The Malaysian Constitution...

1. When the MacMichael Treaties (or agreements) were signed, the states of Malaysia became a colony of the British. The Malayan Union would be ruled entirely by the British. The Malays could no longer claim ownership of the states. There no longer was a Tanah Melayu or Malay Land.

2. As one, the Malays rose in protest. Such was their unity the British had to back down and abrogated all the MacMichael Treaties. The British agreed to replace the Malayan Union with the Federation of Malaya. Officially the accepted name was “Persekutuan Tanah Melayu”. It reverted to being a protectorate by treaty.

3. The Government of the Federation of Malaya was led by the High Commissioner as the Chief Executive, presiding over the Executive Council and the Legislative Council. All members were nominated by the High Commissioner.

4. In 1955 the British decided to hold partial election for 52 of the 98 seats of the Federal Legislative Council.

5. The British believed that no single party could win more than 49 seats to claim a right to form a majority Government.

6. In the event the Alliance of Umno, MCA and MIC won 51 of the 52 seats and was able to claim the right to form a home-rule Government.

7. Immediately there was a clamour among the people and the parties in the Government for independence.

8. Negotiations were held in London and eventually it was agreed that Malaya would become independent in 1957.

9. In preparation for this, the Reid Commission was tasked with drawing up the independent Federal Constitution.

10. It was agreed that Malaya would be a democracy where the people would choose the Government. The rulers would be constitutional heads without executive power. Their position would be guaranteed by the Constitution which would be the supreme law of the country.

11. The party winning the election would name the Prime Minister (or the Chief Minister – Menteri Besar) and the constitutional head would endorse.

12. Should the constitutional monarch refuse to endorse and proposes his own candidate and endorses him, the winning party can reject him in the assembly – ‘dewan’, through a vote of non-confidence.

13. The constitutions of Johore and Terengganu, which were promulgated earlier, were nullified by the new constitution which was accepted by all the states of Malaysia. Accordingly on the 9th of May, 2018, the peoples of Malaysia went to the polls to elect the Governments of (the Federation) Malaysia and the Governments of the states.

14. It is important that everyone concerned respects the constitution and abides by it. Failure to do so would negate the rule of law. - chedet

3. Kerajaan Persekutuan Tanah Melayu diketuai oleh pesuruhjaya tinggi sebagai ketua eksekutif, yang mengetuai Majlis Eksekutif dan Majlis Perundangan. Semua anggotanya dicalonkan oleh pesuruhjaya tinggi.

4. Pada 1995, British memutuskan mengadakan pilihan raya untuk 52 daripada 98 kerusi dalam Majlis Legislatif Persekutuan.

5. British percaya tiada satu parti akan menang lebih 49 kerusi untuk menuntut hak membentuk kerajaan majoriti.

6. Tetapi Perikatan Umno, MCA dan MIC menang 51 dari 52 kerusi dan berjaya menuntut hak membentuk kerajaan pemerintahan sendiri.

7. Sejurus selepas itu kedengaran suara-suara di kalangan rakyat dan parti dalam kerajaan untuk menuntut kemerdekaan.

8. Rundingan dibuat di London dan akhirnya dipersetujui Malaya akan merdeka pada 1957.

9. Sebagai persediaan untuk itu, Suruhanjaya Reid ditugaskan merangka perlembagaan persekutuan yang merdeka.

10. Malaya dipersetujui menjadi negara demokrasi yang rakyat bebas memilih kerajaan. Raja-raja akan menjadi ketua berperlembagaan tanpa kuasa eksekutif. Kedudukan mereka akan dijamin oleh perlembagaan sebagai undang-undang tertinggi dalam negara.

11. Parti yang memenangi pilihan raya akan menamakan perdana menteri (atau menteri besar) dan ketua berperlembagaan akan merestuinya.

12. Jika raja berperlembagaan menolak merestuinya dan mencalonkan serta merestui calon sendiri, parti pemenang boleh menolaknya dalam dewan, melalui undi tidak percaya.

13. Undang-undang tubuh Johor dan Terengganu yang diisytiharkan sebelum itu terbatal dengan perlembagaan baru yang diterima oleh semua negeri-negeri di Malaysia. Pada 9 Mei 2018, rakyat Malaysia mengundi untuk memilih kerajaan (Persekutuan) Malaysia dan kerajaan negeri-negeri.

DNAA in alleged molest case...

The Kangar Sessions Court today gave a discharge not amounting to an acquittal to Arau MP Shahidan Kassim, who was accused of molesting an underage girl in his car six months ago.

Lawyer Zamri Ibrahim, representing Shahidan, said that Sessions Court judge Ainul Shahrin Mohamad made the decision after being informed that the prosecution did not want to proceed with the case due to the victim not wanting to be questioned, even in camera.

