An Umno leader is wringing his hands over what he feels is speaker bias in legislative assemblies of Pakatan Rakyat-ruled states. Seberang Jaya assemblyperson Arif Shah said their lack of even-handed treatment at times had stirred "dissatisfaction and disappointment' among opposition representatives.

He pointed out that when the speaker acted in an unjust manner, assemblypersons have no means to retaliate as the former has "absolute" authority during proceedings.

"Sometime he punishes us wrongly; when the opposition raises a question to the state executive committee member at the assembly sittings, the replies are not relevant but the speaker simply says 'sit down'," he complained.

He also griped during a dialogue session at the Penang assembly yesterday that backbenchers (from the ruling party) take advantage of the standing orders to prevent them from speaking. Arif said such a situation only happened

after March 2008, unlike the times when the Barisan Nasional was ruling the state.

Seorang pemimpin Umno mendakwa bahawa speaker Dewan Undangan Negeri (DUN) yang diperintah oleh Pakatan Rakyat bersikap berat sebelah terhadap wakil rakyat pembangkang.

ADUN Seberang Jaya Datuk Arif Shah berkata layanan tidak adil itu telah menimbulkan rasa "tidak puashati" di kalangan wakil rakyat pembangkang. Menurutnya, apabila speaker bersikap tidak adil, maka wakil rakyat tidak dapat membantah kerana speaker mempunyai kuasa "mutlak" di dewan.

"Kadang-kadang beliau menghukum kita secara salah; apabila pihak pembangkang mengajukan pertanyaan kepada exco negeri di sidang DUN, jawapannya tidak relevan tetapi speaker hanya kata 'duduk'," tambahnya.

Tapi bila ahli2 BN mengambil tindakan untuk mengheret keluar macam anjing Speaker PR yang sah dan melantik seorang speaker(grafik diatas) haram serta MB lantikan mahkamah Adun2 BN kita buat diam saja.....

Bukan Melayu tergugat, tapi UMNO takut ianya pupus....

Kebimbangan Umno kononnya hak dan keistimewaan orang Melayu semakin terhakis di bawah kuasa Pakatan Rakyat adalah tidak berasas sama sekali sebaliknya sengaja diada-adakan untuk menakut-nakutkan rakyat agar tidak menyokong pakatan itu. Sedangkan PAS dalam Pakatan Rakyat konsisten untuk mempertahankan hak dan keistimewaan orang Melayu seperti yang terkandung dalam Perlembagaan Persekutuan.

Exco Dewan Pemuda PAS Pusat, Abdullah Karim berkata, golongan muda tidak harus terpengaruh dengan ketakutan yang ditimbulkan itu kerana perlembagaan bukanlah perkara yang boleh dipinda dengan sewenang-wenangnya. "Secara realitinya, walaupun perlembagaan itu merupakan dokumen yang boleh dipinda tetapi kita semua tahu tidak cukup untuk dipinda kalau sekadar mendapat dua pertiga.

“Prosesnya cukup ketat, kena dapatkan kebenaran dari Majlis Raja-Raja sebagai contoh. Jadi apa yang nak dibimbangkan? “Saya pernah sebut dalam PAS, kalau katakan DAP menang majoriti dalam Dewan Rakyat, mereka pun tak mampu buat kalau mereka kata nak pinda perlembagaan berkaitan perkara ini,” kata beliau dalam forum Ketuanan Melayu: Umno Rasis atau PR Retorik di Dewan Perhimpunan Cina Kuala Lumpur-Selangor, dekat sini malam tadi.

Beliau berkata, Ketuanan Melayu kembali dicanangkan Umno selepas pilihan raya umum 2008 yang menyaksikan kemerosotan sokongan rakyat terhadap Umno BN. Kenapa bising-bising (mengenai ketuanan Melayu) sekarang ini? Timbul hak Melayu makin terhakis, Raja Melayu semakin dipinggirkan? “Sebabnya senang sahaja. Bukan sebab hak orang Melayu digugat tapi yang menjadi masalah besar ialah hilangnya ketuanan Umno,” katanya.

