PKR bentang usul undi tak percaya di parlimen minggu depan

Satu kenyataan media menyebut Ahli parlimen Petaling Jaya Selatan Tuan Hee Loy Sian akan membentangkan usul undi tidak percaya terhadap PM Najib Razak pada sesi parlimen bermula minggu hadapan.

Kenyataan  itu menyebut usul tersebut dibentangkan atas sikap tidak bertanggungjawab PM Najib Razak menerima dana sumbangan RM2.6 bilion yang meragukan dari penderma Arab yang tidak dinyatakan identitinya.

Derma juga, menurut kenyataan itu, tidak sepatutnya dimasukkan ke dalam akaun peribadi Najib sebaliknya kepada Umno.

Usul itu juga akan menyentuh mengenai siasatan skandal 1MDB yang berlaku di mana 

 “Special Task Force” yang sepatutnya menyiasat skandal utu dibubarkan tanpa memberi sebarang alasan sehingga Peguam Negara Tan Sri Abdul Gani Patail ditamatkan perkhidmatan; pegawai SPRM dipindahkan; pihak polis mengganggu siasatan SPRM dan Bank Negara; Public Account Committee (PAC) yang sedang menjalankan siasatan terhadap kes 1MDB tidak berfungsi akibat daripada empat anggota PAC yang terbabit telah dilantik menjadi Menteri atau Timbalan Menteri oleh Perdana Menteri; Pengarah Cawangan Khas (SB) diberhentikan; Timbalan Pengarah Cawangan Khas dipindahkan ke Jabatan Perdana Menteri tanpa diberi tugasan.

Usul itu juga menyebut Najib Razak telah menjejaskan imej negara di mata dunia dan menyebabkan pelabur tidak yakin terhadap Kerajaan sekarang sehingga ekonomi menjadi tidak stabil, serta pasaran saham menjunam teruk dan kejatuhan nilai wang ringgit Malaysia berbanding dengan dolar Amerika Syarikat. - suarapakatandaily

MP seeks to table confidence motion against Najib...

An opposition MP is seeking to table a confidence motion against the Prime Minister, Najib Razak, when the Dewan Rakyat resumes on Monday.

It is the 25th of 28 proposed motions listed on the Order Paper for business in the House, which meets from Monday until Dec 3 for the Budget meeting in its final session for the year.

However, as the Budget and other government business usually take priority, the House may run out of time before it gets to Hoy’s motion.

A confidence motion, if carried by the House, would result in the resignation of the prime minister. However, the Barisan Nasional commands 137 of 222 votes in the House and the motion, allowed by the Speaker to be tabled and debated, could only succeed if a sufficient number of Barisan MPs vote against Najib.

The basis of the proposed motion is the reported US$700 million (RM2.6 billion) deposit in Najib’s private bank account which was later explained as being a political donation from a Middle Eastern source.

It also raised other issues connected with the government investment arm 1Malaysia Development Bhd which critics of Najib, principally what the former premier Dr Mahathir Mohamad, has used against him in a year-long campaign to force him out of office.

Dr Mahathir has publicly supported the tabling of a confidence motion and has urged Umno MPs to vote against Najib.

The proposed motion said...

“By not explaining why this ‘donation money’ was transferred into his personal account and not under the party’s name, the House is also not satisfied with the investigation into the 1MDB (1Malaysia Development Berhad) scandal where the ‘special task force’ that was supposed to probe the scandal, was dissolved without any explanation while Attorney-General Tan Sri Abdul Gani Patail had his services terminated, MACC (Malaysian Anti-Corruption Commission) officers were transferred, police interfered with MACC and Bank Negara probes, the Public Accounts Committee (PAC) that was investigating 1MDB ceased to function because four of its members were appointed to be ministers or deputy ministers by the prime minister, the director of Special Branch was terminated, his deputy transferred to the Prime Minister’s Department without assignment.- fmt

Yesterday, PKR secretary-general Rafizi Ramli said the public has to adjust their expectations as the Malaysian parliamentary system means it is difficult to get a no-confidence motion through.

"My worry is that if the public doesn't understand the rules of Parliament, they might say that the opposition has lied to them.

"(But) something that is difficult but is right, you still have to push. But then you have to be realistic of the outcome," he said. - mk

Johor can't secede but TMJ can test it in court...

Constitutional expert Abdul Aziz Bari insisted that states, including Johor, cannot secede from the Federation of Malaysia.

He said this in response to Johor crown prince Tunku Ismail Sultan Ibrahim (photo,above) who in an interview with sports publication Fourth Official claimed the state can secede if the terms set out when it joined the federation was breached.

"The prince should not view the agreement between Johor and other states as private agreements between individuals.

"Some have said there is a right to enter federation but unfortunately the same cannot be said about leaving.

"In any case the prince can put up a claim in the court and see what the judges have to say about it rather than barking the one and same thing again and again," said Aziz who is attached to Universiti Selangor (Unisel).

He added that the only way for a state to exit the federation is through expulsion in Parliament.

Right to equality under constitution

Aziz also indicated that the prince may be subjected to the Sedition Act if he called for secession.
"I am not particularly fond of sedition but if one keeps talking about secession then the police better do something about it.

"Under the constitution there is a right to equality and certain Sabahans and Sarawakians have incurred the wrath of the law for saying the same thing," said Aziz (photo).

