Anwar claims trial to Bersih 3.0 charge...

PKR de facto leader Anwar Ibrahim, along with party deputy president Azmin Ali and former party supreme council member Badrul Hisham Shaharin are charged today at the Kuala Lumpur Sessions Court with participating in a street protest under the Peaceful Assembly Act.

Anwar, along with his wife, Dr Wan Azizah Wan Ismail, arrived at the Sessions Court 5 at 9.15am.

In a strange twist, former solicitor-general II Mohd Yusof Zainal Abiden, the lead prosecutor in Anwar's Sodomy II trial, will be teaming up with senior counsel Karpal Singh in defending the opposition leader.

Anwar told Sessions judge Mahmud Abdullah that the charge was yet another “political” campaign mounted against him, and he pleaded not guilty.
Both his lawyers, Karpal and Yusof, asked that Anwar be allowed to be given personal bond but deputy public prosecutor Abdul Wahab Mohamad objected.


Karpal then submitted that Anwar is the “prime minister in waiting” and has never shirked a court appearance in the past.

Added Yusof: “He may be late sometimes but he comes to court ... Imposing bail would be too much, as he has a good track record of attendance.”


Yusof was a surprise inclusion in the defence team, since he had led the prosecution team against Anwar in the Sodomy II trial.

Abdul Wahab applied for bail to be set at RM2,000 to secure attendance.DPP Ishak Mohd Yusof told the court that waiving bail for Anwar would not be fair to the other accused, who had each posted bail of RM500.


The judge then ordered bail to be set at RM500 and fixed July 2 for mention of the case.


Sivarasa Rasiah and Gurcharan Singh represented Azmin, while Latheefa Koya appeared for Badrul Hisham, who is popularly known as Chegubard.

Sankara Nair and Ramkarpal Singh are co-counsel for Anwar.

Second charge


The three claimed trial to a second charge under the Section 188 of the Penal Code in that they allegedly breached a magistrate’s order.


They are also said to have conspired with Rasah PKR division deputy head R Tangam, lawyer G Rajesh Kumar and van driver Farhan Ibrahim @ Alias by inciting them to breach the barricade surrounding Dataran Merdeka, which ‘could have caused a riot or clashes’.

If convicted, they are liable to a maximum jail term of a month or fine of RM2,000, or both.

Abdul Wahab applied for bail, while the defence sought their release on a personal bond.

The judge agreed to releasing them on a personal bond and fixed July 2 for the case to be mentioned.

Among the opposition leaders spotted in court were DAP supremo Lim Kit Siang, PAS vice-president Mahfuz Omar, PAS MP Dr Mohd Hatta Ramli, PKR vice-president Chua Jui Meng and PKR disciplinary committee chairperson Dr Tan Kee Kwong.

Meanwhile, Azmin who was represented by lawyers Sivarasa Rasiah and Gurcharan Singh, and Badrul Hisham, who was represented by lawyer Latheefa Koya, were also ordered to post RM500 bail each.

Among the opposition leaders spotted in court were DAP supremo Lim Kit Siang and PAS MP Dr Mohd Hatta Ramli. The three PKR leaders are the first to be charged under the recently passed Peaceful Assembly Act, of which Anwar and Azmin may lose their post as elected representatives if found guilty. 


The trio could be fined RM10,000 if convicted of the offence under the Act. Elected representatives will automatically lose their post should they be convicted by a court of law and punished by a fine of over RM2,000 or a jail term of more than one year.

The three are charged under section 4(2) (c) of the Peaceful Assembly Act with participating in the Bersih 3.0 rally and violating magistrate Zaki Asyraf Zubir's court order dated April 26 which prohibits the gathering at Dataran Merdeka and the area bordering Jalan Sultan Hishammuddin, Jalan Raja and Jalan Kelab.


They allegedly committed the offence between 2.30pm and 3pm on April 28.


Additional charge

They also face another charge under the Penal Code with disobedience to an order duly promulgated by the magistrate to be with more than five Bersih 3.0 supporters and conspired with R Tangam, G Rajesh Kumar and Farhan Ibrahim @ Alias by inciting them to breach the barricade surrounding Dataran Merdeka and could have caused a riot or clashes in the area.

