Chandra Muzaffar tarik balik kenyataan fitnah terhadap Anwar...

Kes saman fitnah RM10 juta ketua pembangkang Datuk Seri Anwar Ibrahim terhadap Dr Chandra Muzaffar selesai selepas presiden International Movement for Just World (Just) itu menarik balik perkataan-perkataan berunsur fitnah berhubung artikel yang diterbitkan pada 2008.

Dalam pernyataan tuntutan itu, Anwar mendakwa komen itu diterbitkan akhbar The Star melalui artikel bertajuk Disaster if Anwar is PM dan Chandra breaks silence on Anwar yang diterbitkan akhbar The New Straits Times pada 5 Mac 2008.

Anwar gets consent judgment against Chandra...

Just World president Chandra Muzaffar has retracted a defamatory remark made in 2008 against Anwar Ibrahim, which had resulting in a news report entitled ‘Disaster if Anwar is PM’ being published a few days before the 12th general election.

The Kuala Lumpur High Court has recorded a consent judgment between the two, concluding Anwar’s RM10 million defamation suit against Chandra.

Chandra, Anwar and his wife Dr Wan Azizah Wan Ismail were present in court today.

When contacted, Anwar's lawyer Latheefa Koya (right) said the consent judgment was recorded by Justice Nik Hasmat Nik Mohamad, who made no order as to damages or costs.

She said Chandra's lawyer Firoz Hussein Ahmad Jamaluddin had agreed to the retraction of the statement by his client.

Anwar had filed the suit in 2008 following Chandra's remarks at a public forum organised at Menara Star in Petaling Jaya and which was reported by Star on March 5, 2008.

Chandra (right), a former PKR deputy president, had claimed that "Anwar in his dealings with the Kampung Jawa clash between Hindus and Indian Muslims in Penang had said that he would make sure the temple bell would not ring in the country any more if his dictum was not accepted".

Anwar’s legal team maintained that this inferred he “was and is promoting and inciting racial hatred amongst the races in Malaysia” and had committed criminal offences of sedition.

It further meant that he was “deceiving the public” with his multi-racial attitude and that he is now "speaking differently" from when he was in government.-

Walaupun Marina dipuji atas pendiriannya kerana membela hak agama minoriti, ketua pemuda Perkasa,Irwan Fahmi Ideris telah mengecam Marina sambil mengatakan bahawa Marina sepatutnya berdiri bersama2 umat Islam.

Perkasa full of rubbish, says Marina Mahathir on group’s criticism of her...

Datin Paduka Marina Mahathir will not be dragged into a fight with Malay rights group Perkasa, who had accused her of seeking cheap publicity by supporting the Christians in the Allah controversy.

Marina, who is the daughter of Perkasa patron Tun Dr Mahathir Mohamad, had refused to comment when she was asked about Perkasa's criticisms against her.

"I don't want to comment about Perkasa. They talk so much rubbish," she said after attending the first National Unity Consultative Council meeting in Kuala Lumpur today.

Bearing flowers, Marina had turned up with a group of people at Our Lady of Lourdes Church in Klang yesterday morning as Catholics turned up for Sunday mass.

After the service ended, she handed the flowers to parish priest, Reverend Father Michael Chua, with worshippers cheering and applauding the act.

Marina, accompanied by Sisters in Islam and several other groups, was at the church to show support against threats by Muslim groups who had said they would hold a protest outside the house of worship.

While Marina was lauded for standing up for the minority religion, Perkasa Youth chief Irwan Fahmi Ideris had hit out at her, saying that she should have instead stood by the Muslims.

“As a Muslim, she should be with us to defend the word Allah so that it is not used by the Christians,” he was quoted as saying.

Perkasa also questioned Marina whether she agreed with the use of the word Allah by Christians.

“As a Muslim and daughter of a former prime minister who had championed Islam and defended the Malays, her actions had resulted in numerous questions being asked by Malaysians, especially the Muslims.

“Where is her faith and does she agree that the word Allah can be used by non-Muslims? We strongly condemn her actions,” he said, adding that she was looking for "cheap publicity".

He had further criticised the social activist, saying that she supported beliefs that are un-Islamic, such as fighting for the rights of lesbians, gays, bisexuals and transgenders (LGBT) and being closely associated with Islamic group Sisters in Islam, a non-governmental organisation that advocates equal rights for women, human rights and justice. - tMi

- Bernama

Appellate Court rules Bersih 3.0 ban defective...

The Court of Appeal has today unanimously set aside the order by Kuala Lumpur Magistrate Zaki Asyraf to ban the Bersih 3.0 rally in 2012, under Section 98 of the Criminal Procedure Code (CPC).

