Who is Yang Arif Ramly Ali,that granted the stay of execution.........

The Appeal Court Judge,Ramly Ali who granted a stay of execution on the High Court decision which recognised Mohammad Nizar Jamaluddin as the rightful Perak menteri besar, was a former Chief Registrar who was appointed as Appeal Court judge on 15 April 2009.

He was one of the candidate recommended by V.K.Lingam in his controversial Lingam Tape scandal that showed lawyer V.K.Lingam who was in a monologue over his mobile phone and it was unclear who he was talking to.

The telephone conversation focussed on the following reasons:

a. Ahmad Fairuz was referred to as “Datuk” and there was talk of getting a “Tan Sri”-ship for him the same year. Ahmad Fairuz was awarded the Panglima Setia Mahkota (P.S.M) by the Yang di Pertuan Agong during the King’s birthday in June 2002, making him a Tan Sri.

b. There was reference of making “Datuk Heliliah, Datuk Ramli and Datuk Maroop” as judges — on 8th February 2002, Datuk Heliliah Mohd Yusuf, former Solicitor-General, Datuk Ramly Ali, a former Chief Registrar and Datuk Ahmad Maarop, a former Commissioner of Law Revision, received their letters of appointment as High Court judges from the Yang di Pertuan Agong. Their appointments were from Feb. 1, 2002.

c. There was reference that “in three months time” Ahmad Fairuz would be made President of Court of Appeal and “six months time” he was going to be Chief Justice - Ahmad Fairuz was sworn in as President, Court of Appeal on Dec. 1, 2002 and appointed Chief Justice of Malaysia on March 17, 2003.

Shouldnt an Appeal Court sits with a minimum of 3 judges? I am no loyarburuk, but thats what my father use to tell before, unless they changed the rules of the game.......

Shouldnt those names mentioned by the lawyer in the Lingam tape scandal be investigated first?

Btw. the dissolution of DUN Perak is up to Tuanku Sultan. Since the legitimate MB Nizar receive the 'stay order' he cannot perform his duty of seeking the Sultan to dissolve the State Assembly.

While Zambry, the high court rules that he is not the rightful MB. He is now the caretaker MB and its against the law to claim himself as MB, thus the Sultan cannot accept and act according to what this illegal MB wants.

Since both MB cannot represent the State Government, it is rightfully up to the Sultan's decision whether to call for a dissolution or not.

Beranikah Najib ajak Tuanku Sultan bubarkan DUN Perak.......

Pilihan raya semula adalah satu daripada opsyen yang ada untuk menyelesaikan kemelut politik di Perak tetapi ia bukanlah sesuatu yang harus, kata Najib Tun Razak. Perdana Menteri berkata keputusan sama ada untuk mengadakan pilihan raya negeri di Perak bergantung kepada budi bicara Sultan Perak Sultan Azlan Shah.

Bercakap kepada pemberita selepas menghadiri majlis perhimpunan Hari Pekerja Sektor Awam di sini hari ini, Najib berkata Barisan Nasional tidak gentar untuk menghadapi apa jua kemungkinan termasuk pilihan raya sekiranya itu yang diputuskan.

Najib Tun Razak hari ini berkata bahawa beliau bersedia mengadakan perbincangan dengan Pakatan Rakyat bagi menyelesaikan krisis politik di Perak. Bagaimanapun, katanya, tidak harus ada sebarang prasyarat untuk mengadakan perbincangan tersebut dan ia harus terbuka untuk menerokai semua kemungkinan. "Saya telah berkata, prinsip nombor satu ialah hormat menghormati antara satu sama lain," katanya. "Nombor dua, kita mesti mengikut aturan dan peraturan dalam Dewan dan di luar Dewan," tambahnya.

Anwar Ibrahim berkata kemelut politik di Perak bukanlah isu yang boleh diselesaikan di mahkamah. Sebaliknya, beliau yang juga ketua umum PKR berkata, ia hanya boleh diselesaikan melalui pilihanraya yang bebas dan adil.

"Penyelesaiannya bukan pada istana atau mahkamah, tetapi mahkamah rakyat yang akan menentukannya," katanya.

Sehubungan itu, Anwar mencabar Perdana Menteri, Najib Tun Razak supaya mengadakan pilihanraya baru di Perak bagi menyelesaikan kemelut politik sekarang.

Apabila beliau bertanya mengapa Najib perlu takut untuk mengadakan pilihanraya baru di Perak, kira-kira 3,000 hadirin yang memenuhi dewan tersebut melaung: "Takut kalah". Najib dikaitkan dengan tindakan BN merampas kuasa di Perak dari Pakatan Rakyat.

