to sentence the shoe-throwing imam to one year’s jail for contempt of court, saying that the ruling is excessive and inappropriate.
On defending Hoslan Hussain (right), Surendran said in a statement that the Federal Court did not consider the circumstances surrounding the case and had failed to temper justice with mercy.

“Imam Hoslan was unrepresented and very emotional when he committed the unfortunate act. He is also a struggling father with seven children, whose case had been delayed since 1999.

“A stern reprimand or fine would have been adequate in this case,” he added.

Hoslan had flung his shoes at the three-man bench led by Chief Judge of Malaya Zulkefli Ahmad Makinudi last month after the court rejected his application to hear his appeal over an eviction case.

The same panel which heard the case yesterday ruled that Hoslan must be punished to protect the dignity of the court.

Lack of public confidence

According to Surendran, a practising lawyer, the court should guard its dignity by the strength of its moral authority, not by imprisoning people. He urged the judiciary to take a hard look at itself as public confidence has shrunk due to the perception that judges are not independent and have failed to safeguard the basic rights of Malaysians.

“This lack of confidence and respect can lead to a recurrence of incidents like the shoe-throwing case,” he said.

Meanwhile, PAS Youth said they would assist Hoslan’s family when the latter serves his jail term.

PAS publicity chief  Riduan Mohd Nor said Hoslan’s shoe-throwing action was a manifestation of anger against the judiciary for its failure to defend the rights of common citizens.

“This serves as a reminder to all quarters to not despise the grassroots,” he said.- malaysiakini

AngryBird - There are people who ordered C4ing other people's daughter, rapists, cheats, swindlers, liars and yet no action is taken against them simply because the judges rice bowl depends on these people.It is horrifying to find a poor Imam who threw shoes at judges due to frustration on the way justice is dispensed to poor people and politically unconnected people, jailed for a year. I think Malaysian judges have lost their sense of direction.

The court and AG should not punish a person under the circumstances that there are crooks who have stolen the likes of RM 250 million and are still free and on the prowl.... this is totally utter rubbish. the poor man has 6 children to feed and he has earlier quoated corruption and the puppeteers are stupid and greedy with avarice. the rakyat will help this man. third finger to you duds...

YF - Where is Hasan Ali and Ibrahim Ali? Here we have the uncivilised civil court punishing a member of the ummah who is standing up for Islamic justice and fairness? Suddenly Hasan Ali and Ibrahim Ali no longer defend nor champion the cause of Islam but rather the cause of the corrupt UMNO instead. These two hypocrites should stop preaching their hypocrisy when we DO NOT see these hypocrites but instead see non-Malays fighting for this poor imam's cause and the suffering he and his family now have to go through under the tyranny of UMNO. 

Dark Knight - To protect the eminence and dignity of the courts? While the Federal Court expects the imam to behave as Islam expects him to, the whole nation is praying that the judiciary will dispense justice as judges have sworn to, irrespective of the government of the day. But these judges, whether at the High Court, the Court of Appeal or the Federal Court, are kangaroo judges. Malaysians have lost confidence in them. Citizens, complainants and litigants are so frustrated that slippers and sandals thrown at judges not only reflect the sense of injustice, it is a verdict about BN's mismanagement of the economy and the destruction of the pillars of democracy and its institutions.

eawan - What do you expect from the Malaysian judges...they're only to punished they oppositions, the weak and the poor...the rich and powerful get the freedom even killing innocent people is acceptable......

Sabahan - I am sure the rakyat will be most willing to help the family of this courageous man, while he serves his jail sentence. If Malaysiakini can publish his wife's bank account number, many will be happy to contribute. I will.

 Swipenter - Maybe his wife has a bank account. Someone can get in touch with her and let her know that many ordinary Malaysians are behind her husband and would like to help the family out in their hour of need.We must stand together united as Malaysians to fight for social justice and what is right for our country and society.
