Sungai Siput MP Michael Jeyakumar Devaraj and five other PSM members were re-arrested under Emergency Ordinance (EO) immediately after their release from seven-day remand at 2pm today.

Apart from Jeyakumar, 56, the other members are PSM deputy chairperson M Saraswathy, 58, central committee members Choo Chon Kai, 33, M Sukumaran, 50, Sungai Siput branch secretary A Letchumanan, 49, and Youth leader Sarat Babu, 25. According to a PSM tweet earlier, they are to be brought to the federal police headquarters in Bukit Aman, Kuala Lumpur.

The group was released from IPD Kepala Batas, Penang this afternoon, but re-arrested by Bukit Aman police outside the station, said PSM treasurer A Sivarajan during a press conference outside Butterworth court.

"The six were released... but they were still in the police compound when they were re-arrested and told they were being arrested under the Emergency Ordinance," said Nalini Elumalai, a representative of rights group Suaram.

The Emergency Ordinance is similar to the Internal Security Act, which allows police to detain suspects for up to 60 days.

Deputy inspector-general of police Khalid Abu Bakar said at a press conference today that the six were arrested under section 3(1) of EO, while the remand for the remaining 24 detainees will be extended.

"Under the EO, we can detain them for up to 60 days."

According to him, the police have intelligence indicating interference by foreign powers trying to "harm public order" and as such action must be taken to prevent potential violence and criminal activity. Khalid said that a total of 150 people have been arrested so far in connection to the Bersih crackdown.

The six detained under EO are part of 30 nabbed on July 25 while aboard a bus at the Sungai Dua toll plaza, and the party members are being investigated under Section 122 of the Penal Code for the charge of waging war against the king.

On Thursday July 30, Penang High Court maintained that the six were to be remanded until today.

In an immediate response, PSM said the police force was being “used as a political tool by the government of the day” and was a “gross violation of human rights” and pointed out that it was an “outright political decision” by the Umno-BN government.

“First (they called it) an illegal assembly, second it was sedition, third it was Printing Presses Publications Act, fourth it was waging war against the Agong and the link to the Malaya Communist Party (PKM).

“After all this political drama, finally it is now the Public Order and Prevention of Crime (POPO): Emergency Ordinance,” read an email statement from PSM secretary-general S Arutchelvan today.

He said the “highly inconsistent charges” only shows the ill intentions of the authorities in the recent police crackdown.

The party secretary-general demanded an unconditional release of all detained, calling upon “all international and local comrades” to put pressure on the government.

Selangor exco Ronnie Liu from DAP was arrested shortly after midnight today and was apparently 'forced' out from Menteri Besar Khalid Ibrahim's car that he was riding in.

In the 12.20am incident, several excos had just finished a state ceramah function in Hulu Selangor and were returning to Kuala Lumpur before the police stopped them midway.

According to fellow exco and eyewitness Elizabeth Wong, they were in a convoy of about "eight or nine" cars led by a patrol car on the trunk road in Rawang when the incident took place.

"The patrol car in front of us slowed down and another patrol car sped up from behind us.

"Liu who was riding with Khalid, was suddenly put in a patrol car and was taken away without explanation," said Wong, who witnessed the incident from inside her car.

She added that in the ceramah organised by the state government, Liu had spoken earlier but she was unsure of the contents of his speech since she arrived just after he had ended his speech.

'Liu promoted Bersih rally'

Khalid later wrote in his Twitter that Liu was arrested because he had asked the people to join the upcoming Bersih 2.0 rally planned for July 9. The MB also tweeted that he was being held at the Serendah police station. Efforts to reach Liu have been futile.

According to Selangor DAP Youth publicity secretary Lim Swee Kuan, Liu was released at 3.40am on police bail of RM3,000.

Since last Friday, the police have arrested more than 100 people around the country including lawmakers in connection with the Bersih 2.0 rally. Most of them were arrested because they were wearing the yellow Bersih 2.0 T-shirt.

Home Minister Hishammuddin Hussein had earlier this week declared the T-shirt illegal since they were "related to an illegal activity".

Kelmarin Timbalan Pengerusi SPR, Wan Ahmad Wan Omar dengan bangga berkata, “BN sudah mula menang... (saya rasa) mereka sudah mula risau, trend (kemenangan dalam pilihan raya) sudah berubah (memihak kepada BN),” kata beliau pada sesi dialog forum makan tengah hari bertajuk “Tuntutan Bersih — Apa Penjelasan SPR?” anjuran Institut Perkembangan Minda (Inmind) di sini hari ini.