A three-member panel, headed by Justice Linton Albert, deemed the ban order defective, following an appeal filed by PKR deputy president Azmin Ali (left) and Rembau PKR chief Badrul Hisham Shaharin.

The duo had argued that the order went against the federal constitution.

The other judges on the panel were Justices Zakaria Sam and Wong Dak Wah.

Azmin was represented by CV Prabhakaran while former deputy solicitor-general Mohd Yusof Zainal Abiden, who has since retired and joined private practise, while lawyer Sankara Nair represented Badrul Hisham, or better known as Chegubard.

Zaki had issued the order on April 26, 2012, two days before the mammoth rally.

The duo filed their application last year to strike out charges against them under the Peaceful Assembly Act 2012 (PAA) on the grounds that the order issued by Zaki to ban the rally was ultra vires of the PAA, which had come into force on Jan 30, 2012, and that the magistrate had acted beyond his jurisdiction.

It was reported that Azmin and Chegubard had earlier failed to strike out the charges at the Kuala Lumpur High Court.

Should the prosecution decide not to appeal today's decision at the Federal Court, then Azmin and Badrul Hisham's lawyers may apply to strike out the charge at the Sessions Court.

Sankara said they would write to the Attorney-General's Chambers to drop the charges against the two as the court found the order as defective.

Application made at High Court

As their application originated in the High Court, the prosecution could appeal today's decision at the Federal Court, which is the highest court in the land.

Azmin and Badrul Hisham were charged along with opposition leader Anwar Ibrahim for not abiding with the magistrate's order.

However, Anwar - who was represented by Karpal Singh - filed a separate application before the duo at the Sessions Court, but it was also dismissed.

It was reported that the three of them are charged under Section 4(2)(c) of the PAA, with participating in the rally and violating the magistrate's court order between 2.30pm and 3pm on April 28 in 2012.

They are also charged under Section 188 of the Penal Code in that they allegedly breached the magistrate’s order and a third charge of conspiring with Rasah PKR division deputy head R Tangam, lawyer G Rajesh Kumar and van driver Farhan Ibrahim @ Alias by inciting them to breach the barricade surrounding Dataran Merdeka, which “could have caused a riot or clashes”.-

“Semua orang terkejut, bukan saya seorang.

Marina Mahathir defend Klang church...

Amid threats of protest by Muslim pressure groups at a church in Klang this morning, progressive Muslims made a stand outside the church to defend their fellow Christian Malaysians.

Among the group was Marina Mahathir (right in photo), daughter of former prime minister Dr Mahathir Mohamad who like some 40 others, came bearing flowers and stood outside the Our Lady of Lourdes church as mass was in session.

"We are here to show solidarity with the congregation. A lot of us here are Muslims and we believe Islam is a religion of peace.

"It is not something that we only say (in words), but there must also be action," she told journalists outside the church.

A conservative Muslim group dubbed Sekretariat Solidariti Muslim Klang had planned to protest outside the Church after Lawrence Andrew, the editor of Christian publication The Herald, insisted that Christians will continue to use the word Allah.

However, in the face of mounting tension and criticism, they later decided to relocate their protest to a nearby field.

Selangor Umno which initially said that it too will protest in front of Churches, yesterday banned its members from attending such demonstrations, citing the need to maintain harmony.

Business as usual

Some 900 people turned up at the Church this morning for 8am mass proceeded as usual with parish priest Michael Chua leading the mass.

Lady of Lourdes Church administrator EA Louis said the congregation today, which spilled outside the Church and had to sit on plastic chairs, were no more than the usual.

"It's like any other Sunday. We all know it is our obligation to come pray and worship. We don't feel threatened. Nothing at all," he said.

He added that it was the right of any group to protest and the Church is leaving the matter to the authorities.

However, he expressed concern that interfaith relations may be affected until government leaders are willing to speak up.

The mass was like any other, with hymns and prayers until the very end, where Chua specifically addressed the recent controversy.

"A word of appreciation to the parishioners for not being cowered by what is happening and coming to mass to worship God," he said.

Chua also thanked supporters from other Churches as well as the Bar Council and MPs such as Seputeh's Teresa Kok and Klang's Charles Santiago who were present.

"The police have contained the protesters at a stadium on the other side so we pray they will be able to demonstrate and express their grievances peacefully and hopefully not march to the Church.

"Father Lawrence has also taken the brunt of blame for everything, and we pray for him. May good sense prevail," he said.

'Gesture of peace'

Later, Chua, met with Marina and the group she was with outside the Church and personally thanked them for support and they reciprocated by handing him flowers.

