Sodomy II - Judge refused to drop sodomy charge....

The Kuala Lumpur High Court has dismissed Anwar Ibrahim's application to strike out his sodomy charge, following an allegation that a member of the prosecution team had romantic relations with the complainant. Justice Mohamad Zabidin Mohd Diah ruled that the allegation does not compromise the prosecution's integrity.

This is because DPP Farah Azlina Latif had no access to vital prosecution documents, as stated int he affidavits of investigating officer Jude Blacious Pereira and DPP Mohd Hanafiah Zakaria. Justice Zabidin said there is no reason for the court not to accept the assertion by Jude and Hanafiah on this issue.

"From their explanation, it was reasonable to decide that although DPP Farah Azlina Latif is part of the prosecution team, her role was limited to a 'need to know' basis.

"She did not have access to the investigation papers or documents, and neither was she involved in the briefing sessions. As Farah had no access to the investigation papers or to knowledge of the contents of the case, then (the complainant) Mohd Saiful Bukhari Azlan could not have gained accesss to these through Farah."

According to Jude's affidavit, those who have access include DPP Hanafiah, solicitor-general II Mohd Yusof Zainal Abiden and DPPs Nordin Hassan and Noorin Badaruddin. On the issue of the prosecution's integrity, Justice Zabidin ruled that Farah was not a prosecutor responsible for charging the accused, as she was merely in court to take notes. The judge noted that she was not responsible for examining the witnesses either.

"With that, I am of the view that Saiful did not have any influence on Farah based on the alleged relationship, and that this could not have influenced the prosecution and compromise the integrity of the team.

"...The issue of prejudice to the applicant (Anwar) in this trial, hence does not arise. Based on this reason, I find there has been no abuse of the court process as alleged and hence, the application is dismissed."

He also ruled that the matter was interlocutory and ordered the trial to resume, despite objections from the defence. About 10.50am, following a recess, lead defence counsel Karpal Singh said he would file notice of appeal and a stay application within an hour.

The judge said he will hear the application at 2pm.

Felda cannot sue' Suara Keadilan' says lawyer.......

The Federal Land Development Authority (Felda) cannot sue for slander Suara Keadilan as the government agency was established using taxpayers' money, a lawyer said today.

“Felda is a legal body set up with the people's money. Felda was established to assist and benefit the people. The laws are clear. Felda cannot sue (Suara Keadilan),” said the publication's counsel N Surendran.

“The legal principles are clear. Whatever (government) body is set up using the people's money and for the good of the people cannot sue for defamation every time it is criticised by the people,” Surendran added.

According to him, based on the common law as practised in the local, state and federal governments and statutory bodies cannot sue the people.

“If it (law suits against the public) were allowed, then the right of the people to criticise the government, government institutions and statutory bodies would be affected,” said Surendran, who was speaking at a press conference held today at PKR headquarters in Petaling Jaya. Also present were PKR vice-president Sivarasa Rasiah, PKR's Felda bureau chairperson Suhaimi Said and former land and cooperatives minister Tan Kee Kwong.

To a question, Surendran(left) said he has yet received a writ of summons from Felda, though a letter of demand was issued by the government agency on July 1. Felda was set up to offer schemes to assist settlers, “not to be used by a small group of people to attack opposition political parties”, Surendran said further.

“That was not the (original) aim of Felda. Felda was supposed to help rural settlers with farming schemes. How can a body like that, set up with such a purpose, use its funds to attack individuals and political parties? It's not logical at all,” he added.

In the same press conference, Suhaimi alleged that the money Prime Minister Najib Abdul Razak had announced would be given to Felda settlers - between RM150 to RM350 each person - was from funds collected by the settlers themselves.-Abdul Rahim Sabri

“Kepimpinannya bukan seperti contoh yang dia bawa. Saya rasa dia, seperti peribahasa Melayu sebut, sambil menyelam minum air,” katanya yang sudah dua tahun lima bulan menjadi menteri besar Selangor.

“Kalau bekerja di (kumpulan) Guthrie, beliau (Khir Toyo) tidak akan sampai tahap pengurus kanan pun”

Bakun Dam Project - RM5.75 billion in loans from the EPF and KWAP......

Opposition Leader Anwar Ibrahim has urged Prime Minister Najib Razak to come clean about further potential losses in the troubled Bakun hydroelectric dam project.

This is especially if the losses, said to amount to another RM2 billion following problematic federal-state negotiations, are to be absorbed by the subsidy-cut suffering rakyat.

