MACC on fishing trip in Selangor says MB.....

Selangor Menteri Besar Abdul Khalid Ibrahim has alleged that the Malaysian Anti Corruption Commission is conducting "a fishing expedition for evidence" when it targeted the state government officers in their graft investigations. Abdul Khalid, in his affidavit to strike out the Attorney General's application, to declare invalid a circular issued by the Selangor government on MACC questioning procedures, revealed that two of his staff members had also been subjected to the commission's investigations in the past following the "car and cows" investigation.

The Selangor MB has filed the application on Friday and the matter came-up today for case management. In his affidavit, he said several documents were seized and such documents do not relate to the allegations in the "car and cows" case.

"I have no knowledge of the outcome of the current status of the car and cows investigations. But I have reason therefore to believe that the MACC is taking the opportunity to conduct a fishing expedition for evidence," Abdul Khalid said in his affidavit.

He maintained that the circular was necessary because employees and its elected representatives have been continuously harassed, unnecessarily called in by the MACC and demanded by the MACC to hand over various documents.

"This harassment ultimately resulted in the death of one of our employees, political aide Teoh Beng Hock," he said.

Details of harassment

Abdul Khalid said that ever since the Pakatan government took over the Selangor administration following the March 8, elections, the MACC has relentlessly pursued the state's legislative, executive members and civil servants for "information and documents" on the pretext there is a need to investigate alleged abuse of power and corruption. So far, the MACC has approached, visited, interrogated and demanded documents from the Selangor government at all levels starting with the menteri besar, the exco members and their aides, state assemblypersons, civil servants and employees of state companies and its subsidiaries.

Using the 'cows and cars' investigations as an example, Abdul Khalid said that besides him, other officers who had been subject to MACC investigations include the state financial officer, his political secretary, elected representatives and excos like Ronnie Liu, Rodziah Ismail, Teresa Kok, Hannah Yeoh, Lau Weng San, and Ean Yong Hian Wah. Local councils like Kuala Selangor, Petaling, Kuala Langat, Gombak, Sepang, and Klang district and land office and the Ampang Jaya and Sepang Municipal Councils were also being investigated. State companies like the Selangor Development Corporation and Kumpulan Semesta Sdn Bhd were not spared.

'MACC's starts work after office hours'

Abdul Khalid noted that MACC frequently organises visits and conducts interrogations after office hours and some personnel would have to stay at the MACC building past midnight, regardless of gender or age. He also said MACC's modus operandi was to contact its employees through direct phone calls, conducting surprise visits without proper identification. Abdul Khalid added that they will also ask for documents and very often the interrogations in their offices last till very late hours.

"The personal safety and welfare of the said employees and the welfare of their families remain our primary concern.

"As a responsible employer, the Selangor government is duty bound to protect and safeguard the welfare, well-being and interests of the 18,312 employees. The circular in question was intended to allay the concerns of the said employees in the light of MACC's harassment."

Attorney-general Abdul Gani Patail's application for the judicial review was filed on Aug 20 togther with a supporting affidavit.In his affidavit, Abdul Gani (right) said the state government circular was against the law as it violated the legal rights accorded to the MACC officers in performing their duties. He said that the MACC officers were bound by the MACC Act 2009 in performing their tasks. He also added that the circular meant that any non-compliance could result in disciplinary action against state officers or staff by the state government.

"As attorney-general, I am entrusted with the maintenance and compliance of the law.

"In my task as AG, I am to ensure that there is no action taken based on the directive or circular... such actions are against the law of the country," he stated.

Abdul Gani said that as the guardian of public interest, he was entrusted with protecting the federal law so that public interest could be upheld. It was for this reason that he was making the application to strike out the state circular, he added. The attorney-general has been given until next Tuesday to reply to Abdul Khalid's application to set aside the his originating summons and affidavit.

The MACC thinks that all the rakyat are simpletons! and the MACC only thinks that corruption,grafts and absue of power occurs in Selangor and other PR ruled states.

Its OK if an UMNO ex-MB and family to go on all expense paid trip to Disneyland on the pretext of "lawatan sambil belajar" and live in a RM24 million mansion.
