ADUN Sekinchan, Ng Suee Lim hari ini menunjukkan satu salinan akuan sumpah bertarikh 11 Januari 2011 dan satu dokumen permohonan kaveat bertarikh sama ke atas tanah yang disewa syarikat itu daripada Noh Omar.
"Saya ada dokumen Syarikat Pristine Agrofood yang dalam akuan sumpahnya menyatakan syarikatnya ada usaha sama dengan Noh bin Omar.
"Surat kaveat yang saya ada, syarikat ini (juga) bersetuju mengusahakan tanah itu bersama Noh Omar.
"Ini (adalah) usaha sama. Beliau tak nafikan akuan sumpah ini," kata Ng selepas mengetuai satu demonstrasi di hadapan tapak projek tersebut pagi ini.
Menurut Ng, kaveat berkenaan bertujuan untuk menghalang Noh daripada menjual tanah berkenaan selama perjanjian itu berkuatkuasa.
Ng mendakwa surat akuan sumpah yang menyebut "syarikat telah bersetuju mengusahakan hartanah bersama dengan Noh bin Omar...." membuktikan Noh Omar terlibat dalam projek itu lebih daripada sebagai pemilik tanah yang menyewakan tanahnya.
"Syarikat tersebut telah bersetuju mengusahakan hartanah bersama dengan Noh bin Omar [nombor kad pengenalan dan alamat disertakan] dengan jaminan harga sekurang-kurangnya RM25,200 sahaja setahun. Sesalinan perjanjian usahasama bertarikh 5 Januari 2011 dilampirkan di sini," surat itu dipetik.
Katanya, "usahasama" yang disebut dalam dokumen itu menimbulkan "keraguan yang munasabah" dan definisi istilah itu juga sangat luas.
"Jadi kita mahu pihak berkuasa siasat. Sama ada (Perdana Menteri, Datuk Seri) Najib (Razak), polis atau SPRM (Suruhanjaya Pencegahan Rasuah Malaysia)," katanya.
Beliau memberi contoh, seorang menteri perumahan boleh membeli rumah tetapi menteri berkenaan tidak boleh terlibat dalam mana-mana syarikat perumahan.
Justeru, prinsip yang sama katanya diguna pakai dalam kes projek udang yang membabitkan Noh Omar.
"Noh Omar boleh makan udang termasuk otak udangnya tetapi dia tak boleh ternak udang. Ini salah guna kuasa.
"Orang yg kononnya nak jadi menteri besar Selangor ini wajib tampil ke depan dan jawab (dakwaan ini)," kata Ng lagi.
Pengarah syarikat Pristine Agrofood, Chu Bak Teck ketika dihubungi hari ini menegaskan sekali lagi bahawa Noh Omar hanyalah tuan tanah dan tidak terlibat dalam operasi kolam udang itu.
Lindungi kepentingan
Chu juga mengakui bahawa beliau menggunakan istilah "usahasama" dalam surat tersebut, namun beliau menjelaskan bahawa tindakan itu hanyalah untuk melindungi kepentingan syarikatnya.
Menurut Ng, kaveat berkenaan bertujuan untuk menghalang Noh daripada menjual tanah berkenaan selama perjanjian itu berkuatkuasa.
"Perjanjian
itu sebenarnya satu perjanjian penyewaan, tapi kita tulis seperti satu
perjanjian usahasama. Ini untuk melindungi kedua-dua pihak.
"Kita mahu ikat Noh Omar (kiri), supaya dia tidak jual tanah ini dan menyebabkan kerugian kepada kita," katanya kepada Malaysiakini.
Noh pula pada 14 Julai lalu dilaporkan mengakui mempunyai pegangan dalam satu perniagaan penternakan udang di Tanjong Karang, dan menegaskan tidak ada salahnya berbuat demikian.
Akhbar Sin Chew Daily pada hari itu melaporkan, Noh mendakwa masih belum dilantik sebagai menteri ketika tanah seluas 30 ekar di Bagan Tengkorak itu dimilikinya.
Bagaimanapun, dua hari kemudian beliau menafikan mempunyai sebarang pegangan kewangan dalam projek penternakan udang di Tanjung Karang yang diuruskan oleh Pristine Agrofood Sdn Bhd.
"Pegangan" yang dimaksudkannya, seperti dilaporkan Sin Chew, jelas Noh, tidak lebih daripada bermaksud tanah yang dipajakkannya kepada syarikat.

Noh Omar 'not mere landlord' of prawn farm...
Sekinchan assemblyperson Ng Suee Lim and more than 100 supporters have protested in front of a prawn farm in Tanjung Karang, Selangor, alleging that landowner Noh Omar had abused his power as the agriculture and agro-based industries minister.
Ng also revealed fresh evidence that purportedly shows the minister is in fact a joint-venture partner in the farm, not a mere landlord as he had previously claimed.
The document is a letter of affirmation purportedly signed under oath by Pristine Agrofood Sdn Bhd director Chu Bak Teck on Jan 11, 2011, in connection with a private caveat on the land that Ng had revealed last month.
“The company has agreed to jointly develop this land with Noh Omar [MyKad number and address included] on his land [address of prawn farm] for the guaranteed price of at least RM25,200 per year. A copy of the joint venture agreement dated Jan 5, 2011 is attached,” the letter reads.
“In view that the joint venture would take at least 10 years, the company wishes to apply to include a private caveat on the land to protect the company’s interest on the land.”
The caveat prevents Noh from selling the land for the period specified.
Chu had previously denied that the company had teamed up with Noh in the project.
Malaysiakini is attempting to contact both of them for comment on this development.
Residents ‘unhappy’
Ng said local residents are unhappy because it is difficult for them to obtain land when Noh, who is the Tanjung Karang MP, was able to obtain 12 hectares of former mangrove reserves that form part of the farm, which occupies over 40 hectares.
“Noh (left) can eat prawns, including his otak udang (dull brain), but he cannot breed prawns. This is an abuse of power. The person who supposedly wants to become the (Selangor) menteri besar must step forward and answer these allegations,” he said.
He also claimed that the farm cleans its ponds every three to six months and discharges the waste water into the sea.
Local residents suspect that this contains harmful chemicals and have blamed the discharge for a drop in their fishing catch.
Ng had first exposed the matter on July 12 at a state assembly sitting as a series of allegations against Noh and the Tanjung Karang Umno division.

He admitted that he had used the term "joint venture" in the letter of affirmation, but explained that this was to protect the company's interests.
When contacted, Chu insisted that Noh is merely the landlord and has nothing to do with the prawn farm's operations.
