Police want NFCorp directors charged with CBT...

Police have asked the Attorney-General’s Chambers to charge National Feedlot Corporation (NFCorp) directors with criminal breach of trust after opposition politicians claimed a part of the government’s RM250 million soft loan was used for other purposes. 

CCID Director Datuk Syed Ismail Syed Azizan confirmed the matter with several media organisations this evening.

“We are recommending to the Attorney-General’s Chambers that all NFCorp directors be charged (for CBT),” he told The Malaysian Insider.

NFCorp, which operates the national cattle-farming project, is chaired by federal minister Datuk Seri Shahrizat Abdul Jalil’s husband, Datuk Seri Mohamad Salleh Ismail. Their three children also hold executive posts in the company.

The NFC hit the headlines after it made it into the Auditor-General’s Report last year, and has continued to hog the limelight after it was linked to Shahrizat and her family.

Shahrizat maintains that she has no links to the family-run project.

Since then, PKR has revealed numerous startling exposes over the scandal-ridden project, including allegations that millions of ringgit have been siphoned off for land, property and personal expenses unrelated to cattle farming. 

But recently, in response to claims that NFCorp had purchased two luxury condominiums worth RM34 million in Singapore’s posh Marina Bay Suites, Shahrizat’s son Wan Shahinur Izmir had explained that the company had decided that it would make better use of the money by investing in property during a break in business operations.

The break, said Wan Shahinur Izmir, was caused by the government’s decision to suspend the construction of an abattoir that would have been rented to NFCorp.

According to the DAP’s Tony Pua, however, the Finance Ministry had told a parliamentary committee last November that there was no provision that permits the NFCorp to use its federal loan to purchase property.

Earlier today, Pua revealed the NFCorp’s loan agreement, which he claimed proved that the company had violated conditions attached to the RM250 million facility.

Since the scandal exploded in the media, Shahrizat has been faced with repeated calls for her resignation, even from her colleagues in Umno. But she has insisted that the project had nothing to do with her.

The Wanita Umno chief applied for three weeks’ leave from her ministerial duties last month when new allegations of bribery surfaced. She has since resumed her duties.

Deputy Prime Minister Tan Sri Muhyiddin Yassin announced last month Putrajaya would appoint an auditor to scrutinise NFCorp’s books in light of accusations made against the company, but dismissed calls for a royal commission of inquiry into the NFC.- malaysian insider

Polis mahukan pengarah NFCorp didakwa atas kesalahan pecah amanah

Polis telah memohon kepada Peguam Negara supaya pengarah Pusat Fidlot Corporation (NFCorp) didakwa atas kesalahan pecah amanah selepas pemimpin pembangkang mendakwa sebahagian daripada RM250 juta pinjaman mudah kerajaan telah digunakan untuk tujuan lain.

Ketua Pengarah Jabatan Siasatan Jenayah Komersial (JSJK) Bukit Aman Datuk Syed Ismail Syed Azizan mengesahkan perkara itu petang tadi kepada beberapa organisasi media.

"Kami mencadangkan Pejabat Peguam Negara supaya semua pengarah NFCorp didakwa atas kesalahan pecah amanah," katanya kepada The Malaysian Insider.

NFCorp, yang dimiliki oleh suami dan tiga anak Datuk Seri Shahrizat Abd Jalil, merupakan syarikat yang bertanggungjawab menguruskan skandal Pusat Fidlot Nasional (NFC).

NFC mula menjadi topik hangat setelah syarikat itu tersenarai dalam Laporan Tahunan Ketua Audit Negara 2010. Shahrizat tetap menegaskan dirinya tidak mempunyai sebarang kaitan dengan projek berkenaan.

Sejak itu, PKR mula membuat pendedahan berterusan terhadap skandal NFC, termasuk tuduhan penyalahgunaan dana kerajaan jutaan ringgit untuk pembelian tanah, hartanah, dan perbelanjaan tidak berkaitan dengan projek ternakan lembu tersebut.

Namun demikian, baru-baru ini berhubung dakwaan pembelian dua unit kondominium bernilai RM34 juta di Singapura, di kawasan Marina Bay Suites, anak Shahrizat, Wan Shahinur Izmir menjelaskan syarikat berkenaan telah membuat keputusan untuk menggunakan wang tersebut dalam pelaburan hartanah ketika berehat daripada aktiviti perniagaan.

Penangguhan berkenaan jelas  Wan Shahinur Izmir, adalah disebabkan siasatan yang dijalankan kerajaan ke atas NFCorp.

Menurut Tony Pua, Kementerian Kewangan ketika sidang Parlimen lepas menjelaskan tiada peruntukan dalam perjanjian pinjaman itu yang membolehkan NFCorp membeli hartanah.

Awal hari ini, Pua mendedahkan perjanjian pinjaman tersebut, yang mana dakwanya membuktikan syarikat itu telah melanggar syarat perjanjian bernilai RM250 juta.