Menurutnya, tanpa melaungkan Ketuanan Melayu, PAS konsisten menjaga perkara yang termaktub dalam perlembagaan ini malah menjadikan perkara tersebut sebagai agenda dalam Pakatan Rakyat. “Sikap PAS sejak puluhan tahun dulu sehingga sekarang, kita konsisten mempertahankan keistimewaan orang Melayu yang wujud dalam perlembagaan.

“Sebab itu PAS sanggup bersama dalam Pakatan Rakyat, kita tidak kompromi soal tersebut dan perjanjian dibuat bersama Pakatan Rakyat sebelum konvensyen pertama Pakatan Rakyat pada 2009,” katanya.

Sehubungan itu, golongan muda tegasnya tidak perlu terpengaruh dengan Ketuanan Melayu yang menjadi agenda politik sempit Umno. “Momokan ini bagi orang muda yang semakin celik maklumat, kita akan faham bahawa segala kekalutan yang timbul ini semata-mata bersifat politik,” katanya.

Sementara itu, Pengarah Strategi PKR, Rafizi Ramli berkata, Ketuanan Melayu hanya mementingkan kuasa politik dominan Melayu tanpa menyedari bahawa kekuatan Melayu yang sebenar ialah jati diri. “Kuasa politik dominan orang Melayu dikatakan perlu untuk kononnya menjamin kedudukan orang Melayu. “Kalau tak ada kuasa politik, hak dan kedudukan orang Melayu akan terjejas. Sebab itu Mac 2008 merupakan titik tolak yang sangat besar kerana dilihat berlaku hakisan dominan politik,” katanya.

Tambahnya, Melayu terus dilemahkan dengan kononnya terus memerlukan ‘tongkat’ dari kerajaan untuk maju dalam ekonomi selain diajar untuk mengambil hak bangsa lain jika ingin maju dalam ekonomi. “Teras yang terus dipasakkan dalam pemikiran Melayu ialah orang Melayu terus perlukan tongkat untuk maju dalam ekonomi kerana tanpa bantuan berterusan dari kerajaan Melayu akan tenggelam. “Untuk orang Melayu mendapat kedudukan dalam bidang ekonomi, kita perlu ambil bahagian orang lain. Itu yang menjadi teras Ketuanan Melayu yang perlu diteliti kembali,” katanya.

Ujarnya, perbincangan mengenai Melayu seringkali disensitifkan tanpa merujuk sejarah secara keseluruhan menyebabkan timbulnya sifat tidak senang Melayu terhadap kaum lain. “Perbahasan tentang Melayu ini terlalu emosi dan diherotkan perbincangannya. Contohnya bila kita bercakap tentang ekonomi, kita tidak adil apabila menidakkan peranan kaum lain dalam membina ekonomi negara. “Kalau baca sejarah negeri Johor, berapa ramai yang tahu bahawa dalam tahun 1850-an dan 1860-an lebih ramai orang Cina daripada orang Melayu di sana.

“Kita kena baca sejarah secara keseluruhan, jangan tinggalkan idea tokoh pimpinan dahulu yang banyak beri kesan kepada negara. mereka bukan Umno, bukan Perkasa tapi orang seperti Zaaba, mereka bawa kesedaran kepada rakyat bahawa orang Melayu tertekan dan dimangsakan golongan elit pemerintah dari dulu lagi,” katanya.

Turut menjadi panel pada forum yang dihadiri majoriti golongan muda itu ialah Naib Presiden Perkasa, Dr. Asyraf Wajdi dan blogger Umno Reform, Anuar Mohd Nor.

3 male DNA samples found...

The presence of three male DNA samples including that of victim Mohd Saiful Bukhari Azlan in the peri-anal area (the border of the anal region) as reported by the chemist in her report, created a buzz among Anwar Ibrahim's supporters in court. Earlier, chemist Dr Seah Lay Hong, who is the head of the Serious Crime Unit of the Chemistry Department, testified that two semen stains each were found on Saiful's trousers and also grey underwear.

