Cubaan terakhir untuk menamatkan karier politik Anwar...

PAS menyifatkan pendakwaan fitnah liwat II terhadap Datuk Seri Anwar Ibrahim sebagai cubaan terakhir untuk menamatkan karier politik ketua pembangkang itu.

Ketua Penerangan PAS Pusat, Datuk Mahfuz Omar berkata, tindakan juga dilihat untuk mengaibkan Anwar supaya masyarakat hilang kepercayaan terhadapnya.

"Saya tidak boleh menyentuh perjalanan di dalam mahkamah secara langsung tetapi saya yakin apa yang dihadapi Anwar adalah percubaan akhir untuk kerajaan menamatkan karier politik beliau.

"Sama ada memenjara ataupun menghilangkan kredibiliti Ketua Pembangkang itu, tindakan ini secara tidak langsung untuk mengaibkannya supaya masyarakat hilang kepercayaan," katanya kepada Harakahdaily.

Ahli Parlimen Pokok Sena itu juga yakin Anwar tidak akan berganjak dalam menghadapi situasi yang mencabar berhubung tuduhan fitnah tersebut.

Sejarah dan liku-liku kehidupan yang dihadapi Anwar kata Mahfuz, sudah cukup menunjukkan betapa kentalnya pemimpin politik itu.

Mahfuz turut berharap ahli-ahli dan penyokong PAS hadir pada hari esok bagi memberi sokongan moral kepada Anwar dan keluarganya.

"Terlalu banyak perderitaan yang dihadapi Anwar dan keluarganya, sejak dahulu mereka tidak pernah berhenti berhadapan dengan situasi yang cukup pedih dalam kehidupan.

"Saya fikir cara terbaik kita semua hadir memberi sokongan, esok merupakan hari terakhir dan mereka yang menyatakan sokongan kepada Pakatan Rakyat wajar hadir," katanya.

Sementara itu Naib Presiden PAS, Salahuddin Ayub pula mengharapkan akan ada keadilan ditegakkan dalam kes fitnah Anwar kali ini.

Beliau yang hadir di mahkamah hari ini turut memberitahu selagi doktrin pemisahan kuasa tidak wujud, keadilan di dalam sistem perundangan sukar ditegakkan.

"Saya mengharapkan perbicaraan anwar peringkat terakhir pada hari ini sebelum keputusan akan ada keadilan yang dapat ditegakkan.

"Kita sebenarnya masih dalam suatu perjalanan yang panjang untuk melihat tertegaknya suatu keadilan dalam negara, bila kita bercakap tentang doktrin pemisahan kuasa yang sehingga hari ini menjadi harapan rakyat," katanya.

Naib Presiden PAS itu turut mendoakan agar Anwar dan keluarga diberikan keadilan dalam konspirasi fitnah ini.

"Saya mendoakan dan mengharapkan Anwar serta keluarganya dapat diberikan keadilan dan keputusan yang benar-benar adil.

"Keputusan itu akan memberikan kembali sinar kehidupan kepada beliau sekeluarga, apa yang penting adalah kita masih memerlukan kehadirannya bersama Pakatan Rakyat," ujar beliau lagi.- harakahdaily

Zero access to DNA notes a major ‘handicap’ to defence case...

Lawyer Ramkarpal Singh questioned today why the notes and documents that the government's DNA expert had relied on in her Sodomy II testimony were neither tendered as evidence nor supplied to Datuk Seri Anwar Ibrahim's defence team during trial.

Anwar's counsel pointed out that the DNA expert could not answer questions unless she had the said notes with her but despite this, the documents were still not provided to the defence.

This, he told the five-man panel at the Federal Court today, had created a major “handicap” in their case.

“We need this information for our experts. She (government's expert) would not have been able to come to findings without benefit of such information... this not been produced.

“We have a background at how disadvantaged the defence waa at the trial,” he said during submissions.

During the High Court trial for Sodomy II, the defence had repeatedly applied but failed to have access to the notes and documents of the government's DNA expert.

Ramkarpal also argued today that the Court of Appeal, when deciding to overturn Anwar's initial acquittal in the case, had not even considered the evidence given by the defence's DNA experts.

Instead, he pointed out, the appellate court had immediately concluded that they were merely “armchair experts”.