Parti Gerakan Pulau Pinang juga telah mendesak MB Perak, Zambry Abdul Kadir supaya segara memohon pembubaran Dewan Undangan Negeri (DUN) bagi membuka jalan mengadakan pilihan raya negeri. Pengerusinya Dr Teng Hock Nan berkata langkah membubarkan DUN akan membolehkan rakyat Perak memutuskan parti mana yang sepatutnya memimpin urusan pentadbiran negeri itu. Desakan yang juga datang dari Tengku Razaleigh, MCA, Majlis Peguam,Suhakam dan ramai lagi.

Sementara itu mentor Najib, Mahathir Mohamad, pula berkata, jika ada pilihanraya Pakatan akan menang dan sebab itu tidak perlu BN adakan pilihanraya negeri. Katanya lagi ,pilihanraya negeri itu, tambahnya, hanya membazirkan wang rakyat. Awat Che Det suka tengok gomen Perak lintang pukang kah?

Najib Tun Razak berkata terserah kepada Zambry untuk memutuskan langkah selanjutnya. Sebaliknya Najib cuba berdolak dalik. Najib sebenarnya tiada pilihan,bubar DUN dia kalah,tak bubar DUN pun dia kalah. Kalau bubar DUN tak tentu lagi 28 + 3 ADUN BN dan katak-katak itu akan dipilih semula. Seperti mana yang diramalkan oleh mentornya, BN akan kalah, nyaris-nyaris tinggal 8 saja.

Kalau tak bubar DUN, Najib juga dapat malu, kerana MB yang dilantik itu adalah lantikan mahkamah bukan pilihan rakyat. Sudah pasti rakyat Perak tak mahu seorang MB yang dipilih oleh mahkamah. Mahu tak mahu Najib kena juga suruh MB Zambry minta Tuanku Sultan bubar DUN.

Now Najib is stuck between the devil and the deep blue sea........

He even throws the ball to the Sultans court!

The question is whether Najib got balls to advise Zambry to seek the Sultan permission to dissolve the Perak State Assembly?

Sikap double standard Mahkamah Rayuan.............

Mahkamah Rayuan menetapkan Isnin(18/5/09) ini bagi mendengar permohonan Mohammad Nizar Jamaluddin untuk mengetepikan perintah Mahkamah Rayuan yang diperoleh Zambry Abdul Kadir semalam, yang menangguhkan pelaksanaan pengisytiharan Mahkamah Tinggi bahawa Mohammad Nizar adalah MB Perak yang sah.

Tarikh itu ditetapkan selepas Mohammad Nizar memfailkan notis usul itu di pejabat Pendaftar Mahkamah Rayuan di sini pada jam 2.20 petang menerusi firma guaman Tetuan Leong & Tan.Turut disertakan bersama notis usul itu ialah sijil supaya kes itu disegerakan.

Hakim Datuk Ramly Ali sudah membenarkan permohonan Zambry semalam untuk supaya ditangguhkan pelaksanaan perintah pengisytiharan itu sehingga kes rayuannya selesai diputuskan oleh mahkamah.

Dalam permohonannya, Mohammad Nizar, 52, mahu Mahkamah Rayuan mengetepikan perintah pelaksanaan itu dan secara alternatifnya memohon mahkamah meminda perintah pelaksanaan itu dengan memasukkan terma-terma yang difikirkan wajar.

Dalam afidavit sokongannya, Mohammad Nizar berkata, keputusan Mahkamah Rayuan semalam untuk memberikan perintah penggantungan itu kepada Zambry adalah salah dan beliau (Nizar) mengemukakan permohonan untuk membetulkan perkara itu.

Nampaknya Mahkamah rayuan tidak mahu bertindak sebegitu pantas seperti mana yang dilakukan kelmarin bila Zambry memohon untuk ketepikan perintah Mahkamah Tinggi dalam tempoh 2 jam setelah Zambry menfailkannya. Kedua-dua permohonan itu adalah atas dasar kepentingan awam,tetapi kenapa bagi Zamry dibuat dalam tempoh 2 jam sedangkan Nizar kena tunggu sampai hari Isnin?

Kalau ini bukan sikap double standard, apakah jadah namanya?...... mungkin mahkamah kita dah tahu membeza antara orang gomen dengan orang pembangkang kot!

When the Court of Appeal strikes like lightning..........

It took almost 2 years for the Court of Appeal to finally reject Canny Ong murder appeal after the High court convicted Ahmad Najib Aris for raping and murdering the IT analyst.

On Feb 23, 2005, the Shah Alam High Court sentenced Ahmad Najib to death for raping and murdering Canny Ong, 29, at the 11th kilometre of Jalan Klang Lama between 1am and 5am on June 14, 2003.

