Petisyen Pilihanraya - Selinsing kekal di tangan BN...

Mahkamah Pilihan Raya di sini hari ini menolak petisyen yang difailkan PAS untuk membatalkan keputusan pilihan raya Dewan Undangan Negeri (DUN) Selising yang dimenangi Barisan Nasional (BN) pada pilihan raya umum ke-13 (PRU13) lalu.

Hakim Pilihan Raya Datuk Zamani Abdul Rahim, yang membuat keputusan itu, berkata ini kerana pihak pempetisyen gagal mematuhi peraturan penyampaian.

“Petisyen itu tidak disampaikan dengan sempurna dan dengan ini petisyen ini tidak sah dan ditolak dengan kos,” katanya ketika membacakan keputusan itu. Zamani kemudiannya mengarahkan pihak pempetisyen membayar kos RM30,000.

Pada PRU13 lalu, DUN Selising dimenangi calon BN Zulkifle Ali yang mengalahkan calon PAS, Saipul Bahrim Mohamad dan calon Bebas, Ibrahim Ismail dengan majoriti 107 undi. Petisyen itu difailkan Pengarah Pilihan Raya PAS DUN Selising, Semsudin Muhammad.

Pada prosiding hari ini, Zamani turut menolak bantahan awal yang difailkan defendan-defendan daripada PAS bagi membatalkan petisyen bagi kawasan Parlimen Bachok, DUN Jelawat dan DUN Gaal yang dibuat oleh BN.

Zamani mengarahkan defendan membayar kos RM30,000 bagi setiap bantahan awal yang ditolak itu. Sehubungan itu, beliau menetapkan sembilan hari iaitu dari 12 hingga 15 Ogos dan dari 18 hingga 22 Ogos ini untuk tarikh perbicaraan bagi petisyen kawasan Parlimen Bachok dan DUN Jelawat, serta dari 1 hingga 5 Sept untuk tarikh perbicaraan petisyen DUN Gaal.

Bagi kawasan Parlimen Machang, Zamani menetapkan 16 Julai ini untuk mendengar keputusan bantahan awal dan jika ditolak, beliau menetapkan 8 hingga 12 Sept sebagai tarikh perbicaraan. -fmt





Polls petitions: BN keeps Selising in Kelantan...

Kelantan BN has retained the Selising state seat after the Kota Bharu Election Court found in the coalition’s favour today.

azlanThe court allowed a preliminary objection by BN’s legal team, thereby resulting in the petition being struck out.

BN lawyer Hafarizam Harun argued that the petition had failed to comply with the rule of service, as well as failed to plead the alleged corrupt practices under Section 11 (1)(c) of the Election Offences Act.

Hafarizam later told Malaysiakini that Justice Zamani A Rahim allowed the preliminary objection and struck out the petition.

PAS candidate Dr Saipul Bahrim Mohamad, who lost to BN's Zulkiflee Ali by 107 votes in the May 5 polls, had filed the petition and was represented by Hisham Fauzi.

In the case of the election petition over the Machang parliamentary seat, the BN’s preliminary objection was against the appearance of lawyers Sivarasa Rasiah, Latheefa Koya and Afiq M Noor for defeated PKR candidate Wan Zawawi Wan Ismail.

Lawyers for the BN's Ahmad Jazlan Yaakub argued that the trio had not been listed as counsel for Wan Zawawi, who had lost the seat by 805 votes.

When contacted, Sivarasa said Justice Zamani allowed the objection, but that Wan Zawawai would appeal the ruling in the Federal Court.

“He is allowed to have his lawyer of choice to represent him,” noted Sivarasa.


The Election Court will rule on the petition itself on July 16.

 Hisham also told Malaysiakini that the election court judge Justice Zamani had also rejected the preliminary objections posed by PAS on the Bachok parliamentary seat, and also the Jelawat and Gaal state seats.

“Hence, these three petitions will go for a full trial,” said Hisham.-malaysiakini
