Seven years on, 'molest' complainant arrested and charged...

Wong bee fong demonstrating how she was molested by policeSeven years ago, an accounts manager complained about being molested by 11 police personnel but heard no more about investigations. About midnight, however, the police finally acted - they detained her.

Having spent the night in a police lock-up cell, she was produced in court today and charged with obstructing a police personnel from performing his duty.

Wong Bee Fong, 39, is said to have obstructed L/Cpl Mohd Faudzi Abdul Aziz at the General Operations Force headquarters in Batu 9, Cheras, about 2.30am on Aug 13, 2004.

She claimed trial in the Kajang Magistrate's Court in Putrajaya. The charge, under Section 186 of the Penal Code, carries a penalty of two years' jail or fine of RM10,000, or both.

Bee Fong was granted bail of RM2,000, which was posted by her employer, according to her lawyer Keppy Wong (right).

"What is the country turning into? They could have informed her of the charge instead of arresting her in the middle of the night," Wong had told Malaysiakini
earlier today.

"It is bad enough that she was molested. To subject her to time in a lock-up is traumatising."

NONE'Bribe sought'

Bee Fong had alleged that she was stopped at a police road-block in Taman Connaught, Kuala Lumpur, on suspicion of drink driving. Following a discussion, she told the police personnel to return her driving licence and to issue a ticket.

The police personnel allegedly refused and demanded a bribe of RM3,000.

She then drove towards the Batu 9 police station in Cheras, but said a brown Proton Wira gave chase and forced her to turn into the premises of the General Operations Force building.

When Bee Fong alighted from her car, 11 police personnel approached her and allegedly began touching her body (demonstrated in photo). Relating her ordeal today, Bee Fong said four police personnel including a female officer came knocking at her door at just about midnight.

“They showed a warrant briefly, which I could not see clearly, and acted very rough. They threatened to break my padlock and door and tried to shame me in front of my neighbours.

“I told them not to make so much noise as my neighbours have children and babies. Furthermore, they have to go to work in the morning.

“However, they kept on knocking on my door asking me to produce my identity card. I was scared and called my employer,” she said, adding she was alone at that time.

Bee Fong said after her boss arrived, they left for the police station together, where she was immediately shown to the lock-up. Luckily, she added, she was treated well at the police station while her boss tried to secure her release.

“This morning, the police handcuffed me and took me to the Putrajaya court, where I was charged,” she said.


“I would like to thank my boss for posting bail and granting me leave today,” she said.

Mala fide action


Wong, her lawyer, said the police action on her client was truly mala fide (in bad faith) as police had reacted to charge his client after the complaint was highlighted to the media in August. He said they issued a warrant of arrest against her, resulting in Bee Fong being picked up.

“However, the police abused the warrant, as she must be released if she can produce security or guarantee. Her employer accompanied her to the police station last night and was willing to produce security. However, the police kept her in custody.

“This is truly an abuse of the warrant. She should not spend her time overnight in the lock-up before being charged. The purpose is to secure her attendance. This is a clear violation of human rights and an unusual practice by the police,” Wong said.


He also said that Bakri MP, Er Teck Hwa had contacted him, indicating that the politician will table a motion in parliament soon, calling on the prosecutors to charge the 11 policemen who had harassed and molested her. The lawyer said he could not understand how his client could be charged with obstructing the authorities, whereas there were other policemen around at that time.

This, Wong said, was truly a high-handed tactic employed by the authorities.

- The question is why waited 7 years before charging her? If it's obstruction of police duty then, it should be apparent immediately and she could be arrested and charged there and then. The fact that there was no arrest made then, and the police did nothing for 7 years shown that there is something fishy going on. The way the police handle her case have given credits to her claims. I am more inclined now to believe her story that these policemen have molested her, that's why the hush-hush manner in dealing with her. More reasons to justify the setting up of IPCMC.

Kalau betul-betul menghalang polis daripada melaksanakan tugas, kenapa tunggu sampai 7 tahun baru nak tangkap? Sebaliknya dalam kes Anwar polis bertindak cepat seperti kilat.....