"The continued lackadaisical attitude of the prime minister to limit the exposure of public funds committed to the Bakun Dan is in stark contrast to his strong opinion on the immediate removal of subsidies on sugar and fuel," Anwar said. This was so despite the fact that the targeted savings pale in comparison with the amount of public funds wasted on the Bakun Dam so far, he said in a statement today.

The Bakun saga, he added, proved the double standards BN practised, whereby a 20 sen per kilogramme subsidy for sugar was more burdensome than billion-ringgit corporate subsidies dished out "without the slightest sense of guilt". Worse still, the RM750 million of savings from the subsidy cuts only make up approximately 10 percent of the total cost of the dam, which is reported to have ballooned to RM7.3 billion, Anwar (left) said.

He pointed out that to date, the project had cost government-linked company Sime Darby RM450 million, not including the RM900 million government bailout. These two amounts by themselves should be enough to pay for measures to alleviate the rakyat's burden when faced with subsidy cuts, said the PKR de-facto leader.


Anwar also raised the alarm over the total RM5.75 billion in loans from the Employees Provident Fund (EPF) and Retirement Fund Incorporated (KWAP), which have largely funded the Bakun Dam project.

"Who will pay for the losses? Will the prime minister instruct the EPF and KWAP to quietly write off a part of the RM5.75 billion in loans to Bakun Dam to hide the losses from the public?

"The public has the right to know, especially when they are asked to tighten their belts to assist state coffers," he added.

Khalid - 'Whatever I do, I know I'll be better than Khir Toyo'......

It has been a rocky two-and-a-half years for Selangor Menteri Besar Khalid Ibrahim, and the glass remains half-full for this pragmatic politician.

"I spent the first six months understanding the administration... and (now) we are trying to correct the activities of the past, some of which are beyond rationality. We stumbled on quite a lot of things... I think hundreds," he said.

But despite all the problems the former corporate high-flyer has inherited, he is thankful that at least it means he does not have big shoes to fill.

"What excites me is that it gives me an opportunity to do better, because I can see that going by the old record, I can certainly do better.

"I can tell you now that there were some dumb MBs previously. I don't come from that group of people," the 63-year-old Khalid said.

High on the irrationality scale

Among the list of issues to untangle is the water tariff, which Khalid feels ranks high on the irrationality scale.

"This is (an agreement) prepared by somebody (else) and the state was asked to sign... an intelligent man - of course I'm not saying Umno does not have them, but there might be less of them around - would ask, 'how much would it cost after so many years'?

"It would cost more than petrol, so we say jokingly, it's better to drink petrol than water!" he said of the agreement signed by the previous BN government allowing concessionaire Syabas to increase water tariffs by certain percentages over the years.

Despite these setbacks, Khalid said his government "is better (than the BN government) by any imagination", even after less than three years in office. Likewise, he was less than kind about his predecessor Dr Khir Toyo, saying that the Umno man did "not deserve to be an MB" and "won't even reach senior manager level" at Guthrie, where Khalid was once CEO.

"He does seem to me to reflect the Malay proverb, sambil menyelam minum air (opportunistic). From an investment banker's point of view, he cannot sign a guarantee because his word may not be his bond," he said.

The MB's dim view of Khir extends to the "exposes" that the latter claimed to have made on sand-mining in a bid to discredit the Selangor administration.

"I cannot imagine why they are saying this. (Khir's government) was doing it illegally so they should keep quiet at least! Not saying that we're digging bigger holes than they were.

"But once these people get addicted to certain things, and we withdraw them, then the withdrawal syndrome kicks in, and they act irrationally," he said, shrugging, as if to show how little he thought of the past administration.

Second wife allegations

Personal attacks from pro-Umno bloggers who claimed Khalid appointed his "second wife" as the coordinator of MB Incorporated have left even less of a dent on the self-professed reformist. Going on the record about it for the first time, he said the individual in question is his personal assistant who had been working for him for over three decades now, since his days in Permodalan Nasional Bhd.

"When the previous assistant retired, I offered the job to her because I had worked with her for over 30 years and it is better to have someone I know, to avoid leaks and all that," Khalid said.

Brushing off the allegations, he added that his wife too has known his 50-plus years old assistant, who is married and has two adult children, for over three decades. While BN politicians and cyber-troopers appeared to have failed to get on his nerves, the same cannot be said about Giant, and the 19 other cats his family cares for.

"My daughter is a cat surgeon (so) we have a lot of cats, but I have a weakness, I have a sinus (problem). I pat them but they can't crawl on me. I'll throw them away.

"Sometimes they'll come next to me and sleep, so I say, 'Okay, you can sleep here for 10 minutes'," he said, trying unsuccessfully to show his distaste.