"Today it was the victim’s turn to testify. She is the fifth prosecution witness. 

"The victim when testifying initially had confirmed the police report lodged by her, but thereafter told the court that she did not want to be questioned further, and did not want to continue with the case," he said.

Zamri said the prosecution then informed the court that they did not want to call the next witness, and asked that the accused be given a discharge not amounting to an acquittal under Section 254 of the Criminal Procedure Code.

Shahidan, 68, a former minister in the Prime Minister’s Department under the previous government, was charged with molesting the girl, who was then aged 15, in his Toyota Harrier SUV at the compound of the Tuanku Syed Putra Stadium on Oct 20, 2018, at about 11.30pm. 

He was charged under Section 14(a) of the Sexual Offences Against Children Act 2017, which provides for imprisonment of up to 20 years and whipping, if convicted.

Shahidan when asked to comment on the court's decision afterwards, simply said: "I am fasting, I am a Muslim."

The prosecution was conducted by Perlis prosecution director Mohd Nordin Ismail.

The case, hearing of which began yesterday, had called two witnesses to testify. Earlier today, the court heard testimony from two witnesses who testified in open court.

After that, the complainant was called to testify in camera, and the court asked the members of the public seated in the gallery to leave the courtroom.

Earlier, Norzuki Husin, who is in charge of the Kangar Special Branch, testified that he did not know the case clearly until he was informed by his friend Saiful Anuar Abdul Hamid, a member of Buskers DSSK, while they were having a drink at a shop in Kuala Perlis on the evening of October 20, 2018.

He said he did not influence the family of the girl to lodge a police report and had only read the report made by the complainant while at the Kangar police headquarters the next day.

Another witness, Abdul Fatah Abdul Manaf, testified that he was the officer who recorded the complainant's statement for the report at 3am on Oct 21, 2018, and also recorded her statement again when she came to withdraw the complaint at 11am the same day.

“I only handled the case for a week before I was directed to hand it over to ASP Salwani (no full name) from the Perlis contingent headquarters,” said Abdul Fatah.- Bernama

A Humiliating U-Turn...

Events unfolding the last weeks reached a climax when the Pakatan Harapan government, led by Dr Mahathir, reneged on its promise to ratify the much-anticipated UN-sponsored Rome Statute. In doing so we have joined the ranks of other non-signatory countries such as the People’s Republic of China, India, Saudi Arabia, Israel and Indonesia, to name a few. Incidentally, United States of America and Russia were signatories once but have since withdrawn ratification for reasons best known to them.

The Rome Statute forms the basis for the establishment of the International Criminal Court (ICC) at The Hague. It was adopted following a diplomatic conference in Rome on July 17, 1998, and was enforced worldwide on July 1, 2002. As of March 2019, 124 member countries of the United Nations are party to the statute. Unfortunately, Malaysia is one of the handfuls of countries who has yet to ratify.

The Rome Statute oversees four international crimes namely, genocide, crime against humanity, war crimes and the crime of aggression. The ICC can investigate and prosecute those committing the aforementioned crimes when states are unable or unwilling to do so themselves.

The court has jurisdiction over crimes committed in the territory of a state party or if they are being committed by a national of a state party. The court too has jurisdiction over crimes when authorised by the United Nations Security Council.

The arrest of Chile’s dictator General Pinochet in London on October 10, 1998, for numerous human rights violations in Chile and his subsequent trial in Chile, is a case in point. Pinochet was also accused of amassing over USD28 million when he was the de facto leader of Chile from 1974 to 1998.

In short, the ICC is a court of last resort to prosecute those who committed atrocities in places where national authorities could or would not step in. Had America not decided to use Emperor Hirohito as “a tool to control Japan” he would have been tried along with his Prime Minister, General Hideki Tojo.

Hypothetically speaking, had Najib Razak refused to concede defeat in spite of his party’s loss in the May 9, 2018, general elections and, aided by a corrupt Election Commission, no official results were forthcoming, Pakatan Rakyat would remain in political limbo for good. Scandal-plagued Najib, having gained the upper hand, would declare a state of emergency to reinforce his power. The police and the military would meekly follow whatever Najib told them to do. After all, cousin Hishamuddin Hussein was the Defence Minister and Javanese immigrant, Zahid Hamidi, was the Home Minister.

To flex his political muscle Najib would have decreed that all opposition leaders be incarcerated while his one-time mentor now nemesis, Dr Mahathir be abducted just like Pastor Koh and activist Amri Che Mat using the Police Special Branch to do the dirty work. And while his enemies languished behind bars Najib, his wife Rosmah and his corrupt ministers would continue to plunder the nation and live happily ever after.

