Aktivis 'Occupy' menang saman ke atas gomen...

Polis dan Dewan Bandaraya Kuala Lumpur (DBKL) diperintahkan membayar gantirugi kepada aktivis Occupy Dataran, Fahmi Reza kerana ditahan secara tidak sah pada tahun 2012.

"Kita menang. Akhirnya kita menang," tulis Fahmi di akaun Facebook miliknya.

Fahmi turut menyiarkan sepucuk surat dari Peguam Kanan Persekutuan, Habibah Nordin yang memaklumkan bahawa pihak DBKL dan polis dikehendaki membayar pampasan melebihi RM30,000 kepada Fahmi.




Fahmi ditahan pada 22 April 2012 sewaktu pihak DBKL cuba mengosongkan Dataran Merdeka daripada aktivis Occupy Dataran yang berkampung di situ.

Mereka berkampung di situ susulan daripada demonstrasi pada 14 April 2012 bagi menuntut pemansuhan Perbadanan Tabung Pendidikan Tinggi Negara (PTPTN) dan pendidikan percuma.- mk

The legal saga of activist Mohd Fahmi Reza Mohd Zarin charged over the student occupation of Dataran Merdeka in 2012 has finally come to a happy end.

"We have won. In the end, we have won," said Fahmi on his Facebook today.

Writing from abroad, he said his lawyers have informed him that the court has ruled in his favour and ordered KL City Hall (DBKL) and the police to compensate and pay costs for his wrongful detention.

He was detained on April 22, 2012 by DBKL officers who had tried to clear the iconic square in the heart of Kuala Lumpur of students who had decided to camp there in protest.

The Occupy Dataran camp-in recipitated after a rally on April 14 where some 500 university students marched through the city from Masjid Jamek LRT station, through Jalan Raja Laut to Dataran Merdeka demanding the abolition of the National Higher Education Fund (PTPTN).

Fahmi said six months after the legal proceedings on his arrest that began last July 18 he finally had the verdict.

He said he has only just arrived in New York today, when his lawyer Syahredzan Johan informed him of the KL High Court decision by justice Hue Siew Kheng.



'I chose to fight'

According to Fahmi, the court has ordered DBKL and the police to pay him compensation of RM5,000 and RM3,000 respectively and exemplary damages of RM20,000 (by DBKL) and RM10,000 (by the police) respectively.

The court has also ordered the two parties to pay costs of RM20,000 (by DBKL) and RM10,000 (by the police) respectively to Fahmi.

However, the activist said the compensation was not the focal point.

"This case is not about the money. This case is about the importance for us to rise and speak out when there is injustice.

"For us to rise up and fight when we are suppressed by the authorities, and dare to fight to defend our freedom and our rights," he said.

However, he said one would not read about his case in the newspapers, "Because I am only an ordinary person like you," he quipped.

"This time I chose not to remain silent. I chose to fight," he added.- mk

Zahid cemar reputasi kami dengan surat sokong tauke judi, kata polis...

Anggota Polis Diraja Malaysia (PDRM) yang sebelum ini tidak percaya, kini naik marah, kerana merasakan reputasi pasukan itu tercalar oleh Menteri Dalam Negeri Datuk Seri Ahmad Zahid Hamidi yang mengutus surat kepada Biro Penyiasatan Persekutuan (FBI) membersihkan nama seorang ketua judi yang menghadapi dakwaan melanggar undang-undang pertaruhan di Amerika Syarikat.

Mereka kecewa kerana surat Zahid bercanggah dengan kerja perisikan terhadap Paul Phua Wei Seng, yang menurut polis terlibat dalam aktiviti kongsi gelap dan kini menghadapi dakwaan pertaruhan sukan haram di Las Vegas, Nevada, selepas ditangkap ketika Piala Dunia FIFA 2014.

Zahid juga gagal mengikuti prosedur dengan bertindak sendirian dalam mengutus surat itu kepada FBI, dan juga tidak memeriksa fakta mengenai Phua sebelum menghantarnya.

Seorang pegawai kanan polis memberitahu The Malaysian Insider, sebagai Menteri Dalam Negeri, Zahid sepatutnya mendapatkan nasihat undang-undang sebelum menulis surat itu.

"Apabila isu itu pertama kali dihebohkan, ada pihak yang pada mulanya tidak percaya Zahid bertindak mengetepikan laporan rasmi dari PDRM," kata pegawai itu.

"Kemudian, ketika isu itu semakin berkembang dan peguam Umno Tan Sri Muhammad Shafee Abdullah membuat sidang akhbar, rasa tidak percaya itu bertukar menjadi ketawa dan akhirnya marah.

"Kredibiliti pasukan polis hancur lumat kerana orang ramai mula mempersoalkan kenyataan bercanggah yang datang dari Malaysia berhubung kes Phua," kata seorang pegawai berpangkat tinggi.

Salinan surat dan rencana mengenainya mula-mula diterbitkan dalam South China Morning Post.

Dalam surat itu, Zahid bukan sahaja membersihkan nama Phua, tetapi juga berkata beliau terlibat membantu kerajaan dalam projek-projek keselamatan negara. Zahid teruk dikutuk  banyak pihak kerana bertindak secara unilateral dan menyalahgunakan jawatannya.

Isu itu menjadi cukup serius hingga Putrajaya mengarahkan peguam Phua menarik balik surat Zahid dari Mahkamah Daerah Nevada di mana sebelum itu ia dikemukakan sebagai sebahagian pertahanan Phua.



