Keputusan Speaker DUN Perak boleh dicabar kenapa tidak keputusan Speaker Dewan Rakyat....

Keputusan Mahkamah Persekutuan bahawa mahkamah boleh mengenepikan keputusan Speaker Dun Perak kini bakal makan tuan apabila Pakatan Rakyat mahu mencabar keputusan Speaker Dewan Rakyat.

Oleh itu, pandangan Menteri di Jabatan Perdana Menteri, Datuk Seri Nazri Aziz bahawa keputusan Speaker Dewan Rakyat tidak boleh dicabar oleh mahkamah telah tertolak dengan keputusan Mahkamah Persekutuan itu. Demikian kata peguam Mohamed Hanipa Maidin, Pengerusi Lajnah Undang-undang PAS dalam satu kenyataannya kepada Harakahdaily.

Sebelum ini, Mohd Nazri melabelkan ahli parlimen Pakatan Rakyat sebagai 'bodoh dan gila' kerana mengugut untuk mengheret speaker Dewan Rakyat, Tan Sri Pandikar Amin Mulia ke mahkamah.

Mengulas kenyataan ahli parlimen Bukit Gelugor, Karpal Singh - Nazri, menteri yang bertanggungjawab ke atas hal ehwal parlimen berkata mahkamah tidak boleh mencampuri urusan atau prosiding Dewan Rakyat.

“Ini kerja gila dan saya percaya ia akan ditolak oleh mahkamah kerana parlimen ada supremasinya,” katanya di lobi parlimen hari ini.

Menurut Nazri, telah ada penghakiman yang dengan jelas menyatakan bahawa mahkamah tidak mempunyai jurisdiksi atau bidang kuasa ke atas Parlimen.


Karpal yang merupakan seorang peguam sebelum ini berkata tindakan akan diambil ke atas Speaker Dewan Rakyat, Datuk Pandikar Amin Haji Mulia kerana menyalah-gunakan kuasa meluluskan usul menggantung Ketua Pembangkang, Datuk Seri Anwar Ibrahim dan tiga ahli parlimen yang lain, termasuk dirinya selama enam bulan.

Bagi Hanipa, Umno telah terbelit dengan tindakannya sendiri apabila seolah-olah membenarkan tindakan Mahkamah Persekutuan campur tangan dalam kes keputusan Speaker Dun Perak V Sivakumar apabila beliau menggantung Zambry Abdul Kadir dan enam Exco haramnya.

"Adakah Nazri tidak sedar dalam kes Perak, Umno telah menyalahgunakan mahkamah untuk cabar keputusan V Sivakumar, Speaker Dun Perak. "Bukankah Mahkamah Persekutuan telah memutuskan keputusan Sivakumar sebagai Speaker boleh dicabar. Sekarang kes Perak ini dah makan tuan," kata Hanipa dalam kenyataannya.

Ini kerana, kedudukan Speaker Dun dan Speaker Dewan Rakyat tidak ada bezanya dalam konteks sistem dewan perwakilan di Malaysia. Jika keputusan Speaker Dun boleh dicabar, maka keputusan Speaker Dewan Rakyat juga boleh dicabar.

Karpal Singh said today Pakatan Rakyat will take Dewan Rakyat speaker Pandikar Amin Mulia to court over the suspension of four opposition MPs from Parliament. Saying that the coalition will file its suit “as soon as possible”, he also rubbished Minister in the Prime Minister's Department and de facto law minister Mohamed Nazri Abdul Aziz's remarks that decisions of the Dewan Rakyat cannot be challenged in court.

“But in the case of (Puchong MP) Gobind Singh Deo, we took the speaker to court and we won,” said Karpal, referring to Gobind's six-month suspension without pay, where the court ruled that the withholding of an MP's salary was unconstitutional.

“The (Perak constitutional crisis) showed that even the state assembly proceedings can be questioned. “Action against the speaker will be filed soon and I am surprised that Nazri said it cannot be challenged when there is already a precedence,” he added as the Pakatan MPs present broke out in laughter.

“This matter will go to court and we are serious about it,” he said at a press conference called by Pakatan at the PKR headquarters in Petaling Jaya this morning.

