PKR semalam mendedahkan salah seorang pengarah Bestinet, ialah bekas Pengarah Jabatan Tenaga Kerja ‎Datuk Tengku Omar Tengku Bot selain bekas Menteri Dalam Negeri Tan Sri Azmi Khalid.

– tmi

Bangladeshi given access to crucial data...

A Bangladesh citizen is among the directors of Bestinet Sdn Bhd, an IT solutions company that developed and manages the Foreign Workers Centralised Management System (FWCMS) for the Home Ministry, PKR claimed today.

In a joint statement, PKR Youth information chief Lee Chean Chung and deputy information chief Naim Jusri said that Aminul Islam Abdul Nor, a Bangladeshi citizen with a Malaysian permanent resident (PR) status is also a shareholder of Bestinet.

As such, PKR has raised concerns about a programme containing border control and immigration data, such as the FWCMS, being handed to a company linked to a foreigner.

"How can such an important project be outsourced to a private company managed by a foreigner?" the duo asked.

Previously, PKR revealed that former home minister Azmi Khalid is also one of the directors for Bestinet, and had demanded both him and Home Minister Ahmad Zahid Hamidi (left) to explain their roles in the awarding of the contract to the company.

However, Zahid had continued maintaining his silence as Azmi merely said that there was no "hanky-panky" in the deal, without elaborating further on the matter.

Zahid has received flak before for the Home Ministry's decision to outsource foreign worker permit renewals to MyEG Services, another private entity.

The outsourcing resulted in higher fees for employers who wish to renew the permits of their foreign workers, while also increasing levy on insurances not bought through MyEG.

The FWCMS is a website handled by Bestinet, which will also handle online applications for foreign worker quotas, their electronic temporary working permits (ePLKS), and insurance, among others, beginning January 15 this year. All health checkup centres in the source countries, where the workers are from, are also compelled to use the Bestinet system.

The arrangement had reportedly caused tension among labour agencies and the Nepali government when they were informed that they must use the new system.

"Bestinet not only will make huge profits through monopolising the eVDR and biometric system. The company will also cause the increase in cost to hire foreign workers.

"When the increase in cost is not monitored, it will expose foreign workers to risks of exploitation and human trafficking," Johari and Lee said.

The two PKR reps again challenged Zahid and Azmi to explain within 24 hours about their roles and the contract awarded to Bestinet.

"It is unfortunate that both the minister and former minister have kept mum on the issue together and would not come forward to end the doubts of the people so far.

"If they do not do so, we will reveal further information that is 'very critical'," they said.

Of late, the PKR lawmakers had also raised concerns that Malaysia's national security was at risk due to the use of the new system.

They feared that the information in the system was related to border control and immigration, and the sensitive information could be used to threaten the security and sovereignty of the country. - mk.tmi

Altantuya...

The Federal Court has ruled that Chief Inspector Azilah Hadri and Corporal Sirul Azhar Umar are guilty of murdering Altantuya Shaariibuu. Sentencing them to the gallows offers some measure of justice to Altantuya and her family, but despite the highest court’s ruling the wound that this case has afflicted on this country’s soul has not been healed.

People are still demanding answers to many unanswered questions. There can be no closure to this gruesome and senseless murder until they know why she was killed in the first place. Ordinary men and women want to know if Altantuya was killed by Azilah and Sirul , under instruction from someone else.

They want to know if the offer of Ringgit 100,000 to Sirul ( Siruls own admission) was true, and who made the offer. They also want to know what was the instruction given to the two commandos ;the exact words used to “assist Razak” as the judge puts it. They want to know why there were changes to the prosecutors and the High Court judge hearing the case.

They want to know if Najib Razak knew Altantuya despite his much publicized mosque declaration that he did not. They want to know why Bala the private investigator and his family were asked to leave the country.

Federal Court judge Datuk Suryadi Halim Omar reportedly said Prime Minister Dato’ Sri Najib Tun Razak’s former aide-de-camp DSP Musa Safri never instructed Azilah on how to assist Razak Baginda, that Azilah was merely told to meet with him. How does the judge know this for sure?

Azilah could have said this but Musa was never called as a witness. Did the judge have access to Musa’s police statement, or to some other reliable piece of evidence adduced at the High Court? It seems to me the court accepted that Musa was the one who gave instructions to Azilah, but it somehow came to the conclusion that the instruction was of a friendly and innocuous nature; something like, “Do what you can to assist Razak.”