He said the Johor crown prince should be mindful of the provision of both the federal and state constitutions, pointing out that some states have sacrificed more or had a stronger claim to more rights.

"He must be aware that the so-called rights of Johor are also available to other states; especially Sabah and Sarawak which have bigger rights and autonomy.

"Selangor and Sabah have given more; the former gave KL and Putrajaya while Sabah surrendered Labuan," he said. - mk

Johor crown prince Tunku Ismail Sultan Ibrahim has warned that the state has every right to secede from the country if any of the terms in the agreement between Johor and the Federation of Malaya are breached.

In an interview with sports website FourthOfficial.com, the crown prince said that his views might be seen as instigating state-based sentiments, but his main concern was the people of Johor.

"I am going to be the future Sultan of this state and my main responsibility is towards the people of Johor. Malaysia is important to me, but Johor and JDT will always come first," he was quoted as saying. Continue reading...

Johor berhak tarik diri daripada perjanjian Persekutuan Malaysia-TMJ

Bar Council member Syahredzan Johan says the Johor Crown Prince's remark about Johor's right to secede is a personal opinion while senior lecturer Shad Saleem Faruqi feels it is seditious.

Constitutional experts are of different opinions on whether Johor has the right to secede from Malaysia as was claimed by Johor Crown Prince Tunku Ismail Ibrahim today.

Bar Council's National Young Lawyers Committee co-chairperson Syahredzan Johan said Tunku Ismail was merely stating his personal opinion, and as such his statement on Johor seceding from Malaysia could not be deemed as seditious.

“His remark is not seditious. He is stating an opinion and his opinion cannot be regarded as seditious,” Syahredzan told Berita Daily.

“Whether it is correct or wrong, that is a separate matter. That is the problem with the Sedition Act, it is so vague and so wide,” Syahredzan explained.

Earlier today, the 31-year-old Tunku Ismail broached on the possibility of the state breaking away from Malaysia if terms of it joining the federation were broken.

“Over the years, we’ve always been strong and independent as well as resourceful.

“In fact, we only joined the Federation of Malaya upon both parties agreeing to several basic terms.

“And if any one of those terms are breached, we have every right to secede from this country,” said Tunku Ismail in an interview with sports portal fourthofficial.com.

Although the interview was on his role and influence in making Johor a footballing power house in Malaysia, the question of Johor seceding from Malaysia came when he was asked on his state-based sentiments that could create a divide on the national scale.

“I am going to be the future Sultan of this state and my main responsibility goes towards the people of Johor. Malaysia is important to me, but Johor and JDT (Johor football team) will always come first.

“People deserve to know, that the mess we have in the country right now, should in no way be associated to the Johor royal family.

“You can accuse me of instigating state-based sentiments, but to me, I’m merely doing my duty to the people of Johor, and reminding them of the history and heritage behind this great land,” said the prince who is known for his frank views.

'It is seditious'

However, Universiti Teknologi Mara (UiTM) Emeritus Professor of Law Prof Dr Shad Saleem Faruqi told Berita Daily that there was no state in Malaysia that could secede from the federation as every state falls under the territory of Malaysia following the Independence in 1957, and then the formation of Malaysia in 1963.

The constitutional expert added that Tunku Ismail should have not made such a remark, adding that it was seditious for one to call for a secession.

“It is stated clearly under Article 1, clause 2 of the Federal Constitution. No state has the right to break away from Malaysia under the constitution. You cannot simply withdraw from the federation. In fact you cannot.

“The Crown Prince should not have said it. Calling to secede is an offence and it falls under the Sedition Act,” the law expert said.

Earlier this year, Tunku Ismail's younger brother Tunku Idris Ibrahim first raised the issue of seceding by posting of an image of Johor state’s agreement with the Federation of Tanah Melayu.

The 1946 agreement, signed by the late Sultan Abu Bakar, stated that the agreement was inked after several conditions set by the state government.

The agreement also stated that Johor will leave Malaysia if any of its conditions are not met.

Among the conditions are Islam as the official religion of the state, land and water being the absolute right of the Johor government and no interference in its state laws.

Tunku Idris' reminder of the agreement came about following a public spat between Tunku Ismail and Culture and Tourism Minister Nazri Aziz over the Crown Prince's remarks about Prime Minister Najib Razak avoiding a public forum to explain the 1MDB scandal.

Constitution experts meanwhile argued that the agreement between Johor and Federation of Tanah Melayu has become null and void after Merdeka.

Similar calls for secession of Sabah from Malaysia have resulted in the arrest of several Sabah activists for sedition.

Another activist, Doris Jones, is wanted by the police over her calls for an independent Sabah. She is now rendered stateless in London after the Malaysian government refused to renew her expired passport. - beritadaily

An independent Johor would be an economic powerhouse

Jika sebelum ini Rafizi Ramli antara yang lantang mendesak undi tidak percaya terhadap Perdana Menteri Datuk Seri Najib Razak, naib presiden PKR itu kini mengatakan tindakan itu sukar dilaksanakan di Parlimen.

"Kita kena realistik. Ia (undi tak percaya) bukan mudah," kata Rafizi pada sidang media di Ibu Pejabat PKR di Petaling Jaya hari ini.

Rafizi berkata pembangkang tidak dapat menentukan sama ada usul undi tidak percaya terhadap perdana menteri dapat diadakan atau tidak.