If the above scenario happens what can we do? Frankly speaking, there is nothing we can do other than to knock ourselves silly for allowing the unthinkable to happen. However, had the country signed the Rome Statute, Najib could be investigated and prosecuted for committing one of the four fundamental crimes mentioned.

It is simply ridiculous that a likeable monarch like Sultan Ibrahim of Johor would object to the country ratifying the Rome Statute. There are absolutely no discernible reasons why the sultans should reject the international treaty unless they have plans to commit the four international crimes – genocide, crimes against humanity, war crimes and crime of aggression.

And like the ICERD (International Convention on the Elimination of All Forms of Discrimination) Prime Minister Dr Mahathir on Friday, April 5 announced that Malaysian would make another U-turn by not endorsing the Rome Statute.   

On the same day Umno kingpin Ismail Sabri, the former Minister of Rural and Regional Development, announced that Selangor Umno would protest to the Sultan of Selangor against Malaysia acceding to the Rome Statute as “it affects the sovereignty of the Malay rulers” he claimed.

Well, it does not take a rocket scientist to conclude that after inciting the Johor Sultan, Umno is roping in the Selangor Sultan to go against the Mahathir government. And it is not difficult to put the sultans at loggerheads with Dr Mahathir, as the grudge between the two started decades ago in 1993 when Mahathir stripped the royalty of its legal immunity.

There were even rumours of a possible military coup should the inevitable happen. Being a former soldier I am somewhat amused by these revelations. Coup is a foreign word to our armed forces. The closest the country had come to one was when General Mohamad Sany, the then Army Chief, threatened to let soldiers on the streets if their demand for a pay revision was not entertained by the government. This was in 1972. Fortunately, nothing untoward happened.

The general consensus is Mahathir is pussyfooting in sending all these Umno goons to prison for corruption, money laundering, grand larceny, tax evasion and what have you. Instead in an attempt to hasten the transformation his nascent political party PPBM (Bersatu) into an Umno lookalike he has been happily accepting corrupt lawmakers from Umno.

And worse, Mahathir’s own party lacks talents so much so that even leaders with fake degrees are being treated like lords. Instead of leveraging on his earlier promise to promote meritocracy and communality, he chooses to play the overused 3R game – race, religion and royalty. This concoction is deemed unsavoury and counterproductive as well.

Q. Are you happy with the way the media portrayed you and the government in this past one year?

Dr.M - The media interprets what we say. It is not always what we say that is publicised. Sometimes, we are victims because of that. As far as the media is concerned, I am used to being called nasty names. I don’t care about that, you can call me what you like. I have to concentrate on my work and even if the media says those things, people would not believe them. The onus is on the media itself to control itself. We don’t want to have censorship. On the other hand, the media must report the truth. And we have abolished the anti-fake news law but people still make caricatures, insult people and all that. That should stop by itself. We don’t want to use force to stop.

Q. When you leave office, what is the Malaysia you would like to see?

Dr.M - In terms of performance, it should be like the years (when) I was (the fourth) Prime Minister. The country has obviously and physically grown. You see people moving into new areas of business because things are going to change and your response must be quick. Nowadays, you talk about artificial intelligence and blockchain. You have to know something about that, for the man in my position, to resolve this problem or to apply this technology. You have to read also. Mantra 'cash is king' memperlihatkan Melayu rapuh semangat, jadi munafiq, dikuasai syaitan yang mendendangkan syurga dunia. Islam diperdagangkan tanpa malu dan segan. Alim ulamak jadi ular dalam semak, menghalalkan kemungkaran sebagai pasot ke syurga dunia. Lihat muka-muka lusuh, bodoh, berminyak yang mengiringi bossku. Jangan salahkan bangsa lain kalau Melayu menjadi bangsa hina. Cermin diri sendiri. Kaji kekuatan dan kelemahan kepimpinan Melayu sejak 1957 sampai era Melayu sekarang. Jangan emosi melulu menunding jari pada bangsa lain. Melayu sekarang hilang maruah, tiada jatidiri, rapuh semangat, emosi menggila, miskin ilmu, jadi munafiq. Mereka hilang pedoman hidup seperti layang-layang putus tali.

Melayu mesti buka minda, kuasai ilmu, hadapi cabaran hidup dengan segala kejantananmu, berpegang teguh pada tali Allah, dan mesti mempertahankan keadilan, hak dan kebebasan rakyat, berjiwa patriotis dan bersatu tekad memperjuangkan nasib bangsa, agama dan tanahair tercinta. Money Trail Established – Najib’s Lawyer Now Hopes The Judge Will Be Too Stupid To Realize Najib Is Faking His Stupidity...

For years, Najib administration had been rubbishing the Wall Street Journal’s exposure of money laundering in the 1MDB scandal. The former prime minister had also played down the role of his partner-in-crime, Jho Low (full name: Low Taek Jho), in plundering billions from the 1Malaysia Development Berhad sovereign wealth fund.