Sulaiman mempertahankan kerusi Dewan Undangan Negeri (DUN) Tenang pada pilihan raya umum 2008 dengan menewaskan calon PAS Mohd Saim Siran, majoriti 2,492 undi.

DUN Tenang berada dalam Parlimen Labis, yang menjadi kubu kuat Presiden MCA Datuk Dr Chua Soi Lek dan kini disandang oleh anaknya Chua Tee Yong. Satu lagi DUN yang berada dalam Parlimen Labis adalah Bekok yang turut dimenangi Barisan Nasional.

Tenang dilihat sebagai kubu kuat Umno dan pada pilihan raya umum 2008, Sulaiman mengalahkan lawannya, Mohd Saim Siran dari PAS dengan kelebihan 2,492 undi.

Menurut perangkaan Suruhanjaya Pilihan Raya 2008, Tenang mempunyai 49.66 peratus pengundi Melayu, manakala Cina 38.13 peratus, India 12.11 peratus dan bangsa-bangsa lain 0.10 peratus.

Nazri calls Karpal and gang 'stupid', 'crazy' and 'cow dung head'....

Minister in Prime Minister's Department Mohd Nazri Abdul Aziz has described Pakatan Rakyat MPs as “stupid” and “crazy” for threatening to sue Dewan Rakyat speaker Pandikar Amin Mulia.

Commenting on legal threats by Bukit Gelugor MP Karpal Singh, Nazri, who is both de facto law minister and minister in charge of parliamentary affairs, said that the courts cannot interfere with Dewan Rakyat proceedings.

“This is a crazy thing to do and I believe that it will be rejected by the courts due to parliamentary supremacy,” he told reporters at the Parliament lobby today.

Nazri that there had already been judgments which clearly states that the judiciary has no jurisdiction over Parliament.

“There is the sovereignty of Parliament and supremacy of Parliament. They have got cow dung in their heads. “I assure you that if they take it to court it will be kicked out. What law did Karpal (Singh) read? He is a third-class lawyer,” said Nazri with a laugh.

Karpal had warned that legal action would be taken against Pandikar for abusing his powers in relations to the passing of a motion to suspend Opposition Leader Anwar Ibrahim and three others for six months.

Karpal Singh said, “We don’t accept the motion. That’s the reason why we walked out. We may take it to court. There is precedence in the case of Gobind Singh where we took the Speaker, Pandikar Amin, to court.

“The court has ruled that in certain circumstances, especially when the rule of natural justice is not complied, then the court has the jurisdiction. We will take it to court. The action of the Speaker is so blatant that it cannot in anyway be defended. We want a judicial ruling on that so we can’t let him get away with this. We don’t want this to become a precedence in future,”

Courts cannot interfere with Dewan Rakyat proceedings. But it can interfere in Perak State assembly proceeding.

The proceeding in Perak went through the court simply because BN wanted it so that BN remain in power and the courts granted BN's wishes.

Now Nazri is telling that the case will be thrown away. So another dictated BN's decision in the making. Another ketuanan UMNO show off.

The rakyat know the constitution is clear but then it was made unclear by BN's actions in Perak. Why the double standards.....

Anwar berpeluang kempen 6 bulan lebih awal....

Parlimen pagi ini menggantung Ketua Pembangkang Datuk Seri Anwar Ibrahim selama enam bulan tanpa membahaskan sama sekali laporan Jawatankuasa Hak dan Kebebasan yang dibentangkan kelmarin. Ahli Parlimen Permatang Pauh itu digantung ekoran dakwaan beliau mengenai isu berkaitan APCO Worldwide dan gagasan 1 Malaysia.

Tiada perbahasan diadakan berhubung usul menggantung Anwar selepas Speaker Tan Sri Pandikar Amin mendakwa pembangkang bertindak tidak sopan, menunjukkan mereka tiada berhasrat untuk membahaskan usul tersebut. “Saya tidak melihat adanya hasrat di pihak pembangkang untuk membahaskan perkara ini. Jadi, kita akan meneruskan dan akan mengundi perkara ini tanpa dibahaskan,” kata Pandikar walaupun ada kedengaran rasa tidak puas hati di kalangan ahli-ahli Barisan Nasional.