Tests on the stains found Saiful's DNA on the two stains on Saiful's trousers, while on the underwear, a stain contains Saiful's DNA while the other contains the alleged victim's DNA and another unknown male contributor, dubbed “Male Y”. While the DNA of “Male Y” was found on all four cotton buds retrieved from Saiful's anus, it was one of them which possessed DNA from another unidentified male which is raising eyebrows. The cotton bud in question is B5 which was retrieved by the Hospital Kuala Lumpur doctors from Saiful's peri-anal area.

Seah, in replying to questions from DPP Noorin Badaruddin in the afternoon, said the DNA profile derived from B5 consisted of a mixture of male-origin DNA profiles. “It is concordant with the profile of blood stain specimen B10 (Saiful's blood sample), the Male Y and one other male contributor,” she said.

Explaining her findings on Appendix 1 under the Summary of STR results, Seah, who has been with the Chemistry Department since 1991, said B5 is a non-sperm extract. She said it contains readings of Saiful's DNA string, Male Y DNA string and that of another unidentified male. All these tests, she said, are done through an electropherogram (DNA sequencing) machine.

When asked by DPP Noorin as to how it was possible to have three DNA samples, Seah said this could have been as a result of 'touch DNA' whereby Saiful may have sat on a toilet seat. “This could be possible... it may require a 'touch' for someone's DNA to be transferred. However, I agree I am no expert in this.” Seah also said she could not answer as to how long such a seminal stain can last in one's rectum, as she was not a medical expert.

Dominant 'Male Y'

Seah also testified that her findings and DNA analysis from the sample taken from the cotton bud revealed that Male Y is the dominant. “The sperm extract conducted on B7 (high rectal swab) showed the dominance of Male Y. Similar findings were made on the second semen stain found on Saiful's grey underwear,” she said. Seah also testified that no DNA profiles were retrieved from swabs B, B1, B2, B3, B4 and B6.

The chemist has yet to testify on two other swabs namely B8 and B9, where DNA analysis was also performed after finding traces of semen. B8 was retrieved from the higher rectal area while B9 is from the lower rectal area. What the prosecution is trying to prove today is that the presence of the Male Y DNA inside the rectum is proof of sodomy.

Earlier in the trial, the HKL doctors testified that a seminal stain can stay in the rectal area for 72 hours. They had also testified that following traces of semen stains in the anus from the Chemist's Report, they adduced that penetration and sodomy had taken place. The hearing was put off earlier when it was discovered that the DNA charts which were provided to the defence before the trial were not ample. This was clarified with Anwar's specialist, Dr Brian McDonald, who was also present to assist the defence team.

1. Sehelai seluar dalam kepunyaan Mohd Saiful. Seluar dalam tanpa jenama itu sebelum ini didakwa saksi terdapat kesan air mani Saiful.
2.Sehelai permaidani berwarna warni juga turut dijadikan sebagai ‘saksi’ pendakwaan, yang dikatakan disita dari Jabatan Kimia.
3.Kain cadar berwarna kelabu turut ditanda sebagai bahan bukti.
4.Sepasang seluar hitam tanpa jenama.
5.Kemeja biru dan kolar putih berjenama Ralph Lauren.
6.Baju hijau jenama G2000 kepunyaan Saiful.
7.Helaian bulu kemaluan.

Peguam, Sankara Nair bagaimanapun membantah cadangan pihak pendakwaan ia adalah bulu kemaluan dan menyoal bagaimana Dr Seah tahu perkara tersebut? Sankara Nair mempersoalkan mengapa ia tidak disebut sebagai ‘rambut sahaja’ kerana ia kelihatan seperti helaian rambut. Hakim Zainal Abidin Mohd Diah berkata Sankara boleh menyoal balas Dr Seah kemudian.

TG.Nik Aziz - Moga Mahathir mendapat hidayah Allah SWT....

Mursyidul Am PAS, Tuan Guru Datuk Nik Abdul Aziz Nik Mat berharap bekas Perdana Menteri, Tun Dr Mahathir Mohamad mendapat hidayah Allah SWT.