Ironically and amusingly, Najib’s powerful lawyers have to now depend on the “Billion Dollar Whale” book written by the WSJ correspondents, Tom Wright and Bradley Hope. Attorney Harvinderjit Singh read out in court excerpts from several WSJ reports and the book chronicling the 1MDB scandal and fugitive businessman Low Taek Jho’s role in it.

Najib’s lawyers have requested several documents to defend their client, but at the same time told the court that they were not admitting that the contents of the book and reports were true. In short, Najib’s team of top lawyers is “cherry-picking” whatever contents of the book that are favourable to the disgraced former leader of Malaysia.

Not only has the defence indirectly admitted the credibility of the “lies” spewed by the Wall Street Journal, and Sarawak Report for that matter, they have also produced the “Billion Dollar Whale” in court as testimony that crooked Najib had been a victim of a scam. They wanted detailed transcripts of the conversation between Jho Low and Joanna Yu to be produced.

The plan was to establish that Jho Low and Joanna Yu, Najib’s relationship liaison manager at Ambank, were the culprits. Muhammad Shafee Abdullah, lead counsel of Najib Razak, claimed the defence team already has copies of BlackBerry messages of Joanna Yu. And if the prosecution is unable to produce the document, there would be “trouble”.

Shafee said the transcript was a vital piece of evidence for the defence team – “It is a very important matter. If they (the prosecution) are trying to hide it, then it would be the end of them. They cannot hide it as it has been raised everywhere, including by The Wall Street Journal and Sarawak Report. If it has gone missing, there would be big trouble.”

Money Trail From SRC Into Najib Razak Accounts

It seems Najib’s so-called hotshot lawyer has been reduced to relying on articles published in the WSJ and the book detailing transcripts of the conversation between Jho Low and Joanna, where the duo discussed how to conceal information concerning Najib’s account – obviously a trick called “plausible deniability” to protect the PM. So the new mission is this – to prove that Najib was a victim of a conspiracy by Jho Low and his gang.

Besides Joanna Yu, the defence team has demanded all communication between Jho Low and others included Nik Faisal Arif Kamil, Jerome Lee Tak Loong, Terrance Geh Choh Heng, Jasmine Loo, Shahrol Azral Ibrahim, Mohamed Azhar Osman Khairuddin, Ismee Ismail, Suboh Mohd Yassin, and See Yoh Peng – a fishing expedition tactic.

Attorney Shafee declares – “My client does not deal with his account himself. He was misled and is a victim.” So the line has been drawn. Najib was a good and honest person. He was misled, tricked, scammed, cheated, swindled, conned, lied, deceived, swindled, exploited, duped, hoodwinked, fooled, misguided, bamboozled and whatnot by a group of scammers led by Jho Low.

The game plan was to convince the judge, the people, and even the US Department of Justice, that Najib was actually a stupid prime minister – and hopes judge Mohd Nazlan Mohd Ghazali will be too stupid to realize that Najib is actually pretending his stupidity. Call Najib a sucker or whatever, but his lawyers desperately need the judge to believe that the ex-PM was really that dumb.

Yes, there’s little room for Najib to wriggle out of criminal breach of trust and abuse of power trial in the SRC International Sdn Bhd after the trial of the century entered its fourth day on April 17. Hotshot lawyer Shafee can no longer dispute the overwhelming evidence of the money trail from SRC International to subsidiary companies Gandingan Mentari Sdn Bhd and Ihsan Perdana Sdn Bhd and into Najib’s accounts.

Two officers of Bank Negara Malaysia (Central Bank of Malaysia) have already testified about their raid at Ambank and Affin Bank on July 6, 2015, retrieving details about the accounts owned by Najib Razak, SRC International, Gandingan Mentari and Ihsan Perdana. The despicable man had received RM42 million in three tranches of payments of RM27 million, RM5 million and RM10 million.

The question is,from where comes the amount of money 

in Najib's account and who put it in?

A fifth witness, AmBank cheque processing senior manager Badrul Hisam Mohamad confirmed yesterday (April 18) that a total of 15 cheques amounting to RM10.77 million (RM10,776,514) were issued by Najib during the month of January and February 2015 via his personal AmBank and AmBank Islamic accounts. He also confirmed 17 cheques worth nearly RM30 million were issued by several AmBank accounts.

Najib’s defence team tried to disqualify a sixth prosecution witness from testifying yesterday (April 18), but was rejected. Zulkarnain Mohamad testified that his company ABS Trend Master Sdn Bhd had received a RM100,000 cheque for works carried out in Najib’s residence at Jalan Langgak Duta – including the building of a dry kitchen, clothes cabinet and pantry.

