A visit to Kelantan has changed a constitutional expert's perspective of hudud law - it has convinced him that it is what the majority of the people there want, and that the state government is under pressure to implement it.

"After going to Kelantan to brief Tok Guru (Kelantan Menteri Besar Nik Abdul Aziz Nik Mat, left, yesterday) and listening to the grassroots' sentiments... I admit that what I saw and heard during the short visit have changed my perspective on the issue," said Abdul Aziz Bari in an email to Malaysiakini.

According to the UIAM law lecturer, the PAS-led state government is willing to hold a referendum on the implementation of hudud law, since it is the wish of the Kelantanese.

"Given this sentiment, Umno leaders over there cursed (Prime Minister) Najib (Abdul Razak) for saying 'No' to hudud because that statement simply means Umno can now close shop in the state," he said.

He commented that Najib's rejection of hudud law may not help BN to regain non-Muslim votes.

"Tok Guru is not stupid. They have their Facebook and from the response, PAS is confident that Umno is now vulnerable in Malay/Muslim areas. And there is no guarantee that they will get the non-Muslim votes given the Facebook response," he said.

Contention over the long-simmering issue was resurrected last week when Nik Aziz blamed former premier Dr Mahathir Mohammad for obstructing Kelantan in implementing hudud law in the 1990s.

Mahathir then challenged Nik Aziz to carry on with implementation when he was no longer the prime minister. Najib has asserted that the federal government will not enforce hudud law nationwide due to realities, dismissing it as another gimmick by PAS to divert the people's attention.

He also stressed that there are already elements of hudud law in the system "minus the extreme part".

Abdul Aziz observed that Najib's statement is self-contradictory - on the one hand, the premier has admitted that elements of hudud law are already in the system but, on the other, he said he opposes implementation of the law.

"Umno should be helping instead of maintaining the obstacle. That is why I said Umno is in danger of losing the Malay/Muslim votes in their attempt to court the non-Muslim support,” said Abdul Aziz.

"And the non-Muslims (will) not necessarily believe what the media have reported so far. Just watch out from(today) onwards (to see) what PAS will do."

He emphasised that the federal constitution does not prohibit the application of Islamic law including hudud law.

"What the DAP has said about the constitution being secular is not true. Somehow the DAP shares this erroneous belief with MCA and Gerakan."

'PAS will not budge'

Abdul Aziz also slammed the DAP for "trying to outdo MCA and Gerakan in opposing hudud law", stressing that such implementation does not change Pakatan Rakyat policy.

"There is no question of changing Pakatan policy as alleged by (DAP secretary-general) Lim Guan Eng because hudud is just for Kelantan and for Muslims.”

The DAP's opposition to hudud law without considering the Kelantan people's voice, he said, is an undemocratic approach.

"The DAP overlooked the fact that Nik Aziz is just listening and acting in accordance with grassroots sentiment in his state... It is essentially about respecting popular demand rather than imposing hudud or betraying Pakatan partners.

"PAS will not budge. Not because it is stubborn. But simply that hudud (law) is what the majority in Kelantan want. It is democracy pure and simple. PAS (has not done it) in Kedah because that is not the case."

Abdul Aziz also reminded the DAP that the state government's power to implement hudud law in Kelatan is part of an ideal federalism which Pakatan and DAP have been championing.

"The DAP forgets about true federalism which allows unity in diversity. Around the world such is actually common... In federal systems, like (in the) US and Canada, there are states which apply different laws. Quebec is one good example.

"I think PAS is open and transparent about hudud (law) and that is why it (is) willing to conduct a referendum in Kelantan. I believe PAS will allow the DAP to go the ground to ascertain the true wishes of the people in the state."

Realistic move

Defending PAS, Abdul Aziz(left) argued that pushing hudud law is a realistic move for the party to survive in Kelantan, which it has held since 1990.

"For one thing Kelantan is unique. It has been sticking to PAS from 1990 and managed to survive even when it was left with just a one-seat majority after 2004. It has also steadfastly loyal to PAS when other states were with Umno-BN.

"I think the Kelantanese are telling us to be mindful of their wishes. They would like to be with the rest of the Malaysians but at the same time they also want their fellow countrymen to respect their choice.

"The problem now is clearly not about PAS forcing non-Muslims and non-Kelantanese to accept hudud (law) but rather those against (this) trying to force Kelantanese to part with their preference for (this law)."

If the DAP is willing to soften its stand on the proposal, he said, implementation in Kelantan would strengthen rather than weaken Pakatan.

"It would also acknowledge the diversity in the country."