That bothers me. Altantuya was here to ask for money from Razak that she claimed was due to her. She was not waging a war against the country. She did not bring along commandos from Mongolia to kill someone if her demands were not met. Razak/Musa Safri could easily have asked a friend to mediate and see Altantuya on their behalf.

Even if they had wanted a man in uniform, someone from the Cheras police station—helped perhaps by an immigration officer—would have sufficed. All they needed to do was persuade Altantuya to leave the country peacefully if her claim was frivolous. I am anxious to know what was on Musa’s mind when he decided to introduce Razak to Azila and Sirul.

When you ask people whose job is to eliminate and destroy to “assist” you, and they are in possession of C4 explosives, you cannot expect them to engage in peaceful and polite negotiations. You expect them to do exactly what they were trained to do: take orders, ask no questions and kill if necessary.

Many people want to know what Musa’s exact instructions were. Did Musa, for example, give any kind of caveat to say no harm should come to the girl? Some are happy with the AG’s explanation for why he chose not to call on Musa during the trial, and obviously the judges are within their rights to convict a murderer without any known motive.

But in the real world, nothing like that ever happens. In the real world, a prosecutor would want to present the full story, for only a madman kills for no reason. Everyone else has a motive for doing something.

That’s why there has to be closure for this case. Our country will forever be seen as callous with human lives , with no regard for the truth, until the mystery surrounding Altantuya’s murder is solved. I believe there are things we don’t know about the murder, and the conduct of the police and the AG regarding the matter has hardly been beyond reproach.

Justice is about more than compliance with the letter of the law. It’s more than just a court decision, for the court can only do so much based on the materials the AG and the Police put forward. Justice in this case requires the country to have an independent inquiry to ascertain why the case unfolded as it did and to determine if the roles played by the Police and the AG were aboveboard.

Although we cannot depend too much on Royal Commissions of Inquiry nowadays to determine the truth, if we can get enough men of courage and integrity to conduct the inquiry we might be able to get some justice. So far we have found two men guilty. There could be more if the truth were allowed to finally surface.

I may be a lone voice in seeking to know more about the murder of Altantuya, but for our system of government to operate well we need to have enough conviction to raise questions and get answers when we are in doubt. We need to defend what is just and right. I hope the Opposition Leader (who has been unusually silent on this matter) will be willing to support my proposal for a full inquiry.

We need to make sure that we have not left important clues behind, and remove all doubt that the stakeholders in our justice system might have been less than honest in dealing with the case.- Zaid Ibrahim

Sirul 'dikhianati', kata ibu...

- mk

Sirul 'betrayed', says mum...

Sirul Azhar Umar has been "betrayed" for merely doing his duty as a police officer, his mother Piah Samat reportedly said.

According to PAS organ Harakah Daily, Piah, 74, said the family still hopes that Sirul would be freed after being sentenced to death for the murder of Altantuya Shaariibuu.

"Only Allah knows how I feel, I can only pray that he remains safe," the publication quoted her as saying after several PAS leaders visited Sirul's family home in Taiping.

Sirul did not appear in court for the verdict and is currently in Australia.

PAS information chief Mahfuz Omar (left in photo) had paid the visit - along with PAS Youth chief Suhaizan Kaiat - to the family home.

Piah also described her son as someone who was responsible and hardworking, according to the report.

She referred to him as someone who cared for the family and - as the fourth child among eight siblings - constantly kept in touch with them.

Meanwhile, Piah noted that the stories being told about her son had made her feel "ashamed" to meet people.

"There are also people who say all sorts of things, they say he's been paid off despite the fact that he did not get anything, until now I am ashamed to meet people," she admitted.

Piah also lamented that these were trying times for the family as Sirul's younger brother had passed away just last year.

Sirul, who apparently fled the country before the verdict was announced on Jan 13, was arrested in Brisbane by the Australian authorities.

Malaysia is expected to seek his extradiction but Australia has a policy of not sending an individual back to his home country should he face the death penalty there. - mk

Sirul yet to be brought to court for extradition...

Convicted murderer Sirul Azhar Umar, who was arrested by Australian authorities a week ago, has yet to be produced before a magistrate for his extradition hearing.