“He was clearly qualified as an expert with over 30 years of experience,” said Ramkarpal, referring to one of  Anwar's own expert Dr Brian McDonald.

Ramkarpal is the fourth lawyer from Anwar's defence team to submit at the hearing of Anwar's Sodomy II appeal.

Earlier in court, the lawyer questioned the reliability of government DNA expert Dr Seah Lay Hong's analysis of the DNA profiles taken in the case, saying she had been inaccurate and evasive during questioning.

“Sperm extract found in rectum... shows sample contaminated,” he told the court.

Anwar was held overnight from July 16 to 17, from 11.05pm to 12.30pm, in 2008, after being arrested for allegedly sodomising his former aide Mohd Saiful Bukhari Azlan.

Samples taken from the toothbrush, mineral water bottle and “good morning” towel that were given to Anwar during his jail stint were later used to match with the DNA samples taken from Saiful.

During trial in 2011, one government chemist Nor Aidora Saedon had testified that there were two DNA profiles found on the evidence samples ― that of “Male Y” and that of an unknown DNA profile.

The chemist had also testified that the DNA profiles found on the items match those whose sperm extracts had been found on Saiful's anus earlier.

The Federal Court is hearing today Anwar’s challenge of the Court of Appeal’s decision to overturn a lower court’s decision to acquit him of his 2008 sodomy charge.

The High Court had in 2012 acquitted Anwar of the charge but the appellate court ruled on March 7 this year that the trial judge had erred when rejecting the DNA evidence produced in the case.

Anwar has repeatedly maintained his innocence, insisting that the charges were trumped up to kill his political career as he allegedly poses a threat to the Barisan Nasional coalition's decades-long rule with the Pakatan Rakyat alliance, which he now leads.

If Anwar fails to reverse his five-year imprisonment sentence and conviction in the Federal Court, he would lose his seat as the law bars anyone fined RM2,000 or imprisoned for one year from serving as a lawmaker.

Today’s hearing is presided over by a five-member panel led by CJ Ariffin. Others include Court of Appeal president Tan Sri Md Raus Sharif and Federal Court judges Tan Sri Abdul Hamid Embong, Tan Sri Suriyadi Halim Omar and Datuk Ramly Ali, who replaced Tan Sri Ahmad Haji Maarop.

Anwar is represented by a 14-man defence team led by Sri Ram. Others include lawyers R.Sivarasa, Latheefa Koya, N. Surendran and Gobind Singh Deo.

Lawyers from the prosecution team are Shafee and Datuk Mohamad Hanafiah Zakaria.

The hearing is expected to extend beyond today and the judges are believed likely to reserve judgement to a later date.- msn

Malaysian opposition leader Anwar Ibrahim is choosing to fight a sodomy charge and five-year jail term rather than live in exile overseas and we were given access to his family home in the hours ahead of learning his fate.

LEIGH SALES, PRESENTER: During a recent trip to London Malaysia's opposition leader Anwar Ibrahim was urged to stay and live in exile. Instead, he's returned home to face a possible third jail term.

During the next two days Anwar Ibrahim will fight to have a sodomy charge and a five year jail term overruled, but he's preparing for the worst.

7:30's been granted intimate access to Mr Anwar's family home as he awaits his fate.

Here's South East Asia correspondent Samantha Hawley.

SAMANTHA HAWLEY, REPORTER: At his home in the Malaysian capital, Anwar Ibrahim is preparing himself and his family for a possible return to jail.

A family reunion is under way. Some of his children have returned from overseas. No one is optimistic about what lies ahead.

ANWAR IBRAHIM, MALAYSIAN OPPOSITION LEADER: There is concern, but we've gone through this, not only once, but repeatedly a number of times during the last 16 years. So I think we have got to remain strong and calm.

SAMANTHA HAWLEY: This is a story of politics, power and a judiciary beating the career out of the man.

Nearly two decades ago charges of corruption and sodomy widely viewed as politically motivated sent the star of Malaysian politics to jail for six years. All of it served in solitary confinement.

He was acquitted of a second lot of sodomy charges in 2012, but earlier this year just before Mr Anwar was due to contest a crucial bi-election for a powerful chief minister's position, that acquittal was overturned with unusual speed by the Court of Appeal.