Sehubungan itu kata beliau rakyat Malaysia perlu faham “apa agenda mereka”, dilihat merujuk kepada perkembangan semasa menyaksikan sokongan penyertaan komponen Pakatan Rakyat ke atas Himpunan Bersih 2.0 pada Julai ini.

Wan Ahmad juga mendakwa isu-isu yang dibawa Bersih dan parti-parti sokongan mereka bertujuan menimbulkan kebencian ke atas SPR dan institusi kerajaan, yang mana suasana itu akan diterjemahkan ke dalam bentuk undi ketika pilihan raya umum.

Kata Wan Ahmad, mereka akan pergi ke kawasan-kawasan kampung menyebarkan isu-isu yang tidak tepat untuk mempengaruhi pengundi di kawasan luar bandar. “Sampai kakak saya pun kata apa yang dikatakan mereka itu betul,” katanya lagi.

SPR sering berkata bahawa daftar pemilih mereka adalah bersih dan tidak dicemari dengan pengundi2 hantu. Sungguhpun YB Azmin Ali menunjukkan bukti bahawa ada 11 pengundi hantu yang didaftarkan dengan menggunakan alamat rumah ibunya. SPR masih menolak tuduhan tersebut.

Kelmarin beberapa orang blogger yang mendapati 88 penggundi menggunakan 1 alamat, dan minta SPR memberi penjelasan.

Sebaliknya bukan setakat SPR membisu, tapi lebih malang lagi bila website daftar pemilihnya tak boleh diakses.

How do we deal with Anwar....

I think Anwar himself knows his days are numbered. He may probably be intimating to friends saying goodbye. Aku nak habaq selamat tinggai kat hampa semua. And the friends may have retorted jokingly by saying- lain kali hang nak bantai cina mana, hang panggil kita semua.

Here is the problem though. Anwar behind bars is as much a problem as he is outside. It will still cause BN so many seats. So the question how do we deal with Anwar?

Anwar's good fortune is brought about by the incompetence of UMNO. It messed up the video clip issue by way of mishandling it. It shouldn't have given a semblance of involvement or relationship with the video.

We should have let this Eskay chap do it by himself. But the UMNO president felt compelled to meet up with Rahim Tamby Chik and Shuib Lazim, thereby giving the impression that UMNO is involved. UMNO has implied knowledge about it then, if not direct.

UMNO multiplied its stupidity by releasing clips involving Mat Sabu and the latest about Johari. Who are the ignoramuses surrounding the UMNO president?

The proximity of sequential releases of the clips would now suggest that only an organization with sufficient clout and resources can muster all the sideshows. All 10 fingers point toward UMNO. If we put up both up our legs or spread-eagle them, all 20 fingers point towards UMNO.

How do we deal with Anwar? It's not about doing something to save UMNO. It's about doing something to save the country. Anwar and all interested parties have to think about placing the country in capable hands now.

The irony is, the answer in dealing with Anwar for the purpose of saving the country lies with Anwar. Unfortunately, Anwar has no place in the equation for now at least. The best solution is for him to give up the de-facto leadership of the opposition in preference to someone else with the respectable clout.

I have written some time ago, and I wasn't joking about it, perhaps the best way for Anwar to hasten the downfall of the BN government is to allow himself to be jailed. Then the government will fall and if he is jailed before the downfall, he will be out in no time.

By mid-July Anwar will know his fate. Judging from the case being built up against him, he is likely to be the government's special guest. Special guest is the title of the book once written by Aziz Ishak.

What will happen then? There will be a leadership vacuum in the opposition group. Anwar has been the unifying factor this far. He is a crowd puller but not necessarily a vote puller. If that happens, the opposition parties will have to look for a leadership material sufficiently credible and respectable to become the rallying point.

That person if one is around has to step up to assume the mantle of leadership to save this country from gross mismanagement, fraudulent management, corruption, widening income disparities, re organize institutions of governance, dispensing justice, stemming corruption and all that.

Heavy police presence failed to thwart pro-Bersih rally...

Despite heavy police presence, a Pakatan Rakyat’s pro-Bersih rally went on without a hitch the at PAS state headquarters in Pongsu Seribu, Kepala Batas last night. About 200 police personnel, including a small Light Strike Force unit, arrived in trucks, jeeps and other vehicles soon after the rally began at 10am.

Many youths among the 2,000 crowd, quickly shut down the entrance gates to the venue and formed a human shield to block any attempts by the law enforcers to barge through. Seeing the determined crowd, police personnel did not take any drastic action and merely lined up and stood guard outside and the rally went on without any incident for two hours.