The seventh prosecution witness, plumbing company owner Mohammad Zakariyya Zearat Khan said he was hired to install a 12,000 litre water tank, due to the house having frequent water disruptions. His company Mox (M) Sdn Bhd was paid with a cheque for RM56,500. Ambank manager Badrul Hisam Mohamad has also confirmed cheques made out to ABS Trend master (RM100,000) and Moz (RM56,500).

The burning question is – will the judge believe that Najib was so stupid that he did not know the legitimacy of the RM42 million transferred into this account, but miraculously was clever enough to issue cheques for his home renovations? He had also issued cheques for UMNO divisions, not to mention a RM3.5 million cheque to another of this hotshot lawyer, Hafarizam Harun.

The cheque to Mr Hafarizam’s legal firm – Hafarizam Wan & Aisha Mubarak – hit a snafu when the court was told how instead of RM3.5 million, only RM3,500 was transferred by Najib into the law firm’s account on Feb 12, 2015 due to an input error made by the receiving bank, namely the CIMB Bank branch at the Putra World Trade Center (PWTC).

Well, as comical as it may sound, the supposedly dumb Najib Razak was somehow smart enough to pay the balance to his lawyer through the Real-time Electronic Transfer of Funds and Securities System (RENTAS), as testified by AmBank cheque processing senior manager Badrul Hisam Mohamad. So, he can be fabulously dumb at one moment, but would regain his intelligence at another moment.\

In January this year, a total of 145 mule account holders were detained following a three-week nationwide crackdown against scammers. The police said – “The basic modus operandi for mule accounts are large sum of money will be transferred into the account and will be withdrawn soon after. The accounts were used for various cyber-crimes, including Macau Scam, loan scams, and e-commerce scams.”

Those detained gave multiple explanations such as being “duped” into being mule account holders, including claiming that their banking information was misused when they borrowed from loan sharks, or giving their bank account and ATM details to new acquaintances they met online. Some even claimed that they lost their wallets, which contained their ATM cards and other banking details.

Is Najib’s band of top lawyers trying to prove that their client, the 6th Prime Minister of Malaysia and the Finance Minister from 2009 to 2018, was as dumb as those 145 mule account holders so much so that he had been scammed by Jho Low and his gang for years? Hotshot lawyer Shafee should stop insulting the people’s intelligence with such cock and bull story.

Even if the judge is too stupid to believe Najib’s incredible stupidity, there’s one problem. The serial liar has been telling all and sundry that the money discovered in his account were donations. He had even released partial documents which he claimed as proof that Saudi Prince Abdul Aziz Al-Saud had indeed donated hundreds of millions of Ringgit to him.

How could a donation story suddenly become a Macau Scam? It would definitely be fun to see if the judge believes Najib was really clueless about being conned, but was super-smart to detect some missing chocolate in his fridge after police raided his home last year. Attorney Shafee should stop consuming too much toddy before going to court. - FT

Isu Statut Rom mengapa 

4 pensyarah membisu....

Ada pihak cuba menangguk di air keruh, sengaja menimbulkan krisis antara kerajaan PH dengan raja-raja Melayu. Dari kenyataan Tun M mengenai isu Statut Rom kononnya ada dalang yang cuba menimbulkan ketegangan antara raja-raja Melayu dengan Tun M. Sejak diberi pengampunan oleh Agong Anwar nampaknya begitu berminat mencium tangan sultan. Bagi mereka yang tahu watak peliwat super tegar ini dapat membaca kilat dalam kilaunya. Bagi Tun M ikan menangkap sudah tau jantan betinanya.

Aneh bin hairan kononnya ada empat orang pensyarah yang kononnya pakar bidang undang-undang menyembah buah fikiran mereka kepada Majlis Raja-raja. Kononnya menurut tafsiran mereka Statut Rom bahaya kerana ia akan menghapuskan kedaulatan negara dan mungkin institusi raja juga. Maka gubralah mereka yang mendengar pendapat itu. Ada pula orang mengipas di angin lalu mengharapkan raja-raja Melayu mengambil tindakan tertentu terhadap Tun M.

Yang jadi tandatanya siapakah yang memperkenalkan empat pensyarah kepada Majlis Raja-raja itu? Apakah ada orang politik yang meroyan membisik nama-nama pensyarah itu kepada salah seorang raja Melayu? Mustahil raja-raja Melayu mengenali keempat-empat orang tersebut. Malah banyak orang pun tak mengenali mereka apakah mereka itu akademik kawakan atau bertaraf kangkung.

Sekiranya mereka mempunyai integriti, maruah dan jujur sebagai ahli akademik maka wajar mereka menerima jemputan para pelajar UM untuk mengambil bahagian dalam forum mengenai Statut Rom. Jangan menyepi diri, dan takut berhadapan dengan para mahasiswa yang ingin mengetahui dan menguji kepakaran metreka dalam bidang undang-undang.

