Pasai Hudud, UMNO tawar 2 jawatan Menteri kepada PAS...

Dua jawatan bertaraf menteri kepada ahli parlimen Pas...

Mungkin pihak-pihak tertentu termasuk Pas sendiri boleh menyiasat atau menafikan maklumat ini bahawa dua orang ahli parlimen Pas dijanjikan jawatan setaraf menteri kabinet sekiranya projek hukum hudud yang kini dibantu oleh Umno berjaya dengan selamatnya.

Maklumat ini sesuatu yang agak ganjil bunyinya kerana kalau ini benar, bermakna kesediaan Umno untuk menyokong perlaksanaan hukum hudud Pas di Kelantan itu dibuat bukan saja atas tanggungjawab bersama dari kontes Islam tetapi ia merupakan adalah kerjasama politik.

Ia juga dibuat bukan atas tanggungjawab agama tetapi kerana kepentingan diri dan mahukan kedudukan. Ia juga boleh dianggap sebagai hukum hudud digadai untuk mencapai kedudukan. Hal ini tidak mustahil kerana gagasan Unity Government (UG) yang diusahakan satu masa dahulu ia juga bertolak atas kepentingan diri dimana ia dilaksanakan kerana dijanjikan jawatan menteri.

Menerusi UG dahulu Pas diberi dua jawatan menteri dan dua timbalan menteri. Individu yang disebut sebagai bakal diberikan jawatan menteri ketika itu ialah "Presideng" Abdul Hadi Awang dan timbalannya, Nasharuddin Mat Isa. Adun Kok Lanas, Alwi Che Amat yang menjadi Setiausaha Politik perdana menteri Abdullah Ahmad Badawi boleh mengesahkan kerana beliau adalah mediator yang menghadiri perjumpaan dan makan tengahari wakil Pas dengan Abdullah di kediamannya di Jalan Balamy dan juga di hotel terkenal di Petaling Jaya.



Jadi maklumat terbaru diterima itu tidak mustahil kalau hal sama berlaku sekali lagi kerana individu yang disebut itu masih ada hubung kait dengan agen-agen UG sebelum ini.

Dari sumber yang boleh dipercayai, berlaku pertemuan beberapa individu dengan Muhyiddin Yassin di Kuala Lumpur sejak dua bulan lepas. Pertemuan itu juga pernah sekali melibatkan pucuk pimpinan tertinggi Pas. "Pertemuan itu bukan kebetulan, tetapi ia diatur demikian rupa," kata sumber dari sebuah kementerian.

Dua tahun lepas satu pertemuan berlaku di sebuah pulau di Langkawi yang turut sama melibatkan Dr Mahathir Mohamad, seorang bekas menteri dan seorang bekas Ketua Pengarang Kumpulan sebuah syarikat penerbitan. Muhyiddin yang sepatutnya hadir bagaimana diwakili oleh wakilnya.

Pas perlu menyiasat perkara ini bagi memastikan isu hudud yang mengghairahkan dunia ini tidak dijadikan cagaraan atau gadaian dengan kedudukan atau pun sebagai umpan untuk kepentingan individu tertentu sahaja.

Menteri Besar Kelantan Ahmad Yaakub yang merupakan arkitek pelaksanaan hudud di Kelantan dipercayai tidak mengetahui mengenai perundingan ini dan beliau hendaklah lebih waspada agar tidak tergigi lidah ketika memamah pinang kosi.- MSO@msomelayu.blogspot

Ahli Parlimen PAS setuju hudud ditangguh, tetapi terpaksa akur pendirian parti...

Walaupun PAS menyatakan dengan jelas niatnya melaksanakan hudud di Kelantan, terdapat kumpulan dalam parti itu yang menentangnya, kata seorang ahli panel dalam satu forum mengenai hukum Islam itu, malam tadi.

Ahli Jawatankuasa (AJK) PAS Pusat Mohamed Hanipa Maidin mengakui bahawa pelaksanaan hukum hudud perlu ditangguhkan‎ sehingga rakyat Malaysia benar-benar bersedia menerima undang-undang Islam tersebut.

Bagaimanapun, menurut Hanipa, ia merupakan pendapat peribadinya dan tidak mewakili pendirian PAS yang mahu pelaksanaan undang-undang Islam itu disegerakan. 