Kanang anak Langkau is a 'Datuk' thanks to....

Kanang anak Langkau(right) of Simanggang, Sarawak was a Malaysian Ranger from the 8th Battalion Royal Rangers (now known as the 8th Paras) is the first and only living recipient of both the "Seri Pahlawan Gagah Perkasa" and the "Pingat Gagah Berani."

He is the first and only person thus far to have received two gallantry awards in the Malaysian Armed forces.

He joined the service with the Sarawak Rangers as an Iban Tracker on the 21 April 1962. He was absorbed into the Malaysian Rangers when Malaysia was proclaimed on the 16 September 1963. He retired as a Warrant Officer 1 after 21 years in the service.

Kanang anak Langkau, one of the national heroes during the communist insurgence in the 70s, has humbly declined offers to make him a Datuk. In a statement to press, he told that he can’t afford the Datukship title as he is not rich enough to dress and act like one.You can read the full write-up here.

Inilah lumrah pemimpin yang ada, hanya melihat kepada pembodek-pembodek di bawah ketiak mereka sahaja.

Selangor Pakatan rule a torture only to BN cronies...

The Selangor government said they agreed with Deputy Prime Minister Muhyiddin Yassin that Pakatan Rakyat's rule in the state has been a torture to certain segments, namely the “Umno-BN cronies”.

“This sector (who are said to have suffered under Pakatan rule) are the cronies and family members of the Umno-BN, who have been reaping their wealth from the state through directly being awarded projects, acting as middlemen or through their lobbying,” said Faekah Husin in a statement today.

The political secretary to the Selangor Menteri Besar was commenting on Muhyiddin's statement yesterday, that she said showed that the ruling party was “increasingly desperate to gain the sympathy of the people”.

“Maybe this is what the prime minister meant when he said that Umno members like to 'syok sendiri',” she quipped.

Muhyiddin had said at BN State Assembly Backbenchers Club's retreat in Selangor that the people of the state had had enough of life under Pakatan rule and were ready to support the BN again.

Faekah commented that such people would include businessmen who were fond of bribing public officers and politicians to get help and special treatment, and to take advantage of certain policies such as the low cost housing policies that had been abused by some to reap huge profits.

“What's worse, under the Umno-BN government projects were completed with an eye to oppressing the poor even further,” she said.

Cronies 'beyond the law'

Faekah said that during Umno rule of the state the businessmen allied to the ruling party had become “all too powerful”.

“While Umno-BN was in power, these businessmen were all too powerful that they did not fear the law, as they knew they had the permission and 'protection' of the policians who condone such criminal activities.

These parties did not have the capital nor the expertise, she said, and only needed to flatter the ruling politicians to get the jobs.

“These types are not ashamed to visit and hang out at the politicians' offices. This scenario has been taking place since Muhyiddin was Johor Menteri Besar and the filthy practice still continues till today,” she said.

The political secretary elaborated on how cronies would get huge projects to the tune of millions of ringgit, and immediately sell it off to the highest bidder to reap a tidy commission.

She said such days were over with the Pakatan government and that most Selangor residents were happy with their administration for this.

“From our polls, Selangor residents are happy with our style of governance that does not allow such groups to hang around the offices of the menteri besar or the senior officers. This phenomenon was widespread during Umno's time,” she said.

She said it was natural that such groups were unhappy with Pakatan rule, as they are no longer able to “bodek” (suck up to) the politicians for favours.

State reserves at 28 year high

Faekah(left) challenged the DPM to ask the ordinary people instead, who have benefited from the state's policies.

“In the past four years we have spent over RM500 million on the rakyat, for example through the free water scheme.

“Why would these recipients feel tortured by Pakatan's welfare programmes that they are enjoying?

“It is very shameful when the number two in our country and the number two in the party makes such ridiculous statements that only embarrass himself,” said Faekah.

Meanwhile Selangor MB Khalid Ibrahim said the state coffers has achieved a record high in 28 years.

“The Selangor reserves totalled RM918 million through 2010 and in the six month period of 2011 has increased by as much as RM200 million, making the total cash reserves for Selangor RM1.1 bilion,” said the MB in a statement yesterday evening.

Khalid announced this in conjunction with the three-day visit of the Yang di-Pertuan Agong dan Raja Permaisuri Agong to the state.

“His majesty was also informed that the Program Merakyatkan Ekonomi Selangor that was introduced over the 100 days since the present administration took office has channeled as much as RM500 million back to the rakyat of Selangor,” said Khalid.

