Jib nak saman Tony Pua pasai 1MDB...


Perdana Menteri Datuk Seri Najib Razak hari ini menghantar surat tuntutan kepada Tony Pua ekoran kenyataan yang dibuat terhadapnya pada 3 November mengenai 1 Malaysia Development Bhd (1MDB) yang disifatkannya sebagai 'sangat tertekan dan memalukan'.

Dalam surat yang ditandatangani peguamnya Datuk Mohd Hafarizan Harun, Pua diminta menyiarkan penarikan balik kenyataan itu dan memohon maaf dalam masa 14 hari dalam dua akhbar nasional atau menghadapi tindakan saman ekoran ucapannya yang dirakamkan pada 3 November bertajuk "Tony Pua: Najib is creating the biggest scandal ever in the history of Malaysia."

Ahli Parlimen Petaling Jaya Utara itu juga diminta mengeluarkan video itu dari Internet, hentikan sebarang kenyataan fitnah dan membayar sejumlah wang pampasan kepada Najib.

Hafarizam berkata, kenyataan Pua dalam video itu "bermaksud dan membawa maksud" Najib tidak layak menjadi perdana menteri dan pemimpin Barisan Nasional, menimbulkan skandal terbesar dalam sejarah Malaysia; bersikap kejam, kuku besi dan tidak boleh dikritik, serta zalim dan menindas rakyat.

"Arahan anak guam kami adalah kenyataan fitnah dan yang serupa dengannya membawa kepada tuduhan yang serius dan/atau fitnah terhadap anak guam kami dan menyebabkannya berasa malu dan menerima tekanan hebat," menurut surat itu.

Video itu mengandungi ucapan Pua mengenai isu kontroversi 1MDB semasa majlis makan malam kutipan dana pada 3 November.

Menurut transkrip dalam surat itu, Pua berkata:

"Inilah masalah Barisan Nasional. Tiada siapa yang berani bantah perdana menteri, dan Najib sekarang seperti raja. Raja yang menimbulkan skandal terbesar dalam sejarah Malaysia. Besar! Tiada siapa yang berani bersuara, tiada, sama ada pemimpin MCA atau Gerakan atau pemimpin Umno.

"Amat memalukan skandal milik 100% entiti menteri kewangan dengan lembaga penasihat dipengerusikan perdana menteri sendiri tidak mampu menyerahkan akaun tepat pada masanya terutamanya apabila syarikat besar dan menjadi tumpuan dengan hutang 36 bilion.


"Hanya satu sebab ini boleh berlaku. Sebabnya adalah semua MCA, MIC, Gerakan tidak berani mencabar perdana menteri mereka sendiri, semuanya kata okay okay terima kasih, teruskan dan rompak duit rakyat."


Peguam Najib berkata, Pua mengeluarkan kenyataan sama "berulang kali" dan terus menyiarkannya dalam beberapa forum, portal berita, media sosial dan media online.

"Berbeza dengan kenyataan fitnah diatas, anak guam kami sebagai pengerusi Lembaga Penasihat 1MDB hanya memberi nasihat kepada Lembaga Pengarah 1MDB yang ditugaskan mengurus dan mengendalikan 1MDB, bukannya zalim dan menindas serta autokratik dan tidak terbuka kepada kritikan, bukan pemimpin yang terlibat dengan korupsi dan bukan pemimpin yang merompak duit rakyat.

"Sewajarnya, dakwaan tidak berasas dan salah anda dengan tujuan utama mahu menyerang dan merosakkan nama baik serta reputasi anak guam kami tanpa sebab kukuh.

"Oleh demikian, tindakan anda itu berniat jahat," menurut surat itu.

Surat itu menyatakan jika Pua gagal mengemukakan jawapan balas yang memuaskan hati, tindakan undang-undang akan dimulakan terhadapnya "termasuk permohononan injuksi menghalang sebarang penerbitan lanjut."

Pua memberitahu The Malaysian Insider peguamnya, Gobind Singh sedang meneliti perkara itu dan akan memberikan respons sewajarnya.

Tambahnya, media TV3 juga hadir bersama wakil firma guaman Najib ketika menyerahkan surat kepada kakitangannya hari ini, namun beliau tidak ada di pejabatnya.

Hafarizam ketika dihubungi mengesahkan surat itu sudah dihantar ke pejabat Pua, namun menafikan pihaknya menjemput media datang bersama.