"Pandapat saya, hudud bukan merupakan keutamaan. Bagaimanapun sebagai pemimpin saya kena mempertahankan agenda politik parti," katanya pada satu forum "hudud@Malaysia?" bertempat di Dewan Perhimpunan Cina Selangor dan Kuala Lumpur (KLSCAH) di Kuala Lumpur.

Ahli Parlimen Sepang itu menegaskan pelaksanaan hukum hudud di negeri Kelantan merupakan kemahuan rakyat di negeri itu sendiri yang memberi mandat kepada PAS untuk merealisasikan undang-undang Islam tersebut.

"Hudud inilah yang dimahukan rakyat Kelantan, mereka memberi mandat kepada PAS jadi kerajaan negeri dengan menggunakan demokrasi," katanya.

Hanipa turut menangkis kritikan ‎ daripada Pengarah Eksekutif Islamic Renaissance Front (IRF) Dr Ahmad Farouk Musa, yang mendakwa pelaksanaan hudud di Kelantan bertujuan mendiamkan suara masyarakat Islam dan bukan Islam.

Hanipa yang merupakan seorang peguam, berkata PAS tidak pernah membuat keputusan melaksanakan hudud bagi mendiamkan pendapat rakyat, bahkan parti Islam itu terbuka dalam menerima kritikan daripada rakan Pakatan Rakyat (PR) sendiri.

Selain Hanipa dan Dr Farouk, forum tersebut turut menampilkan peguam, Syahredzan Johan, dan penasihat perundangan 'Save Sarawak River' Abun Sui Anyit daripada Sarawak.

Forum itu turut mendapat sambutan luar biasa apabila dewan dipenuhi dengan kehadiran kira-kira 200 orang ramai daripada pelbagai kaum dan peringkat umur.

‎Sebelum ini, The Malaysian Insider melaporkan rang undang-undang persendirian (hukum hudud) yang bakal dibentangkan PAS bertujuan mendapatkan kuasa daripada Parlimen untuk membenarkan Kelantan mewujudkan undang-undang perkara jenayah yang terletak di bawah bidang kuasa persekutuan.

Ia juga ingin meluaskan bidang kuasa Mahkamah Syariah, di mana hukuman maksima dihadkan kepada tiga tahun penjara, denda RM5,000 dan enam sebatan diganti.

Sebaliknya, ia mahu kuasa menjatuhkan hukuman bunuh, sebatan dan potong tangan bagi jenayah mengikut hudud diberikan kepada Kelantan.

Hanipa berkata, pelaksanaan hukum hudud hanya menyasarkan kepada jenayah berat sahaja.

Katanya, tahap bukti yang diperlukan adalah sangat teliti dan tidak dibuat sebarangan dalam menentukan seorang itu bersalah atau tidak.

Beliau mempersoalkan adakah dengan pelaksanaan undang-undang Islam itu dapat mengurangkan jenayah seperti didakwa PAS Kelantan.

Dr Farouk membentangkan senarai 10 negara paling selamat di dunia, tetapi Arab Saudi, negara yang mengguna pakai undang-undang hudud, berada di kedudukan ke 131.

‎"Keadilan dan kesaksamaan sentiasa menjadi mesej jelas dalam negara Islam, bagaimanapun statistik yang didedah membuktikan sebaliknya," katanya.
‎Menurut Dr Farouk, ‎daripada kerajaan Kelantan membelanjakan puluhan ribu ringgit menghantar delegasi ke Brunei bagi memahami pelaksanaan hudud, PAS perlu menghantar wakil mengkaji urus tadbir kerajaan yang baik di negara paling selamat di dunia, iaitu New Zealand.

Beliau turut mencabar pemimpin PAS untuk bertemu dengan raja dan sultan untuk mendapatkan sokongan mengenai hudud kerana golongan monarki dilihat berada di atas undang-undang.

Syahredzan pula mempersoalkan, biarpun hudud hanya tertakluk kepada masyarakat Islam dan perbicaraan hanya akan diadakan di Mahkamah Syariah, apakah negeri mempunyai kuasa perundangan untuk membicarakan kes jenayah daripada Putrajaya.


"Parlimen tidak boleh memberi kuasa kepada kerajaan negeri di mana ia akan dipisahkan kepada dua perundangan jenayah‎.," kata beliau.

