Pertemuan dengan Dr M bincang dakwaan 'salah laku' AG...
Tiga bulan lalu, seorang bekas pengawai tinggi polis menerima satu panggilan telefon mengejutkan semasa sambutan Hari Raya Aidilfitri, yang menggesa beliau menghadiri pertemuan dengan bekas perdana menteri Tun Dr Mahathir Mohamad.
Panggilan tersebut dibuat oleh peguam yang dikaitkan dengan Umno, Datuk Seri Muhammad Shafee Abdullah manakala bekas pegawai tinggi polis yang dimaksudkan adalah bekas pengarah Jabatan Siasatan Jenayah Kuala Lumpur Mat Zain Ibrahim.
Rentetan itu, Mat Zain bertemu dengan Shafee pada 10 Ogos di pejabat yang juga merupakan kediaman peguam tersebut di kawasan elit Bukit Tunku.
Dalam pertemuan tersebut, kedua-duanya berbincang mengenai dakwaan “salah laku” Peguam Negara Tan Sri Gani Patail, termasuk isu yang mendapat perhatian umum seperti kes Batu Puteh – pulau di perairan Johor yang kini jatuh ke tangan Singapura selepas kes itu berlarutan ke Mahkamah Keadilan Antarabangsa pada 2008.
Beberapa jam kemudian, Mat Zain dan Shafee mengadakan pertemuan dengan Mahathir di Country Heights, Kajang. Bekas perdana menteri itu nampaknya baru saja pulang dari Kedah.
Turut menyertai pertemuan itu adalah bekas setiausaha politik Mahathir, Matthias Chang dan bekas pengarah Jabatan Siasatan Jenayah Datuk Ramli Yusuff, yang turut memaklumkan kepada Mahathir mengenai masalahnya dengan Gani.
Perbincangan semasa pertemuan dalam suasana sambutan Hari Raya itu tertumpu kepada dakwaan salah laku Gani.
Ia bermula dengan kes mata lebam Datuk Seri Anwar Ibrahim, yang mana Mat Zain merupakan pegawai penyiasatnya. Bekas ketua polis negara Tan Sri Abdul Rahim Noor disabitkan kesalahan dalam kes tersebut dan dipenjarakan.
Liwat I
Mat Zain memberitahu Mahathir bahawa beliau menemui pemalsuan bukti yang didakwa dilakukan oleh Gani seamsa siasatannya.
Gani pada masa itu merupakan salah seorang dari pendakwa utama kerajaan yang menangani kes Liwat I dan dakwaan penyalahgunaan kuasa Anwar.
Dakwaan pemalsuan bukti itu berlaku apabila Gani mengemukakan seorang ahli patologi Dr Abdul Rahman Yusoff sebagai saksi dan memberitahu mahkamah bahawa Anwar mendakwa kecederaan itu mungkin dilakukannya sendiri.
Perkara ini bertentangan dengan beberapa lagi laporan perubatan.
Susulan itu, satu suruhanjaya siasatan diraja dibentuk untuk menyiasat kes mata lebam tersebut, di mana Abdul Rahim kemudiannya didapati telah menumbuk Anwar.
Anwar membuat laporan polis pada 2008 – 10 tahun selepas kejadian tersebut – ke atas Gani dan bekas ketua polis negara Tan Sri Musa Hassan yang menjadi penyiasast dalam kes liwat Anwar.
Satu jawatankuasa Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) yang terdiri dari bekas hakim kanan kemudiannya dibentuk untuk menyiasat dakwaan tersebut dan membebaskan Gani dan Musa dari tuduhan salah laku dan memalsukan bukti yang dibuat ke atas mereka.
Dalam perbincangan semasa Hari Raya dengan Mahathir itu, Shafee bersetuju bahawa pelantikan jawatankuasa SPRM dibuat dengan tidak mengikut undang-undang yang sah, dan hanya satu tribunal yang boleh membebaskan AG atau IGP dari sebagai tuduhan salah laku – dan bukannya satu panel yang dibentuk oleh SPRM.
Mat Zain bagaimanapun hairan kerana Mahathir dan Shafee memanggilnya untuk pertemuan tersebut kerana bukti yang mereka kehendaki sudahpun dilaporkan dengan meluaas.
Salinan akuan berkanun
"Ia boleh didapati dengan mudah di Internet dan mereka boleh cari surat terbuka saya. Susulan pertemuan itu, Shafee meminta salinan dokumen yang saya miliki dan saya mengirimnya kepada peguam itu pada 24 September,” kata bekas pegawai tinggi polis itu kepada Malaysiakini.
Susulan pertemuan 10 Ogos itu, Mat Zain membuat pengakuan berkanun berhubung perkara tersebut pada 7 Oktober.
Beliau mengirim salinan pengakuan berkanun tersebut kepada Perdana Menteri Datuk Seri Najib Razak dua hari kemudian.
