Dr M admits contradiction, but denies being untruthful...

Former prime minister Dr Mahathir Mohamad admitted in the cheating trial of former transport minister Dr Ling Liong Sik today that he had provided contradictory evidence, but denied that he was an untruthful witness.

NONETestifying in the trial of Ling, who is accused of cheating in the Port Klang Free Zone (PKFZ) land deal, Mahathir admitted that he had wrongly stated the cash price of the land to be RM25.82 per square feet (psf) during the court hearing last year.

He then corrected the figure to RM21psf during cross-examination by the lead prosecutor and deputy solicitor-general II Tun Abdul Majid Tun Hamzah when the trial resumed yesterday.

"I may have wrongly used the terms 'cash price', 'special price' and 'contract price', but I have to admit that I am not an accountant," Mahathir told Kuala Lumpur High Court judge Ahmadi Asnawi.

However, Tun Majid did not appear satisfied with the answer from Mahathir, who is the fourth witness for the defence.

Tun Majid: One does not need to be an accountant, a lawyer or a doctor to understand the word 'cash'. Even a schoolboy knows the word. I am putting it to you that you are being untruthful.

Mahathir: I beg your pardon, but I am being truthful. I am merely stating that I may have used these terms inaccurately because I'm unfamiliar with these terms.

And a schoolboy doesn't understand 'cash price', 'special price' and 'contract price'. They may understand 'cash', but not 'cash price', 'special price' and 'contract price'. I may be as good as the schoolboy at that time.


Tun Majid was today referring to Mahathir’s testimony last year, during his examination by the defence counsel Wong Kian Kheong, when the former prime minister repeatedly said that RM25.82psf was the cash price for the PKFZ land the government purchased.

In fact, Mahathir had admitted and corrected the mistake yesterday, saying the RM21psf and RM25.82psf were, respectively, the cash and contract prices for the land.

Denies Ling misled him on the purchase

Mahathir also denied that he was misled by Ling over the purchase of the 1,000-acre land in Pulau Indah, stressing that the government was "in a hurry" to buy the land for the project.


NONE“I was not misled by the accused person… We were in a hurry, we needed to acquire this land to start the hub.”

He said that because of differences within the government as to whether the land should be purchased or acquired, the project was delayed for three years and this caused millions of ringgit in losses to the government.

“Even if the price was high, we had made the decision to purchase the land,” he added.

Mahathir was also grilled by Tun Majid on the decision of the government to purchase the land from Kuala Dimensi Sdn Bhd, instead of acquiring it at the lower price determined by the Valuation and Property Services Department (JPPH).


The former prime minister continued to defend the government decision, saying it “may not be good for election” if the government makes good but unpopular decisions.

Tun Majid: Do you think that saving the government’s money is good?

Mahathir:
Yes, it’s very good, but as an elected government, we have to be fair.

Tun Majid: Are you saying that to be fair is to maintain popularity?

Mahathir: Yes, to maintain popularity. If we act unfairly, we will become unpopular.

Tun Majid:
But the government in saving money can also become popular.

Mahathir:
It depends. If we acquire, we can save a little money, but it’ll be unfair and unpopular.

Tun Majid: But it will be good for the government.

Mahathir: It will be good for the government, but not good for election.


Ling is charged with deceiving the cabinet into approving the purchase of 999.5 acres of land for the PKFZ project, which had resulted in wrongful losses for the government.

The former MCA president was charged on July 29, 2010, under Section 418 of the Penal Code, which carries a penalty of up to seven years in prison, or a fine or both upon conviction.

He also faces two alternative charges.
