Naib Presiden Parti Keadilan Rakyat (PKR) Tian Chua hari ini dihukum penjara sebulan dan denda RM1,000 oleh Mahkamah Sesyen selepas didapati bersalah tidak mematuhi perintah polis supaya beredar dari kawasan larangan di Pusat Latihan Polis Diraja Malaysia (Pulapol) di sini, dua tahun lalu.
Hakim Mahmud Abdullah memerintahkan Tian Chua atau nama sebenarnya Chua Tian Chang, 51, menjalani hukuman penjara itu bermula hari ini.
Bagaimanapun, Mahmud membenarkan permohonan peguam Eric Paulsen yang mewakili pemimpin pembangkang itu, untuk menangguhkan pelaksanaan hukuman penjara sementara menunggu rayuan terhadap keputusan itu selesai.
Mahkamah menaikkan jumlah wang jaminan daripada RM500 kepada RM1,000.
Mahmud dalam keputusannya mendapati pihak pembelaan gagal menimbulkan keraguan munasabah terhadap kes pendakwaan, selepas mendengar keterangan sembilan saksi pendakwaan dan dua saksi pembelaan.
Mengaku tidak bersalah
Tian Chua, yang juga Anggota Parlimen Batu, mengaku tidak bersalah terhadap pertuduhan tidak mematuhi perintah pegawai polis DSP A Rajagopal untuk beredar dari kawasan yang diisytiharkan sebagai kawasan larangan mengikut Perintah Kawasan-Kawasan Larangan 1975.
Dia didakwa melakukan kesalahan itu di Pulapol, Jalan Semarak, di sini pada 2.30 pagi 29 April 2012, iaitu sehari selepas perhimpunan Bersih 3.0.
Dia didakwa mengikut Seksyen 4(2) Akta Kawasan Larangan dan Tempat Larangan 1959 (Akta 298) yang boleh dihukum mengikut Seksyen 7 akta sama yang membawa hukuman penjara maksimum dua tahun atau denda maksimum RM1,000 atau kedua-duanya.
Terdahulu Timbalan Pendakwa Raya Amirah Mohamed Yusoff memohon hukuman setimpal dikenakan kepada tertuduh kerana kesalahan itu adalah serius walaupun tiada kecederaan berlaku semasa tertuduh berada di Pulapol.
“Sebagai Yang Berhormat, tertuduh perlu memberi contoh yang baik kepada masyarakat, tetapi dia telah melanggar perintah polis. Pohon beri hukuman setimpal dalam bentuk pemenjaraan bagi memberi pengajaran kepada tertuduh dan masyarakat supaya tidak melakukan kesalahan sama,” katanya.
Eric pula memohon mahkamah mengenakan hukuman denda sahaja kepada anak guamnya atas alasan ia adalah satu kesalahan teknikal yang tidak membawa apa-apa keuntungan kepada orang ramai dan juga tertuduh. - Bernama
Tian Chua slapped with one-month jail term...
PKR vice-president Tian Chua has been jailed for one month and slapped with a RM1,000 fine for intruding into the restricted area of the Pulapol police training centre.
The Batu MP, who has a slew of court cases, was found guilty of violating the Protected Areas and Places Act.
Tian Chua, who is also Batu MP, was charged on May 15, 2012 after he allegedly disobeyed police orders to leave Pulapol after his release at 2.30am on April 29, 2012.
He was arrested with 512 others after the Bersih 3.0 rally for electoral reform in the Kuala Lumpur ended.
Kuala Lumpur Sessions Court judge Mahmud Abdullah granted a stay of execution pending appeal but the deputy public prosecutor objected and asked the court not to grant bail.
Under the law, an MP who is jailed for a year or more and slapped with a fine of RM2,000 or more will be disqualified and a by-election will be held.
However, he was granted a stay of execution of sentence. According to his office, Tian Chua will be holding a press conference this afternoon.
Lawyer N. Surendran said Tian Chua would appeal against the conviction and sentence because the charge was improper and unjustified.
"We are disappointed with the ruling of the trial court but an appeal will be made on a matter of principle," said the PKR vice-president and Padang Serai MP.
There is a risk of Tian Chua losing his seat should the DPP appeal against sentence as the maximum penalty for the offence is RM1,000 fine and up to two years' jail.
Under Article 48 of the Federal Constitution, an MP is disqualified if he is convicted of an offence and sentenced to imprisonment for a term of not less than one year or to a fine of not less than RM2,000.
"I doubt the appellate court will increase the jail term," Surendran said.
In 2010, Tian Chua had his fine reduced to RM2,000 from RM3,000 or six months’ jail after his appeal to the High Court here over the charge of biting a police officer during a protest in 2007.
He paid the fine in lieu of a reduced sentence of two months’ jail.
He kept his Batu seat and defended it in the 2013 general election.
He had been charged with voluntary hurt towards Constable Rosyaidi Anuar, 22, from the Anti-Narcotics Division, KL Police Contingent, at the entrance to Parliament. – TMI