Anwar and Azmin are accused of abetting this with Tangam, Rajesh Kumar and Farhan. Under section 188, they stand to face a jail term of up to a month or a RM400 fine, or both.


Tangam, was the first to be charged on May 3 under Section 143 of the Penal Code for participating in an unlawful assembly, which was read together with an alternative charge of breaching a court order under Section 188 of the Penal Code.

NONEKetua Umum PKR, Datuk Seri Anwar Ibrahim bersama dengan Timbalan Presiden, Azmin Ali dan bekas ahli majlis pimpinan pusat, Badrul Hisham Shaharin dihadapkan ke Mahkamah Sesyen Kuala Lumpur atas tuduhan mengambil bahagian dalam protes jalanan,  di bawah Akta Perhimpunan Aman.

Anwar bersama dengan isterinya, Datuk Seri Dr Wan Azizah Wan Ismail, tiba di Mahkamah Sesyen 5 pada jam 9.15 pagi.


Bekas peguamcara II Datuk Mohd Yusof Zainal Abiden - yang mengetuai pasukan pendakwa dalam kes Liwat 11 terhadap Anwar - kali ini bersama peguam kanan Karpal Singh dalam pasukan peguambela ketua pembangkang itu. Mohd Yusof meletak jawatan dari Jabatan Peguam Negara pada akhir perbicaraan kes liwat tersebut.

Anwar memberitahu Hakim Mahmud Abdullah bahawa pertuduhan tersebut adalah satu lagi kempen "politik" terhadapnya, dan dia tidak mengaku bersalah.

Ketiga-tiga mereka merupakan yang pertama didakwa di bawah Akta Berhimpun Aman yang diluluskan baru-baru ini, di mana Anwar dan Azmin boleh kehilangan jawatan mereka sebagai wakil rakyat jika didapati bersalah.

Mereka boleh didenda RM10,000 jika sabit kesalahan di bawah akta tersebut. Wakil rakyat secara automatik hilang jawatan jika disabit oleh mahkamah dan didenda lebih RM2,000 atau penjara lebih setahun.

Mereka dituduh mengikut Seksyen 4(2) (c) Akta Perhimpunan Aman kerana didakwa mengambil bahagian dalam yang perhimpunan BERSIH 3.0 dan melanggar perintah Majistret Zaki Asyraf Zubir, bertarikh 26 April yang melarang perhimpunan di Dataran Merdeka dan kawasan yang bersempadan dengan Jalan Sultan Hishamuddin , Jalan Raja dan Jalan Kelab.

Mereka didakwa melakukan kesalahan itu antara jam 2.30 petang dan 3 petang pada 28 April.


Mereka juga menghadapi satu lagi tuduhan di bawah Kanun Keseksaan, iaitu bersama penyokong BERSIH 3.0 yang melebihi lima orang yang masih bebas, dalam mencapai niat bersama, telah bersubahat dengan Tangam a/l Raju, Rajesh Kumar a/l Gejinder dan Farhan bin Ibrahim @ Alias, telah mengingkari perintah yang dikeluarkan oleh Majistret Zaki Asyraf Zubir pada 26 April.

Azmin dituduh bersubahat dan menghasut Tangam, Rajesh dan Farhan membuka sekatan besi halangan di Dataran Merdeka yang mungkin menyebabkan rusuhan atau gaduh-gempur di kawasan tersebut.- malaysiakini




Yusof to AG: It's not personal...

Former solicitor-general II Mohd Yusof Zainal Abiden has raised eyebrows by representing Anwar Ibrahim on a Bersih 3.0-related charge, after having led the prosecution team in the Sodomy II trial.

Yusof (right), met after the court proceedings today, was asked if this would be seen as a personal battle between Attorney-General (AG) Abdul Gani Patail and himself.

He said he has nothing personal against Abdul Gani in taking up the case.

"I am a professional. They called me last night and I am available. I do not have any political affiliations," he said.