SIVARAS RASIAH, DEFENCE LAWYER: This trial from the outset has been a political trial with the aim of removing Anwar Ibrahim, if possible, from the political arena and because he is perceived as the biggest threat in this country at this point in time to the continuing dominance of the UMNO Barisan government. Our position is that this allegation by this young man Saiful is a complete fabrication. 

SAMANTHA HAWLEY: Anwar Ibrahim's a accuser in this sodomy case, Saiful Bukhari Azlan, worked briefly in Anwar's office.

SAIFUL BUKHARI AZLAN (subtitled translation): I swear I was sodomised by Anwar Ibrahim on 26th June 2008.

SAMANTHA HAWLEY: Najwan Halimi was his university dorm mate from 2003 to 2008. He's one who never believed his onetime friend's version of events.

NAJWAN HALIMI, UNIVERSITY FRIEND: He associates himself with the ruling party during his university days and it's quite shocking to see him working for Anwar a few months after he dropped out from studies. I don't know, maybe to me, during that time I assumed that he was actually planted to become a spy.

SAMANTHA HAWLEY: For Malaysia, and its democratic future, this is about much more than the innocence or otherwise of one man. When the five judge panel of the Federal Court decide Anwar Ibrahim's fate, the future of the political landscape will also be up for grabs.

ERIC PAULSEN, LAWYERS FOR LIBERTY: Malaysia it's no longer a young country and we must have state institutions, the police, the attorney-general's chambers, the judiciary. They must be free from political interference. They must be able to act independently and fairly, not at the behest of the ruling party.

So until we have that, then I fear for the future of Malaysia.

SAMANTHA HAWLEY: From all accounts what is happening in the majority Muslim nation is deepening political, ethnic and religious divisions in a nation that's struggling to move forward.

Proof of that is the increased use of an age old sedition act, which outlaws speech which is deemed to incite unrest or insult the Muslim majority. About 40 people, including one of Anwar Ibrahim's lawyers have been charged or convicted this year.

ERIC PAULSEN: The sedition act, it's 1948, it's obviously archaic and out of place in any modern democracy.

SAMANTHA HAWLEY: You've got many books.

ANWAR IBRAHIM: I've been 30, 40 years of collection.

SAMANTHA HAWLEY: For Anwar Ibrahim a mental shift back to a prison cell is already under way and it will be reading that sustains him.

(Speaking to Anwar Ibrahim) You spoke when you were released from jail last time about how much you read while you were in there, particularly Shakespeare. How did that help you with the process, I suppose, of being confined?

ANWAR IBRAHIM: In the six years of solitary confinement I had a chance to reread with copious notes 4.5 times, the entire collected works of Shakespeare. And I think it's a phenomenal task and it's a great success and it gives me so much of, not only the intellectual, but also spiritual satisfaction.

SAMANTHA HAWLEY: Around the kitchen table the family gather to watch raw footage taken in their home by the ABC in 1999, just before Anwar Ibrahim was sentenced to six years jail when his children were still young.

Anwar Ibrahim's wife, his daughters and son have never seen the vision before.

(Talking to the family) How does it feel watching that?

DAUGHTER: I think it's still very meaningful to look at those years and realise that we survived. All of us.

There were days, you know, you didn't get the footage in prison and the footage in prison were much more melodramatic. It was very meaningful. Very sad. Poor mamma.

SAMANTHA HAWLEY: The Malaysian government led by prime minister Najib Razak says it won't be commenting on the case until after the verdict is delivered, which could be as early as tomorrow.

ANWAR IBRAHIM: Well at my age I'm going to go again the ordeal for the third time, two years and six years of solitary confinement and now of course it is not easy, I mean no one would choose to do that.

Peguambela Tan Sri Gopal Sri Ram dalam perbicaraan di Mahkamah persekutuan Putrajaya hari ini menimbulkan isu kredibiliti dan kelakukan Mohd Saiful Bukhari Azlan yang mendakwa dirinya diliwat Datuk Seri Anwar Ibrahim.

Beliau mempersoalkan kehadiran gel KY Jelly, yang dikatakan digunakan dalam kejadian berkenaan dan ditandakan sebagai bahan bukti di Mahkamah Tinggi.

Gopal berhujah, seseorang yang tidak ingin diliwat tidak akan membeli pelincir berkenaan.

