Sex video: PAS’ four reasons to back Anwar......

A PAS religious scholar has listed four reasons why it is hard to believe that the sex video implicating Anwar Ibrahim is anything but a conspiracy. The party’s cental committee member Mujahid Yusof Rawa also chided those asking Muslim leaders to swear on the Quran to prove their innocence, saying it is an abuse of the holy book.

Speaking to FMT, he said that PAS is not blindly supporting the opposition leader over this issue and the Islamic party’s stand is based on the reasons below:

1. The timing of the release of the video strangely coincided with the recent Sarawak state election.

2. Before anyone is charged in court, photographs which resemble Anwar is published with an intent to humilate him in public.

3. Certain parties have already jumped to the conclusion it is Anwar without waiting for the the police investigation to be completed.

4. Bits and pieces of the investigation made public contradicted each other.

“The more certain parties tend to justify the video, the more it is starting to look like a political ploy whose grand design, is nothing other than to sow doubts in Anwar’s character,” said Mujahid.

The PAS leader also pointed out that in the Syariah law context, Anwar’s accusers failed to convince Islamic jurists and the public. Besides not producing four witnesses, the accusers – businessman Shahril Eskay Abdullah, former Perkasa treasurer Shuib Lazim and former Malacca chief minister Abdul Rahim Tamby Chik – have only provided a CCTV recording and a watch.

“Of course, some folks will claim that it is impossible to produce four witnesses for the Syariah Court. This is exactly why in Islam, when one accuses a person of high social standing of a crime, the accuser must ensure that the evidence is intact and not something done in bad faith,” he said. Both material items of the video and watch are argumentative at best under the evidence category and this is also inadequate in the Syariah interpretion, he reasoned.

According to Islamic terms, leaders who have deceived the public, committed heavy crimes, or been unfaithful, can receive up to 80 lashes of whipping and be stripped of their social status. However, Mujahid said, if the accusers failed to stick their accusations on such leaders, they will be whipped instead.

“Whether the accusers have CIA experts to verify if the content (of the sex video) is authentic, a strong doubt continues to prevail in our society,” he said.

Don’t abuse the Quran

As for swearing on the Quran, Mujahid warned that if this becomes an acceptable norm among Muslims, then real criminals can abuse the process by using the holy book to pledge innocence. They may escape public perception, but in the eyes of Allah, nobody can escape from their sins, especially those involving slander, murder or ruining the reputation of other Muslims, he said.

“Are we becoming a nation where by swearing on the Quran, we can prove we are innocent. There must be a strong basis to swear although doing it, is part of the Muslim custom,” he added.

Mujahid said before challenging Muslims to swear on the holy book, in the Syariah Law context, their accusers must furnish four witnesses or have in hand, evidence which proves beyond reasonable doubt that the accused is guilty. Then the challenge to take an oath or swearing before the Quran is valid, he pointed out.

If any Muslim simply accepts the need to swear on the Quran to prove their innocence, they are indirectly lending credence to the accusation levelled at them, Mujahid said. He added that there must be a strong basis to use the holy book to pledge innocence and it is a highly religious act in Islam. Therefore it is rare to see Muslims adopting this practice although there are provisions for it, he noted.

He was responding to calls by certain quarters for PAS spiritual adviser Nik Abdul Aziz Nik Mat and Anwar to swear on the Quran that they are innocent. Nik Aziz has been accused of nepotism and corruption, which the veteran politician has denied.
