AG's 'prosecutorial dishonesty'........

Attorney-General (AG) Abdul Gani Patail has been accused of “dishonesty” and the lack of even-handedness in prosecuting Anwar Ibrahim for sodomy.

Anwar's lawyer Sankara Nair said this in a statement today, in which he questioned why similar action has not been taken against Dr Chua Soi Lek, who has admitted to involvement in oral sex.

Sankara did not name Chua, but referred to the video footage implicating “a former minister of health of the ruling (coalition) ,who has just won the presidency of his party”.

“The (DVD) has been in the public domain for about two years. The video shows him engaging in oral sex with a woman. He also publicly admitted that he was the actor in the video.

“Indeed oral sex with or without consent is no different from anal sex and it clearly falls within the same Section 377B of the Penal Code under which Anwar is charged.”

In pointing out that several police reports have been lodged (against Chua), Sankara noted that the AG has refused to charge him “when incontrovertible evidence is staring at all”.

“This is discrimination of the highest order and a clear testament of the AG's bias. I therefore call upon the AG to drop the charge against Anwar.”

Sankara later added in a text-message: “The AG is bound to act according to law and Article 8 of the federal constitution which states that 'all people are equal before the law and entitled to the equal protection of the law'.

“If the AG persists with the prosecution of Anwar, then it will amount to flagrant political persecution (that is) in serious contravention of the constitution.”

Chua has openly admitted that he was the person in a sex video recorded in a hotel room, but attributed to the exposé to ulterior motives on the part of political rivals.

He quit his posts in the government and the party, but later made a comeback as MCA deputy president. Yesterday, he was elected to the top party post.

Anwar has been charged with sodomising his former aide, Mohd Saiful Bukhari Azlan, 25, on June 26, 2008. The trial is underway.