“Saya tidak berhasrat setakat ini untuk mengulas jawapan Tun Mahathir terhadap saya seperti yang tersiar di muka hadapan akhbar Utusan pada hari ini,” tulis beliau yang juga Menteri Besar Kelantan di laman Twitter.

Akhbar Utusan Malaysia hari ini melaporkan Mahathir berkata, tujuan hidup Mursyidul Am PAS itu hanyalah untuk memenangi pilihan raya dan kemudian menjadi pemerintah bersama DAP serta Parti Keadilan Rakyat (PKR). Katanya, Nik Abdul Aziz secara terbuka sanggup mengkafirkan orang Islam Umno, dalam masa sama bersedia bekerjasama dengan syaitan menjayakan perjuangannya.

Beliau berkata, Menteri Besar Kelantan itu juga sanggup bekerjasama dengan pihak yang menolak perjuangannya untuk mendirikan negara Islam ala PAS di samping mempertahankan pendapat tokoh bukan Islam supaya umat Islam melonggarkan pegangan mereka terhadap ajaran Islam.

‘‘Harapan Nik Aziz ialah dengan melakukan semua ini orang bukan Islam di Malaysia akan sokong partinya di dalam pilihan raya. Bukan Islam yang diutamakan, bukan mengabdikan diri kepada Allah tetapi kemenangan dalam pilihan raya.

‘‘Orang Umno beragama Islam. Walaupun bagi Nik Abdul Aziz mereka bukan Islam kerana tidak sokong PAS namun dunia mengiktiraf bahawa orang Melayu termasuk ahli Umno dan ahli PAS juga adalah orang Islam,’’ ujarnya lagi. Karpal - 'Attempted sodomy' and 'attempted oral sex'....

Lead defence counsel Karpal Singh managed to put a major dent into the prosecution's case in Anwar Ibrahim's sodomy trial in the Kuala Lumpur High Court. The veteran lawyer pointed out this morning that the pro forma form filled by a Hospital Kuala Lumpur doctor has the words 'attempted sodomy' and 'attempted oral sex'.

The form was filled by doctors - mainly forensic pathologist Dr Siew Shueu Feng - who had interviewed and examined complainant Mohd Saiful Bukhari Azlan on June 28, 2008.

Former HKL Accident and Emergency Unit head Dr Khairul Nizam Hassan told the court that Saiful had told the medical team that he had been sodomised and forced to perform oral sex. "He (Saiful) did not mention 'attempted' but 'sodomy' and 'oral sex'," he said.

When shown the pro forma form, however, Khairul Nizam agreed the form states 'attempted sodomy' and 'attempted oral sex'. Despite this, he maintained that the medical examination was conducted to check for sodomy and oral sex.

Karpal pursued the matter, asking Khairul Nizam many times if the pro forma form was based on interviewing Saiful. The witness agreed, but stressed that the form is just as a guideline.

"How can you say it is sodomy or oral sex when the report states 'attempted'?" asked Karpal. He persisted with this line of questioning until Solicitor-General II Mohd Yusof Zainal Abiden - who is leading the prosecution team - objected to the repetition of the questions.

Karpal also pointed out that vital information which should have been indicated in the pro forma form had not been filled by the doctors. The 'vital information' included the circumstances that led to the alleged incident; on the complainant's medical history; and on past rectal examination as to whether or not the victim had defecated.- Hafiz Yatim.

John R. Malott Responds: This is why I can sue the NST, Utusan Malaysia for Libel – and some other people, too...

Minister in the Prime Minister’s Department Dato Seri Mohd Nazri Abdul Aziz will be proposing that the Cabinet bans former US Ambassador to Malaysia John R. Malott from entering the Malaysia.This follows Malott’s scathing criticism of the Najib Administration’s handling of race relations in an article published by the Wall Street Journal last week.

According to a report published by Sin Chew Daily today, Nazri had described Malott’s article as “lies and defamation”.