Sejak pendedahan tersebut dibuat, Shahrizat telah berhadapan dengan tuntutan meletak jawatan termasuk daripada barisan kepimpinan Umno sendiri. Namun beliau enggan melakukan tindakan sedemikian sebaliknya tetap bertegas projek itu tiada kaitan dengan dirinya.

Ketua Wanita Umno itu turut membuat permohonan cuti selama tiga minggu daripada perdana menteri apabila tuduhan rasuah dibongkar. Beliau telah menyambung semula tugasnya sebagai menteri.

Timbalan Perdana Menteri Tan Sri Muhyiddin Yassin mengumumkan Putrajaya akan melantik juru audit bebas bagi menyemak dokumen kewangan NFCorp, namun enggan mewujudkan Suruhanjaya Diraja bagi menyiasat NFC. - malaysian insider

NFC broke terms of loan agreement...

Petaling Jaya MP Tony Pua today revealed that the contents of the much-sought loan agreement between National Feedlot Corporation (NFC) and the government, affirming the perception that it was lopsided and the purchase of luxurious properties breached the agreement.

The 35-page document clearly states that the purpose of the government soft loan at two percent annual interest is solely for the National Feedlot Center project.
 
"The Borrower shall use the Loan Facility to part finance the Project as described in the First Schedule of this Agreement," read Clause three of the document under the topic ‘Purpose'.

Hence the earlier statements made by NFC directors that the loan can be used for property investment, said Pua, were "complete rubbish".

"The fund can only and strictly used to part finance and set up the center, nothing else," he said.

Clause 18.1 of the agreement under the topic "Particular Covenants", it was again stated that as long as the loan is still not repaid, NFC shall use the loan for the purpose of the project.

During the press conference at the DAP's Kuala Lumpur national headquarters today, Pua distributed copies of the agreement to reporters which he described as "one of the worst loan agreements I have ever seen".

He claimed that the document is genuine and provided by an unnamed source.

MOF took no action

According to Pua, the parliamentary Public Accounts Committee where he is a member, is supposed to disclose the agreement at the next meeting but its chairperson Azmi Khalid has yet to call for one after the last held in November last year.

Although the agreement contains provisions for the government to monitor NFC's operations, it was not fully utilised by both the Agriculture and Agro-Based Industry Ministry (MOA) and the Finance Ministry (MOF), claimed Pua.

The agreement requires the NFC to submit a project progress report before it can withdraw funds from the special loan account.

The report has to be certified by an authorised technical committee comprising four representatives, one each from the MOA, the veterinary department, Universiti Putra Malaysia (UPM) and Universiti Kebangsaan Malaysia (UKM).

However, Pua noted that despite the Auditor-General's Report revealing that the project had failed to meet its target, NFC continued to draw from the loan.
 
"The Agriculture Ministry is equally culpable for the mess," he said.

At the same time, the MOF took no action although NFC is required to provide monthly bank statements of the special loan account to the ministry on a quarterly basis, detailing how the loan was used, Pua noted.

"Unless NFC submitted false reports... We don't know if they submitted false reports. The MOF has to verify the reports," said Pua, adding that MOF officials had told the PAC that no NFC report mentions the purchase of condominiums.- malaysiakini

NFC has defaulted on soft loan

The agreement between National Feedlot Corporation (NFC) and the government reveals that the company has defaulted on its RM250 million government soft loan for year, claimed Petaling Jaya MP Tony Pua.

According to the much-sought agreement leaked to Pua (right) by an unnamed source, NFC enjoys a three-year installment and interest-free grace period from the day it obtains the first drawdown.

Earlier on, NFC had said that the first drawdown of RM7 million was in January 2008.

Hence the repayment should begin as early as January 2011 when the three-year grace period ended, Pua pointed out.

"We are now in February 2012. Our understanding is that they have not paid a single sen. They are long beyond the grace period," he said.
 
However, NFC claimed that it will start servicing its loan repayment beginning this year as stipulated in its loan agreement.

The DAP national publicity secretary then took to task the Finance Ministry (MOF) for not doing anything to recover its loan and freeze the project as NFC had clearly defaulted on the loan.
 

No penalty

On the penalty stated in the agreement in the event of a default, he flashed a wry smile and pointed out that Clause 11 of the document states that NFC only needs to pay default interest on the outstanding loan at a non-compounding flat rate of two percent annual interest.This is the same interest rate as for the whole loan.

"This is one of the worst loan agreements I have ever seen,"  he said Pua, who was a CEO and founder of a Malaysian IT company listed in Singapore before venturing into politics.

The agreement was signed by NFC chairperson Mohamad Salleh Ismail and his son Wan Shahinur Izran who is also NFC director, and two senior MOF officials representing the government, on Dec 6, 2007.

Salleh is the husband of Women, Family and Community Development Minister Shahrizat Abdul Jalil who has been under tremendous pressure to resign from cabinet after the scandal exploded.- malaysiakini.

Tony Pua hari ini mendedahkan bukti yang didakwanya perjanjian pinjaman yang ditandatangani oleh Pusat Fidlot Nasional (NFC), yang mana menurutnya bukti syarikat berkenaan telah melanggar syarat pinjaman berjumlah RM250 juta bagi fasiliti tersebut.