"There is one cat that only eats ikan bilis, and ikan bilis is very expensive. This is competing with my nasi lemak! Very manja!" said the reluctant cat lover of the tabby that received a special treat when Khalid visited Sabah recently. Giant and his posse may have made their way into the MB's heart, but for now, the shine behind the his often fingerprint-stained glasses belongs to the state of Selangor.

"I'm lucky to be an MB. I want to be a very good MB, I don't want people to say (that I made) a stupid decision. I take pride in my work," Khalid said.- Aidila Razak & Jimadie Shah Othman

Khalid - What is RM15 million,when Najib paid APCO RM 70 million for dissemination of information.....

Barisan Nasional should think twice before accusing the Selangor government of abusing state funds for budgeting RM15 million for the dissemination of information, says Selangor Menteri Besar Khalid Ibrahim.

Sounding a little agitated, he said in an interview with Malaysiakini earlier this week: "For Umno, MCA or MIC to say this, they are like spitting into the air, and it will fall back onto their faces."

In fact, Khalid said, if anyone was wasting public funds it was the federal government, for paying RM70 million "just for a consultant (public relations company Apco) to tell them how to send messages around".

He added: "To spend one percent (of our budget), equivalent to less NONEthan one sen per day (per Selangor resident) to make sure our position is understood is justified... because the federal government has betrayed us in terms of providing communication support.

"You say it is politics? Yes, but who started it first? There is politics, but not at the expense of the people. Selangor is expected to be ready for the 'info war' by November."

Playing by BN's rules

The former corporate giant also appeared unabashed about playing by BN's rules, saying that he was left with no choice after being stonewalled by the other media. For example, he said, in 2008 the federal government pulled out of Selangor the information officers who were meant to propagate state policies.

"When I came in I was very happy because in my previous job, radio and television (stations) interviewed me for discussions. So I thought, 'Yeah! This is Radio Selangor, operating in this building'."

But his enthusiasm was soon dampened when the radio station not only ignored his requests to talk about state policies but actually moved out of the state secretariat building.

"I could have repaired a road, I could have given out books, but I need (to communicate), if not the people of Selangor can say, 'Hey, you didn't tell us'," Khalid said, adding that while he was CEO of Guthrie, the conglomerate spent three to five percent of its budget on communications.

EC as stupid as federal government

Promoting democracy is also something a penny-pincher would not scrimp on, which was why Khalid got riled up when touching on the Election Commission's (EC) claim that a separate state election would be a waste of money.

"This is why I am quite worried about the EC... the people elect us for five years, (not) on the basis that state assemblypersons and parliamentarians should come in and go out together.

"(The EC) should not be acting such that the citizens will say it is as stupid as the current Federal Government," he said, grinning.

However, Khalid kept his cards close to his chest over when asked whether Selangor would call for separate polls in the wake of mounting speculation that a snap general election would be called.

"Politics is also strategy, if the federal government collapses and we think we can win, we will join the game," he said.

He added that snap polls very early into the term of a government was something the EC should worry about, since this was cheating the voters, as well as not giving the elected representatives time to justify being elected.-Aidila Razak and Jimadie Shah Othman

Mohd Saiful Bukhari Azlan dicadangkan supaya mengambil kesempatan di bulan Ramadhan ini untuk membersihkan namanya dengan bersumpah sekali lagi di masjid ekoran tuduhan hubungannya dengan seorang timbalan pendakwaraya Farah Azlina Latif.

Anggota Parlimen Bukit Gantang, Datuk Seri Mohamad Nizar Jamaludin dalam laman twitternya berkata, "Bulan Ramadhan lebih baik bagi Saiful bersumpah seperti mana pernah dibuatnya dalam masjid dulu perihal penafian hubungannya dengan DPP Farrah Azlina." Cadangan Nizar itu dipercayai dibuat ekoran dakwaan Saiful mempunyai hubungan romantis dengan salah seorang anggota pendakwaan terhadap Datuk Seri Anwar Ibrahim iaitu Farah Azlina.

Ekoran dakwaan itu, Peguam Negara telah menggugurkan Farah dari pasukan itu dan dikeluarkan juga dari bahagiannya sekarang. Dakwaan ini bermula apabila blogger Raja Petra Kamarudin menulis dalam blognya, Saiful mempunyai hubungan dengan salah seorang anggota pasukan pendakwa ke liwat II Anwar itu.

Saiful dan Farah dikatakan masing-masing telah bertunang sebelum ini namun kedua-duanya sudah putus dengan tunang masing-masing. Namun, serius manakah hubungan antara kedua-duanya tidak diketahui kerana usaha pasukan pembela Anwar untuk membawa kedua-dua ke kandang saksi ditolak oleh hakim perbicaraan.

