Why is Jawi silent about Eskay's false accusation...

Why is the Federal Territory Islamic Department (JAWI) silent on qazaf (unsubstantiated allegation of adultery) action against businessman Shazryl Eskay Abdullah even two days after he denied accusing Opposition Leader Anwar Ibrahim of committing zina (adultery)?

PKR Youth chief Shamsul Iskandar Mohd Akin, who went to Jawi for the third time today following his qazaf complaint against Eskay, said the businessman's statement outside the Kepong police station two days ago brings into question the oath he took at the Amru-Al-As Mosque last Friday.

"In Eskay's press conference, he denied accusing Anwar of committing zina, but in his oath (sumpah laknat) at the mosque, he made the accusation. There seems to be a conflict, so which is correct?

"I am puzzled that despite such clear contradictions, Jawi has failed to react and take action against Eskay till today," Shamsul Iskandar said in pressuring the Islamic enforcement agency to act.

Qazaf is an unsubstantiated allegation where a person accuses another of committing zina without procuring four male witnesses or an iqrar (declaration) from the accused. Under Islamic law, the accuser, upon conviction, shall be punished with a fine of not more than RM5,000 or jail of up to three years or both. This is based on Section 41 of the Federal Territory Criminal Offences Act 1997, where those who make false allegations can face such a punishment.

Shamsul Iskandar had on April 4 lodged a report against the Datuk T trio for qazaf following the three - Eskay, Risda chairperson and former Malacca chief minister Abdul Rahim Thamby Chik and former Perkasa treasurer Shuib Lazim - admitting to their role in screening the controversial sex video.

Anwar the next day lodged a police report on the matter, followed by the qazaf report lodged by Shamsul Iskandar, who had said that any failure on the part of the authorities to take action on the Datuk T trio would only serve as proof that Umno and the BN government were behind this politically-motivated caper.

Today, Shamsul Iskandar went to Jawi again, after Friday prayers, to reiterate his call for action to be taken against Eskay as well as against Rahim and Shuib.

Eskay's turnaround?

Speaking to reporters on Wednesday, Eskay, had denied any role in hiring the woman sex worker in the video, which featured a man resembling Anwar, and said he had not accused Anwar of committing adultery.

"I want the reporters to ask... because you guys know him (Anwar) best - you have been interviewing him - adakah ini (is this) Datuk Seri Anwar Ibrahim?

"Fitnah atau tak fitnah (slander or not), it has nothing to do with me. It is up to the public to perceive who he (Anwar) is. As far as I am concerned, I will do whatever needs to be done," Eskay was quoted as saying on Wednesday.

However, the oath Eskay had taken last Friday at the Amru al-As Mosque in Sentul, Kuala Lumpur, in the presence of about 100 people, was the contrary to what he had claimed on Wednesday.

Eskay's oath on the Quran: "Pada hari ini, 29 April 2011, dengan nama Allah yang Maha Pemurah lagi Maha Penyayang, saya Shazryl Eskay Abdullah berikrar dan bersumpah seperti berikut: A'uzubillahi minal syaitanirrajim, aku bersumpah bahawa aku dan Datuk Seri Anwar Ibrahim berada dalam paparan video yang dirakamkan pada 21 Februari 2011. Datuk Seri Anwar Ibrahim adalah pelaku dalam video tersebut. Sekiranya aku melakukan fitnah, maka Allah akan melaknat akanku."

("In the name of Allah, I, Shazryl Eskay Abdullah, swear that Anwar Ibrahim and I were in the video, which was recorded on Feb 21, 2011. Anwar was the actor in the said video. If I have committed slander, then Allah will lay a curse on me.")

Allegation not to be taken lightly

Shamsul Iskandar also warned that allegations of someone committing fornication should not be taken lightly by anyone. Quoting Islamic history, the PKR Youth chief said the second caliph, Omar al Khattab, had himself witnessed someone committing adultery, and he immediately called for a meeting for punishment to be meted out.

"He was the caliph at that time. However, his companions asked Omar whether anyone else had witnessed the act of adultery, to which the caliph replied 'no', as he was the only one. In Islam there must be four witnesses to the event.

"Following the advice of his companions, Omar decided against taking action against the person, since he was the only witness," Shamsul Iskandar said.

Accusing someone of committing adultery is a serious matter, he said, and that clearly, Eskay had contradicted himself with his revelation at the Kepong police station on Wednesday. He also questioned the presence of Jawi director-general Che Mat Che Ali, who was seen trying to hide himself in the mosque last Friday, and asked whether Eskay's oath-taking ceremony was sanctioned by Jawi.

Shamsul Iskandar said he would go to Jawi again next week to follow-up on his complaints. He had also gone to Jawi on April 18, after which he said that he was told that Jawi was investigating his complaint.- Hafiz Yatim

Jawi membisu kerana Menteri Agama Najib arah supaya pejam mata dan tutup telinga. Maka tak hairan kalau pegawai2 Jawi semua kecut teloq....