Menurutnya, Saiful telah memberi keterangan bahawa mereka melakukan perbuatan itu (liwat) di atas karpet dan memakai gel itu di bahagian duburnya.

Gopal menunjukkan satu dokumen yang tiada dalam rekod rayuan, dan berkata, ‘keadaan barang kes (senarai barang yang dirampas) tidak termasuk KY Jelly itu’. Ini, katanya, menunjukkan keterangan Saiful yang tidak konsisten.

Gopal berkata KY Jelly muncul semasa pemeriksaan utama oleh pihak pendakwa ke atas Saiful. Peguambela itu berkata jika bahan pelincir merupakan satu bahan bukti yang penting, pegawai Penyiasat, DSP Jude Pereira tidak akan menyerahkannya kepada Saiful pada 28 Jun (2008), hanya untuk Saiful memberikan kembali kepada pegawai polis yang lain pada hari berikutnya.

Gopal berkata keterangan Saiful bahawa dia berada dalam kesakitan dan telah menyimpan air mani di dalam dubur selama beberapa hari turut meragukan, lapor Malaysiakini.

Semasa dalam pemeriksaan balas, katanya, Saiful mendakwa diminta oleh Anwar untuk memakai KY jelly pada duburnya. Dalam perbicaraan tertutup kemudiannya, Saiful mendakwa berada dalam kesakitan di dubur dan perut.

Menurut Gopal, kehadiran gel itu menimbulkan keraguan dan kekurangan kredibiliti terhadap Saiful. Gopal mengatakan jika gel itu telah digunakan, Saiful tidak akan mengalami kesakitan.

Beliau turut mempersoalkan pelakuan Saiful yang tidak ke tandas selama dua hari dan dilihat berada di rumah Anwar pada hari berikutnya selepas kejadian liwat dikatakan berlaku. Beliau menyerahkan gambar Saiful yang dirakamkan di rumah Anwar. 

Bagaimanapun,Ariffin berkata gambar itu tidak dikemukakan sebagai bahan bukti dan meminta Gopal berhujah sama ada gambar tersebut boleh diterima sebagai bahan bukti atau sebaliknya.= keadilandaily

Defence mauls Saiful’s credibility...

The first day of Datuk Seri Anwar Ibrahim's sodomy appeal today saw the defence punching holes in the credibility of the complainant, Mohd Saiful Azlan Bukhari, to make the case that the opposition leader should have been acquitted without his defence being called. 

Anwar's lead counsel Datuk Seri Gopal Sri Ram tried to persuade the Federal Court today of weaknesses and inconsistencies in Saiful's testimony, saying that the prosecution's entire case would collapse if the court agreed that he was a discredited witness.

Any other evidence, including medical findings, would then be rendered useless.

The High Court had accepted Saiful's evidence, and judge Datuk Mohamad Zabidin Mohd Diah had only acquitted Anwar at the close of the defence case on grounds that the court could not be "100% certain" on the integrity of samples taken from Saiful for DNA testing.

The lower court found that the exhibits could have been compromised before they were handed over to a chemist.

A three-man bench in the Court of Appeal led by Datuk Balia Yusof Wahi convicted Anwar on March 7 this year, setting aside the acquittal by the High Court in early 2012.

Today, Sri Ram, a retired Federal Court judge, said both the High Court and the Court of Appeal were wrong in accepting Saiful's evidence.

"The Court of Appeal did not reevaluate the evidence of Saiful. In any event, his evidence was not corroborated," Sri Ram told the five-man Federal Court bench led by Chief Justice Tun Arifin Zakaria.

Sri Ram, who was roped in at the eleventh hour to replace lawyer Datuk Sulaiman Abdullah, said the trial judge had erred in accepting Saiful's explanation on why it took him two days to make a police report after the alleged sodomy.

Saiful had said that he was afraid for his safety.

Instead, Sri Ram submitted today, Saiful had met Anwar the day after the alleged crime for a discussion and a tea session.

"Seen in a photograph below, Saiful's demeanour hardly looks like a person who is under threat or someone forcefully sodomised 24 hours before," Sri Ram told the court.

He also questioned why Saiful did not complain as soon as possible after the incident, or why he did not seek help if indeed he was sexually assaulted.

Sri Ram said Saiful should have been treated as an accomplice as he was an active participant if such an alleged incident did take place, but the lower court did not make such findings.