Ahli-ahli Parlimen Pakatan Rakyat dari awal lagi telah berusaha untuk melengah-lengahkan penggantungan Anwar dengan cuba mencela dan mempertikaikan Pandikar dari semasa ke semasa. Mereka juga kelihatan membawa pelekat-pelekat yang membawa mesej “mahkamah kanggaru” ke dalam Dewan Rakyat. Kesemua wakil rakyat Pakatan Rakyat bertindak keluar Dewan Rakyat selepas usul menggantung Anwar diluluskan.

Dewan sedang membahaskan usul hukuman menggantung enam bulan ke atas Azmin Ali, Karpal Singh dan Sivarasa Rasiah. Ketika itu tidak ada anggota Pakatan Rakyat dalam Dewan Rakyat.

Dewan Rakyat semalam dibentangkan dengan usul yang mencadangkan supaya tiga anggota Parlimen pembangkang itu digantung enam bulan kerana menghina dewan. Usul dibawa Menteri di Jabatan Perdana Menteri Datuk Seri Nazri Aziz mencadangkan supaya Karpal (DAP-Bukit Gelugor), Sivarasa (PKR-Subang) dan Azmin (PKR-Gombak) digantung enam bulan daripada menghadiri sidang dewan kerana menghina majlis berkenaan.



Datuk Seri Anwar Ibrahim was suspended today for six months from Parliament amid loud protests and a walkout by Pakatan Rakyat (PR) MPs calling the Dewan Rakyat a kangaroo court. The opposition leader received the boot for claiming earlier this year that Datuk Seri Najib Razak’s public relations consultants APCO Worldwide had been behind both the 1 Malaysia and One Israel concepts.

There was no debate on the motion to suspend Anwar as Speaker Tan Sri Pandikar Amin Mulia claimed that the opposition’s rowdy behaviour showed that they had no intention to debate the matter. “I see no intention on the opposition’s part to debate the matter. So we will go ahead and vote on this without debate,” said Pandikar over shouts of agreement from Barisan Nasional MPs.

PR lawmakers had tried their best to delay the voting on Anwar’s suspension by interjecting and disturbing Pandikar every few minutes. The MPs had brought placards calling the Dewan Rakyat a “kangaroo court”. All PR lawmakers walked out after the motion to suspend Anwar was passed.

The Dewan Rakyat is currently debating the motion on suspending Azmin Ali, Karpal Singh and Sivarasa Rasiah. There are no PR lawmakers inside the hall as of right now as only BN MPs are debating the motion.

'Altantuya' and 'murder'scares BN leaders...

Over the weekend, a series of cables, obtained by WikiLeaks and published in Australia’s ‘The Sun-Herald’, disclosed discussions between senior US officials and their Singapore counterparts Peter Ho, Bilahari Kausikan and Tommy Koh. All three Singaporeans gave damning assessments of Malaysia in the period 2008 and 2009.

Prime Minister Najib Abdul Razak avoided the press on Sunday, when the Wikileaks revelations first appeared in the Malaysia online news portals. A day later, Najib issued his first public statement about the disclosures and told Malaysians to ‘ignore contemptuous regional neighbours and focus on achieving the country’s goals instead’. “We can show to our neighbours, that although sometimes they make disparaging remarks about us, that Malaysians can actually achieve. The greatest achievement is when we can be a developed nation by 2020.” said Najib in a speech at the 1 MCA Medical Foundation fund-raising dinner.

Surprisingly, none in Najib’s administration have come to the defence, either of Najib's leadership or of Malaysia. Could it be because there is a 'blanket-ban' on the words Altantuya and murder? In the end, it was left to the ‘lone ranger’ Ibrahim Ali who claimed that the Wikileaks expose revealed the island republic’s “jealous” nature.

The Perkasa president believed that the island state had long held a “grudge” against Malaysia, and that the disparaging comments of its senior government officials betrayed its “true colours.” “I am convinced that they (Singapore) are really jealous of Malaysia as they are not happy with Malaysia on many things. I am not surprised with the WikiLeaks report about Singapore... they are the ones that actually practice ‘politik sempit’ (narrow-minded politics),” said Ibrahim.

The Singaporeans officials had reportedly said “Malaysia’s decline” was fuelled by incompetent politicians. Other less than complimentary descriptions about Malaysia’s prime ministers, past and present, were also made. One of them called Najib “an opportunist” and referred to his alleged involvement in the Altantuya murder. Ibrahim also alleged that Singapore had vested interests in wanting to cause discord in Malaysia.