"Kita perlu susun semula jangkaan. Kita tidak mahu situasi di mana selepas Parlimen, Najib masih berkuasa, dan orang menyalahkan kita," katanya.

"Bukan kami yang kawal, Najib dan Speaker," tambahnya lagi.

Beliau berkata Najib akan memastikan kehadiran semua ahli Parlimen Barisan Nasional pada hari mengundi jika Speaker membenarkan usul tidak percaya.

Kenyataan Rafizi itu senada dengan Ahli Parlimen Gua Musang, Tengku Razaleigh Hamzah baru-baru ini yang mengakui kesukaran melaksanakan undi tidak percaya terhadap Najib.

Bekas perdana menteri Tun Dr Mahathir Mohamad antara pemimpin yang lantang mencadangkan perkara itu.

Rafizi, bagaimanapun, masih berharap untuk mencuba walaupun peluang tipis.

"Betul, memang sukar, tetapi kita kena cuba," katanya.

Setiap ahli Parlimen, katanya, boleh mengundi semasa Bajet 2016 yang bakal dibentangkan Najib pada 23 Oktober ini. – tmi

No-confidence vote against PM a tough one...

It will be difficult to pull off a no-confidence vote against Prime Minister Najib Abdul Razak in the coming Parliament sitting, which starts next Monday, said PKR vice-president Rafizi Ramli.

Therefore, the Pandan lawmaker said the public needs to "re-calibrate their expectations" and not blame the opposition if it does not materialise.

"My fear is that we have to re-calibrate the public's expectations, because I don’t think the public understands the standing order," he told reporters at the party headquarters in Kuala Lumpur today.

Rafizi explained that the process of a motion to table a vote of no-confidence in this country would have to go through the speaker, who would then refer it to the prime minister.

He noted that a vote of no-confidence which the public is used to in other countries is "near impossible" in Malaysia and so they have to be realistic in their expectations.

"My worry is that if the public doesn't understand the rules of Parliament, they might say that the opposition has lied to them," he said.

However, this does not mean the opposition will still not try to force Najib to step down, Rafizi said.

"My opinion is that this has always been our attitude as activists.

"Something that is difficult but is right, you still have to push but then you have to be realistic of the outcome," he said.

Another possible way is for the opposition to defeat a bill tabled by Najib, he added, because it can be taken to mean that the prime minister has lost the confidence of the majority.

Being realistic

The next major bill will be the Budget 2016, he pointed out, and Najib will be expecting the opposition to try its best to defeat that bill.

"He will try his best to make sure that every single BN MP will be there so I think there will be a heightened sense of intimidation from BN," he said.

The opposition will try any method to take Najib down, said Rafizi. 

"Whether it is through defeating a bill, whether it is through filing a motion of no-confidence, we will do it […] but we are not in control.

"The one in control is Najib and the speaker so therefore we have to be a little realistic about it," he noted.

He said Najib would ensure the presence of all Barisan Nasional MPs on the day of voting if the Speaker allowed the motion of no-confidence to go through.


The opposition has been talking about tabling a motion of no-confidence vote for months now, though it has been a lot more coy about whether it will actually do it. - mk

What does Saifuddin’s ‘departure from UMNO’ mean...

It is less than an hour before PKR president Dr Wan Azizah Wan Ismail announces who from Umno will be joining the party.

But all eyes are already on former deputy higher education minister Saifuddin Abdullah, who lost to a PAS candidate in Temerloh in the last general election.

Although Saifuddin himself has not personally responded to any WhatsApp enquiries, there are already reports confirming that he will be the one making a debut in Pakatan Harapan politics.

What are the implications, if Saifuddin is the one who decides to hop?

May signal an even bigger migration

Surely, Saifuddin’s former colleagues in Barisan Nasional (BN) would say there is no big deal with him moving on to Pakatan Harapan.

However, looking at the bigger picture, Saifuddin’s departure may signal an even bigger migration of his fellow Umno members to Pakatan Harapan, after members nationwide become disillusioned with Prime Minister Najib Abdul Razak.

Saifuddin is known to be one of the better Umno leaders compared to others in the like of Abdul Rahman Dahlan, Salleh Said Keruak and Ismail Sabri Yaakob.

However, his push for moderation and being vocal has not earned him very much respect from Najib himself. Saifuddin is definitely not a ‘Mr Yes’ man which Najib would prefer to have in his cabinet.

He was one of the few leaders who spoke up for the university students who had battled against the Universities and University Colleges Act 1971.

Saifuddin, who was also well-liked by the operators of private tertiary education institutions when he was deputy minister, will do better when he takes the Pakatan Harapan platform.

Saifuddin’s debut in Pakatan Harapan may also pave the way for others who are finding themselves unable to introduce reforms within their own parties.

Leaders such as former MCA president Ong Tee Keat is also a likely candidate who will move to Pakatan Harapan to boost the existing quality of leaders. Others such as former Umno minister Abdul Kadir Sheikh Fadzir may also join Pakatan Harapan. Both have been vocal recently.

Umno less attractive

With the latest development, it could only mean one thing - Umno will not have the pool of quality leaders that can be picked to lead the country.

In the words of former prime minister Dr Mahathir Mohamad, the present cabinet ministers are ‘half-past-six’. Instead of showing their leadership in their respective portfolios, they have become preoccupied with the politics of the day.

What is worse is when you have ministers like Ismail Sabri making allegedly racist statements without being punished for it. And a minister who talks about Malaysians preferring to have slower speed Internet connections!