This is according to his lawyers, Kamarul Hisham Kamaruddin and Hasnal Rezua Merican, both of whom are in Sydney to meet their client.

Malaysia’s Attorney-General’s Chambers will need to make a formal application for extradition, requiring Sirul to be brought to court for the request to be heard by a magistrate.

Home Minister Ahmad Zahid Hamidi had previously said that his ministry had submitted a request to extradite Sirul.

Meanwhile, Sirul’s lawyer Kamarul (left) said his client is looking at hiring Australian lawyers to represent him in his fight against detention and possible extradition.

"I can confirm that we have met Sirul and he is well and well-treated by the Australian authorities,” Kamarul told Malaysiakini by telephone today.

"Besides this, we are seeing or engaging Australian lawyers to discuss his detention. Sirul has also expressed his desire that we should continue to represent him and deal with his legal matters.”

When asked whether they knew whether the Attorney-General’s Chambers had filed an application to extradite him, Kamarul said he cannot confirm the matter.

Kamarul said his client was detained by Australia's Immigration and Border Protection Department following the Interpol’s red notice issued on Jan 20.

Unaware of Sirul’s mother’s remarks

Asked to comment on reports which appeared in PAS organ Harakah, where party leaders met Sirul's mother Piah Samat, who expressed that she felt her son was "betrayed", Kamarul said he and Sirul were not aware of such report and hence, could not comment on the matter.

Piah, 74, was reported to have said that his son had been betrayed for merely doing his duty as a police officer and hopes that her son will be freed despite being sentenced to death for the murder of Mongolian woman Altantuya Shaariibuu.

"Only Allah knows how I feel, I can only pray that he remains safe," Harakah quoted Piah as saying.

Sirul was arrested on Jan 20 in Brisbane where he had been staying with his 19-year-old son and a relative, and is now being detained at Sydney’s Villawood detention centre, a maximum security prison in Australia.

While Australia and Malaysia have inked an extradition treaty, Sirul’s deportation is expected to be hampered by Canberra’s firm stand against death penalty, where it will not deport anyone facing capital punishment back to the country demanding it. - mk

Hadi sepatutnya tukaq kapai...

PasMa hints that Hadi should abandon ship...

Returning fire, NGO Persatuan Ummah Sejahtera Malaysia (PasMa) president Phahrolrazi Zawawi has hinted that PAS president Abdul Hadi Awang should quit the party.

Speaking to Malaysiakini today, he said those in PAS who are opposed to Pakatan Rakyat should be the ones to abandon ship.

In a Facebook posting yesterday, Hadi had employed a seafaring analogy to hit out at PasMA, which he accused of "punching holes in its own vessel."

He said that PasMa should opt to switch ships if they wished to reach the intended destination faster.

"Go to the DAP ship, PKR ship, if you want to reach Putrajaya quicker, join the Umno ship," he added.

However, Phahrolrazi pointed out that the party annual assembly (muktamar) agreed that PAS should remain in Pakatan.

"That was the decision of PAS and the muktamar.

"So those who don't agree with that principle (of staying with Pakatan) also don't agree with what has been decided by PAS.

"They are the ones who should leave the party," he said.

Phahrolrazi also argued that disagreeing with PAS leaders and possessing a different opinion do not mean that members must exit the party.

He also pointed out that the attack on PasMa by Hadi was irrelevant as not all in PasMa are PAS members.

"PasMa is an NGO, which is an entity on its own - the question of going in or out of PAS does not arise as PasMa never joined PAS in the first place," he added.- mk

Council lays to rest RM4K Muslim burial shocker...

The copy of a receipt for a Muslim burial ceremony in Sungai Bakap, Penang, costing a whopping RM4,375 had tongues wagging after making the rounds on the internet.

But the Penang executive council for Islamic Affairs denied that only well-heeled Muslims can afford burial ceremonies in the state, explaining that the services offered varied from mosque to mosque.

Council chief Abdul Malik Kassim said he has studied the copy of the receipt.

Listed on the receipt were 21 services including telephone calls to invite guests to attend the funeral prayers which cost RM0.50 sen each, light refreshments, transportation and fees for prayers recited at the burial site, which cost RM1,900.

According to Abdul Malik, basic burial ceremonies for Muslims cost only about RM700.