"Saya hanya suruh penghantar surat serahkan surat itu, seperti penghantar surat yang lain mereka menaiki motosikal. Tidak ada rombongan besar.

"Saya menafikan sebarang niat dan diluar pengetahuan saya ada publisiti sebegini. Hanya menghantar surat tuntutan seperti biasa," katanya.

Tambahnya, beliau masih tidak dapat lagi laporan daripada Pua yang mengesahkan sudah menerima surat tersebut. – tmi


Najib threatens to sue Tony Pua over 1MDB...

Prime Minister Najib Abdul Razak has threatened to sue DAP lawmaker Tony Pua for his remarks on the state-owned 1Malaysia Development Bhd (1MDB).

A letter of demand served on Pua this afternoon claimed that he had defamed Najib in a Youtube video.

The video, entitled: 'Tony Pua: Najib is creating the biggest scandal ever in the history of Malaysia', was recorded at a DAP fund raising dinner in Petaling Jaya on Nov 3 and uploaded by Media Rakyat.

Pua had questioned why BN component parties did not dare challenge Najib, who chairs the 1MDB board of advisors, even though the multi-billion ringgit company was late in submitting its accounts.

Among others, Najib demanded an unequivocal written apology from Pua and a retraction of the alleged defamatory statements.

The letter, which was sighted by Malaysiakini, was issued by legal firm Hafarizam Wan and Aisha Mubarak.

Contacted later, Pua confirmed his office staff had received the letter of demand.

"My lawyer, Gobind Singh Deo is looking into the matter and would respond accordingly," he said.

Najib 'distressed and embarrassed'

The letter of demand said Pua's remarks had meant that Najib was not a “competent leader; is cruel, harsh, autocratic and not open to criticism; is tyrannical and oppressive and has created the biggest scandal in the country.”

It added that the statement also carried the meaning that Najib had "conspired against the country in bad practices; is a corrupt leader, robbed and misused the people's money and abused his power."

"Contrary to your defamatory statements above, our client (Najib) being the chairman of the board of advisors of 1MDB only renders advice to the board which is tasked for the management and operation of 1MDB, not a tyrannical and oppressive autocratic who is not open to criticism and shuns criticism, not a leader involved in corrupt practices and not a leader who robs the people's monies," read the letter.

It said Pua's statement was aimed at damaging Najib's goodwill and reputation for "no justifiable reason" and had caused the prime minister "tremendous distress and embarrassment."

It added that the apology and retraction are to be published in at least two national newspapers which page and size to be determined by Najib.

Pua was also asked to cease making any similar "defamatory statements" through a written undertaking.

Najib also wanted the alleged offending video to be removed as well as a "suitable sum" in compensation.

The letter added if Pua failed to respond to Najib's demands within 14 days, legal proceedings would be initiated.

Meanwhile, Media Rakyat confirms that they had received a letter of demand from Najib’s lawyer as well.

“Najib threatens to sue Media Rakyat over the 1MDB video. We have received a letter of demand from Najib’s lawyer this afternoon,” said Media Rakyat on its website.

Anonymous_Ingrates  - Najib is peeing in his pants and sweating now. 14 days? if want to sue, go ahead lah!!!!!!! Let the shit hits the fan, the rakyat wants to knows everything and all needs to be transparent. Najib.... you better not wish what you hope for. You are surrounded by nincompoops.

Mr Malaysian  - Najib,instead of suing, why don't you just be transparent? 1MDB is of National interest. When you hide, people question, you sue! Ini macam style Gangster !! 

APA INI?  - Pick up the challenge, Tony. Malaysians want to see Najib in court - for good or for bad! Problem with corruption in Malaysia is getting at the big fish. Wish you luck and COURAGE!

Versey PM  - Najib is ill-advised. As mentioned by many, once in court, many facts and related matters that most Malaysians ( the kampong folks and those busy earning a living & have no time to care much about politics or national issues) would not have known will come to light. If this case were to be brought up in court, it surely will catch the attention of the international communities world wide, so even if PM Najib wins the case, it will be of no advantage to him but may even ( and most likely) be detrimental to his standing in the eyes of the world who will make their own assessment of him and the case. Don't forget that the ex-PM, Dr M, had also commented on this 1MDB. Regardless of whether people like him or not, Dr M's comments on national issue still carry some weight in the eyes of the world leaders, particularly PM Najib was recommended by him to his successor, the 5th Malaysian PM, Tun Abdullah Badawi.