"As an accomplice, Saiful cannot corroborate himself. The trial judge failed to ask the right questions and instead wrongly treated his evidence as corroboration," he added.

He said it was Saiful who had introduced a bottle of lubricant when giving testimony during the trial, but the sex aid had never been on the prosecution's initial list of exhibits.

"The absence of the lubricant from the list casts serious doubt on the credibility of Saiful and the entire investigation," he said.

Sri Ram said Saiful told the trial court that the sexual act "was vigorous and fast" and that he suffered pain.

"If that is the case, a lubricant could not have been used because the very object of it is to facilitate penetration without pain," he said.

He said medical evidence confirmed that there was no trauma or injury found on Saiful's anus.

Anwar is accused of committing the offence at a unit of the Desa Damansara condominium in Bukit Damansara, between 3.10pm and 4.30pm, on June 26, 2008.

Anwar, 67, who was sentenced to five years' jail by the Court of Appeal, is now on RM10,000 bail in one surety.

The prosecution has also filed a cross-appeal for a higher jail sentence against Anwar which is up to 20 years.

Anwar's political career as an elected representative will be over as he will be disqualified from office, should his conviction be sustained and he is fined more than RM2,000 or jailed more than a year, and he does not receive a free pardon.

The defence team ended their submissions today with lawyer N. Surendran telling the court of evidence that emerged during the trial which showed that the sodomy charge against Anwar was a political conspiracy.

The claim of conspiracy was made by Anwar in statements from the dock, which Surendran said the High Court and Court of Appeal did not give adequate weightage to.

The defence will resume tomorrow with their submission on the relevance and weight of an accused's statement from the dock. - tmi

Only Saiful among Malaysians had the opportunity to meet with Najib at the DPM residence to discuss personal matter with Najib. Najib confirmed that the meeting took place,( two days before Saiful said that he was raped by Anwar,) to discuss Saiful's application for a government scholarship. That raises many questions.

Najib as DPM then was not concurrently the Minister of Education nor the Minister for Higher Education. Clearly he had no official responsibility to approve scholarship to any person even if that person had shown merit for a scholarship award. Saiful was not known to be a scholar, Why did Najib meet Saiful if not for reasons other than that mentioned? So it was a meeting to implement a scheme against his political opponent to whom Saiful could have the convenience to carry out. Being Anwar's assistant, Saiful could have tea with Anwar in private, and he conveniently claimed that he had participated in an act of sodomy with Anwar.

Saiful claimed that he was raped. If the prosecution believed that Saiful was raped, why did not Anwar charged for raping Saiful? Clearly the prosecution did not believe that this could happen. Najib said that Saiful had a right to justice. To seek justice, Anwar should be charged for raping Saiful. But the AG office knew that the story was unbelievable. So najib was trying to cover up his intention.

Then it was consensual sodomy; why should Anwar be charged and punished based on the law but Saiful is free? There is no law in the land, not even the "Whistle Blower Act" would allow a person committing crime to be above the law if he gave evidence against his accomplice. So Saiful is given special protection because he brought down Najib's political opponent? That is making use of the law of the land for political gain. Is Malaysia a land where the laws are to be used selectively based on political party affiliation? - loh333

Mahkamah Persekutuan melanjutkan pendengaran kes rayuan Ketua Pembangkang Datuk Seri Anwar Ibrahim sehingga tiga hari disebabkan jumlah penghujahan yang dikemukakan barisan peguam bela.

Pendengaran yang bermula hari ini akan bersambung sehingga Khamis, kata Ketua Hakim Negara Tun Ariffin Zakaria sebelum menangguhkan sesi rehat tengahari.

Peguam utama Anwar yang juga bekas hakim mahkamah persekutuan Datuk Seri Gopal Sri Ram sepanjang pagi tadi mengemukakan hujah bagi membuktikan pengadu kes liwat, Mohd Saiful Bukhari Azlan bukan saksi yang boleh dipercayai.

Selain Sri Ram(gambar bawah), peguam lain yang akan mengemukakan hujah kes adalah Ramkarpal Singh, Sangeet Kaur Deo dan N Surendran.