However it barely took about 19 hours for the Court of Appeal to grant a stay of execution on the High Court decision which recognised Mohammad Nizar Jamaluddin as the rightful Perak menteri besar.

Btw. shouldnt ex-MB Zamry apply the stay of execution to the High court rather than the Court of Appeal ( refer to Civil Procedure by Jefrey Pinsler page 860) and the manner in which the Court of Appeal strike like lightning speed is disputable. The Court of Appeal did not dispute yet the findings of the High Court, so who is the real MB Perak?, please stand up. By right Zambry is now heading a caretaker gomen........

Najib ruled out on calling for a snap state election in the state, stating that such a thing was the prerogative of the Sultan.

Yes, it is the Sultan prerogative to call a snap election by agreeing to dissolve the assembly. But, Mr.Najib, how is the Sultan gonna do this when you tied his hand and mind with your pending appeal at the Appeal Court?

In fact, its only Najib's decision that decides the faith of the Perak DUN imbroglio. So, it's Najib's call........

Today Nizar Jamaluddin is applying to set aside yesterday's Court of Appeal order to stay his declaration as the rightful mentri besar of Perak. Lets see how quick will the Court of Appeal act when its the opposition turn to apply..................

Sementara itu Majlis Peguam berpendirian keputusan Mahkamah Rayuan itu bererti Zambry hanyalah penjaga kuasa kerajaan negeri atau “head of a caretaker government” sehingga rayuan penuh beliau didengar.

“Oleh itu Zambry tidak harus merancang untuk memanggil sidang khas Dewan Undangan Negeri tergempar kerana beliau tidak mempunyai kuasa berbuat demikian,” kata Naib Presiden Majlis Peguam Lim Chee Wee.

Desas-desus kencang bertiup Zambry akan memohon kepada Sultan Perak untuk memanggil sidang tergempar DUN itu bagi meluluskan usul tidak percaya terhadap Nizar.

Ex-MB Zambry likened himself to Nelson Mandela and Mahatma Gandhi.........

Datuk Seri Dr Zambry Abd Kadir, whose nearly three-month tenure as mentri besar was ruled illegitimate by the Kuala Lumpur High Court on Monday, has likened himself to Nelson Mandela and Mahatma Gandhi.

Warning Pakatan Rakyat not to under-estimate him, he said the High Court’s “shocking decision” did not mean he would give up the fight.

“To me, losing the mentri besar post will not reduce my fighting spirit in upholding the truth.

If reinstated Mentri Besar Datuk Seri Mohammad Nizar Jamaluddin and his “friends ... assume that the High Court’s decision will dampen my spirit, then they have read me wrong,” he said in a blog entry early Tuesday morning.

He said a person did not need to hold a post in his struggle to uphold the truth, and likened the recent struggles faced by him and his “comrades from the Barisan Nasional” to those endured by politicians like Nelson Mandela and Mahatma Gandhi.

“Nelson Mandela sacrificed his freedom for 27 years in order to free South Africans from the grip of ‘apartheid.’

Nizar diterima mengadap Raja Nazrin pagi ini...........

MB Perak Nizar Jamaluddin telah diterima mengadap oleh Raja Nazrin Shah pada 8.30 pagi ini, mengikut satu kenyataan S. A Sivanesan ADUN Sungkai sebentar tadi.

Adalah dipercayai, persetujuan Raja Nazrin Shah untuk terima mengadap akan digunakan sepenuhnya oleh DS Nizar bagi memohon perkenan pihak istana Perak bagi membubarkan Dewan Undangan Negeri Perak dan seterusnya diadakan pilihanraya semula bagi seluruh DUN di negeri Perak Darul Ridzuan.

Adalah difahamkan bahawa DYM Sultan Azlan Shah kini masih lagi berada di Amerika Syarikat.

Mohammad Nizar berkata, beliau dan kesemua Exconya akan memulakan tugas seperti biasa pada pukul 7.15 pagi ini.

Beliau juga berkata, mesyuarat tersebut memutuskan untuk meneruskan dasar-dasar yang diputuskan oleh kerajaan negeri di bawah BN selama tiga bulan yang boleh membawa manfaat kepada rakyat.

Selain itu katanya, V Sivakumar masih merupakan Speaker Dewan Undangan Negeri (DUN) yang sah.

Katanya, Datuk R Ganesan yang dilantik oleh BN sebagai Speaker DUN adalah tidah sah kerana masih belum mengangkat sumpah.

Sehubungan itu kata beliau, apa juga kemungkinan sidang DUN tergempar yang akan dibawa BN pada pagi ini adalah tidak sah.