The MB said he brought this to the Agong's attention because their successes and their programmes for the rakyat had “received little publicity, because the mainstream media are 'too careful' about reporting such positive news”.

Muhyiddin Yassin feel tortured coming to Selangor...

The signs are becoming unmistakable, snap polls are around the corner. Deputy Prime Minister Muhyiddin Yassin himself let slip the information during a speech in Selangor, admitting that he was "campaigning".

Amid accusations he was in denial mode for saying the people were being 'tortured' under the Pakatan Rakyat administration, Muhyiddin expressed confidence that BN would recapture Selangor in the next general election, widely expected to be held in November.

"No factual basis. Selangor folk are happy there is no more corruption and cronyism for the first time ever. No one disputes that MB Khalid Ibrahim is clean. Why would Selangor go back to the old corrupt and rotten system under the BN," PKJR vice president N Surendran told Malaysia Chronicle.

The DPM had tried to rally the troops, who have been demoralized by a sparkling performance from Mentri Besar Khalid Ibrahim's team. He also insisted BN did not forsake the state even though it had fallen to the Pakatan in the 2008 general election.

"A man told me, 'I want the election to be called soon so I can vote for BN because I feel tortured living under the rule of Pakatan in Selangor'. Sorry, I'm campaigning..." Muhyiddin told a BN Backbenchers' retreat.

"If they don't pay attention to the social needs, of health needs or in any area at all, BN remains committed to fill this void left by Pakatan as best we can," said Muhyiddin.

High cash reserves in 28 years

However, despite the bravado, BN faces an uphill batttle. Khalid has just announced his state government had managed to increase its cash reserves by some RM200 million in the first six months of this year, bringing the total to RM1.1 billion.

The amount is the highest achieved by the state over the past 28 years, said Khalid.

Since taking over from BN, Pakatan has propelled the state to register a significant increase in investment amounting to RM35 billion between 2008 and June 2011.

“This means the present Selangor state government has not only succeeded in increasing the revenue but also in implementing effective and efficient financial management," Khalid told during a royal dinner on Thursday.

"From the onset, I had misgivings in shouldering this responsibility given by the majority of the people in Selangor who wanted change, in the sense that the state’s profits can be distributed and enjoyed in a fair manner to the multi-cultural citizens of this state.”

Suruhanjaya Pilihan Raya (SPR) akan mengeluarkan sejumlah 220 lagi warga asing daripada rang daftar pemilih di negeri itu.

Mereka antara 222 orang yang dibantah PAS Paya Jaras - dalam parlimen Subang - dan didengar suruhanjaya berkenaan pada Selasa dan Rabu lalu.

Setiausaha Jabatan Pilihan Raya PAS DUN itu Mohamad Fisal Mohamad Yusoff berkata, semua mereka memegang kod 71 dalam kad pengenalan penduduk tetap (PR) - kad pengenalan merah - sewaktu membuat semakan.

"Dalam rekod JPN (Jabatan Pendaftaran Negara), mereka semua memegang kad pengenalan merah, oleh kerana itu kita membuat bantahan.

"Dan semasa bantahan, mereka masih lagi memegang kad pengenalan merah," katanya ketika dihubungi Malaysiakini hari ini. Menurutnya lagi, daripada jumlah keseluruhan itu, seramai 30 orang hadir semasa pendengaran di pejabat SPR negeri di Shah Alam.

"(Seramai) 28 orang daripadanya memberitahu tidak pernah memohon (sebagai pemilih) dan tidak tahu nama mereka didaftarkan sebagai pengundi," kata Mohamad Fisal.

Beliau menegaskan kebanyakan daripada pemegang kad pengenalan itu berasal dari Kemboja dan Indonesia.

Sehubungan itu, kata Mohamad Fisal, SPR akan menggugurkan nama mereka sebagai pemilih susulan bantahan yang dibuat pada 2 Ogos lalu.

Semalam SPR dilapor menerima bantahan PAS Shah Alam dan bersetuju menggugurkan 52 nama yang meragukan daripada daftar pemilih di kawasan itu, kata Timbalan Pesuruhjaya PAS Selangor Khalid Samad.

A video promoting the right to vote has been taken off the air by local broadcasters despite a push for greater democracy because it contains opposition figures and Tengku Razaleigh Hamzah’s speech talking about Malaysia having problems.

The Malaysian Insider learnt that the Malaysian Communications and Multimedia Commission (MCMC) directed local broadcasters this week not to use the public service announcement (PSA) produced by musician Pete Teo just days after its launch on September 16.