What more a home minister who writes to the Federal Bureau of Investigation (FBI) to support someone who is known to be an alleged online gambling kingpin. Instead of being reprimanded, he becomes the country’s No 2 man!

What hope do Malaysians still have in Umno to lead the nation?

Parti Keadilan (PKR) menarima seorang lagi tokoh hari ini apabila bekas ahli Majlis Tertinggi Umno, Saifuddin Abdullah telah diistyharkan menyertai parti tersebut. Presiden Keadilan, Dr Wan Azizah Wan Ismail dalam satu sidang media khas diperjabat parti itu di Damansara tengah hari ini mengumumkan kemasukan Saifuddin ke dalam PKR.

Dua minggu lalu PKR menerima penghijrahan dua tokoh politik veteran dan juga pimpinan Pas, Kamaruddin Jaafar dan Muhammad Mohd Taib. Kamaruddin merupakan bekas ahli jawatankuasa kerja Pas manakala Muhammad yang juga bekas MB Selangor adalah bekas naib ketua penerangan Pas Pusat.

Kedua-dua tokoh Pas itu diberi tempat dan jawatan dalam PKR sesuai dengan pengalaman luas mereka dalam politik.

Begitu juga Saifuddin katanya akan dilantik menjadi Setiausaha Eksekutif Pakatan Harapan yang akan mengandungi tiga parti PKR, DAP dan Amanah. Penyertaan ketiga-tiga mereka itu sudah tentu memberi suntikan semangat dan kekuatan kepada kepimpinan PKR.

Kehadiran Saifuddin yang dikenali sebagai tokoh belia dan membawa pemikiran politik baru akan meransang anak-anak muda untuk menyertai PKR.

Dalam pada itu sudah pasti dengan pengumuman rasmi bekas MP Temerloh itu beliau akan memulakan era baru dalam politik dengan menjadi ahli politik pembangkang. Kerenah dan cabaran termasuk hemburan personal akan banyak diterimanya selepas ini.

Terlalu awal apakah beliau akan dicalon oleh Pakatan Harapan pada pilihan raya akan didatang di kerusi parlimen Temerloh ataupun akan berpindah ke kawasan lain? Tetapi yang pasti Saifuddin akan menjadi calon istimewa dalam pilihan raya akan datang mewakili PKR. Kehadirannya di Temerloh menyebabkan ahli Parlimen itu sekarang ini tidak cukup "siku dan lutut" untuk menyelamatkan diri. Haha. - mso

Obama Picks Najib As Friend Because The President Is Mentally Unwell...

By now, it’s an international knowledge that Prime Minister of Malaysia – Najib son of Razak – is allegedly linked to corruption, money laundering and the murder of Mongolian Altantuya. No previous prime minister has been so popular, not even the evil dictator Mahathir Mohamed. And if everything goes well, Najib could overtake Mahathir as the longest serving PM.

Coincidently, both Mahathir and his self-picked successor Najib were sworn in as the most powerful man in the country at the age of 56 (*spooky*). When Mahathir resigned in 2003, he was already 78-years-old, having ruled for a good 22-year. He, however, chose to retire because his popularity dropped like a rock. Still, UMNO controlled two-thirds majority.

Najib, on the other hand, performed worse than his predecessor – Abdullah Badawi – when he lost the popular vote to merely 47%, the first in the history of Barisan Nasional that he leads, on top of a failure to recapture two-thirds majority that Badawi had lost earlier on. He’s now into his sixth year of premiership; another 16-year to go before he can match Mahathir’s record.

But even with roughly one-third of his journey before breaching Mahathir’s 22-year-rule, Najib has already broken every Mahathir’s record imaginable. He has accumulated more than RM600 billion (new definition in debt is close to RM800 billion) in external debt within 6-year of premiership, in comparison to Mahathir’s RM200 billion by 2003 when he retired.

Judging by his habit of spending taxpayers’ money and borrowing as if there’s no tomorrow, he could easily create another record of breaching RM1 trillion in external debts before 90-year-old Mahathir could kick the bucket. Najib regime also has proudly purchased more private jet for his official (and private) use than any other prime ministers.

It’s perplexing to imagine why Najib and his wife need 6 private jets, with the latest ACJ319 (registered under 9H-AWK) purchased last December. Nevertheless, he is the only prime minister who had convinced some wealthy Arabs for donations to the tune of RM2.6 billion, without any strings attached, something which charismatic Mahathir couldn’t achieve.

Bad luck or otherwise, it was also under PM Najib Razak that Malaysia saw the losing of two commercial planes in 1-year – the missing of MH370 and the crashing (shot-down) of MH17 – killing more than 500 innocent lives in both incidents. Despite not experiencing global financial crisis such as the 1997-98, the ringgit plunges to as low as RM4.48 to US$1 dollar under his administration.

For the first time, a Chinese ambassador had taken the trouble to visit Petaling Street (Chinatown) while warning Beijing would do everything under its arsenal to protect its investments, after Red Shirts gangsters endorsed by Najib regime threatened to terrorise the area which could possibly start a racial riot.

Mana janji sebelum PRU 13 kurangkan kadar tol...

Ahli parlimen Pokok Sena Datuk Mahfuz Omar menempelak kerajaan BN kerana sanggup menaikkan kadar tol setinggi 17% – 80%.