“I think they have their own agenda, and they also have political allies in Malaysia. The DAP was once part of Singapore’s PAP (People’s Action Party). They just want to mess around with Malaysia because they are not satisfied with Malaysia’s achievements,” said the Pasir Mas MP.

The Singaporean officials’ remarks have already strained ties between the two countries. Najib may have shown great restraint at the accusations hurled at him and his administration, but is that enough? What happened to the show of support from his cabinet or fellow politicians to condemn the Singaporeans for calling Malaysia and its leaders, names?

Regardless of whether the accusations were true or not, although many believe them, the Malaysian politicians should at least show that they are not meek. Couldn’t they have at least come to the defence of their country, if not their leader(s)? Many of us would hate to admit it; at least Ibrahim Ali did admonish Singapore, even though they were all for the wrong reasons.-Mariam Mokhtar

Anwar - Saya lawan bila dituduh;Najib bila dituduh,kata 'perkara kecil aje"...

Datuk Seri Najib Razak cuba mempertahankan kerajaan BN yang dipimpinnya daripada tumbang kerana bimbang didakwa di mahkamah, terutamanya berhubung dakwaan skandal pembabitan pembunuhan perempuan Mongolia, Altantuya Shaaribuu seperti yang didedahkan dalam laman WikiLeaks, kata Ketua Umum PKR Datuk Seri Anwar Ibrahim.

Sehubungan itu, Anwar yang juga Ketua Pembangkang mempersoalkan media arus perdana yang sengaja "memadam" menyiarkan dakwaan skandal berkenaan seperti yang didedahkan oleh WikiLeaks.

"Sebab apa Najib mahu mempertahankan Putrajaya (kerana) takut didakwa (di mahkamah) kemudian hari... Mengapa media padam perkara (dakwaan) ini (daripada disiarkan)," katanya ketika menyampaikan ceramah di tapak pasar malam Taman Melati di Wangsa Maju malam semalam.

"Saya akan mempertahankan diri saya dan integriti saya. Saya mahu tanya Najib, adakah awak boleh mencabar Singapura agar membuktikan dakwaan itu. Itu sebabnya media Umno tidak berani melaporkan perkara itu. "Apabila saya dituduh, saya akan melawan, tetapi apabila Najib dituduh apa beliau kata? Ini hanya perkara kecil," kata Anwar.

Dalam ceramah itu, Anwar membaca petikan laporan pendedahan dalam WikiLeaks yang mendakwa masa depan Najib dihantui dengan skandal pembunuhan Altantuya. Berikutan laporan dalam laman web berkenaan, Anwar juga mencabar Najib mengemukakan bukti berhubung dakwaan tersebut.

“Adakah kamu fikir saya ini bodoh untuk memasuki perangkap apabila tahu ia perangkap? Jangan cabar saya terlalu berlebihan! Saya akan dedahkan kes pembunuhan yang telah dilakukan dan cuba ditutup rapat.”

Dalam ceramahnya juga, Anwar turut menyelar bekas perdana menteri Singapura Lee Kuan Yew seperti yang didedahkan oleh WikiLeaks bahawa pegawai perisikan Singapura dan Australia percaya beliau memang terlibat dengan perilaku dalam tuduhan liwat yang sedang dihadapinya. Anwar yang juga ahli parlimen Permatang Pauh - dalam ucapannya selama kira-kira 40 minit itu - menyifatkan perkara berkenaan sebagai "fitnah" dan mencabar pemimpin kanan itu mengemukakan bukti berhubung dakwaannya itu.

"Ada bukti? Saya minta peguam saya menjawab. Ada bukti?... Lee Kuan Yew (boleh) bawa ke mahkamah (dan) jadi saksi kepada Najib di mahkamah," katanya.

Menurut akhbar Australia, The Sun-Herald, kabel Jabatan Negara Amerika yang bocor mendedahkan bahawa pegawai perisikan Singapura dan menteri kanan Lee Kuan Yew telah memberitahu pejabat Agensi Perisikan Australia bagi Penilaian Nasional (ONA), bahawa "ketua pembangkang Anwar 'memang melakukan dakwaan perilaku yang sedang dihadapinya'." “Wikileaks, apa bukti kamu, bawa Lee Kuan Yew ke mahkamah. Saya tidak peduli, kamu fikir saya buat atau tidak. Itu bukan urusan saya. Kamu ada rakaman video atau catatan doktor, bawa ke mahkamah.

