Will Najib block the hudud bill...


The hudud bill was one of the burning issues raised during the meeting between Prime Minister Najib Abdul Razak and BN component party leaders in Parliament yesterday.

The leaders had reached a consensus that hudud was against the federal constitution.

"Najib also acknowledged this consensus that hudud would be against the federal constitution," a BN component party leader told Malaysiakini on condition of anonymity.

However, a mere consensus leaves much room for interpretation as seen in Pakatan Rakyat's agreement which fell apart after PAS unilaterally bulldozed the theocratic law.

Even the BN leader did not wish to interpret any further than what was said, stressing that the BN component parties had already made it clear that the current civil criminal code is sufficient.

However, another BN component party leader, who spoke on condition of anonymity, saw this as an assurance that Najib would not allow hudud to see the light of day in Parliament.

They said the prime minister also agreed to issue a statement soon, which would reveal his stand.



Balancing act for Najib

Najib, who is also BN chairperson, must not only juggle his coalition partners but also Umno which has taken a stance opposite of what the BN components want.

For example, Umno supreme council Ismail Sabri today told BN component parties to butt out, and defended the 12 Umno state assemblypersons who had voted in favour of amendments to the Kelantan Syariah Criminal Code (II) 1993 which forms the basis of hudud.

PAS has already initiated what it believes is the final hurdle to implement hudud by submitting a notice to table a private member's bill in Parliament this session.

The bill seeks to amend the Syariah Courts (Criminal Jurisdiction) Act 1965, which currently limits punishments imposed by the syariah court to no more than three years imprisonment, a fine of up to RM5,000 and six strokes of the rotan for certain offences.

Removing the limits would allow the syariah court to mete out punishments according to Kelantan's hudud legislation, which among others, includes stoning to death and up to 80 lashings.

If Najib were to cave in to BN component leaders, he could simply do nothing as a private members' bill is normally queued behind a long list of government bills and do not surface.

But if he were to bow to Umno's demands, then the amendment would eventually come up for a vote in Parliament, whether in this session or the next.

This would likely put both coalitions in an awkward situation and strain ties between the Muslim and non-Muslim parties.

Alternatively, Najib could still let Umno have its way for a vote and wait out the legal action initiated by Gerakan and MCA to challenge the constitutionality of hudud.

A downright rejection of hudud is not an option for Najib as Umno might come across as turning its back on a Muslim obligation and lose support among Muslim voters to PAS.

Ultimately, it would be a balancing act for Najib but he is more likely to take Umno's sentiments into account as it is the party that ensures he remains prime minister.- mk



Apakah Najib akan sekat RUU hudud...

Rang undang-undang hudud menjadi salah satu isu panas yang dibangkitkan semasa pertemuan di antara Perdana Menteri Datuk Seri Najib Abdul Razak dengan pemimpin parti komponen BN di Parlimen semalam.

Para pemimpin terbabit telah mencapai kata sepakat bahawa hudud bercanggah dengan Perlembagaan Persekutuan.

 
Najib juga mengakui kata sepakat itu bahawa hudud akan bercanggah dengan Perlembagaan Persekutuan, kata seorang pemimpin parti komponen BN kepada Malaysiakini tetapi tidak mahu namanya disiarkan.

Bagaimanapun, kata sepakat semata-mata masih mempunyai banyak ruang untuk pentafsiran seperti yang dilihat dalam perjanjian Pakatan Rakyat yang berkecai selepas PAS tetap mahu melaksanakan hukum jenayah syariah itu.

Malah pemimpin BN tersebut tidak mahu membuat sebarang tafsiran lanjut mengenainya, dengan menekankan bahawa parti komponen BN telah pun menyatakan dengan jelas bahawa kanun jenayah sivil sekarang sudah mencukupi.

Bagaimanapun, seorang lagi pemimpin parti komponen BN, yang tidak mahu disebut namanya, melihat ini sebagai jaminan bahawa Najib tidak akan membenarkan ia menjadi kenyataan di Parlimen.

Mereka berkata perdana menteri juga bersetuju untuk mengeluarkan satu kenyataan tidak lama lagi, bagi menyatakan pendiriannya.

Najib, yang juga pengerusi BN, bukan sahaja mesti mengimbangi rakan komponen tetapi juga Umno yang telah mengambil pendirian bertentangan dengan apa parti komponen BN mahu.

PAS telah pun mengemukakan notis untuk membentangkan rang undang-undang persendirian berhubung dengan hudud dalam sidang Dewan Rakyat sekarang.

Rang undang-undang ini bertujuan meminda Akta Mahkamah Syariah (Bidang Kuasa Jenayah) 1965, yang kini menghadkan hukuman yang dikenakan oleh mahkamah syariah - penjara tidak lebih tiga tahun, denda sehingga RM5,000 dan enam sebatan bagi kesalahan tertentu.

Dengan menukar had tersebut, ia akan membolehkan mahkamah syariah menjatuhkan hukuman mengikut undang-undang hudud di Kelantan, yang antara lain, termasuk direjam sehingga mati dan sehingga 80 sebatan. - mk


PAS perlu dapatkan jaminan bertulis BN sokong hudud Kelantan...

PAS dinasihatkan supaya berhati-hati dengan taktik Umno dan perlu mendapatkan jaminan bertulis daripada Barisan Nasional (BN) yang mereka akan mengundi dan menyokong rang undang-undang persendirian hudud sebelum membawanya ke Parlimen, kata Rafizi Ramli.

Setiausaha agung PKR itu berkata, ini penting untuk memastikan tiada muslihat dan tipu daya daripada Umno yang pernah memangsakan PAS dengan menendang parti itu keluar BN pada 1977.