"I think it is a wonderful gesture to have so many Muslims come in solidarity. We hope this will grow - the ability to see beyond barriers and boundaries and to open hands in friendship to each other," he said.

At this, Marina replied: "It is a reciprocal gesture of peace. In Myanmar, the Archbishop of Rangoon also spoke up for the Rohingyas (Muslims). That is how it should be."

The "Muslim defenders" today were part of a Facebook initiative dubbed "In the Name of Allah" which invited to Muslims to defend the Church from the planned protest.

At least seven police personnel were spotted guarding the Church perimeter while another two community police members were assisting with traffic.

The congregation dispersed peacefully after mass ended at around 9am.-malaysiakini

Pakatan taking a leaf from BN's playbook...

First it was Selangor Menteri Besar Tan Sri Khalid Ibrahim with his pay hike for elected officials, and now it is Penang Chief Minister Lim Guan Eng with his new Mercedes Benz; both cases seem to point to Pakatan taking a leaf out of BN’s playbook.

Khalid drew fire when he announced very high pay hikes for elected Selangor state officials late last year.

Lim was heavily criticised when the state government decided to purchase a Mercedes Benz for him in place of his current Toyota Camry which is scarcely two months old.

One way to see it is to say that Pakatan leaders are indeed taking the cue from BN leaders in accumulating the perks of being in charge, Khalid with the Selangor pay hike and then Lim’s shiny new Mercedes.

However, that may not necessarily ring true as thus far both the Pakatan moves have been at least justified and have been argued to be far less than what some BN leaders have reaped officially and unofficially.

The Selangor pay hike, for all its controversy, was actually justified when even the BN majority Parliament had decided to increase pay for MPs and federal ministers.

And as PKR strategist Rafizi Ramli told a news portal, Lim's new official purchase is actually value for money.

But perhaps the particular strategy that Pakatan has learnt is to make use of the naturally short attention span of the rakyat in dealing with the fallout of seemingly unpopular decisions.

Indeed how many BN scandals have been swept under the rug from sheer overexposure and lag time in the media?

I mean, how many of us now make a fuss about the Selangor pay hike anymore? Justifiable or not, how many of us actually remember?

This is similar to the shooting-related deaths that had at one time shocked us in 2013, but which now seem the norm and no one pays attention to such cases unless they involve prominent personalities or unique circumstance.

And just as Khalid's “controversy” and all the others have died a quiet death, so perhaps shall the new hoohaa over the Penang CM’s new Mercedes Benz.

After all, this is what Pakatan had learnt the hard way in its campaigning, as issues of BN’s excesses it tried to bring to the rakyat may generate widespread reaction at the outset.

But all scandals will mostly fall through the cracks of public attention after a time unless there is actual traction to sustain the issue or “exposes” to highlight potential abuses.

As Rafizi opined, Lim is more than able to defend the purchase and believes the people will eventually accept it, despite the bad timing of the move when price hikes are burdening the rakyat.

“Pakatan will have to contend with one or two weeks of getting whacked by the media,” the Pandan MP told the portal further, shrugging off long-term effects of the blunder.

And as the person largely responsible for digging up and helping sustain the National Feedlot Centre corruption saga, Rafizi should know what he is talking about.

As out of the many “scandals” he and his Pakatan colleagues had highlighted, they know all too well that public apathy will almost always set in unless you can dig up more spicy tales or create consistent focus on the matter.

A lesson on public perception and the rakyat’s stamina for issue retention that perhaps Pakatan is now using to its own advantage, as Rafizi said it himself when commenting on Lim’s case, it is about timing and public relations.- Hazlan Zakaria, theantdaily

Guan Eng minta SPRM siasat pembelian Mercedes KM...

- Jabatan Penyiaran membeli 20 jam dinding pada harga RM3,810 iaitu 38 kali ganda lebih mahal daripada anggaran harga pasaran sebanyak RM100 dan tiga mesin pengimbas A4 pada harga RM14,670 setiap satu unit, lebih 70 kali ganda daripada anggaran harga pasaran sebanyak RM200;

- Jabatan Kastam telah menghapuskan kasut yang bernilai RM600,000 yang dibeli kerana tidak sesuai dengan pegawai mereka;

- Bangunan haram Kompleks Kastam dan Kuarantin Imigresen kerajaan negeri Melaka yang dibina atas tanah swasta, yang akhirnya melibatkan kos tambahan RM10.8 juta untuk memberi pampasan kepada pemilik tanah, ditambah lagi kos tambahan RM40 juta pada kos bangunan yang telah melonjak kerana kelewatan;

- Kementerian Belia membelanjakan RM3 juta secara mewah untuk sambutan Hari Belia Kebangsaan, termasuk RM1.6 juta untuk membawa kumpulan K-Pop dari Korea;

Merc RM657 ribu tapi dibeli dgn RM298 ribu kira oklaa tuu. Jumlah kerajaan negeri BN/Pusat bakar mercun seluruh negara sambut tawon baru... hampir setengah juta RM, dalam masa beberapa minit saja tapi kereta boleh pakai 20 tahun.