"Ia fitnah kepada saya dan saya akan mempertahankan (diri). Ada bukti, keluarkan video, keluarkan... Bawa (bukti) ke mahkamah. Saya akan mempertahankan kehormatan saya. Ini cara saya," katanya sambil mendapat sorakan daripada kira -kira 1,000 orang di ceramah berkenaan.

Kurang ajar sangat!

Selain itu, Anwar juga membaca isi kandungan seperti yang didedahkan dalam WikiLeaks yang mendakwa Najib adalah seorang yang "suka mengambil kesempatan". Beliau juga meminta Singapura supaya tidak masuk campur mengenai urusan Malaysia.

"Ini bukan soal kamu... Kita (Pakatan Rakyat yang) lawan Najib.... Jaga negara kamu, jangan sombong dan (jangan) kurang ajar sangat," katanya.

Dalam ceramah itu juga, Anwar turut membidas mantan perdana menteri Tun Dr Mahathir Mohamad yang melahirkan rasa ragu-ragu bahawa beliau adalah sasaran 'perangkap seks oleh musuhnya'. "Dia sudah umur 80 tahun, jangan gaduh dengan dia. Jangan kacau... Orang dah umur 80 tahun, (sepatutnya) istighfar sudahlah," sindir Anwar sambil mendapat sorakan daripada hadirin.

Sebelum mengakhiri ucapannya, Anwar menegaskan bahawa beliau tidak risau dengan apa yang berlaku berhubung pendedahan dakwaan yang disiarkan dalam laman WikiLeaks. "Saya tidur masih nyenyak. Makan makanan enak. Isteri masih cantik dan setia. Alhamdulillah. Mereka mahu melemahkan kita, lagi banyak kita diserang, Alhamdulillah lagi banyak rakyat datang kepada kita.

Anwar mula menjelajah ke seluruh negara mulai semalam bagi menerangkan isu yang dihadapinya itu kepada rakyat. Esok, 16 Disember, beliau dijadualkan berada di Dataran Muhibbah, Kampung Ismail, Ampangan, Negeri Sembilan dalam siri Ceramah Perdananya sehinggalah berakhir di Pulau Pinang pada 19 Disember ini.

Setakat hari ini tak ada seekoq pemimpin UMNO mahu bersuara tentang tuduhan WikiLeaks berkaitan dengan Najib seorang oportunis dan penglibatan Najib dengan Altantuya serta tuduhan Singapura bahawa pemimpin UMNO lembab dan kurang cerdik.

Malah Speaker Dewan Rakyat telah menolak usul yang dikemukakannya meminta perbahasan diadakan bagi membincangkan pendedahan oleh WikiLeaks berhubung dakwaan diplomat Singapura yang mengaitkan Najib Razak dengan pembunuhan Altantuya Shaaribuu dan juga memalit Anwar Ibrahim dengan 'perangkap seks'.

Macam ini adanya Parlimen yang dikuasai oleh UMNO-BN maka aku tak hairanlah kenapa pemimpin2 Singapura memandang rendah kepada Najib dan pemimpin2 UMNO sebagai lembab,kurang cerdik dan aku nak tambah...... BAHLOL!!!!

Tak payahlah minta Lee Kuan Yew jadi saksi dalam mahkamah kangaroo Malaysia sebab hakim sudah pasti akan memihak Lee Kuan Yew punya....

Thousands at PR rally to hear about Kuan Yew,Dr M,Najib and Altantuya...

Despite police discouragement, a few thousand people packed the night market compound in Taman Melati, Wangsamaju to hear a Pakatan Rakyat political lecture led by Opposition Leader Anwar Ibrahim.

They were not disappointed. A star-studded line-up greeted them with speeches that soon had them cheering and clapping. Pakatan leaders such as Tan Tee Kwong, Tian Chua, Khalid Samad,Teresa Kok and Shamsul Iskandar Akin renewed the coalition's promises of change and reform.