Sebagai ahli akademik mereka mestilah berani mempertahankan buah fikiran mereka dengan fakta dan ilmu dan bukan syok sendiri. Sekiranya mereka bukan jenis akademik status kangkung terimalah jemputan mahasiswa UM. Kita harap forum itu terbuka kepada orang ramai kerana isu Statut Rom menarik perhatian kerajaan dan juga rakyat Malaysia. - Yahaya Ismail

Dr.M Seems Hungry For 

A War With The Monarchy...

Without hidden hands, the Sultanate of Johor would not dare attack Mahathir government so openly. It definitely smells a rat when some nine student activists exposed how a group of four academics from local universities were involved in advising the Conference of Rulers and convinced the monarchies to reject the Rome Statute.

The gang of four who had apparently ill-advised the Conference of Rulers are Universiti Teknologi Mara’s deputy vice-chancellor and dean of Faculty of Law Prof Rahmat Mohamad, International Islamic University of Malaysia’s law lecturer Assoc Prof Shamrahayu Ab Aziz, and Universiti Sains Islam Malaysia’s law lecturers Fareed Mohd Hassan and Hisham Hanapi.

Is there anybody out there actually believe the nine sultans in the country somehow had approached the four academics to prepare some papers on Rome Statute and presented them “secretly”, without any involvement from some politicians who harboured the evil intention of triggering a conflict between the country’s monarchy and the new government?

Strangely, Johor Crown Prince Tunku Ismail fired his first shot at Mahathir administration on March 10, claiming that there could be orchestrated war crimes to eliminate the country’s royal institution, but the papers prepared by the four academics were dated April 2. It was like an afterthought that some “biased” papers were prepared to justify the rejection of the Rome Statute.

The justification papers conveniently but laughably used the tribunals set up against Emperor Wilhelm II of Germany and Emperor Hirohito of Japan – two monarchies who were involved directly in World War I and World War II, respectively – to conclude that the Malay Rulers in the country were not immune from prosecution by the ICC (International Criminal Court).

While it is a public knowledge the majority of the local university lecturers possess an IQ worse than a carrot, it’s flabbergasting that the supposedly wise Sultanate of Johor actually believed Emperor Hirohito was innocent. The Japanese emperor was directly responsible for the war crimes committed by the Empire of Japan in many Asia-Pacific countries during the period of Japanese imperialism.

Is there any plan by the country’s monarchy to expand the Empire of Malaysia through military invasion and imperialism against its neighbouring countries, Southeast Asia, and even Asia-Pacific for that matter, and in the process slaughter millions of innocent lives, the same way the Empire of Japan had done under Emperor Hirohito during the World War II (1939-45)?

Don’t make my toes laugh. Only four out of the 28 Russian fighter jets owned by the Royal Malaysian Air Force (RMAF) are able to take to the skies – revealed Defence Minister Mohamad Sabu last July. Any military intervention needs tons of money. The Malaysian Army’s financial state was so pathetic that army trucks were used to transport students to schools.

The jurisdiction of Rome Statute of the International Criminal Court (ICC) covers four international crimes – genocide, crimes against humanity, war crimes, and crimes of aggression. The reason the U.S. is not a member is because the global community will punish America for its aggressive foreign policy by using the ICC to prosecute American soldiers and other military actors.

Malaysia Monarchies - Sultans

Obviously, the nine Malay Rulers in the country will not be subjected to ICC prosecution simply because Malaysia is a constitutional and not an absolute monarchy, unlike Japanese Emperor Hirohito. Hence, the fierce rejection of the Rome Statute, especially by the Sultanate of Johor, was nothing but a political game seeking revenge by the second generation of the monarchy.

The Johor Crown Prince has made it his personal vendetta against Mahathir even before the corrupted Najib regime collapsed last May. Back in 2016, the prince cried, whined, moaned and bitched about the old man. Basically, he was referring to the 1993 Constitutional Crisis – which involved the stripping of the monarchs’ legal immunity.

The Johor prince, who was only 8-year-old during the crisis, said – “I will never forget the 1992 constitutional crisis. I remember things such as trying to disband the Johor Military Force, Johor Exco members were told not to receive my late grandfather at the airport, how JKR was told not to fix and maintain anything at any of the Johor Palaces.”

Recalling how his mother was stopped by Malaysian officials upon her return home from Singapore, the crown prince said – “I still remember how my family was treated by the federal government officers. She was told to step out of the car because they wanted to inspect everything in the car. I still remember everything and I still remember the individuals responsible for it.”