“Mallot defamed our government through foreign newspaper. How would he know the real situation if he did not reside in Malaysia? We know he is a staunch supported of PKR de facto leader Anwar Ibrahim,” said Nazri

I don’t really know who Rachel Motte is, or why she suddenly has become an expert on Malaysia in the past year. But I do know that she wrote an article about me recently, saying that I am “a pet” of Anwar Ibrahim, who – according to her – has “direct connections to terrorist organizations” and a long history of being an anti-Semite.

I also know that – to her credit – when I contacted Rachel on February 12 and told her that I believed that her article was inaccurate and potentially libelous, she immediately took it down for review. It no longer is on her website, and I thank her for that.

But I also know that Utusan Malaysia has reported her article verbatim – and even went to the trouble of translating it into Malay. And thanks to Dato Din Merican, now I know that the NST has chosen to print it as well.

Motte’s Article: Why Libelous

Here are the problems with the article, and why I believe that I would be well within my rights to sue the NST, Utusan Malaysia, and others for libel. As someone who has been in public life for over 40 years, I know very well that anything I do, say, or write is open to examination. So that is why I am always very careful to have documentation for everything I say. We can disagree on the analysis, but not on the facts.

Motte’s Article: Anwar’s “Pet”? I am Nobody’s Pet

When I took a look at Rachel’s article, I had two major areas of concern. First, Rachel characterized my relationship with Anwar as being his “pet.” This is offensive to me, as I served my nation for over 30 years as an Ambassador, Deputy Assistant Secretary of State, and Consul General under seven Presidents. It would be like me calling Dato Johan Jaffar the lapdog of UMNO. I am Nobody’s pet.

Second, there were many statements that to my mind are libelous:

(a) that I am defending “a man with direct ties to terrorist organizations, and a man whose anti-Semitic comments and conspiracy theories are too long to discuss;”

(b) that “rational thinking men and women are able to discern the difference between good and bad individuals, people you should support, versus those you should distance yourself from,” implying that I am not a rational thinking person; and

(c) that I am “blinded by [my] support of an anti-Semite with clear and undeniable ties to an organization that supports terrorism.”

As a former Ambassador to Malaysia, I had access to intelligence reports, and I can say categorically that Anwar does not have ties to any terrorist organizations. Furthermore, Anwar continues to be a friend of former Vice President Al Gore, former Secretary of Defense William “Bill” Cohen, and former Deputy Secretary of Defense Paul Wolfowitz.

None of these gentlemen would continue their relationship with Anwar if he had ties to terrorists. Furthermore, Anwar would not be admitted to the US if he had such a connection (and he was here last week). Furthermore, Paul Wolfowitz (who is Jewish) would not be Anwar’s friend if Anwar were anti-Semitic.

In a libel case, the burden of proof will be on NST and the others to prove that Anwar has terrorist ties and that he has a long history of anti-Semitic comments. By publishing Rachel’s article, after she removed it from her website, the NST has asserted something that it cannot prove. It has claimed that I am defending a terrorist and an anti-Semite.

These former senior USG officials would support and defend me, based on their knowledge and access to official USG records. The only “evidence” that Rachel and the NST will have will be blog postings that have circulated over the past few years, as part of a campaign to smear Anwar and discredit his reputation and standing in the United States.

For example, the efforts of Jack Abramoff and others to smear Anwar – a multi-million campaign funded by the Malaysian Government — were well-documented in US Senate hearings conducted by Senator John McCain. We also know, according to The Washington Post newspaper, that APCO was engaged in a similar effort last year, paid for by the Malaysian Government, according to APCO’s official filings.

Rachel says that Anwar’s connections to terrorist organizations are because he was a founder of the International Institute of Islamic Thought (IIIT), which is based in Virginia. Like many other Islamic/Muslim groups, the IIIT was raided by the FBI after 9/11 and was investigated thoroughly. The US Government never filed any charges against IIIT. The US Government has never listed it as a terrorist organization, and the US Government has never closed it down. Yet the charges of an IIIT connection to the Muslim Brotherhood continue to circulate, without evidence, on various right-wing blogs. What do these bloggers know that the US Government does not? Does the NST take the word of unknown bloggers over the US Government? What evidence can the NST present in court in a libel case?