Malaysiakini berpeluang melihat salinan pengakuan berkanun tersebut.
Salinan pengakuan berkanun tersebut juga dihantar kepada Peguam Cara Negara Datuk Idris Harun dan dipercayai turut diperolehi Timbalan Perdana Menteri Tan Sri Muhyiddin Yassin melalui seorang pembantu.
Malaysiakini telah menghubungi Shafee dan Chang untuk mendapatkan reaksi mereka.
Ironinya, Shafee dilantik oleh Gani untuk mengetuai pihak pendakwaan dalam rayuan ke atas keputusan Mahkamah Tinggi Kuala Lumpur yang melepaskan Anwar dari dakwaan Liwat II.
Mat Zain memberitahu Malaysiakini bahawa pertemuan itu turut melibatkan kekalahan Malaysia dan kes Pulau Batu Puteh dan juga perkara yang mungkin menyebabkan kes tersebut disia-siakan oleh Gani.
Sementara itu, Ramli pada hari Jumaat lalu memfailkan saman ke atas Gani, Musa dan 10 yang lain kerana pendakwaan berniat jahat.-malaysiakini
Mystery meeting with Dr M suggests move against AG...
Three months ago, a former senior police officer received a surprise phone call during Hari Raya Aidilfitri, urging him to attend a meeting with former prime minister Dr Mahathir Mohamad.
That call was from Umno-linked lawyer Muhammad Shafee Abdullah and the retired top cop was former Kuala Lumpur Criminal Investigations Department director Mat Zain Ibrahim.
Following this, on Aug 10 - three days after Hari Raya - Mat Zain met Shafee (left) at the lawyer's office-cum-residence in Bukit Tunku.
At the meeting, the duo discussed the "misconducts" of attorney-general Abdul Gani Patail, including the highly-publicised international case on Batu Puteh - the island off Johor that Malaysia lost to Singapore in a legal dispute before the International Court of Justice in 2008.
Several hours later, Mat Zain and Shafee proceeded to meet Mahathir at his residence in Country Heights, Kajang. The former PM had apparently just arrived back from his home state of Kedah.
Joining the meeting were Mahathir's former political secretary Matthias Chang and former Commercial Crimes Investigation Department director Ramli Yusuff, who also briefed Mahathir over his run-ins with Gani.
Over a Hari Raya meal, the discussion centred on the alleged wrongdoings of Gani. It began with Anwar's black-eye case, in which Mat Zain was the investigating officer, and for which former inspector-general of police Abdul Rahim Noor was implicated and jailed.
Alleged black-eye fabrication
In the course of his investigations, Mat Zain told Mahathir that he uncovered fabrication of evidence allegedly committed by Gani, who then was one of the key government prosecutors handling Anwar's Sodomy I and abuse of power cases.
The alleged fabrication took place when Gani (right) brought in pathologist Dr Abdul Rahman Yusoff to say that Anwar claimed his injuries could have been self-inflicted, which contradicted a slew of other medical reports by other doctors.
As a result, a royal commission of inquiry was set up to investigate the black-eye incident, where Abdul Rahim was subsequently found to have inflicted the blows on Anwar.

A three-member Malaysian Anti-Corruption Commission (MACC) committee comprising former senior judges was eventually formed to probe the complaint and it cleared both Gani and Musa on accusations of fabrication and misconduct that were made against the duo.
At the Hari Raya discussion with Mahathir (left), Shafee agreed that the appointment of the MACC committee had been illegally constituted, and further, only a tribunal could clear the AG or the IGP of any wrongdoing - not a panel formed by the MACC.
Mat Zain is nevertheless puzzled by Mahathir and Shafee calling him for the meeting because the evidence that they sought had been widely reported.
"It is readily available on the Internet and they can search for my open letters.
Following the meeting, Shafee asked me for copies of the documents I possess and I sent them to the lawyer on Sept 24," the former top cop told Malaysiakini.
AG blamed over Batu Puteh
After the Aug 10 meeting, Mat Zain made a statutory declaration on the matter on Oct 7. He then sent copies of his statutory declaration to Prime Minister Najib Abdul Razak two days later. A copy of his SD was sighted by Malaysiakini.
Copies of the SD were also sent to solicitor-general Idrus Harun, inspector-general of police Khalid Abu Bakar and it is also believed to have made its way to Deputy Prime Minister Muhyiddin Yassin, through his aide.
Malaysiakini has contacted Shafee and Chang for their comments and is awaiting their response. Ironically, Shafee was appointed by Gani to head the prosecution in its appeal against Anwar's acquittal by the High Court in Kuala Lumpur on the Sodomy II charge against him.
Mat Zain told Malaysiakini the meeting also revolved around Malaysia's defeat in the Batu Puteh case and how Gani could have bungled in the case.
Meanwhile, Ramli last Friday filed a suit against Gani, Musa and 10 others for malicious prosecution as the tussle between the two former top cops continues.-malaysiakini