Menurut Mahfuz kerajaan BN telah memungkiri janji mereka sebelum pilihan raya umum ke 13 lalu untuk mengurangkan kadar tol antara bandar bagi menarik pengundi bandar dan sub bandar pengundi pemerintah.

“Persoalannya, ke mana perginya janji Kerajaan yang berikrar menjelang PRU13 lepas untuk mengurangkan tol antara bandar? Ke mana hilangnya janji Kerajaan yang hendak runding semula perjanjian dengan syarikat konsesi tol? 

Kenapa dibiarkan perjanjian yang bersifat pro syarikat dan tidak pro pengguna? Apakah jika tidak dinaikkan tol dan tidak dibayar pampasan, syarikat konsesi akan bankrap?

“Kerajaan memberi alasan adalah lebih baik wang pampasan diguna untuk pembangunan yang lain untuk membina hospital dan sekolah. Sedangkan sebelum ini, PM menyatakan dengan GST kerajaan boleh membina hospital, sekolah dan jalanraya.

“Kini Menteri Kerjaraya pula berkata dengan kenaikan tol, Kerajaan boleh bina hospital dan sekolah. Jadi, adakah kerajaan hanya mampu membina sekolah dan hospital dengan syarat menaikan tol dan kenakan cukai GST ke atas rakyat? Kerajaan apakah yang selemah ini?” katanya dalam satu kenyataan.

Mahfuz menggesa kerajaan BN berhenti memperbodohkan rakyat. Sebaliknya, beliau mencadangkan, belanjawan negara pada Oktober ini perlu dibentangkan dengan kenaikan gaji kakitangan awam beserta peruntukan khas bayaran elaun tol bagi kakitangan awam di Lembah Klang bagi meringankan beban golongan pekerja yang terkepung pergerakan mereka dengan lebuh raya bertol.- suarapakatandaily

Azmin wants state-owned companies to explain toll hikes...

Selangor Menteri Besar Azmin Ali said today he will summon two state firms, which have minority stakes in two expressways in the state, to explain on the toll hike issue.

The two firms are Selangor State Development Corporation (PKNS) and Kumpulan Perangsang Selangor (PKS).

"I have asked PKNS and Kumpulan Perangsang, which hold minority stakes in Kesas and LDP (sic) respectively, to attend the Selangor Economic Action Council (MTES) meeting tomorrow.

"MTES will scrutinise the feedback from PKNS and KPS. The state government's policy is to oppose any toll hike that will burden the rakyat," Azmin (photo) said in a series of twitter postings.

According to the 2014 PKNS annual report, it controls a 20 percent stake in Sprint Expressway.

PKNS also holds a 30 percent stake in the Kesas Expressway but has no stake in the Lebuhraya DamansaraPuchong (LDP).

On Monday, it was announced that a total of 18 highways will be increasing their toll rates after the government moved to stop subsidising the toll fees paid to the concessionaires.

Starting tomorrow, the toll rates at Plaza Damansara, Pantai and Bukit Kiara on the Sprint Expressway will be RM2, and RM2.50 and RM3.00 respectively.

This is in contrast to the old rate of RM1.00, RM1.50 and RM2.00 respectively.

If Najib is a “Bugis warrior”,he should not run away from battle...

After two initial motions, said DAP elder statesman Lim Kit Siang, Parliament should set aside two or three days for a motion by the Prime Minister, Najib Abdul Razak, to seek the confidence of Parliament so as to re-establish moral and political authority and legitimacy for him to continue as the head of government.

But if he is to be true to his claim as a “Bugis warrior”, added Lim, Najib should not run away from battle in the way he had backed off from the Nothing2hide Forum on 1MDB in early June or the 16th IACC Opening Ceremony last month.

On the contrary, reiterated Lim who is also DAP Parliamentary Leader and Gelang Patah MP, Najib should take the battle of his premiership to Parliament on the very first day by moving a motion of confidence in him as Prime Minister of Malaysia. “This is what Hussein Onn did when he became Prime Minister in 1976. Najib should emulate his maternal uncle to continue as Prime Minister.

Lim does not rule out Najib biding his time to see whether there would be any motion of no confidence against him in the forthcoming Parliament, convinced that any such move would be blocked and sabotaged by a Speaker who would do his bidding, “but this would not be keeping with his boast to be a ‘true Bugis warrior’.”

Najib moving a motion of confidence on Monday when Parliament reconvenes would be a smart political move, ventured Lim, as at this moment of time, it appears unlikely that a majority could be organised to defeat it.

If Najib misses this chance, the possibility of a “no confidence motion” being moved and to get a majority support during the course of the 25-day budget parliamentary meeting until Deember 3 would improve by the day, warned Lim.

The Bugis warrior...

Elsewhere, the first official parliamentary business after Question Time from 10 am to 11.30 am next Monday should be to adopt two motions, said Lim.

The first motion is to reconstitute the Parliamentary Selection Committee to appoint new members to replace Muhyiddin Yassin, as he was no more Deputy Prime Minister; and G. Palanivel as he was no more MIC Minister; and Anwar Ibrahim as he has been disqualified as MP and was serving a jail sentence in Sungai Buloh Prison, said Lim.

The second motion is to fill the three-month vacancy of the Chairman of the Public Accounts Committee (PAC), created by the stratagem of elevating the PAC Chairman Nur Jazlan as Deputy Home Minister and, together with the elevation of three other PAC members into the Executive as Minister or Deputy Ministers, said Lim.