 

Rome Statute - ICC International Criminal Court Building

The Johor Crown Prince might still feel insulted that his family was stripped away the VVIP treatments during the 1992 crisis. However, the fact remains that had his grandfather (Sultan Mahmud) behaved and didn’t beat up hockey coach Douglas Gomez in 1992, not to mention the murder of a golf caddie in 1987 while serving as Agong (King), Mahathir would not have had the excuse to strip the monarchy of their immunity.

The intervention of Sultan Ibrahim of Johor in protecting his crown prince has made the war of words between the 93-year-old PM Mahathir Mohamad and the 35-year-old Crown Prince Tunku Ismail more explosive than Donald Trump and Kim Jong-Un during the nuclear weapon confrontation. Things heated up a few notches after Mahathir told all and sundry that the Johor prince was not above the law.

On the day Johor Menteri Besar (Chief Minister) Osman Sapian was rumoured to resign, the crown prince childishly tweeted that his father, the Sultan of Johor, had wanted to replace Mr Osman for some months. He said – “The order to change the Menteri Besar has been said before. But someone else wants to take the credit and mileage, as if he ordered it.”

Without the crown prince realising it, his admission that Chief Minister Osman only resigned two days ago (April 9) after a meeting with Mahathir, despite months of lobbying by the Johor Palace to replace him, goes to show that the prime minister is still the boss calling the shot, and not the royalty as the future Sultan of Johor would like people to believe.

But the biggest controversial remark which attracted the attention of PM Mahathir was when the crown prince said that the power to choose the Menteri Besar (Chief Minister) is the absolute right of the Sultan. Get real, if the Sultan of Johor possesses the absolute right to do so, it would not be known as constitutional monarchy but an absolute monarchy, would it not?

Going by the sultan’s amusing logic, probably his crown prince can contest for a state election and upon winning the seat; the monarch can thereafter appoint his own son as the Chief Minister. Perhaps the Johor Sultan thinks the Kingdom of Johor was an “independent nation” when he warned unnamed parties, obviously referring to premier Mahathir, not to interfere with his state’s affairs.

Mahathir gladly and cleverly answered that the federal government is authorised to comment on Johor’s affairs as the state is part of the federation. The prime minister, despite his advanced age, has proven to be a hard nut to crack when he said the role of appointing the new Johor Menteri Besar lies with the party that won the election, not with the Johor Sultan.

Like it or not, Mr. Mahathir is the only man in the entire nation who has the balls of steel to confront the monarchies. Not even PM-in-waiting Anwar Ibrahim has a fraction of the old man’s guts when comes to war with any of the nine sultans. In fact, the more one tries to intimidate or bully the world’s oldest prime minister, the more he will fight back.

The Sultanate of Johor, and the rest of the monarchies for that matter, should be careful what they wish for. At Mahathir’s current ripe age of 93, do you really think he is afraid of anybody or anything now? He has nothing to lose but everything to gain should the royalty challenges him to a war. In fact, he’s begging the monarchy to declare war on him.

 

Johor Crown Prince Tunku Ismail Sultan Ibrahim

Today (April 11), PM Mahathir fired his first warning shot – “There have been a lot of attempts to make the Rulers unhappy with the government. But it is not going to succeed. It will fail. They cannot just get rid of the government and substitute it, unless of course you want to drop democracy and become a kleptocracy or become an autocracy.”

While his statement does not sound very threatening or fearsome, it contains hidden messages which could be absolutely deadly. Mahathir is notorious for saying one thing but meant another altogether. Any dumb moves or missteps from the Sultanate of Johor could be interpreted as possible attempts of overthrowing the legitimate government or even inciting an uprising against the Agong (King).

If the Johor Palace is not careful, not only the crown prince, but also Sultan Ibrahim himself could be dragged and charged in a Special Court. Established in 1993 after the Constitutional Crisis, the Special Court has exclusive jurisdiction to try all offences committed in the Federation by the “Yang di-Pertuan Agong (King)” or the Ruler of a State, which in this case include Sultan Johor.

Perhaps the Sultanate of Johor thinks Mahathir, who ruled the country with an iron-fist for 22 years from 1981 to 2003, is an easy meat today due to his old age. The question is can you handle the old ginger? If he could single-handedly tame the nine monarchies when they still possessed immunity in 1993, how difficult it is to handle a sultanate without immunity today?

For all you know, Mahathir probably has already prepared the necessary chess pieces for the Royal Rumble. One has to remember the life of this old horse is on the battlefields. Retirement makes his life dull and meaningless. He had brought down his successors PM Abdullah Badawi and PM Najib Razak, not to mention deputies and opponents like Musa Hitam, Tengku Razaleigh and Anwar Ibrahim. - FT

 Johor bukan negara asing kata Tun M...

Masuk gelanggang tunjuk kejantanan kamu sebagai pahlawan atau lanun Bugis. Tun M mencabar siapa saja pahlawan silat pulut atau silat cekak berhadapan dengan beliau dalam gelanggang politik. Jangan menyalak seperti anjing gila atau berkokok seperti ayam jantan pondan di bawah payung kuning.