Anwar’s so-called long record of anti-Semitism!

Rachel’s other claim was what she called Anwar’s long record of anti-Semitism. She said that I am supporting an anti-Semite. The reality is, there is no long list of anti-Semitic comments by Anwar Ibrahim. Indeed, throughout his political career, Anwar often has been accused of being close to Jews. The first is that when Anwar was kicked out of the Cabinet in 1998, Mahathir – who had accused George Soros and the Jews of causing the 1997 Asian financial crisis – briefed the Cabinet on Anwar’s Jewish connections, pointing out that his friends were people like Robert (Bob) Rubin, Bill Cohen, James (Jim) Wolfensohn, Paul Wolfowitz, and so on. All American Jews. The second Buruma story is Mahathir’s famous comment that Anwar would make a “good Prime Minister of Israel.”

Rachel wrote an article, “The Reversal of Anwar Ibrahim,” claiming that Anwar had become an anti-Semite, in the New Ledger blog on April 29, 2010. But two months later Deputy Prime Minister Muhyiddin Yassin undercut her thesis and his own Government’s efforts to portray Anwar as anti-Semitic when he said on July 1, “We know for a fact his ties with pro-Zionist groups.” - http://www.bernama.com/bernama/v5/newsindex.php?id=510092

According to The Washington Post, the Malaysian Embassy and APCO worked hard last year to publicize Anwar’s comments on “Zionist aggression,” after the May 31 Israeli action against the relief ship Mavi Marmara. But for reasons that are very understandable, the Malaysian Government did not want to call attention to Najib’s own remarks, which were even stronger, accusing the Israelis of terrorism. Najib also said that, “The Israeli commandos shot the activists point blank and even from the back, and this is an act of a coward which cannot be forgiven. Anwar’s comments last year caused a lot of problems, but to say that he has a long history of anti-Semitism, and that I therefore am linked to an anti-Semite, is wrong. I know that the NST has been running op-eds attacking me everyday. But they need to be careful about crossing the line into libel.–John R. Malott

Aku tak mau komen apa cukuplah sekadar aku petik sebahagian pandangan Dato' Mohd.Ariff Sabri bin Hj. Abdul Aziz aka Sakmongkol AK47....

"Kepada saya itu petanda bahawa apa yang Malott katakan bukanlah definitive. Maka kalau ianya bukan definitive, apa pasal kita hilang akal sebentar dan mahu kenakan travel ban?

Sepatutnya, kita jemput Malott datang untuk memberi pandangan nya. Dan jika Nazri terror, dia boleh berdebat dengan Malott. Kita akan sokong kalau dia menunjukkan kejantanan nya dalam gelanggang.

Kalau menteri UMNO bersikap tongong macam ini, susah lah kita hendak mempertahankan kredibiliti kepimpinan UMNO. Ada orang kata, kita tak perlu layan Malott sebab dia bukan taraf itu dan ini. Adakah ini bermaksud, hanya bila kita ada taraf dan kedudukan, maka kita ada hak untuk beri komen? Kalau macam saya ADUN pencen, di kira takde taraf, tak boleh beri pandangan keatas buah fikiran bangang pak menteri , ADUN atau MP?

Ada menteri kata pandangan Malott ketinggalan zaman. Kalau ketinggalan zaman, ekau tunjukkan di mano jang. Jika main beri kenyataan yang umum, tidak lah ekau terer eh jang. Kalau kita nak ban orang sebab dia beri pandangan yang tidak menyenangkan kita, ini nama nya macam ke budak budakan.

Yang paling saya meluat ialah kita memperkecilkan pandangan Malott sebab dia di katakan berkawan dengan Anwar Ibrahim. Siapa dia nak berkawan sepatutnya tidak mendatangkan masaalah kepada kita. Anwar Ibrahim ini dahulu kan Timbalan Perdana Menteri kita dan TImbalan presiden UMNO. Suatu ketika , semua mereka yang sekarang ini dok hentam Anwar cium tangan Pak Sheikh. Kita harus membezakan antara penyakit peribadi dan ingatan tulus ikhlas."