Sebelum itu, peguam Anwar, Karpal Singh memohon agar kes terhadap Anwar ini digugurkan kerana telah berlaku salah kepentingan dalam kes ini ekoran hubungan antara Saiful dan DPP itu. Anwar mahu membatalkan pertuduhan itu atas alasan bahawa integriti dan tidak memihak terhadap keseluruhan pasukan pendakwaan yang telah dipersetujui berikutan dengan dakwaan hubungan sulit itu

Bagaimanapun, Karpal berkata pihak pembelaan hendaklah mendengar kedua-dua keterangan daripada Mohd Saiful Bukhari dan Farah Azlina sebelum meneruskan permohonan itu. Karpal berkata adalah penting kedua-dua Saiful dan Farah disoal sebagai saksi memandangkan keterangan mereka adalah “penting” dan dakwaan hubungan ‘sulit’ boleh menjejaskan keseluruhan perbicaraan kes liwat.

Di peringkat awal kes ini, Saiful telah membuat sumpah di masjid Wilayah Persekutuan Kuala Lumpur mengaku bahawa beliau telah diliwat oleh Datuk Seri Anwar. Mungkin ekoran sumpah itulah, hari ini Nizar, Menteri Besar Pakatan Rakyat Perak itu mencadangkan agar Saiful bersumpah sekali lagi untuk mengesah atau menafikan dakwaan terhadap beliau itu. Namun, sehingga kini, respon dari Saiful adalah keyakinan beliau, akhirnya keadilan akan terdedah jua.

1Malaysia broken and can't be fixed........

A slogan is in trouble if you have to have a load of explanation to sustain it. Winning slogans are magically self-explanatory. The best of them blend poetic craft with contemplative vision, translating tacit desires into attainable objects.

'1Malaysia' was a catchy slogan at its launch by Prime Minister Najib Razak when he took over as premier in April 2009. It had lilt, its phonetics pleased the tongue and its pay-off line - 'People first, Performance now' - sent off ripples of resonance that hinted at subversion of the status quo.

No genius was required to know that the status quo, a year after the seismic general election of March 2008, was in dire need of change. Every new leader at the helm needs a starting slogan, an 'all hands on the deck' catchphrase that invites the people to put their shoulders to the wheel.

Najib's '1Malaysia' had the lift of a trumpet blast, a striking summons to a new beginning. Although he was seen as saddled with baggage that could not be conjured away, his gave off activist vibes that positioned him in welcome contrast to his ineffectual predecessor. However, it did not take long for the forces of political gravity to work their deflationary poison and knock the stuffing out of the '1Malaysia' slogan.

First, Nasir Safar, an aide to Najib, uttered a racial profanity that is the very antithesis of '1Malaysia'. Nasir resigned but the damage was done.

Second, DAP aide Teoh Beng Hock mysteriously fell to his death while or just after a bout of interrogation at the Malaysian Anti-Corruption Commission headquarters in Shah Alam. The public suspects foul play; his interrogators say they were not responsible in any way. The mystery, more than a year after Teoh's death, continues to resist unraveling. The ongoing judicial inquest, if it issues in a verdict that sounds inauthentic, will only stoke public suspicions that '1Malaysia' is all sound and no substance.

The third blow to the slogan's credibility was what private investigator P Balasubramaniam said on resurfacing after a 15-month disappearance that followed his sudden retraction of a sensational affidavit sworn in July 2009 in connection with the Altantuya Shaaribuu murder.

Real test

There were other '1Malaysia' deflating incidents, such as Petronas' disclosure of a sharp drop in its revenue, but nothing of the import of Nasir's faux pas, Teoh's death and Balasubramaniam's new revelations.

All three shindigs had the recognisably bad odor of the status quo that Najib's '1Malaysia' start shaped to radically alter. But the real test of 1Malaysia's substance or inanition arrived when the New Economic Model was unveiled in March 2010.

The NEM intimated that poverty alleviation would henceforth be needs-based more than race-based, and meritocracy would be emphasised, a hint that affirmation action imperatives would be de-prioritised. This drew opposition from Malay pressure groups with former PM Dr Mahathir Mohamed joining the chorus of naysayers.

Apparently, the opposition was enough to see the NEM relegated to a bit part rather than a major role in the 10th Malaysia Plan that Najib unveiled in Parliament in June.By this time the '1Malaysia' slogan was looking like a kidney patient deprived of dialysis.

Current talk that the '1Malaysia' concept needs to be explained in some depth to resuscitate belief in it ignores the point that missed opportunities to give it credence had damaged its credibility irrevocably. More talk would just invite more cynicism. - Terence Netto