For the first week of Parliament from Monday to Thursday, Lim disclosed that he had given notice to pose oral Parliamentary questions on the hot topics of the day, viz: on the Special Task Force on 1MDB; the RM2.6b political donation controversy; the Prime Minister’s absence from the 16th International Anti-Corruption Conference in Putrajaya; and the US Federal Grand Jury Investigation on 1MDB.

Lim noted that MPs have so far not received the Parliamentary Order Paper for the first week or even the first day of the 25-day Parliamentary meeting which is to be held from Oct. 19 to Dec. 3. “There should a proper agenda for the first week of Parliament from Monday.”

Parliament on Monday should also approve a requisition by Seputeh MP Teresa Kok, invoking Standing Order 18, asking for an urgent debate on a definite subject of public importance, the scandal and tragedy of the seven missing SK Pos Tohoi children in Gua Musang, ranging from seven to 11 years, for seven weeks, leaving only two survivors in “skin and bones”, stressed Lim. - fmt

MH17 shot down by Russian-built Buk missile...

MH17 - Dutch Safety Board simulates MH17 being hit by BUK missile...

Malaysian Airlines Flight MH17 crashed as a result of a Russian-made Buk missile, the Dutch Safety Board says.

The missile hit the front left of the plane causing other parts break off, it said in a final report into the July 2014 disaster, which killed 298 people.

The West and Ukraine say Russian-backed rebels brought down the Boeing 777, but Russia blames Ukrainian forces.

The report does not say who fired the missile, but says airspace over eastern Ukraine should have been closed.

The plane - flying from Amsterdam to Kuala Lumpur - crashed at the height of the conflict between government troops and the pro-Russian separatists.

Among the victims were 196 Dutch nationals and 10 Britons.

The report says the three crew members in the cockpit were killed by the missile explosion instantly.

However, it adds, it was unclear at which point the other occupants died, and the possibility of some remaining conscious for some time during the one-and-a-half minutes it took for the plane to go down could not be ruled out.- BBC News

Menyifatkan ia hanya janji kosong, Ahli Parlimen Petaling Jaya Utara, Tony Pua, berkata pentadbiran BN berselindung di sebalik kadar tol rendah pada awal projek bagi mendorong pengguna menerima skim konsesi tol.

“Janji Datuk Seri Najib Razak pada manifesto pilihan raya BN 2013 betapa kadar tol akan berkurangan secara berperingkat dalam tempoh lima tahun hanya janji kosong untuk meraih undi.

“Bahlkan, Kementerian Kerja Raya tidak peduli untuk memberi alasan lebih meyakinkan, selain menyatakan jumlah yang dijimat boleh digunakan untuk melaksanakan projek pembangunan yang memberi kesan berganda kepada ekonomi.

“Alasan itu tidak masuk akan kerana perbelanjaan rakyat terhadap pembelian selain dari bayaran tol juga memberi kesan sama kepada ekonomi,” katanya pada kenyataan media, hari ini.

Pua berkata, kenaikan kadar tol juga membuktikan BN tidak berupaya mengurus ekonomi negara sebaliknya, rasuah, pembaziran, ketidakcekapan dan penyelewengan dana kerajaan, berleluasa.

How about using Sosma on toll operators...

A pro-government portal today demanded that the Security Offences (Special Measures) Act 2012 (Sosma) be used against toll operators after it was announced yesterday that toll rates for 18 highways will be increased by 100 percent.

MyKMU, which has in recent months staunchly defended Prime Minister Najib Abdul Razak against calls for his resignation, said toll operators were guilty of "economic sabotage".

"It would be appropriate if action is taken under Sosma 2012 for economic sabotage and sparking public anger at the government.

"The government cannot compromise with old cronies who try to sabotage the country's economy and government of the day.

"Just seize all the highways and nationalise them. Arrest all the concessionaires who are insistent on defending their lopsided deals," it said.

In a break from its usual pro-government stance, the portal was also mildly critical of Putrajaya.

"The government must reconsider its decision to allow toll concessionaires to decide on the toll hike as it is not only senseless but can also affect the rakyat's support for the government," it said.

Dr Mahathir blamed

However, in a separate report, MyKMU placed most of the blame on former premier Dr Mahathir Mohamad, stating that many of the lopsided concessions were signed during his time.

"Mahathir had ensured in the past that when the agreements were signed, the concessionaires would never suffer losses.

"If the rakyat did not bear the costs, then the government would bear the costs using public funds, there would be no room for losses (for the companies)," it said.

The portal's call for Sosma to be used on toll operators came amid accusation of abuse after the government arrested 1MDB critics under the anti-terrorism law.

Former Batu Kawan Umno vice-chief Khairuddin Abu Hassan and his lawyer Matthias Chang were arrested under the anti-terrorism law on grounds of "sabotaging the nation".

They had lodged police reports in several countries concerning bank accounts linked to Prime Minister Najib Abdul Razak and 1MDB.

Najib is embroiled in a controversy over the deposits of RM2.6 billion in his personal bank accounts.

He had denied taking public funds for personal gain while his supporters claim the money is a political donation.- mk

1MDB - rogues skip free, heroes pilloried...

Khairuddin Abu Hassan and Matthias Chang were charged yesterday for committing offences under Section 124 L of the Penal Code which reads:

'Whoever attempts to commit sabotage or does any act preparatory thereto shall be punished with imprisonment for a term which may extend to fifteen years.'