Pihak pendakwa yang diketuai Tan Sri Muhammad Shafee Abdullah akan mengemukakan hujah selepas pihak pembelaan, kemudian diikuti hujah akhir oleh kedua-dua pihak sebelum pendengaran berakhir.

Shafee ketika ditemui pemberita semasa sesi rehat berkata, beliau menjangkakan lanjutan itu kerana hujah panjang lebar dan jumlah kertas kerja yang perlu diteliti.

"Kami mendengar hujah mereka. Seperti dijangka, kami perlu mengemukakan jawapan balas.

"Mahkamah akan dilanjutkan sehari lagi sehingga Khamis, dan kemungkinan sehingga Jumaat," katanya di luar mahkamah.

Lima panel hakim mendengar rayuan Anwar, diketuai Ariffin, serta Tan Sri Raus Sharif, Tan Sri Abdul Hamid Embong, Tan Sri Suriyadi Halim Omar dan Datuk Ramly Ali.

Barisan peguam bela Anwar diketuai Sri Ram, serta 14 peguam lain.

Pada Januari 2012, Mahkamah Tinggi membebaskan Anwar daripada dakwaan meliwat Saiful di sebuah apartmen di Damansara pada Jun 2008.

Anwar, 67, dikenakan hukuman penjara lima tahun oleh Mahkamah Rayuan, tetapi mendapat penangguhan sehingga keputusan rayuan di Mahkamah Persekutuan.

Sri Ram pada awal tadi mengemukakan beberapa kesilapan bukti dan testimoni Saiful yang tidak konsisten sepanjang perbicaraan.

Anwar memberitahu wartawan di luar mahkamah bahawa dirinya yakin akan dibebaskan berdasarkan fakta dan undang-undang.

Court extends hearing for Anwar’s appeal until Thursday...

The Federal Court has extended the hearing for Datuk Seri Anwar Ibrahim's sodomy appeal from two to three days because of the volume of submissions by the defence. 

The hearing, which began today, would now continue until Thursday, Chief Justice Tun Arifin Zakaria said, before adjourning the court for a mid-day break.

Anwar's lead counsel, retired Federal Court judge Datuk Seri Gopal Sri Ram(pix,below), had spent the morning making submissions to show that sodomy complainant Mohd Saiful Bukhari Azlan, 29, was not a credible witness.

Besides Sri Ram, other lawyers who will be submitting for Anwar are Ramkarpal Singh, Sangeet Kaur Deo and N. Surendran.

The prosecution, led by Tan Sri Muhammad Shafee Abdullah, will submit after submissions from the defence, and this will be followed by final arguments by both sides before the hearing ends.

Shafee told reporters during the court's recess that he expected a reserved judgment because of lengthy submission and amount of paperwork to go through.

"We are listening to their submissions. It is something expected, so we have the answers.

"The court will extend one more day as indicated to Thursday, and possibly even Friday," Shafee said outside the courtroom.

A five-member bench is hearing Anwar's appeal, led by Arifin. Others on the bench are Tan Sri Raus Sharif, Tan Sri Abdul Hamid Embong, Tan Sri Suriyadi Halim Omar and Datuk Ramly Ali.

Anwar's defence team is led by Sri Ram and comprises of 14 lawyers.

In January 2012, the High Court, following a lengthy trial, acquitted Anwar of the charge after calling for his defence. He was charged with sodomising Saiful at an apartment in Damansara on June 26, 2008.

Anwar, 67, was sentenced to five years' jail by the appellate court but has obtained stay of execution pending the outcome of his appeal in the Federal Court.

Sri Ram had earlier submitted on the trial's mishandling of evidence and the inconsistencies in Saiful's testimony.

Anwar had told reporters waiting outside the court earlier that he was optimistic about an acquittal based on facts and the law.

The K-Y jelly lubricant allegedly used on Mohd Saiful Bukhari Azlan was the subject of scrutiny in the sodomy II appeal at the Federal Court today.

Senior lawyer and former Federal Court judge Gopal Sri Ram (left) said the use of the lubricant was not mentioned in Saiful's police report against Anwar.

He further submitted that the K-Y jelly was not on the list of exhibits by the police on items seized from Saiful.

"Saiful alleges the sodomy incident was done on a carpet. He admitted that the lubricant was used and placed on his anus.

"Saiful complained that the sodomy action was rough (rakus) and he had pain in his anus or stomach. If a lubricant is applied he should not have suffered the pain," he said.