"Untuk mengadakannya, mereka mesti memberi notis," katanya.

Petang tadi Mahkamah Tinggi Kuala Lumpur memutuskan bahawa Nizar adalah Menteri Besar yang sah.

Sementarea itu Najib berkata, rayuan akan dikemukakan terhadap keputusan mahkamah hari ini.

"Kita akan merayu terhadap keputusan itu dan kita harap mendapat tarikh awal untuk melakukannya. Saya tidak boleh mengulas banyak kerana perkara ini masih dalam bidangkuasa mahkamah.

Najib, tolonglah jangan biarkan krisis ini berlarutan. Eloklah DUN Perak dibubarkan segera dan biarlah rakyat Perak tentukan siapa yang mereka mahu untuk diangkat jadi gomen. Soal menang kalah adalah perkara kedua. Kedua-dua pihak PR dan BN harus menerima keputusan rakyat ini secara gentleman...........

Nizar - MB Perak yang sah..........

Mahkamah Tinggi Kuala Lumpur mengumumkan Datuk Seri Mohamad Nizar Jamaluddin sebagai menteri besar sah Perak setelah digugurkan jawatan tersebut awal bulan lalu.

Dalam penghakimannya, hakim Abdul Aziz Abd Rahim berkata seseorang menteri besar hanya boleh dipecat melalui undi tidak percaya di DUN, seperti kes Stephen Kalong Ningkan.

Hakim menambah, dalam kes pelucutan Mohamad Nizar, tiada persidangan dewan diadakan untuk meluluskan usul sedemikian.

Mengulas kemenangannya, menteri besar Pakatan Rakyat itu berkata beliau akan menghadap Sultan Perak berhubung penghakiman mahkamah tersebut.

The High Court here ruled rule on Monday that Datuk Seri Mohammad Nizar Jamaluddin is the rightful Perak Mentri Besar, and not Barisan Nasional’s Datuk Seri Dr Zambry Abdul Kadir. In an immediate response, Zambry said he would apply for a stay pending appeal. This was rejected by the court. Zambry's lawyer Cecil Abraham's application for a stay of proceedings pending an appeal was also rejected by the court.

He also ordered Zambry and his exco members to vacate the office as soon as possible.

In his ruling, Justice Abdul Aziz Abd Rahim said that a new mentri besar could not be appointed as the office had not been vacated. He said a mentri besar can only be dismissed by a vote of no confidence, and upheld the Stephen Kalong Ningkan ruling. He noted that the Perak State Legislative did not hold a vote of no confidence.

Nizar is expected to seek an audience with the Sultan of Perak, Sultan Azlan Shah, to get his consent to dissolve the Assembly and call for fresh state elections.

The decision is now set to bring about more uncertainty in the state.

No wonder,Najib Razak was so kind enough to offer help to PR to resolve the crisis in Perak.

Probably its too late........ So will the DUN be dissolve or BN will pressure on to stay in power?

One must not forget that BN still have the upper hand with regards to the state assembly. While the court has not recognised Zambry's appointment as MB, the appointment of new state assembly speaker R Ganesan is still valid. In view of this, Ganesan could call for an emergency sitting where a motion of no-confidence would be moved against Mohammad Nizar. With its '28 + 3' BN as opposed to Pakatan's 28, BN should have no problem in pushing the motion through.

BN willing to cooperate,to overcome Perak crisis says Najib......

The Barisan Nasional (BN) government is willing to cooperate with the opposition parties to resolve the political crisis in Perak but this does not mean it would agree to form a coalition government.

Prime Minister Datuk Seri Najib Abdul Razak said today the cooperation should be based on the spirit of mutual respect and adherence to the law.

"Cooperation does not mean forming a coalition government. It doesn't have to be in that form ... it can take various other forms but the most important thing is that there should be mutual respect," he told reporters after opening a meeting of the Pekan Umno branch.

Najib was commenting on a statement by DAP parliamentary leader Lim Kit Siang on Saturday that Lim was willing to meet Najib to discuss the Perak political impasse. Najib said the Perak political crisis could be avoided if all parties adhered to the law and respected one another.

"If we respect the law, and everyone should respect the law, there won't be any crisis and things won't turn into a crisis," he said.

"But when all are claiming that they are right, then there are bound to be problems."

He said the BN government had always been keeping an open attitude and giving its best service to the people.

"We don't want the situation (in Perak) to prolong. We want to serve the people, for everyone in Perak and throughout the country," he said.

Can you really thrust this fellow? PAS was cheated once and booted out from the BN coalition. If PR wants to talk make sure that dissolving the Perak State Assembly and have an election must be part of the agenda. If not than there shouldnt be any deal........