"Muslim burial is the common responsibility of the community. Within 24 hours, a deceased Muslim must be buried.

"All mosques will carry out burial for free for their members, and for others too, including foreigners, should the need arise," he told Malaysiakini.

Abdul Malik said this is a non-profit undertaking and the family of the deceased normally gives a donation to the imam who conducts the burial rites.

"But this is voluntary and the amount is not fixed," he stressed.

As for the services listed on the aforementioned receipt, Malik said these were optional and commended the mosque for the breakdown in charges.

"In a way, this mosque has done well. The burial cost is open for all to see as there are many options for people to choose from.

"Not all mosques offer the same services. Different mosques have different styles and different services offered," he added.

Abdul Malik clarified that most families only choose basic burial needs like a wooden coffin (RM230), bath and white kaftan (shroud) for the body (RM165), cleaning services (RM50) and digging of the grave (RM140 for adults and RM70 for children).

He said many mosques have set-up a fund called "Tabung Khairat Kematian".

He explained that the money is contributed by members, who then take turns to use the fund for burial ceremonies.

"Moreover, burial land for Muslims are free, so claims of it being expensive or that only rich Muslims can get a decent burial is not true," he added. - mk

Jangan mati kalu takdak duit ...

Undi ketiga bersifat perkauman?

- Ahmad Mustapha Hassan, theantdaily

Sorry Hadi, I Beg To Differ...

Is it true that local government election would lead to instability or May 13? I seriously doubt such a strange proposition, no matter who made that statement.

After all, local government elections were held before Barisan Nasional unjustifiably abolished them.

In fact, those elections predated May 13. Thus, relying on such an unfortunate event to flatly reject such elections is indeed mind boggling, to say the least.

Globally, local election is a universal phenomenon especially in developed countries as well as Muslim countries.

In fact, in the US, where federalism is widely practised, almost all public officers’ are elected. Thus, we see the district attorney and the states’ judges in America have been electorally appointed until now.

In the Muslim world, local government elections are not new. Former Iranian and Turkish prime ministers Mahmoud Ahmadinejad and Recep Tayyip Erdogan were once elected as mayors of Tehran and Istanbul respectively.

Indonesia’s Joko Widodo was a mayor who was elected before he assumed his presidency.

The Indonesian parliament received fierce criticism when it voted for the abolishment of direct elections for the mayor and governor in 2014.

The law was backed by the coalition behind the then presidential candidate, Probowo Subianto.

It is interesting to note that the proponents of such laws never cited the issue of instability as their justification to scrap the process.

On the other hand, hefty costs and corruption were the main reasons for such a move.

Accountability and transparency

Islamists should not be unduly worried about the term “election”, and as it is not a dirty word. On the contrary, local government elections imply accountability and transparency in the public office.

Those two criteria are the hallmarks of good governance. Local election is an efficient mechanism to promote those ideals.

PAS president Datuk Seri Abdul Hadi Awang is duly concerned that local government election would cause instability. In his view, Chinese councillors would take over in certain big cities if elections were held.

Local election, in his view, could lead to instability and ultimately a bloody tragedy such as May 13. And if such a tragedy takes place in future, the real culprit would be local government election.

With due respect, the PAS president’s view is unfortunately misplaced. It presupposes that all big cities in this country are dominated by a single ethnic group, namely the Chinese.

He presumes that the Malays would not be duly represented in Chinese-dominated urban areas.

Using his logic, the Chinese would be equally unproportionately represented in Malay belt states in the event local government election is revived.

As long as Malaysians elect any Malaysian in any local government election, we should not be unduly worry. Let such unwarranted fear be reserved to Perkasa, Isma or Utusan.

If Chinese were not worried to elect PAS candidates in the last general election, why would Malays be worried if they are represented by Chinese, Indian or Malay councillors? - NPR

Phua a convicted criminal in Malaysia...

The man who Home Minister Ahmad Zahid Hamidi said assisted Putrajaya on projects involving national security is a convicted criminal in Malaysia.

Reliable sources from the police informed Malaysiakini that world class high-roller Paul Phua Wei Seng was arrested in Miri in 2004, during the period the Euro Cup football matches were being played.

One of the sources claimed that he was present when Phua was charged and convicted for illegal gambling. He was slapped with a fine.