The word 'sabotage', which is fundamental to any charge under this provision, is defined in Section 130A of the Penal Code as follows:-

(h) 'sabotage'' means

a) an act or omission intending to cause harm -

(i) for the interests of foreign powers or foreign organisations;

(ii) to premises or utilities used for national defence or for war;

or

(iii) to the maintenance of essential services; or

(b) knowingly producing defective materials, premises or utilities used for national defence or for war…; '

The particulars of the charge are that Khairuddin lodged reports with the police and other authorities in France, England, Switzerland, Hong Kong and Singapore between June 28 and Aug 26, 2015.

How the lodging of a police report in a foreign country can constitute a criminal offence in Malaysia is totally baffling.

Whether the police or other authorities in any of these five countries take any action on the report is a matter entirely within their power and discretion.

A relevant factor may probably be whether any laws of the country in question have been violated, although some of these countries have since Sept 11 assumed extra-territorial jurisdiction for offences committed outside their boundaries.

Lodging a police report is an everyday occurrence in every society, and indeed, is encouraged as a civic duty.

Presumably Chang was charged for advising his client, Khairuddin on how to draft and present the police reports.

Hence, the arrest, detention and prosecution of Chang directly threatens the independence of the legal profession and impinges on the ability of lawyers to advise their clients without fear or favour.

The conduct criticised of Khairuddin in the charge does not come anywhere near 'intending' to cause harm to premises 'used for defence or for war' which appear in sub-sections (a)(ii) and (b) of the definition of 'sabotage'.

Neither can his action be intended to cause harm 'for the interests of foreign powers or foreign organisations'. That is intended for spies, traitors and terrorist organisations.

One would be hard pressed to find nationalists like Khairuddin and Chang. They are true and loyal Malaysians genuinely and sincerely acting in the interests of the people and nation

Blatantly unjustified prosecution

That leaves an act 'intending to cause harm….to the maintenance of essential services', which is defined to indicate 'banking and financial services'.

Hence, this prosecution presupposes that what Khairuddin did when he lodged police reports abroad presumably relating to 1MDB and the loss of funds is inimical to the maintenance of Malaysia’s banking and financial services is equally baffling.

Rather than treating them as heroes for endeavouring to ascertain the truth about such losses (which is a necessary first step to enhance the confidence in Malaysia’s financial and banking systems, and in consequence, strengthening them by transparency and accountability), Khairuddin and Chang are subjected to a criminal prosecution of the worst kind.

Hence, not only are they charged under the ordinary criminal laws of the land, but their charges come within the purview of the dreaded Sosma which has meant that they cannot be released pending the trial but remain in detention.

The Bar had condemned Sosma as a terrible substitute for the draconian ISA and this prosecution demonstrates the extraordinary reach of Sosma and its potential for abuse.

A constant feature of the Najib administration is that real culprits are never charged; instead, innocent persons and other victims are targeted.

So it is the ultimate irony that the real wrongdoers and culprits are not charged for flouting the law resulting in the loss of billions and the fall of confidence, both international and local, in our financial market, but courageous souls like Khairuddin and Chang are persecuted for daring to expose the truth.

This is yet again a blatantly unjustified prosecution of wholly innocent persons pursuing the truth. Accordingly, the charges against them should be dropped and both released immediately. - Tommy Thomas,mk

No MH370 wreckage on Tawi-Tawi, says Philippine navy...

The Philippine navy has denied sightings of wreckage of a Malaysian plane in the southern island of Tawi-Tawi, reports the Inquirer.

The Inquirer reported that Captain Giovanni Carlo Bacordo, commander of Naval Task Force 61, said they had deployed a gunboat to investigate the claims of a man about the sightings of the wreckage.

“Since yesterday, we deployed a gunboat there because of the news. We interviewed the people there, the fishermen, but they have no knowledge about it,” he was reported as saying.

Bacordo added that locals had no knowledge of it and were surprised by the news.

Malaysian daily The Star said a report was lodged on Saturday with Sandakan authorities about the sighting of the wreckage.

It said that Jamil Omar, 46, had gone to the police with the information he got from his aunt, who claimed to have been told about it from her relatives who were hunting for birds on Sugbay Island, Tawi-Tawi, last week.

It added that Jamil said skeletal remains fastened to their seats were seen in the plane, which was believed to be part of the Malaysia Airlines flight MH370.

Flight MH370 remains one of the most baffling aviation disasters in history. It disappeared in March last year, while flying from Kuala Lumpur to Beijing with 239 passengers and crew members on board.

This latest rumour comes after French authorities confirmed a piece of wing found on the shore of Reunion Island in the Indian Ocean has been identified as part of the MH370 wreckage.

The flaperon was found on the shore of the French island on July 29 and Putrajaya said paint colour and maintenance-record matches proved it came from the missing Boeing 777. – tmi

DAP Segambut MP Lim Lip Eng challenged deputy minister Tajuddin Abdul Rahman to slap him on the first day when Parliament resumes next week.

Lim issued the challenge to the deputy agriculture and agro-based industries minister in a statement today.

Tajuddin refused to apologise for saying that ethnic Chinese Malaysians who complain to foreign quarters about domestic affairs deserve to be slapped.