The multi-racial crowd was also clearly eager to hear Pakatan's explanation of the accusation made by Singapore's Lee Kuan Yew against Anwar. They wanted to know why the elder statesman would make such a remark on WikiLeaks and were also keen to hear Anwar talk about former premier Mahathir Mohamad, who has insisted Kuan Yew's facts are right.

"Do you think I'm dumb to go into a trap knowing it is a trap? Don't challenge me too much! I will open up the murders - committed and covered up!," Anwar told the crowd, which roared back their support. "WikiLeaks, do you have technical evidence? If you do, bring Lee Kuan Yew to court. Whether you think I did it or not, that's none of my business. You have any video recording or doctors' notes, produce them at court."

Most of the Pakatan's side of the story has been blacked out in the mainstream media which only carried news that Kuan Yew had told Australian officials that he believed Anwar was framed, but he had also committed sodomy. Anwar has repeatedly denied these charges and his lawyers have earlier today announced he will be suing Mahathir. It is likely Anwar's defense team may try to subpoena Kuan Yew to testify in his Sodomy II trial.

"Lee Kuan Yew is afraid that Singaporeans will seek reformasi as the party in Singapore is the same like Umno which has never changed. We are not afraid, confused, or shocked with this allegation," Tian told the crowd.

But most sought-after were the Najib tidbits

But above all, the crowd appeared most eager to hear the latest tidbits about Prime Minister Najib Razak, who was also criticized by Singapore officials. WikiLeaks had also exposed these comments but the mainstream press has again blacked out this news.

"If Utusan published about WikiLeaks on Sodomy, why did it not publish about Najib's link to the Altantuya murder which was also said by the same Singapore intelligence. We want Singapore to bring the evidence about the sodomy and the murder of Altantuya to court. I want to propose to the Dewan Rakyat to debate on the issue of Wikileaks - sodomy and Altantuya murder and expose all the evidences to the public. Dr M responded for sodomy but what about Altantuya's murder and the link to the PM?" said Tian.

Top Singapore diplomats such as Tommy Koh, Peter Ho and Bilahari Kausikan had in comments to their U.S. counterparts called Najib an "opportunist", saying his involvement in the Altantuya murder was tarnishing Malaysia. They also said Malaysia was on a decline due to "incompetent politicians". Najib had tried to keep a lid on these explosive comments by asking Malaysians to ignore the Singaporean criticism. But tremendous pressure from Malay groups have forced him to issue a letter of protest to the Singapore High Commission today.

"Now, it's not me who said Najib is involved in the Altantuya murder but WikiLeaks. WikiLeaks is the one who says our prime minister in involved in a murder," said Anwar.

"The Umno media create havoc about sodomy but sideline the Altantutya link to Najib, which was also in WikiLeaks. Najib is now desperate to defend Putrajaya because he is scared the Altantuya murder will finally be fully exposed. I challenge Najib to challenge Singapore to prove his link with the Altantuya murder is false."

Dissolve Parliament, hold snap polls

Anwar also told the crowd that if Parliament suspended him for linking Najib's 1Malaysia with APCO, a U.S. based firm with Zionist links, he would tour the country and speak to the people.

Police had earlier set up road blocks nearby to Taman Melati but decided to allow the ceramah to carry on as a permit had already been obtained. Meanwhile, PKR Youth Chief Shamsul Iskandar Akin challenged Najib to dissolve Parliament and hold snap general elections if he truly believed Malaysians were behind the Umno-BN.

Political academics have been reported as saying BN would still win the next general election. However, they were not sure if it could regain the two-thirds parliamentary majority lost to the Pakatan in 2008. They warned that a Third Force, promoted by several prominent bloggers and whom many Malaysians believe are actually funded by Umno, may further undermine the Pakatan's chances.

Teresa also lambasted the Selangor Umno for spreading lies about the Pakatan state government. "The federal government alleged that Selangor was suffering a drop in investment. From January to September, we drew RM6.53 bil, the highest in Malaysia whereas Johor - despite all of BN's Iskandar corridor efforts only pulled in RM3.57 bil," she told the crowd. She also explained the Selangor administration's need to regain control of the state's water assets including revoking the existing monopoly granted to Umno crony firm SYABAS, which currently has sole rights over water distribution in the state. "If we don't take over SYABAS, the price of water tariff would increase," said Teresa.