Last night’s rally, which was held without a permit, was to substitute a banned rally scheduled to be held in Seberang Jaya expo site. The police obtained a court on Tuesday to stop two state-sponsored Bersih rallies in Seberang Jaya and Sungai Nibong.

Former state exco Toh Kin Woon, Bukit Tengah assemblyman Ong Chin Wen, state PAS youth wing Mohd Yusin Mat Piah and PKR Batu Kawan division information chief Amizudin Ahmat spoke out in support of the planned Bersih rally in Kuala Lumpur on July 9.

Mohd Yusin said that even the Malaysian football squad had not donned the traditional yellow home colours in pre-World Cup Asian qualifier against Taiwan on Wednesday.

“It’s a shame that the government is so determined to stop a peaceful rally which is meant for free and fair elections, which will only benefit the country. “But the government instead now being hit by the yellow fever … the yellow phobia,” he said, adding that the government machinery has been fully mobilised to halt the July 9 rally.

However, he said the rally will go ahead as scheduled despite threats of detention and court charges by the executives. Ong said that the police’s recent action of arresting Bersih activists and seizing yellow coloured items was clearly an intimidation tactic by Umno to instill fear among the people.

Mohd Yusin accused the Barisan Nasional government of employing fear tactics to scare Malaysians from taking part in the rally.

“It exposes the government’s fear and vulnerability to people’s power,” he said to rousing applause.

Toh chided the government for executing underhand tactics to foil a peaceful rally. “Such undemocratic means should be opposed by all,” he said. Amizuddin, who blogs under the ‘Sharpshooter’ handle, said Umno was worried that the Bersih rally, if it went ahead would trigger another politicall tsunami like in 2008.

Electoral flaw: 152 voters sharing two addresses...

After the Election Commission (EC) attacked the Coalition for Free and Fair Elections (Bersih 2.0) as a Pakatan Rakyat stooge, more evidence has surfaced to show that the electoral roll is marred with flaws as the group's mega rally on July 9 approaches.

A blogger has exposed that two addresses in the state constituency of Seberang Jaya, Penang, are shared by 88 and 64 voters respectively.

The anti-BN bloggerAnak Sungai Derhaka, published all the 152 names in a posting at darisungaiderhaka.blogspot.com today, together with their MyKad numbers.

A Malaysiakini check of all the names using the EC's online electoral roll checking system confirmed the allegation. The first address shared by 88 Malay and Indian voters is No 1155, Kampung Bagan Serai.

According to the results shown by the system, all of them registered at the same parliamentary and state seat, polling district and locality, which is Permatang Pauh, Seberang Jaya, Jalan Sembilang and Kg Bagan Serai (044/10/01/001).

Although their addresses vary in term of format such as “No 1155", “1155" or “1155, Kampung Bagan Serai”, they refer to the same address. Seberang Jaya is one of the three state constituencies under the parliamentary constituency of Permatang Pauh which is held by opposition leader Anwar Ibrahim.

The second address shared by 64 voters of Malay and Indian ethnicity is No 1138, Kampung Bagan Serai, in the same locality as the first address. The blogger claimed the two addresses belong to two small wooden houses.

Purported photographs of the two houses were also published on the blog.

Explanation sought from EC

The posting, written in Malay titled “One address with 88 voters... what is the EC's explanation?”, is in response to EC deputy chairperson Wan Ahmad Wan Omar's attack on Bersih 2.0 yesterday.

“He should first check the electoral roll updated in May. If he is serious about his responsibility, he should explain how this small house can accommodate 64 voters? And how another house located at the same area can accommodate 88 voters?” he asked.

Yesterday, Wan Ahmad labelled Bersih2.0 as a Pakatan stooge and alleged that the July 9 rally was merely to build momentum for Pakatan's bid for Putrajaya.

The opposition described the abnormal number of voters sharing same address as part of the 'phantom voters' phenomena.

Even PKR vice-president Azmin Ali's mother faced such a situation, where five Chinese and one Malay strangers had been registered to her house address.

However, the EC has always denied the existence of 'phantom voters' in the electoral roll and argued that those voters do exist but were wrongfully registered to that particular address.

Under the current election law, the EC has no power to 'correct' this problem unless the 'wrongfully registered' voters approach the commission to change their address.

Wan Ahmad perlu bezakan kesetiaan kepada “government of the day” dengan taat kepada “governing party”...