Syahredzan berkata sekiranya Perlembagaan dipinda bagi membolehkan hudud dilaksanakan, ia akan mengganggu struktur asas Perlembagaan Persekutuan.

Sementara Abun daripada Sarawak berkata, rakyat Malaysia tidak bersedia dengan pelaksanaan hukum hudud kerana faktor penduduk yang terdiri daripada berbilang kaum, agama, bahasa dan budaya di negara ini. 

"‎Perjanjian yang dipersetujui Sabah dan Sarawak dalam pembentukan Malaysia akan tercemar sekiranya kerajaan persekutuan bersetuju untuk meminda Perlembagaan untuk melaksanakan hudud," katanya. – tmi



PAS’ insistence on the implementing hudud could well hand power to Umno “for the next fifty years”, as it could weaken the Pakatan Rakyat coalition Islamic Renaissance Front (IRF) director Dr Farouk Musa warned yesterday.


“We have worked very hard for a regime change in this country. And not for one moment, that is, because we love Pakatan. But, because of this issue alone, Umno will continue ruling for the next 50 years,” Farouk (left) said passionately at a panel that also featured PAS’ Sepang MP Hanipa Maidin.

Farouk, who is also deputy chairperson of electoral reforms group Bersih, told a forum on hudud in Kuala Lumpur last night that PAS should not bite “Umno’s bait”- referring to Umno’s statement that they would support the implementation of hudud in Kelantan.

He also questioned is hudud is really as “divine” as PAS makes it out to be.

“Many offences that are featured in the Kelantan hudud law do not have any basis in the Quran itself. There is no hudud mentioned for apostasy, not any for adultery. This is the work of people in interpreting God’s laws,” he said.

In fact, Farouk argued, PAS should first tell the “Kings, Malay rulers and the Sultans” that they too will be subjected to hudud punishment in a just society.

“Syariah penalties are almost never applicable in a modern society when inequality is clearly abundant.

“And when the burden of proof is so high, the victim might get prosecuted (for a false allegation) instead of the accused. Is this justice? Of course not,” he added.


Syahredzan Johan highlights the challenges that the implementation of hudud faces. He argues that the constitution would need to be amended and this would disturb the basic structure of the constitution.

Hudud 'unconstitutional'

Both Farouk and constitutional lawyer Syahredzan Johan agreed that hudud implementation would be unconstitutional in Malaysia.

This is because, according to both, having this law contradicts Article 8 of the federal constitution which states that everyone is equal before the law with the exception of matter pertaining to “personal law” such as marriage, custody, and inheritance.

“In order for PAS to smoothly implement hudud, the constitution must first be amended to state that this is an Islamic state. Our constitution is secular. States cannot enact laws that have equivalents in the penal code,” Syahredzan (right) said.

However, he said that any constitutional amendments that “changes the basic structure” of the constitution itself can be considered “unconstitutional”.

“Even if the bills tabled by PAS is passed, if the matter is challenged in courts, there is a high likelihood the courts will find that the act is unconstitutional,” he said, adding that arguments about hudud cannot be limited to Muslims alone.

“You cannot say you are non-Muslim, so it does not involve you. In that case, you will never achieve true unity in the country,” he said.- mk


PAS MP: Push for hudud easier if Norway had it...

It would be easier to campaign for the implementation of the Islamic penal code hudud in Kelantan if other countries which have implemented the law before were not “failed states”, said PAS’ Sepang MP Hanipa Maidin.

It would have been better, he said, if countries “like Norway” had implemented hudud.

“But right now, we have examples like Pakistan, and this is a failed state,” Hanipa (right) said at a forum on hudud implementation in Malaysia at the Kuala Lumpur and Selangor Chinese Assembly Hall (KLSCAH) yesterday.

Hanipa, however, pleaded to the packed crowd to give the PAS-led Kelantan government “a chance” to try out hudud in the state.

“We had this in our agenda when we went to the general election. And we were given mandate by the people of Kelantan to govern the state. So the people of Kelantan voted us in on this basis. It is our democratic right (to push for it),” Hanipa, who is also a lawyer, said.

He proceeded to tell the crowd that PAS do not have any clear intentions to implement hudud on a national level.

“We do not intend to widen the implementation in Malaysia. As far as we are concerned, we can only implement anything if we are given the mandate, only then we have legitimacy,” he said.

However, when being prodded with questions regarding the implementation of the law, he later admitted that he “personally” did not think hudud is a priority at this time.