After his remarks backfired, Tajuddin's explanations ranged from outright denial to claiming that he was misquoted, to saying that it was targetted at DAP 

Chinese, to it was “just a reminder” and even declaring that it was just “a joke”.

Lim (photo) said if Tajuddin is an anak jantan (courageous), he should repeat the threat to slap the Chinese in the Dewan Rakyat.

He added that people wanted to see whether he will be receiving the same fate as Penang DAP Sri Delima state assemblyperson RSN Rayer, who was charged under Sedition Act for saying "Umno celaka" in Penang state assembly.

"Slap me if you dare, let the people judge how low is the mindset of a deputy minister."

Lim advised Tajuddin to follow the good example of former Malay leaders in the history, not the thuggish behaviours. - mk

Usaha untuk menjatuhkan Perdana Menteri, Datuk Seri Mohd Najib Tun Razak akan dilakukan menggunakan kaedah lain bukan undi tidak percaya di Parlimen.

Ahli Parlimen Gua Musang, Tengku Razaleigh Hamzah berkata, undi tidak percaya yang mahu dilakukan pembangkang itu tidak akan berlaku kerana kerana awal-awal lagi usul tersebut sudah dihalang oleh Speaker Dewan Rakyat.

“Speaker mempunyai kuasa untuk menolak mana-mana usul sekiranya tidak berada dalam urusan aturan mesyuarat Dewan Rakyat di Parlimen.

“Kita sedar usul tidak percaya tidak akan berlaku, namun kita akan lakukan dengan cara yang lain,” katanya yang enggan mendedahkan usaha terbaharu itu.

Will Zeti be the woman to hasten the downfall of Najib...

History was written today when five Umno veterans and former ministers went rogue to 'whip' Prime Minister Najib Razak in public over the 1Malaysia Development Berhad (1MDB) financial fiasco.

Dr Mahathir Mohamad, Muhyiddin Yassin, Shafie Apdal, Tengku Razaleigh Hamzah, and Sanusi Junid – all time-tested hardcore politicians in harmony upped their call and pressured the government to stop using draconian laws like Sosma against those who spoke and reported against the government and 1MDB.

And they were joined by two MCA's former presidents - Dr Ling Liong Sik and Ong Tee Keat.

How far will their effort go is anybody's guess.

But if there is one person who could possibly rock the government, it may actually be a non-politician and that is the Bank Negara Governor Zeti Akhtar.

Reading from the statement made by the central bank last Friday that it has revoked three permissions granted to the government strategic investment arm 1MDB under the Exchange Control Act 1953 for investments totalling US$1.83 billion, it can be assumed that Bank Negara has taken its own stand on the matter as opposed to the Attorney General.

The AG had cleared 1MDB of any wrongdoing despite an appeal from Bank Negara but that did not hinder and suppress the Central Bank to reveal their findings to the world.

Zeti did the right thing. She has all the powers as the Bank Governor to institute and enforce the relevant laws as permitted under the Act against any party found to have misled the bank into believing the information provided was accurate and complete to obtain various allowance and permissions.

Zeti must have exhausted all avenues at her disposal which eventually pushed her to the corner and make things public.

Under the various financial laws and the vast powers granted to the Bank Governor, Zeti could have unilaterally taken action on 1MDB, as it can for any financial related business that is out of norm and limitations as permitted.

But she may have kept to 'political' protocol since 1MDB is a hot button issue and involves Prime Minister cum Finance Minister Najib Razak directly. Going against her 'boss' could have been impolite and ugly or even detrimental to her career.

But when public opinion and judgment, locally and internationally, came knocking on her doors and with the indirect 'blessings' of the Malay Rulers decree on the 1MDB issue, Zeti must have thought she might as well answer to the call of the nation and its people.

Last beacon of hope

Zeti must have realised that it is not worth the salt dicing with 1MDB that seems to be endlessly finding itself in deeper trouble as the months pass by.

Though reactive actions have been initiated by Najib's government, nothing is going right for him.

Zeti may be holding many more cards close to her chest about 1MDB and their financial dealings for the fact that the Central Bank made detailed audit recently.

Many more documents could have revealed how monies would have been transacted using the 1MDB umbrella here and offshore.

We must keep in mind that the Monetary Authority of Singapore (MAS) had also provided valuable information on the various accounts of 1MDB and related companies to Zeti after their own investigations.

This has never been made public yet. Is Zeti keeping it for another day to launch a greater 'blow' to Najib and team, or even the AG?

MAS has also frozen accounts in Singapore, which again no details have been made public.

Zeti has privy to all the information, some of which even 1MDB may not know for the fact.

All this can sum up into a gigantic ball rolling over those in powers, be it the AG, Najib and other enforcement agencies.

Just after the Bank Negara statement, we can also deduce that the CEO of 1MDB Arul Kanda will make some 'safe' statements that he was not part of some decisions made by the 1MDB board and it was done before he joined the firm.

It can be assumed that the internal pressure is rising to unproportional levels since Zeti made the statement which can also assume to mean that she is getting pretty 'tired' of all the play.

Zeti may well be the last beacon of hope in saving the nation from going worse economically and even socio-economically.

Zeti must not stop now. She is due to finish her term as Bank Governor in April 2016, thus it makes it more urgent that while in office she does her duty well to the nation and not suffer the fate of being pushed aside like former AG Gani Patail.

'The hand that rocks the cradle is the hand that rules the world' - Zeti could be that 'Messiah' to save us all from falling further.