After paying the fine, Phua left the country. The convicted criminal was even barred from re-entering the country during the World Cup in 2008.

According to the source, Phua, 50, is also known as “Sabah kia” (Sahah kid) despite that he is born in Miri, as confirmed by his MyKad details.

Phua made headlines after he was arrested and charged by the Federal Bureau of Investigations (FBI) in United States for a massive illegal online gambling operation in Caesar's Palace, a five-star hotel in Las Vegas in July last year.

It was revealed that Zahid later wrote a letter to the FBI to clear Phua of any links with the 14K triad and added that Phua assisted Malaysia in matters of national security.

The 14K is a Hong Kong-based international crime syndicate active in among others, drug running, illegal gambling, human trafficking, prostitution and money laundering. It said to be second largest triad group in the world with around 25,000 members.

According to 2004 police records sighted by Malaysiakini, “a raid was made on football bookies at a condominium” at Jalan Kelab Golf, Miri, by a police team conducted at 3.15am on July 4, 2004.

“In that raid, 22 Chinese men were arrested ... while running an illegal bet on the finals of the football match of Euro 2004, which was being telecast live, between Portugal and Greece in Portugal.

"The said premise was turned into an Internet online betting centre with an average bet of RM2 million for this match. Evidence confiscated in front of voter Phua Wei Seng ... who was present with the other workers who were inside," the record states.

The source said Phua was then charged and convicted and the case was closed as is normally done when “illegal betting syndicates are busted”.

Malaysiakini is in the process of getting the court records on the case, but these records are manually kept in Miri.

A court staff, when contacted, said only parties with interest in the case can obtain the records, in line with its policy of protecting privacy.

First bookie to pay fine in full

According to the police source, Phua paid the hefty fine in full and then fled to Vietnam to flee from those who had placed huge bets with him when the operation was busted.

"The fact that he paid the fine in full then was a first for a bookie caught, for bookies have never paid their fines in full.

"In 2008, the police were told not to allow Phua back into the country for fear that he would start a betting scheme on the World Cup," said the source.

However, due to lax communications between the police in Kuala Lumpur and Sarawak, Phua did return to the country in 2008.

He landed in Kuala Lumpur but was nevertheless stopped by the Sarawak immigration, after which he flew out of the country.

The source said he believed Phua, whom he described as the "biggest bookie in Asia", subsequently went to Europe.

Phua was described as a "very brainy person, not the typical bookie" and one who is much sought after worldwide for his expertise in opening casinos.

Phua is also said to have “very good connections with big-time Umno politicians”.

'How can he be with national security?'

The source also confirmed that Phua is indeed part of the notorious 14K triad, but operates in Hong Kong where the triad is based, and not in Malaysia.

"We do not know how the home minister can say he is with us on national security," said the source.

Zahid, who has been severely criticised for defending Phua, said he wrote the letter upon the request of Phua’s lawyers in US. However, his letter was rejected in court after an objection from prosecutors for late submission of evidence.

Phua’s lawyer in Malaysia, Muhammad Shafee Abdullah, said that the minister’s letter was to correct a “big mistake” made by the Malaysian police.

The letter was used as defence evidence to invalidate earlier information furnished by Malaysian police to the FBI, linking Phua with the 14K triad.

However, the police defended their earlier reports and, contrary to the claim made by Zahid, said Phua did not assist them in national security matters.

Nevertheless, Zahid insisted that Phua did assist on national security matters but refused to divulge into details on this, saying that the matter was sealed in secrecy under the Official Secrets Act.

Phua is now currently out on bail in the US state of Nevada, together with his son Darren Phua. It was reported that Phua and son were released under the condition of wearing GPS ankle bracelets while residing at the home of a Las Vegas doctor.

Court transcripts show that in addition to US$2.5 million cash, the elder Phua has put up his US$48 million Gulfstream jet as collateral.

Last week, the Phuas had a status hearing in court, in which the judge said she would issue a decision on the motions to suppress the evidence in a few days, probably early next week, the court document shows.- mk

Seek help from Sirul & Azilah,if Mahathir is serious about replacing Najib...

Malaysia at risk with Sirul in Australia...

Have you seen the Final Destination movies? In the end everybody must die. Fortunately for Sirul Azhar Umar, he knows that he would be dead if he returns to Malaysia.