Ketua Publisit DAP itu menjelaskan Perkara 3 perjanjian itu dengan jelas menyatakan dana kerajaan itu mesti digunakan bagi “ membiayai projek tersebut seperti yang dinyatakan dalam Jadual Pertama perjanjian ini.”

Perjanjian Pertama itu menyatakan pinjaman berkenaan harus “konsisten dengan polisi kerajaan Malaysia membangunkan, memperkenalkan, dan mengusahakan pengeluaran  lembu dan produk lembu melalui Pusat Fidlot Nasional menjadi pusat untuk aktiviti komersial dan bersepadu ternakan lembu fidlot.”

“Itu tidak diragukan lagi. Penggunaan duit tersebut hanya di benarkan untuk membiayai pembangunan pusat berkenaan dan bukannya untuk tujuan lain,” katanya (gambar) di ibu pejabat DAP hari ini.

“Ini bermakna, setiap dakwaan yang dibuat eksekutif dan pengarah NFCorp bahawa mereka boleh menggunakan dana itu untuk apa sahaja adalah mengarut.”

Tambah Pua, perkara itu dikuatkuasakan oleh Perkara 18.1 (b), yang menyatakan mana-mana keadaan selagi mana hutang tersebut masih wujud, NFCorp harus menggunakan duit yang dipinjam itu “untuk kegunaan yang dinyatakan dalam Perkara 3 perjanjian ini.”

Pua turut akan menanyakan perkara itu kepada Kementerian Pertanian dan Industri Asa Tani kerana membenarkan NFCorp mencatatkan di akaun pinjaman khas itu, mencatat yang permintaan-permintaan sedemikian perlu diiringi oleh satu laporan kemajuan daripada syarikat itu.

Laporan perkembangan itu harus ditandatangani oleh jawatankuasa teknikal yang berkelayakan dan dipengerusikan oleh pegawai daripada kementerian, berdasarkan perjanjian tersebut.

“Mereka perlu menandatangani laporan kemajuan itu. Jadi, penyusutan telah berlaku walaupun NFC gagal memenuhi sasaran ... (menunjukkan) kementerian pertanian turut sama bertanggungjawab terhadap kecelaruan ini,” katanya.

NFCorp harus mengemukakan kenyataan bulanan daripada bank kepada Kementerian Kewangan setiap suku tahun menjelaskan bagaiman dana itu digunakan, kata Pua dan mempersoalkan kementerian membenarkan pinjaman itu diteruskan.

“Kecuali NFCorp menghantar laporan palsu. Mungkin itu akan diklasifikasikan sebagai jenayah, kita tidak tahu sama ada mereka menyerahkan laporan palsu ketika itu.

“Kementerian Kewangan perlu membuat penjelasan maklumat laporan tersebut,” katanya menambah, pegawai rasmi kementerian yang diberi taklimat oleh Jawatankuasa Kira-Kira Wang Negara (PAC) berhubung NFC menyatakan tidak disebut berkenaan pembelian hartanah dibuat dalam laporan berkenaan.

Ahli Parlimen Petaling Jaya Utara itu turut mempersoal kementerian kerana tidak membekukan akaun kerana Perkara 4 menjelaskan pembayaran balik harus dibuat tiga tahun kemudian selepas bermula sekitar 2008.

“Kita sekarang berada dalam bulan Febuari 2012. Menurut pemahaman saya mereka belum membuat pembayaran walau sesen pun. Kita sudah lebih daripada tiga tahun,” katanya.

“Kenapa mereka tak bayar? Kenapa Kemeterian Kewangan tidak mengambil tindakan terhadap pembayaran lewat? Dan kenapa pinjaman tersebut tidak dibekukan atau dipindah akaun?”

Projek yang dibiayai kerajaan ini menjadi topik perbualan selepas ianya diletakkan di dalam Laporan Tahunan Ketua Audit Negara 2010 dan dikaitkan dengan keluarga Datuk Seri Shahrizat Jalil.

PKR telah membuat beberapa siri pendedahan dengan mendakwa berlakunya penyalahgunaan dana kerajaan termasuksejumlah RM62 juta digunakan untuk tanah, hartanah dan perbelanjaan tidak berkaitan NFC.

Anak Shahrizat dan eksekutif NFCorp, Wan Shahinur Izmir Salleh, bertegas menyatakan syarikat berkenaan telah menggunakan dana dengan lebih baik dengan melabur dalam hartanah ketika menghentikan operasi perniagaan selepas Putrajaya mengambil keputusan menggantung pembinaan pusat penyembelihan yang disewakan kepada syarikat.

Timbalan Perdana Menteri Tan Sri Muhyiddin Yassin bulan lalu mengumumkan Putrajaya akan melantik badan audit khas bagi menyemak buku laporan NFCorp bagi mengenalpasti sekiranya terdapat pertuduhan terhadap syarikat kesa, tetapi menentang cadangan suruhanjaya diraja bagi menangani masalah itu. - malaysian insider