Saya merujuk kepada kenyataan Timbalan Pengerusi Suruhanjaya Pilihan Raya (SPR), Datuk Wan Ahmad Wan Omar yang dilaporkan oleh laman portal Malaysiakini.com bertarikh 30 Jun 2011 bertajuk "SPR: Ambiga diperalat, Besih kian kusut".

Menurut laporan tersebut, Wan Ahmad mendakwa bahawa Pengerusi Gabungan Pilihanraya Bersih & Adil (Bersih), Datuk Ambiga Sreevenasan telah diperalatkan oleh pemimpin politik pembangkang untuk membantu Pakatan Rakyat menawan Putrajaya dalam Pilihan Raya Umum akan datang.

Kenyataan Wan Ahmad adalah tidak bertanggungjawab dan menzahirkan watak sebenar beliau yang selama ini dilihat sebagai alat kepada pimpinan Umno dan sistem yang rosak. Kenyataan sebegini tidak mengambarkan sikap profesional seorang pegawai yang memegang amanah dan tanggungjawab untuk menjamin institusi SPR kekal sebagai badan yang bebas.

Adalah malang apabila Wan Ahmad gagal memperlihatkan profesionalisme sebagai penjawat awam yang seharusnya bersifat berkecuali. Ketaatan membuta-tuli beliau kepada Umno jelas membuktikan beliau gagal membezakan keperluan untuk setia kepada “government of the day” dengan taat kepada “governing party”.

Beliau turut dilaporkan oleh laman berita The Malaysian Insider sebagai berkata komponen Pakatan Rakyat sudah mula risau dengan kebangkitan Barisan Nasional yang memperlihatkan kemenangan dalam beberapa pilihan raya kecil sejak tahun lalu.

Pilihan raya yang bebas dan adil tidak memungkinkan seseorang itu mengetahui siapakah yang akan menang dalam sesuatu pilihan raya.

Sebaliknya, apabila Wan Ahmad menzahirkan kenyataannya bahawa Barisan Nasional semakin kuat, maka timbul persoalan apakah beliau sudah merancang sesuatu bagi menjamin kemenangan Umno dan Barisan Nasional? Kalau inilah peranan yang dicatur oleh Wan Ahmad, maka pilihan raya di Malaysia sememangnya tidak lagi bebas dan adil!

Wan Ahmad seharusnya faham dan menghayati peranan SPR yang termaktub dalam Perkara 114 Perlembagaan Persekutuan, di mana SPR merupakan sebuah suruhanjaya yang bertanggungjawab bagi menyelia dan mengelola pilihan raya yang bebas dan adil di Malaysia. Asas utama dalam mengendalikan pilihan raya yang bebas dan adil ialah daftar pemilih yang bersih untuk menjamin tidak berlaku pengundian berganda oleh seorang pemilih berdaftar termasuk undi pos.

Saya telah menyahut cabaran Wan Ahmad dan telah membuktikan secara berfakta bahawa Daftar Pemilih Induk 2010 yang diwartakan pada Mei 2011 adalah daftar pemilih yang terkotor dalam sejarah pilihan raya dan dakwaan saya telah diakui benar oleh SPR dalam kenyataan yang dikeluarkan oleh Setiausaha SPR, Kamaruddin Mohamed Baria bertarikh 24 Jun 2011. Wan Ahmad harus memikul tanggungjawab ini dan meletakkan jawatan serta merta. Beliau tidak lagi punyai maruah dan kredibiliti untuk memimpin SPR.

Wan Ahmad juga sewajarnya mengetahui bahawa SPR sama sekali tidak boleh berpihak atau mencampuri urusan mana-mana pertubuhan sama ada pertubuhan yang berkaitan dengan kerajaan atau pertubuhan bukan kerajaan (NGO) seperti Bersih.

Lapan (8) tuntutan Bersih iaitu (i) pembersihan senarai pengundi; (ii) reformasi undi pos; (iii) penggunaan dakwat kekal; (iv) tempoh kempen minima 21 hari; (v) memperkukuh institusi awam; (vi) menghentikan rasuah pilihan raya dan; (viii) menghentikan politik kotor; adalah bertujuan untuk menyuburkan demokrasi dalam negara dan memperkukuhkan sistem pilihan raya yang bebas dan adil.