Pembaziran yg ni sapa boleh tolong jawab... Utusan ke TV3?

Ketika Lim Guan Eng dibantai kerana membeli kereta Mercedes dengan diskaun 55%, Najib pula tengah menikmati jet eksekutif kedua yang dibayar oleh wang rakyat.

Guan Eng welcomes MACC probe on Merc...

Penang Chief Minister Lim Guan Eng continues to battle public queries on his latest purchase of a Mercedes-Benz for official use by welcoming any proposed investigation by the Malaysian Anti Corruption Commission (MACC).

"Whether MACC will eventually investigate or not, full cooperation will be given to the commission as the state government is clean and I have nothing to hide," said Lim at a press conference today.

"I will not be asking MACC why no investigation was conducted on BN governments who made similar purchases without the 55 percent discount," he quipped.

"I am certain that MACC will find that the Penang government is as clean as a whistle as the whole transaction of purchasing the Mercedes Benz was handled by the state financial officer Mokhtar Mohd Jait, who has abided by proper and legal procedures with valid documentation," he added.

Lim was responding to a report in news portal FZ.com yesterday, quoting sources that claimed the commission has started a probe on the state's purchase of the 2012 Mercedez-Benz S300L.

The report alleged that MACC is trying to establish a link between the purchase from Lowe Motors Sdn Bhd and tycoon Tan Kok Ping, who is believed to have a stake in the company.

Tan has often been accused of having a "privileged relationship" with the state, and especially with Lim, however when the former's company, General Accomplishment Sdn Bhd, was charged RM30,000 by the court for illegal clearing on Bukit Relau, the CM had appealed for a higher sentence to punish the culprits.

A source within MACC told Malaysiakini that no such probe has been initiated, while the commission has denied that it had issued any statement regarding the matter.

Lim and Mokhtar have strongly defended the purchase of the car, but the chief minister has been labelled a hypocrite as he had previously criticised the Terengganu government for buying 14 Mercedes E200 at RM 245,000 totalling RM3.43 million, in 2008.

"I criticised them because they were not value for money. They did not get a 55 percent discount for the 14 Mercedes, unlike the 55 percent discount obtained by the Penang government when purchasing one Mercedes Benz," Lim later explained.

Probed for saving public money?

Lim said only in Malaysia will buying a car with a 55 percent discount and saving public monies be worthy of being probed by the MACC.

However, it is not worthy of investigation when buying at higher than market price and wasting public funds, Lim mocked.

The state government was dragged into the spotlight when it bought the Mercedes Benz S300L for RM298,263.75, at a 55 percent or RM358,954.25 discount and with tax exemption from the original price of RM657,218.00.

Lim mocked further that he is not surprised that MACC would probe the state government for saving money amounting to RM 358,954.25 while letting off those who buy at marked-up prices, as exposed in the annual Auditor-General's Reports.

He cited the latest 2012 Auditor-General's Report that exposed malpractices involving at least RM6.5 billion, including wastage of public monies.

Lim then rapped the MACC for not acting on such  wastage of public funds that involves a BN government, but takes a different approach when public monies are saved by a Pakatan Rakyat government.

"This is really Malaysia Boleh!" Lim exclaimed.- malaysiakini

RM100k Mercedes discount not only for Lim...

A generous RM100,000 discount on a Mercedes Benz S300L for Penang Chief Minister Lim Guan Eng has raised questions whether it was in exchange for favours.

No, said a dealer. The offer, he revealed, was not exclusively for Lim.

The discount is part of Mercedes-Benz's year-end offers and stock clearance exercise to anybody who buys a 2012 model of the Mercedes Benz S Class vehicle, The Star quoted an unnamed dealer a saying.

"The discount is offered to anyone, including individual buyers, as long as the 2012 stock is still available," the MCA-run English daily quoted the dealer as saying.

However, he said, that offer does not apply to the newer models.

The Penang government had on Dec 31 last year, announced the purchase of a Mercedes Benz S300L, which will be the chief minister's new official vehicle, for RM298,263.75.

State financial officer Mokhtar Mohd Jait defended the purchase, saying the original price was RM657,218 but the state was given a tax exemption and a discount of RM100,000.