Those behind the murder of Altantuya Shaariibuu want him to die with the knowledge of the murder, by hook or by crook. Sirul can only try to postpone his demise.

But the Australian authorities could already have the confession by Sirul and that could be used by Australia as leverage in dealing with Malaysia.

Fortunately with the exception of the spat between former prime minister Tun Dr Mahathir Mohamad and Mr Paul Keating calling him a “recalcitrant”, Australia has been on friendly terms with Malaysia. Australia has helped in the SAR of MH370 more than necessary.

If Australia used the information given by Sirul against Malaysia, it would look like a “blackmailer” and it would be bad for international politics. But who would guarantee that the information would never leak out and go viral on the internet?

There is not only one Edward Snowden mind you. What about Sirul’s son? He is already at the brink of blowing the whistle. He just needed to be provoked a little bit more!

The murder plan had gone wrong from the start. It was an ad hoc plan, discussed through within minutes and executed a.s.a.p., thus it did not cover every aspect.

It was never and could not be a perfect crime because the perpetrators are not professional criminals and despite a close knit group of people, it is still too many.

Those involved will have to face the repercussions. It is only a matter of time before the whole thing will blow up.

By the way, if Dr Mahathir is really serious to replace Najib, he should seek the help of Sirul and Azilah. See, the threat to the perpetrators could also be from Malaysia and not Australia.

But will Dr Mahathir do it when the time comes? – Nawawi Mohamad, tmi

Sirul Masuk Penjara Paling Teruk Rekod Hak Asasi Di Australia...

– Agensi

Unfair to blame Australia for Sirul's case...

Queen Counsel Mark Trowell said it was unfair for people to blame Australia in handling the Sirul Azhar Umar matter, as the Malaysian prosecution should have imposed strict bail conditions that he should not depart the country, or be allowed to leave on a regular commercial flight.

Trowell - who practises in Western Australia, and is a keen observer in Malaysian affairs - questioned the conduct of Malaysia's prosecution, as they should be aware of the definite prospect of a Federal Court reversal in the Altantuya Shaariibuu murder.

“It should be aware that Sirul would be a flight risk, but it seems nothing was done to guard against that by imposing strict bail conditions that he should not depart Malaysia - or approach an international point of departure - and requiring him to surrender his passport.

“None of these things were done and Sirul was effectively just allowed to leave on a regular commercial flight. Of course, Australia does not want him and we would like to return him, but it’s a bit unfair to blame us for what has happened as we didn’t allow him to flee Malaysia,” he said in an email to Malaysiakini.

Trowell (left) was asked as to what would be next in Sirul's proceeding in Australia following earlier reports by some local newspapers claiming that he had been released on strict conditions, and that the extradition process may take some time.

The senior Australian lawyer, however, said there are no reports there of Sirul being released. Australia's Immigration and Border Protection Department has also issued a statement denying it.

'Australia acted responsibly'

During the prosecution's appeal at the Federal Court last June, the team - led by Deputy solicitor-general II Tun Abdul Majid Tun Hamzah - did not impose conditions on Sirul and Azilah Hadri after the duo had been acquitted by the Court of Appeal on August 2013, and while awaiting decision by the apex court last week.

Trowell noted that Australia acted responsibly by promptly responding to the Interpol red notice to arrest Sirul.

He further pointed out that despite the notice indicating a view to extradite, that process does not automatically lead to extradition.

“It is just the warrant that authorises his arrest. The Malaysian government can complain all it wants, but it needs to make a formal application for his extradition. I am not sure that it has been done yet,” he said.

“The formal legal process should be well known by the Malaysian Attorney-General’s Chambers,” Trowell added.

The Queen's Counsel - who had previously explained to Malaysiakini the Australian extradition process - reiterated that their position is clear, as Australian law dictates that it will not allow a person to be surrendered to another country for an offence punishable by death unless there is an undertaking that such punishment would not be carried out.

Previously, Home Minister Ahmad Zahid Hamidi said that a formal request had been sent to Australia to extradite Sirul through Wisma Putra, and that his ministry is also overseeing the matter. - mk

Jangan Menyesal Kalau UMNO Kalah...

“Kalau pemikiran dia (Dr Mahathir) betul, macam mana?

“Tun Mahathir, Daim bukan nak jadi Perdana Menteri.