Katanya, kepimpinan PAS dan rakyat perlu berhati-hati dan waspada dengan muslihat Umno dan BN yang menggunakan ketaatan orang Islam terhadap hukum Allah sebagai muslihat politik.

"Saya menasihati pimpinan PAS supaya mendapat jaminan bertulis mengenai sokongan daripada Umno dan parti komponen BN lain seperti PBB (Parti Pesaka Bumiputra Bersatu) terhadap cadangan rang undang-undang persendirian mengenai kuasa Mahkamah Syariah terlebih dulu sebelum memutuskan untuk membawanya," katanya dalam satu kenyataan hari ini.

Ahli Parlimen Pandan itu juga menggesa Perdana Menteri Datuk Seri Najib Razak dan timbalannya,Tan Sri Muhyiddin Yassin menyatakan sokongan secara terbuka dan bertulis terhadap hudud di Kelantan dan berjanji akan mengundi rang undang-undang persendirian itu jika dibawa ke Parlimen.

Rafizi yang juga naib presiden PKR itu berkata, Najib dan Muhyiddin perlu mengeluarkan arahan segera secara bertulis agar setiap ahli Parlimen Umno dan parti komponen BN lain yang beragama Islam wajib menyatakan sokongan.

"Setakat ini, tiada satu kenyataan pun daripada Najib menyatakan sokongan dan arahan kepada ahli Parlimen Umno dan BN untuk menyokong cadangan rang undang-undang persendirian mengenai kuasa Mahkamah Syariah itu.

 "Saya khuatir Najib hingga ke akhirnya tidak akan membuat kenyataan. Malah saya juga waspada Umno dan BN tidak akan mengeluarkan sebarang arahan agar setiap ahli Parlimen beragama Islam menyokong rang undang-undang persendirian itu jika dibawa ke Parlimen," katanya yang juga naib presiden PKR.

Katanya, Umno dan BN akhirnya akan terus menggunakan isu hudud ini untuk memecahkan Pakatan Rakyat (PR) dan memastikan mereka kekal berkuasa dalam Pilihan Raya Umum ke-14 (PRU14) akan datang.

"Jika itu berlaku, hudud tidak akan terlaksana dan rakyat akan terus dimangsakan akibat salah tadbir, penyelewengan dan budaya rasuah yang dibawa Umno dan BN," katanya.

Rafizi berkata, setakat ini hanya Umno Kelantan yang menyuarakan sokongan terhadap hudud, namun kenyataan yang dibuat oleh ahli Parlimen Umno dan BN lain mengelirukan dan bertentangan antara satu sama lain.

Pengerusi Kelab Penyokong Kerajaan (BNBBC), Tan Sri Shahrir Samad dilaporkan berkata, tidak ada arahan dan menganggap pendirian ahlinya menyokong hudud sebagai keputusan peribadi.

Kenyataan itu disanggah pula oleh Ahli Parlimen Pulai, Datuk NurJazlan Mohamad semalam dilaporkan berkata, pembangunan Islam sepatutnya diberi keutamaan oleh PAS Kelantan berbanding hudud.

"Mana-mana rang undang-undang persendirian yang dibawa ke Parlimen, yang bertentangan dengan Perlembagaan akan ditolak oleh speaker secara automatik," katanya yang juga Pengerusi Kira-Kira Wang Negara (PAC).

Presiden PBB Tan Sri Adenan Satem secara terbuka menyatakan parti itu akan menolak hudud di peringkat negeri Sarawak atau dan pusat kerana mempunyai pandangan berbeza mengenai Islam.

"Hakikatnya, tidak ada seorang pimpinan tertinggi Umno atau BN pun yang membuat kenyataan terbuka dan jelas mengenai pendirian mereka berkenaan Rang Undang-undang Persendirian," kata Rafizi. – tmi

Get written BN guarantee on hudud...

Pandan MP Mohd Rafizi Ramli is urging members of the public to pressure BN leaders into providing a written undertaking to support the upcoming private member’s bill on syariah criminal law.

They - BN chairperson Najib Abdul Razak and his deputy Muhyiddin Yassin - should also give written instructions to BN parliamentarians to vote in favour of the bill when it is tabled first.

If a commitment is not forthcoming, he said Umno and BN would use the hudud issue to break up Pakatan Rakyat.

“If that happens, the implementation of hudud would fail and the people would continue to be victimised by Umno and BN’s poor governance, embezzlement, and culture of corruption,” he said in a statement today.

The PKR secretary-general also urged PAS leaders not to table the bill until it has obtained a written guarantee from BN and its component parties to support the bill.

“This is important to ensure that there is no deceit from Umno and BN, which had victimised PAS before by booting it from BN in 1977,” he said.

Rafizi (left) was referring to the 1977 Kelantan Emergency, where PAS was expelled from BN after its MPs voted against a law that would give the federal government emergency powers in Kelantan, following violent protests and looting in the state.

He pointed out that to date, BN representatives are giving conflicting statements about whether they would support the private member’s bill, in absence of a directive.

Yesterday, the Kelantan state assembly had unanimously approved amendments to its Syariah Criminal Code II 1993, which spells out offences and punishments based on an interpretation of Islamic law.

Its next hurdle is to push for an amendment to the Syariah Courts (Criminal Jurisdiction) Act 1965 to enable the implementation of the new law, which PAS president Abdul Hadi Awang intends to do during the current sitting.

The upcoming amendment would lift limits on the severity of punishments that can be meted out by the Syariah Court, and thus allowing it to impose punishments that include stoning to death as stipulated under the Kelantan law. - mk