He also confirmed later that the Mercedes Benz S300L bought for Lim was a 2012 model.-malaysiakini

Nasi lemak rm1.50 sen,air suam 70 sen, tapi Najib dok syiok naik jet mewah barunya lagi...

Najib jetting around in new luxury aircraft...

Amid austerity measures, pro-Umno bloggers are questioning whether Prime Minister Najib Abdul Razak is now jetting across the country in a new luxury aircraft.

In blog postings by, among others, Big Dog and RockyBru, they pointed to an Airbus ACJ320 with tail number 9H-AWK using the call number, "Perdana 2" or "NR2" - which incidentally are similar to Najib's initials.

The aircraft is registered in Malta and leased from aviation group -Comlux.

According to aviation news website Aviation Week, Jet Premier One (M) Sdn Bhd, the company which manages flights for VVIPs in Malaysia, including Najib, had indeed leased the Airbus ACJ320 from Comlux.

The lease was supposed to be a temporary replacement for the regular aircraft Najib uses, an Airbus ACJ319, being refurbished by Comlux Aviation Services.

The Airbus ACJ319 with tail number 9M-NAA operated under the call name “NR1” or “Perdana 1” and is the official aircraft for the prime minister, similar to that of the US president’s Air Force One.

It first came under the spotlight in 2011 when Najib flew on the Airbus ACJ319 to Perth, Australia, apparently on holiday.

In a press release by Comlux May last year, the company had announced it had won a contract to rework the VIP area of the Airbus ACJ319 as well as handle scheduled maintenance works for six years.

The company did not specify the value of the project.

In the interim, Comlux leased an Airbus ACJ320 with tail number 9H-AWK to Jet Premier One.

It took over the call name of  “NR1” and "Perdana 1" and was spotted taking off from the Kuala Lumpur International Airport on Oct 6 to Denpasar Internatonal Airport, Bali, according to flight enthuasist site Jet Photos.

Najib left for Bali on Dec 6 for the Asia Pacific Economic Conference (Apec) Summit.

'RM27k an hour operate'

The aircraft comes with a lounge, a private room equipped with personal bathroom and has wifi and phone access while in the air.

Comlux did not reveal how much the plane was leased for but according to the company's brochure, the approximate operating cost for its Airbus ACJ320 flight is US$8,350.31 (RM27,501.75) per hour.

In another press statement in October last year, Comlux announced that it has completed refurbishing the “head of state of Malaysia aircraft” Airbus ACJ319 after working on it since its arrival at its US base in June that year.

Despite the return of the plane, the lease for the Airbus ACJ320 appears to be still e active and has been spotted jetting around in Malaysia.

The Airbus ACJ320 changed its call name to "NR2" or "Perdana 2" while the ACJ319 took back its call name "NR1" or "Perdana 1".

According to air traffic tracker website Flight Radar 24, the Airbus ACJ320 with tail number 9H-AWK last took off from KLIA to  under the call name "NR2" on Dec 31.

The site also recorded the Airbus ACJ319 with tail number 9M-NAA taking off from KLIA on Dec 26 under the call name "NR1".

In a parliamentary reply on Nov 7 last year, Minister in the Prime Minister's Department Shahidan Kassim revealed that the government spent RM14.95 million for fuel and RM160.08 million in maintenance for VVIP flights in 2012.

The government aircraft include a Falcon, Global Express, Boeing Business Jet, Blackhawk, two Augustas and a Fokker F28.

However, that reply did not  mention either the Airbus AC319 or Airbus ACJ320.

‘PMO says aircraft lease over’

In an immediate response, the Prime Minister’s Office (PMO) said the lease of the Airbus ACJ320, which started on Feb 1, 2013, ended on Dec 31 that year.

The PMO added that the lease of the Airbus ACJ320 was necessary due to a shortage of government aircraft.

Prior to this, it said the government had five aircraft, namely the ACJ319, BBJ, Fokker F28, Global Express and Falcon 900.

“In August 2012, the Fokker F28 aircraft was decommissioned as it was over 30 years old and was not replaced.

“Last year, the BBJ and ACJ319 were scheduled for compulsory maintenance. The BBJ went through maintenance between January to July 2013 while the ACJ319 went through maintenance between June 15 to Oct 8, 2013.

“As such, the PMO which is responsible for special government aircraft took the decision to lease the ACJ320 to overcome the shortage of aircraft,” it said.

The PMO added that the aircraft were not exclusively for Najib but is also used by the Agong, sultans, yang di-pertuas, ministers, deputy ministers, foreign guests to the federal government, senior government officials and VIPs.

It added that the aircraft allowed these individuals to move in and out of the country safely and helps with their busy schedule.