The Malaysian Insider juga difahamkan Perdana Menteri Datuk Seri Najib Razak sudah berjumpa Zahid, Ketua Polis Negara Tan Sri Khalid Abu Bakar dan Peguam Negara Tan Sri Gani Patail berhubung perkara itu.

Bagaimanapun, pegawai polis kanan itu hanya boleh mengesahkan pertemuan antara Najib dan Khalid, tetapi tidak tahu apa yang sebenarnya berlaku.

"Terdapat prosedur yang sepatutnya diikuti seperti dinyatakan dengan jelas dalam Akta Bantuan Bersama Dalam Perkara Jenayah 2002 (MACMA)," katanya kepada The Malaysian Insider.

Pegawai itu berkata tiada prosedur yang membolehkan Zahid menulis terus kepada FBI dan membuatkan suratnya serta-merta diterima di mahkamah.

Tambahan pula, kata pegawai itu, Zahid menulis atas sifatnya sebagai menteri dalam negeri, bukan sebagai seorang individu.

"Terdapat prosedur yang perlu diikuti dalam kes seperti itu kerana mahkamah di luar negara tidak akan sewenang-wenangnya membenarkan surat itu menjadi sah diterima.

"Tambahan pula, terdapat anggota polis yang mendapati keseluruhan saga itu satu sandiwara kerana Zahid tidak berunding dengan pihak polis sebelum menulis surat itu.

"Reputasi pasukan polis hancur berkecai kerana tindakan Zahid jelas bertentangan dengan laporan polis yang dikemukakan kepada FBI pada 2008."

Dakwaan yang Phua ialah ahli sebuah kongsi gelap Hong Kong bernama 14K dibuat berdasarkan dokumen dalaman FBI yang sebelum ini dikemukakan kepada mahkamah, kata polis. – tmi

Zahid tarnished our reputation, cops say over letter on gambling kingpin...

Disbelief has turned to anger among members of the Royal Malaysian Police (RMP) who feel the force's reputation has been tarnished by Home Minister Datuk Seri Ahmad Zahid Hamidi with his letter to the Federal Bureau of Investigation (FBI) vouching for a Malaysian gambling kingpin charged with illegal betting in the US.

Police are upset that Zahid's letter contradicted intelligence work on Paul Phua Wei Seng, whom police have found to be involved in triad activity, and who is now facing illegal sports betting charges in Las Vegas, Nevada, after being arrested during the FIFA World Cup 2014.

Zahid had also failed to follow procedure in issuing the letter to the FBI unilaterally, as well as not checking facts on Phua before sending it, they said.

A senior police officer told The Malaysian Insider that as the home minister, Zahid should have sought legal advice before penning the letter.

"When the issue first broke, there was initially disbelief in the police force that an official report from the RMP had been dismissed by Zahid," the officer said.

"Later, as the issue expanded and Umno lawyer Tan Sri Muhammad Shafee Abdullah gave a press conference, the disbelief turned to laughter and then anger.

"Whatever credibility the police force have is being torn to shreds as the public is questioning the contradicting statements coming from Malaysia over Phua," the high-ranking officer said.

A copy of the letter and an article on it was first published by the South China Morning Post.

In the letter, Zahid had not only cleared Phua but said he had helped the government in national security projects. Zahid had been severely condemned by many quarters for acting unilaterally and for abusing his office.

The issue became serious enough that Putrajaya ordered Phua's lawyers to retract Zahid's letter from the Nevada District Court where it was tendered as part of Phua's defence.

The Malaysian Insider has also learnt that Prime Minister Datuk Seri Najib Razak had met with Zahid, Inspector-General of Police Tan Sri Khalid Abu Bakar and Attorney-General Tan Sri Abdul Gani Patail over the matter.

However, the senior police officer could only confirm that a meeting between Najib and Khalid had taken place, adding that he did not know what transpired.

"There is a proper procedure to be followed which is clearly stated in the Mutual Assistance in Criminal Matters Act 2002 (Macma)," he told The Malaysian Insider.

The officer said there was no such procedure for Zahid to write directly to the FBI and for his letter to be immediately admissible in court.

Furthermore, the officer said, Zahid was writing in his capacity as the Home Minister, not as an individual.

"There are proper procedures which should be followed in such cases as courts abroad will not just permit such letters to be legally admissible.

"Furthermore, there are police personnel who find the entire saga to be a farce as Zahid had not consulted the police before writing the letter.

"The reputation of the police force is in tatters as Zahid is apparently contradicting a police report which had been submitted to the FBI in 2008."

The allegation that Phua was a member of the Hong Kong 14K triad was based on an FBI internal document previously submitted to the court, according to the police.

Malaysian police are reported to have informed the FBI’s representative in Kuala Lumpur of Phua's ties with the criminal organisation.

“The RMP has identified the 14K Triad as a local, organised crime syndicate involved in illegal drugs, illegal gambling and money laundering activities in Malaysia,” the internal FBI document, dated July 17, 2008, read.

However, Zahid had refuted these allegations in his letter when he said Phua was neither a member of the triad, nor was he associated with it in Malaysia, nor did the triad exist in Malaysia.

Indirectly, Khalid had appeared to be defending police findings concerning Phua.

While he said that the 14K triad did not exist in Malaysia, he told news portal Malaysiakini that "there are Malaysians abroad who are known to be members of the triad."

"How people wish to interpret this statement (above) is up to them,” Khalid had said, according to Malaysiakini. – tmi