Tidak ada sebuah negeri pun dalam Malaysia boleh keluar tanpa menghadapi risiko besar. Apa yang berlaku pada Tun Mustapha yang hendak memisahkan Sabah dari Malaysia akan berlaku pada istana Johor kalau berani tarik keluar Johor dari Persekutuan Tanah Melayu. Datuk Kalong Ningkan bekas Ketua Menteri Sarawak pernah cuba menarik keluar Sarawak dari Malaysia. Akhirnya dia kecundang, dan hilang jawatan.

Dalam sistem Federalisme semua negeri bersatu menerima perlembagaan negara sebagai sumber kekuatannya. Raja berperlembagaan menjadi asas pentadbiran negara dan negeri. Tidak ada gelaran maharaja dalam budaya kesultanan Melayu. Raja zalim raja disanggah, raja adil raja disembah. Dalam kasino Genting ada raja daimen, raja lekuk, raja sepit dan raja kelawar. Di luar Genting ada raja kapur dan raja gila.

Sila masuk gelanggang kalau berani hadapi Tun M. Sang raja boleh uji apakah dia populer diterima rakyat atau sebaliknya. Yang nyata pada PRU 14 UMNO/BN tumbang di Johor walaupun Johor dikatakan kubu kuat UMNO. Walau pun pihak istana mirip pada Najib maharaja perompak Bugis kelas cakrawala namun rakyat Johor tetap menolak UMNO/BN.

Sikap dan amalan DYMM Sultan Perak, Raja Nazrin Shah, mendapat pujian rakyat jelata. Kata baginda istana patut jangan mencampuri urusan politik. Jaga maruah, integriti dan status raja berperlembagaan. Jangan bermain api dalam politik nanti terbakar segala bintang kehormatan dan pakaian sang raja. Era raja gila kuasa, jadi pembunuh, perogol sudah tamat. Ini era rakyat yang berkuasa dan mereka menentukan nasib mereka dan negara, bukan istana.

Mahu cabar Tun M? Silakan. Jangan jatuh pitam dan merana badan sekiranya berbagai kes jenayah yang dilakukan pihak istana dibongkar semula, dan mereka dihadapkan ke mahkamah. Jangan terkejut kalau ada orang istana yang menjadi banduan di Sg Buloh kelak. - Yahaya Ismail

Sejak minggu lepas..Pemimpin PAS dan UMNO Macam macam depa fitnah, takutkan pendeposit Tabung Haji.. depa kata Aset tabung haji tergadai kepada Cina la, Kerajaan PH Bakal bankrap dan musnahkan Tabung Haji.. sampai buat cerita palsu Cawangan Tabung Haji di Bachok sampai dah takda duit..kononnya punya ramai orang keluarkan Duit.. sapa punya cerita kalau Pemimpin walaun jahat dari PAS..

Tapi Bila kita kata, kami suruh depa keluarkan duit dari Tabung Haji.. Tak berani pulak.. depa kata kalau berlaku " Bank Run" yang teruk adalah Tabung Haji.. Keluar jer lah.. Tabung Haji pun dah kata depa dah sedia kalau ada "Bank run".. Takat 20-30 Billion duit Pendeposit Hilang apa lah sangat, Kerajaan PH pun boleh bailout lebih 17 Billion aset Tabung Haji.. takkan nak cover takat 10 billion hilang pun takda masalah..

Lagi mudah Kerajaan ngan Tabung Haji bayar dividen tinggi sikit..takda beban sangat bayaq kat orang PAS dan UMNO.. boleh bayaq lagi tinggi.. ini Tabung Haji bayaq dividen RM 900 juta, RM 500 juta jer bayaq pada kelompok 1% pendeposit kaya yang ada duit sekurang kurangnya sejuta dalam akaun..

Sebenarnya depa pun takut.. depa pun tahu, sekarang Tabung Haji dah on Track.. Bakal Pulih, saja nak main sentimen Politik perkauman Agama..kononnya nak jadi Hero Ummat Islam dan Melayu.. nak bodohkan pengikut dna pentaksub depa..geng geng Ulama Durjana pun cuma nak cover salah laku Pemimpin Durjana Tabung Haji.. tu jer tujuan depa.. sebab depa dulu puas hati dengan Durjana ni..

Bila Kelmarin Dr Mujahid umumkan Deposit bukannya berkurang.. tapi bertambah pulak..maknanya Tabung Haji dah dapa keyakinan dari Rakyat.. Tiba tiba PAS dan UMNO nak berlakon jadi Hero..sampai pemimpin UMNO mintak pendeposit sabar dan tidak keluarkan duit..sebab ini Jihad Ekonomi..