He added that if the court believes Saiful's testimony on this, "we can believe the moon is made of green cheese".

Gopal further questioned Saiful's testimony where the alleged victim claimed he handed the lubricant to investigating officer DSP Jude Blacious Pereira on June 28.

"Jude (right) handed the lubricant back to Saiful and the next day Saiful went to the police station to hand it over to the police," he added.

The senior lawyer said this proved that Saiful's testimony cannot be trusted.

Gopal was submitting on the first of his three points.

Saiful's demeanour questioned

The former Federal Court judge also questioned Saiful's demeanour and conflicting testimony.

He pointed out that the former aide said he drafted a resignation letter immediately after the sodomy incident.

However, Saiful appeared the next day at Anwar's house and even had his photograph taken.

"His demeanour was normal and inconsistent to the case of alleging he was violently sodomised 24 hours earlier," he said.

The photograph of Saiful (right) serving tea was not earlier tendered as evidence during trial.

However, Gopal sought that it be included as Saiful had agreed he was there as depicted in the picture.

The defence lawyer further said the evidence from Hospital Kuala Lumpur doctors cannot be accepted as Saiful first went to Pusrawi Hospital.

"The first complaint was made at the Pusrawi Hospital and the prosecution did not call Dr (Mohamad) Osman (Abdul Hamid).

"The evidence in HKL does not amount to corroboration,” he said.

"Only (the) first complaint can be used for corroboration and not the subsequent complaint," Gopal said.- mk

Ribuan mahasiswa dan penyokong PKR merempuh pintu pagar Universiti Malaya membolehkan mereka memasuki kampus itu bagi mengikuti pidato Ketua Umum PKR Datuk Seri Anwar Ibrahim.

Mereka merempuh pintu pagar Kuala Lumpur yang berkunci dan dirantai oleh pihak keselamatan sambil melaungkan "buka, buka" dan kemudiannya memasuki kawasan kampus.

Kemudian, mereka berhentikan berarak ke Dewan Tunku Canselor kira-kira 200 meter dari pintu pagar bagi menunggu ketibaan Anwar.

Sementara itu, kira-kira jam 9.40 malam Anwar bersama keluarganya sampai dengan menaiki sebuah pacuan empat roda dan mereka mula berarak ke Dewan Tunku Canselor.

Menyampaikan ucapan atas pacuan empat roda itu di depan dewan itu, Presiden Persatuan Mahasiswa Universiti Malaya Fahmi Zainol mencerita sejarah perjuangan mahasiswa UM untuk rakyat.

Beliau juga bersedia berdepan tindakan displin daripada pentadbiran universiti selepas ini. 

Prof Madya Dr Azmi Sharom turut sama kelihatan cuba berunding dengan pengawal agar mereka dibenarkan masuk ke dalam universiti. 

"Saya tahu pihak UM marah dengan saya. Saya sedia menerima hukuman termasuk dibuang universiti," katanya.

Kemudian, Anwar pula memulakan ucapannya dengan mempersoal pentadbiran kampus mahu menghalang beliau berucap di kampus itu

"Saya dihina dan dikeji 16 tahun. Apa salah saya datang bercakap di sini?" katanya sambil mengucap terima kasih dan tahniah kepada Fahmi dan pelajar UM.

Dalam ucapannya juga Anwar yang juga ketua pembangkang berharap pertuduhan berhubung kes liwat terhadapnya dilucutkan

"Saya wajib dibebaskan dengan menggunakan undang-undang hak asasi yang ada. Sheikh Al-Qardawi utus kenyataan kepada Anwar supaya lucutkan pertuduhan ke atas saya.

"Saya masih menaruh harapan hakim lucutkan pertuduhan kepada saya," katanya sambil memuji Fahmi Zainol kerana memilih untuk melawan.

MP Permatang Pauh itu juga menyifatkan para mahasiswa sebagai "suara kesedaran" kerana berani menentang ketidakadilan.

Menyimpulkan ucapannya, kira-kira jam 10.30 malam, bekas timbalan perdana menteri itu memegang dan mengangkat tangan Fahmi sambil menyifatkannya sebagai harapan negara.