“MCMC emailed both Astro and Media Prima Bhd about the issue, telling them the video clip should not be aired because Ku Li speaks about the country having problems and also because it features opposition leaders,” an industry source told The Malaysian Insider, referring to Tengku Razaleigh by his popular nickname.

A government source confirmed that MCMC sent the email to Media Prima, which is linked to Umno and owns the NTV7 channel, and Astro, the direct broadcast satellite pay-television service.

The MCMC is an independent regulator but it reports to Information, Communication and Culture Minister Datuk Seri Rais Yatim, who was incidentally the Kelantan prince’s comrade in Semangat 46 before the party was dissolved for the politicians to join Umno Baru, the successor party to the original Umno that was declared illegal in 1988.

Apart from Tengku Razaleigh, the 4.38-minute video also features Deputy Education Minister Datuk Dr Wee Ka Siong, Deputy Health Minister Datuk Rosnah Abd Rashid Shirlin and opposition figures Petaling Jaya Utara MP Tony Pua, Lembah Pantai MP Nurul Izzah Anwar, Shah Alam MP Khalid Samad and Seri Setia assemblyman Nik Nazmi Nik Ahmad.

Dalam tempoh enam bulan tahun ini, Kerajaan Negeri Selangor berupaya menambah simpanan tunai sebanyak RM200 juta, menjadikannya RM1,100 juta.

“Jumlah ini merupakan rekod kewangan paling baik negeri bertuah ini dalam tempoh 28 tahun,” kata Menteri Besar, Tan Sri Abdul Khalid Ibrahim.

Beliau menyatakan demikian pada Majlis Santapan Malam anjuran Kerajaan Negeri Selangor Darul Ehsan di Pusat Konvensyen Shah Alam, malam tadi.

Selain Yang di-Pertuan Agong, Tuanku Mizan Zainal Abidin, turut berangkat ialah Raja Permaisuri Agong, Tuanku Nur Zahirah dan Sultan Selangor, Sultan Sharafuddin Idris Shah.

Ini bermakna, ujarnya Kerajaan Negeri Selangor sekarang bukan sahaja berjaya meningkatkan hasil negeri tetapi juga berjaya melaksanakan pengurusan kewangan dengan cekap dan berkesan.

Beliau menambah, demi kemaslahatan negeri dan rakyat negeri ini seluruhnya pula, Kerajaan Selangor sekarang melaksanakan dasar “Merakyatkan Ekonomi Selangor” yang mengandungi pelbagai program kebajikan bagi membantu rakyat majmuk pelbagai peringkat agar dapat sama-sama menikmati hasil pembangunan dan kemajuan negeri ini.

Beliau berkata, sejak dasar itu diperkenalkan 100 hari selepas menerajui pentadbiran Negeri Selangor hinggalah Jun 2011; sejumlah RM500 juta telah disalurkan terus kepada rakyat Selangor.

Selain itu, katanya....

1.Skim Air Percuma 20 meter padu berjumlah melebihi RM387 juta,

2. Skim Tabung Warisan (RM1.8 juta),

3. Hadiah Anak Masuk Universiti (RM19 juta),

4. Skim Usia Emas dan OKU (RM49 juta) dan

5. Skim Mikro Kredit Luar Bandar dan Kemiskinan Bandar yang kini melebihi RM2 juta dan berbagai-bagai bantuan kemasyarakatan yang akan diberikan secara berterusan.

Dalam bidang pelaburan pula, beliau bersyukur kerana negeri Selangor terus didatangi oleh para pelabur dari dalam dan dari luar negara.

Katanya, sejak Januari hingga 30 Jun tahun 2011 ini sahaja jumlah pelaburan negeri Selangor bernilai sebanyak RM5,200 juta iaitu 18 peratus dari keseluruhan pelaburan di dalam negara.

Beliau menambah, pelaburan tersebut terdiri dari pelaburan domestik sejumlah RM2,100 juta dan pelaburan asing berjumlah RM3,100 juta.

“Ini bermakna Selangor berada di tempat teratas dalam keseluruhan pelaburan di dalam negara,” katanya.

Rakyat Selangor juga, kata beliau menikmati hasil dari pengurusan hasil pasir yang kini dijalankan secara tersusun kerajaan negeri melalui anak syarikat kerajaan negeri; Kumpulan Semesta Sdn Bhd di mana peningkatan hasil pasir amat ketara sekali.

Katanya, pada tahun 2007, kutipan royalti hasil pasir hanya RM4 juta, 2009 sejumlah RM 5 juta dan pada 2010 melonjak kepada RM11 juta. Menurutnya lagi, manakala pada tahun ini setakat bulan Jun telah mencapai kepada RM12 juta.