Yusof had ranked third in seniority in the AG’s Chambers when he took up optional retirement from Feb 1.- malaysiakini

Ketika Datuk Seri Anwar Ibrahim mencetuskan berita dengan didakwa di mahkamah, bekas peguam cara negara II Mohd Yusof Zainal Abiden juga mendapat perhatian apabila mewakili orang yang didakwanya dalam perbicaraan 'liwat' II.

Yusof ketika ditemui selepas prosiding mahkamah hari ini berkata tiada masalah peribadi antaranya dengan Peguam Negara Abdul Gani Patail dan beliau profesional sejak memilih bersara.

Beliau mengulas tanda tanya sama ada tindakannya melibatkan perkara peribadi dengan Abdul Gani.

"Saya profesional, mereka telefon saya malam tadi dan saya lapang," katanya.

"Saya tidak ada sebarang penglibatan politik," kata Yusof, orang ketiga alam Pejabat Peguam Negara sebelum bersara pada 1 Februari.- malaysiakini



Anwar dakwa Najib guna mahkamah untuk sekat kemaraannya...

Ketua pembangkang Datuk Seri Anwar Ibrahim mendakwa Perdana Menteri Datuk Seri Najib Razak menggunakan proses mahkamah untuk membendung kemaraan beliau ketika pilihan raya kini semakin hampir.

Beliau juga mendakwa, tuduhan ke atasnya hari ini berhubung perhimpunan BERSIH 3.0 juga satu tindakan politik yang dirancang dan juga untuk mengelak isu pilihan raya yang dibawa dalam perhimpunan 28 April itu.


NONE"Najib perlu menghadapi saya dalam pilihan raya dan dia mahu gunakan mahkamah untuk bantu dia. Saya hendak beritahu Najib, pilihan raya itu diputuskan rakyat," katanya.

Tambahnya, Najib juga tidak boleh menggunakan undang-undang Akta Perhimpunan Aman yang diluluskan dengan bantahan keras pembangkang "untuk menakut-nakutkan dan menghalang seteru politik" sepertinya.

Anwar bagaimanapun yakin bahawa kes berkenaan tidak akan menjejaskan kempennya.

"Najib guna pendakwa iaitu Tan Sri Gani Patail untuk tujuan politik beliau – saya akan berusaha dengan rakan-rakan, teruskan jalan kegiatan politik walaupun hadir ke mahkamah.

“Pendakwaan mahu saya terikat dengan proses mahkamah dan mereka mahu meminta tarikh (perbicaraan) lebih awal. Bagaimanapun, pasukan pembelaan membantah," katanya.


NONETarikh perbicaraan pada 2 Julai itu akan memberikan tempoh sebulan lagi kepadanya untuk berkempen secara aktif, kata Anwar.

"Yang dielak (Najib) adalah isu pokok iaitu isu pilihan raya. Ini tanda dendam kesumat beliau guna aparatus pemerintah untuk tekan kami," katanya kepada pemberita selepas dihadapkan ke Mahkamah Sesyen Kuala Lumpur atas tuduhan tersebut.

Beliau serta dua lagi pemimpin PKR – timbalan presiden Azmin Ali dan bekas ahli majlis pimpinan pusat, Badrul Hisham Shaharin – didakwa mengikut Seksyen 4(2) (c) Akta Perhimpunan Aman kerana didakwa mengambil bahagian dalam yang perhimpunan BERSIH 3.0.

Sodomy II prosecutor now in Anwar’s legal team for illegal assembly charge

mushiro - It always Anwar Ibrahim that they are after. It is only Anwar Ibrahim that they can think off. This is the man that they love to hate but they just do not know how to handle him. The more they misuse the law to trap him, the more popular Anwar gets, the more sympathisers he gets and the more votes he gets. 

TruthSansBorders - Yusuf must have found out the truth about Anwar during the Sodomy II trial. Or worse, he must have found out the truth about Najib and the AG's Chambers.

Absolom - The law cannot do anything about people defacing property, causing comotions and intimidating a lady at her house in a private residential area. But it can bring others to book for gathering in a public area for a worthy cause for which people getting chased around, battered, gased and arrested. Seems justice in Malaysia has not touched rock-bottom yet.