Sebelum itu, keadaan hujan rintik-rintik mereka berkumpul di situ memandangkan pihak keselamatan kampus menutup pintu masuk ke kampus perdana untuk sebarang lalu lintas.

Ada juga di kalangan mereka membuka payung masing-masing.

Pentadbiran kampus itu tidak membenarkan pidato anjuran Persatuan Mahasiswa Universiti Malaya itu kerana tiada permohonan dibuat.

Antara pemimpin yang dilihat hadir MP Petaling Jaya Selatan Hee Loy Sean bersama beberapa penyokong PKR menaiki sebuah kereta dan  memasang sistem audio.

Turut kelihatan ADUN Kuala Sepetang Chua Yee Ling, ADUN Rawang Gan Pei Nie, Ketua Solidariti Anak Muda Malaysia Badrul Hisham Shahrin, aktivis siswa Safwan Anang dan pensyarah Dr Azmi Sharom sebagai pemantau.

Mahasiswa dan penyokong Anwar turut melaungkan "student power" dan "hidup rakyat" sambil meminta pihak keselamatan membuka pintu pagar.

Ini kerana kelihatan sekumpulan pelajar dilarang meninggalkan kawasan kampus menyebabkan siswa yang di luar pintu pagar melaungkan:

"Lepaskan mereka, mereka juga mahu bersama dengan kami," kata mereka.

Students storm locked UM gates for Anwar talk...

More than a thousand students and activists stormed Universiti Malaya's Kuala Lumpur gate to attend a talk by Opposition Leader Anwar Ibrahim there.

The students broke the gate, which was locked and chained by the university security personnel, while chanting "Buka, buka" (Open, open).

They then started marching to Dewan Tunku Canselor, where the talk that has been barred by UM is scheduled to be held.

The students marched alongside Anwar, who arrived at 9.40pm on a four-wheel drive vehicle with his family.

Speaking from the vehicle in front of Dewan Tunku Canselor, UM student council president Fahmi Zainol.

"I know UM is angry with me. I am willing to face disciplinary action, including expulsion from university," he said.

UM had earlier threatened the expel him, after the council refused to cancel the event.

Anwar meanwhile, started his speech by questioning his alma mater's decision to block him from speaking.

"I have been derided and maligned for 16 years. What's wrong with me speaking here?" he asked.

UM student affairs department had at 6pm today sent an email to students barring them from the talk titled 'Anwar Ibrahim: 40 Years from UM to Prison' organised by the student council.

Security had locked the gates and blocked entrance to the campus to all non-Universiti Malaya staff and students.

As a result, students on campus are barred from joining the crowd outside.

Spotted among the crowd is UM law lecturer Azmi Sharom, who said he is there as an observer.

'Good sign for democracy'

Meanwhile, in Petaling Jaya, PKR deputy president Azmin Ali said the students' courage in standing up to university officials is a "good sign for the country to achieve democracy".

He was echoed by civil society group Negara-Ku patron Ambiga Sreenevasan (right) who said when youths stand up for their rights, it is a signal of "real change".

She said that the government likes to use "chaos" as an excuse for not exacting change, like not fulfilling its promise to repeal the Sedition Act.

Snidely, she said other "create" chaos by storming legislative assemblies and threatening to burn holy books so it seems that repressive laws are needed.

"Has there any chaos in this country? The answer is no. Only the government is using this line. If there is no chaos, there is no justification for sedition act."

The launch of the book 'Detention without Trial: The Ugly Side of the Draconian Law', on Saari's time detained under the Internal Security Act was also attended by PAS deputy president Mohamad Sabu and DAP secretary-general Lim Guan Eng.

Anwar was due to attend the event in Petaling Jaya, which is also a fundraising dinner for Gerakan Hapus Akta Hasutan (GHAH), but was represented by daughter and PKR veep Nurul Izzah Anwar instead.

Instead, the Permatang Pauh MP attended a rally in Stadium Mini 3k in Subang Jaya which attracted about 600 supporters.

Speaking at the rally, DAP's Subang Jaya assemblyperson Hannah Yeoh said that sending Anwar to jail for another five years for sodomy is not justice served.

In comparison, she said that former Selangor Menteri Besar Mohd Khir Toyo was sentenced to 12 months in jail for corruption.

"Even if Anwar goes to jail, the struggle does not end here. You put one person in jail, 10,000 will rise up."