“Sejak ditubuhkan hingga setakat Jun 2011, Kumpulan Semesta telah berjaya mengumpul keuntungan berjumlah hampir RM50 juta,” katanya.

Dr McDonald: Kes Anwar, kes tunggal di dunia...

Saksi pakar Molekular Genetesis dari Australia Dr Brian McDoland hari ini terus mempertahankan cadangan bahawa laporan bacaan degradasi profil DNA adalah kritikal.

Beliau yang masuk hari keempat memberi keterangan di kandang saksi kes fitnah liwat kedua Datuk Seri Anwar Ibrahim berpendirian bahawa sebarang laporan berkaitan degredasi akan menyumbang kepada faktor utama bagi mengesahkan kredibiliti bukti.

Beliau yang diperiksa balas oleh peguam Ram Karpal Singh hari ini mempertikaikan peranan pakar kimia Jabatan Kimia Malaysia (JKM) Dr Seah Lay Hong yang mengabaikan beberapa prosedur standard makmal.

Dalam keterangan Seah sebelum ini kepada mahkamah, beliau mengakui degredasi berlaku pada sampel yang diambil dari dubur pengadu Saiful Bukhari Azlan sekiranya ia terdedah pada persekitaran.

Namun beliau mengambil keputusan mengabaikan penemuan tersebut selain mempertahankan pendirian bahawa degredasi tidak penting selepas profil DNA ditemui.

Ram Karpal kemudian menyoal Brian sekiranya sel sperma boleh bertahan selama 113 jam di dalam rektum.

"Kemungkinan 99 peratus ianya tidak akan berlaku... 56 jam adalah yang paling lama pernah dilaporkan," jawab Brian.

Brian kemudian ditunjukkan semula artikel dalam bahasa Thai yang dikemukakan oleh pendakwa semalam namun beliau mengatakan tidak faham.

Timbalan pendawaraya Datuk Yusof Zainal Abiden semalam mengemukakan artikel kajian antarabangsa bersabit jangka hayat sel sperma mampu bertahan selepas terdedah kepada suhu normal.

Ram Karpal sebelum itu bertanya sekiranya pakar itu bersetuju catatan dalam bahasa Inggeris pada artikel tersebut, namun Brian menyifatkan artikel tersebut tidak ada kredibiliti dan musykil bagaimana ianya boleh dijadikan rujukan mahkamah.

Brian tetap mempertahankan kredibiliti beliau sebagai pakar ujian DNA selain membacakan keterangan Mahkamah Rayuan Australia mengatakan beliau adalah seorang saksi yang benar.

Beliau kemudian menolak cadangan bahawa beliau berhasrat mengelirukan mahkamah berhubung ujian AP yang dilakukan Dr Seah dan menjelaskan sekiranya laporan dibuat, ianya dapat dibandingkan dengan kesasteraan perubatan.. -tvsnews

McDonald: Anwar's case the only such one in the world

The Australian DNA expert describes Anwar Ibrahim's case, where the chemist retrieved DNA after 56 hours in the rectum, and left it for another 48 hours in the open, as one of the longest documented discoveries in the world, if the results can be believed.

Dr Brian McDonald said it was extremely rare that one could find sperm after 113 hours in the rectum, in referring to a 1997 article shown to him two days ago by the prosecution.

“That case, along with the 1982 case (which states that sperm can be retrieved after 65 hours), are the only two documented. In 99.9 percent (of the cases), you cannot find sperm at all after such long hours.

“However, this (Anwar) case is the only one (that I know of) in the world where the sperm can be captured after 56 hours and given to the chemist two days later, where you can still find a good DNA sample,” McDonald said.

He was responding to questions from Ramkarpal Singh during re-examination today.

McDonald had two days ago concurred with suggestions by solicitor-general II Mohd Yusof Zainal Abiden, over the finding in the article titled 'Sexual Assault and Semen Persistence' written by GM Willot and JE Ellard.

Ellard was the scientist who made the 1982 discovery that the sperm can last for 65 hours.

McDonald said that to his knowledge and according to some journals, one could find a good DNA after the sample was retrieved from the rectum after eight hours.

Saiful was examined at the Hospital Kuala Lumpur between 9pm on June 28 and midnight on June 29, 2008, where the samples were retrieved.

Investigating officer Supt Jude Blacious Pereira admitted in court that he did not keep the samples in the refrigerator, but placed them in the drawer of his air-conditioned office. Jude gave the samples to chemist Dr Seah Lay Hong two days later.