Tuntutan-tuntutan ini sewajarnya dipandang serius dan positif oleh SPR dalam usaha untuk memastikan perjalanan pilihan raya di negara ini dapat dilaksanakan secara telus, bebas dan adil. SPR harus berlapang dada untuk menerima dan melaksanakan cadangan-cadangan yang dikemukakan oleh rakyat demi memperbaiki imej dan kredibiliti SPR yang dilihat sebagai tidak berwibawa dan bersikap berat sebelah. Keadilan dan Pakatan Rakyat senantiasa mendukung sebarang usaha yang proaktif demi rakyat dan demi menjamin satu sistem demokrasi yang menjanjikan pilihan raya yang telus, bebas dan adil.

Sehubungan dengan itu, saya mewakili Parti Keadilan Rakyat dengan ini menuntut supaya Timbalan Pengerusi SPR itu menarik balik kenyataan beliau atau meletakkan jawatan serta merta kerana telah menjejaskan kredibiliti SPR.

Police who can 'foresee' loss of life and EC who can resurrect the dead...

The police has done a one up on the Election Commission. It is well known that the Election Commission has the capabilities to resurrect dead voters come polling day and to register phantoms at home addresses without the occupants knowing about it - just ask PKR deputy president Azmin Ali.

11 phantom voters were registered to his mother’s residential address. His mum who lives alone apparently did not approve of the other 11 phantoms, and she lodged a complaint. If not the fact that her son is a high profile lawmaker, one wonders if the EC would do anything about it at all. As it its, they only say they will 'look inot it'.

And while the EC can raise the dead, the Malaysian police can see into the future.

Police chief foresees loss of life

The Inspector General of Police, Ismail Omar has foreseen “loss of life” and all things illegal with the Bersih march. Hence, the police’s move to arrest all things deemed “Bersih” in the name of law and order. Yet, isn't this ability to forsee the future based merely on UMNO’s paranoia at seeing citizens stand up and speak out on the corrupt practices in the election process and obviously the BN government.

When measured against the light of the law, the IGP and the police force are acting on the basis of the lies that UMNO and the BN government may have spun. The police should take note that they risk legal action by blindly following such extreme orders. BN is BN and the police are the police. The distinction must be clear but Ismail Omar is very obviously a political appointee.

The moment the Bersih assembly was announced, even before Ambiga and the committee applied to the police for a permit, the assembly was tagged “illegal” by the Home Minister. And this is the news spun by the mainstream media and all organs aligned with UMNO.

Yet, how can an assembly be illegal before it is has gone through the formal process of applying for a permit? If that does not rile you, why then the arrests of supporters for something that has not happened yet?

Can one be arrested for “show of support”? And to charge people using the Sedition Act shows the level of idiocy in those who read the law in UMNO circles. Show of support is not sedition, and wearing a t-shirt that speaks of a future event is not sedition either.

Wearing the Bersih tee is no different than wearing a tee that promotes a Grateful Dead rock concert. Or as someone pointed out, is wearing a tee printed with a marijuana leaf going to get a person arrested for alleged intent to smoke pot?

Top cops beholden to the UMNO elite

There is no way out of it. No excuses they can hide behind. It is clear the police big guns are playing soothsayers for UMNO. And misguidedly, they are proud about it, but one wonders if the rank and file feel the same.

This is clear when the only people promoting the idea that mayhem and chaos will rain down on Malaysia, come 9th July, are those who stand to gain from the UMNO elite.

It shows just how dependent the police, through the top cops, are on the political masters of the day. The IGP and police force are puppets to the UMNO elite and follow the whims and fancies of their masters to the dot.

They close their eyes to outright criminals like Ibrahim Ali, Perkasa and Mat Rempits from UMNO Youth. But turn the lawful into unlawful when it comes to raiding the office of the Bersih organizers, arresting PKR workers distributing Malaysian flags because they wore Bersih tees, violating the Parliament to record statements from opposition MPs and walking the streets to grab all things yellow.

Time and time again, the police top cops have bent over backwards to please their political benefactors. Bersih is just another event in a string of events whereby the police have shown just how they are not independant as they are required to be.

Politically-motivated sodomy cases where “evidence” suddenly materializes out of mid-air, forever immortalized by the sight of policemen carrying in a soggy mattress into court to falsely nail their target, the convenient delay in investigating the Datuk T trio over a sex video that also suddenly cropped out, the incredible way former Malacca chief minister Rahim Thambi Chik was acquited for raping a minor because of lack of evidence. The list goes on, all highlighting the shady way the police in Malaysia go about their business.

And as the Bersih march draws nearer, expect more arrests by the police. These arrests will not be made to ensure law and order, but instead, the police will arrest citizens of Malaysia because UMNO told them to.- Maclean Patrick