“My personal opinion is that this is not the time for hudud, but when you are in a party personal opinions don’t count,” he said.

Hanipa also opined that the current federal constitution in the country is not secular nor Islamic in its character, thus it would not be unconstitutional to try amend the constitution to introduce an Islamic penal code.- mk

Hudud Bill has slim chance of passage...

There has been much debate since PAS announced it will take it upon itself to table a Private Member’s Bill to seek for the implementation of hudud law in Islamic party-ruled Kelantan.

This follows de facto Religious Affairs Minister Jamil Khir Baharom’s suggestion that it was up to non-government members of parliament to table a bill on the matter.

But what is a Private Member’s Bill?

From earlier experience, it is almost impossible for non-government parliamentarians to table a Private Member’s Bill in the August House.

Opposition MPs had previously attempted to table Private Member’s Bills in Parliament. They included PKR’s Lembah Pantai MP Nurul Izzah Anwar and Subang MP Sivarasa Rasiah and PSM’s Sungai Siput MP Dr D Jeyakumar.

But none of these attempts were successful.

Jeyakumar told Malaysiakini that under Malaysia’s parliamentary system, a parliamentarian who wishes to table a Private Member’s Bill would need to file a notice with the Parliament secretariat three weeks before the sitting.

“In that notice, you must have a full copy of the bill in two languages - Bahasa Malaysia and English - and also a description of the bill to explain why is it important.

“If the Parliament secretariat accepts the notice, it would be put on the agenda of the Dewan, which is commonly known as an Order Paper.”

Ball is in government’s court

However, even if it is included in the Order Paper, the Private Member’s Bill would need to wait until Parliament finishes the debate of government affairs on that particular day.

This, Jeyakumar (right) explained, means a Private Member’s Bill can only be tabled in the House with the nod of the government.           

“In Parliament, the actual government business is handled by Shahidan Kassim, Minister in the Prime Minister’s Department.

“Shahidan will have to tell Parliament that the government gives way to the Private Member’s Bill, only then the MP can table the bill in the House,” he said.

Jeyakumar had tried to table a Private Member’s Bill entitled the Social Inclusion Act in February this year. But the bill was rejected by the Parliament secretariat without even getting into the Order Paper.

Executive director of PKR-linked think-tank Political Studies for Change (KPRU) Ong Ooi Heng wrote in Oriental Daily early this week said that should PAS draft a Private Member’s Bill on hudud, it would not stand a chance for it to be debate in Parliament.

The matter hinged on whether the government would accept it as it had routinely rejected such bills in the past. Attempts to contact Shahidan for comment have been unsuccessful.

However in a move to pave way for the bill, the federal government and the Kelantan state government had yesterday agreed to form a technical committee on the implementation of hudud in Malaysia following a two-hour meeting between both sides.

The state assemblies of Kelantan and Terengganu had passed a state enactment to implement hudud in 1993 and 2003 respectively under PAS rule.

However, the two states were not able to implement hudud due to the federal government blocking the move. PAS is now attempting to overcome the federal government’s resistance by going through Parliament.

Damage done even bill fails

Since the formation of Pakatan in 2008, the issue has emerged off and on a few times. But this is a first time PAS has came up with concrete action.

While PAS opined that this can help the party to combat Umno’s propaganda that PAS is controlled by DAP, it also reflects the Islamic party’s trepidation in winning Malay support after losing seats in the 2013 general election.

PAS argues that the issue could backfire against Umno with its move. Its information chief Mahfuz Omar (left) yesterday challenged Umno to table the hudud bill itself if Umno is not a “sissy” (pondan) political party.

By all accounts, the hudud Private Member’s Bill has a slim chance to get passed in Parliament. Indeed, it looks more like a political gambit by the two rival parties.

However, DAP national organising secretary Anthony Loke said with the media playing up the issue every day, it may change the perception of non-Muslims and erode their support for Pakatan.

“You and I know that it is impossible to pass a Private Member’s Bill. But the ordinary people do not understand the legislative process.

“And why does PAS want to table the bill? They should throw it back to Umno,” said Loke.

Jeyakumar agreed that the issue will severely damage Pakatan even if the bill fails to get passed.

“Once they table it, the damage to Pakatan would be quite severe. BN will use it to panic the non-Malays and break up Pakatan.” - mk
