Rahsia TLDM bocor ok!!, asalkan nama baik bos Putrajaya terpelihara...

Usul tergempar KEADILAN supaya Kementerian Pertahanan menjawab dakwaan penjualan dokumen rahsia berkaitan kapal selam Scorpene kepada syarikat pertahanan Perancis ditolak hari ini.

Speaker Dewan Rakyat, Tan Sri Pandikar Amin Mulia menolak usul yang dikemukakan Ahli Parlimen Sungai Petani, Datuk Johari Abdul itu dengan alasan kononnya kes tersebut tidak mempunyai bukti dan hanya andaian.
 

Usul berkenaan difailkan Ahli Parlimen Lembah Pantai, Nurul Izzah Anwar pada Khamis lalu yang dibuat bawah Perintah Tetap 18(11).

Izzah berkata, skandal tersebut tidak boleh dipandang remeh kerana Malaysia terikat dengan Konvensyen Bangsa-Bangsa Bersatu menentang rasuah dan bertanggungjawab menjelaskannya kepada antarabangsa.

“Isu ini menjadi perhatian antarabangsa. Bukan sahaja di Asia malah turut dibahaskan dalam Parlimen Malta. Malaysia perlu tampil menjelaskan perkara ini kepada antarabangsa lebih-lebih lagi ia melibatkan Perdana Menteri,” katanya pada sidang media di lobi Parlimen.

Turut hadir, Johari, Ahli Parlimen Batu, Tian Chua dan wakil NGO Kelab Kebajikan Veteran dan Pesara Tentera (Kerabat).

Izzah yang juga Naib Presiden KEADILAN memandang serius kenyataan Menteri Pertahanan, Datuk Seri Ahmad Zahid Hamidi yang ada mengesan dokumen sulit ketenteraan itu mengalir ke luar negara.

“Ia cukup membuktikan keselamatan negara terancam,” tegas Izzah.

KEADILAN sehubungan itu mendesak Suruhanjaya Pencegahan Rasuah Malaysia (SPRM) menyiasat rasuah dan penjualan dokumen Tentera Udara Diraja Malaysia (TUDM) dalam urusan pembelian Scorpene, kata Izzah.

Sementara itu, Tian berkata, isu tersebut bukanlah andaian kerana siasatan polis Perancis membuktikan elemen penjualan dokumen sulit kerajaan.

“Parlimen kata mereka tidak menerima apa-apa dokumen.
 


Speaker tak faham mengenai siasatan di Perancis. Dokumen mencukupi untuk Perancis meneruskan perbicaraan. Mengikut undang-undang, dokumen ini tak boleh dicetak dan diterbitkan.

“Hanya peguam sahaja yang boleh memegangnya. Peguam boleh mendedahkannya kepada anak guamnya dan wartawan. Jadi kalau mereka kata mereka tak dapat dokumen berkenaan skandal ini, saya kira ia tidak tepat,” katanya.- keadilandaily




Scorpene motion torpedoed...

An emergency motion aimed at discussing the alleged sale of highly secret Scorpene submarine-related documents to a French company was rejected in Parliament today. 

Dewan Rakyat Speaker Pandikar Amin Mulia(right) rejected the Lembah Pantai MP (PKR) Nurul Izzah Anwar’s motion in his chambers this morning, as it did not adhere to Standing Order 23(1)(h).

The Standing Order states:

“A question shall not be asked for the purpose of obtaining an expression of opinion, the solution of an abstract legal case or the answer to a hypothetical proposition.”

He later told the Dewan Rakyat that the alleged sale was still an “assumption”, and not official.

“The matter raised in this motion is an assumption, and not a specific matter, because the matter about the transaction sale of the documents is not clear.

“…It is still an allegation,” Pandikar said.

FMT previously reported the disclosure by Suaram about the sale of the document – which supposedly contained an evaluation of the Scorpenes by the Navy and contract details – to French-based DCNS for 36 million euros (RM142 million).

Suaram’s lawyers said that the secret document was sold by Terasasi (Hong Kong) Ltd, whose directors are Abdul Razak Baginda and his father Abdul Malim Baginda.

Both are believed to be closely linked to Najib.

Speaker’s decision ‘disappointing’

The document was allegedly sold to Thales International, also known as Thint Asia, a subsidiary of DCN (later known as DCNS).


DCNS is the company central in the legal suit filed by Suaram in 2009 in the French courts, which recently commenced a judicial inquiry at the Tribunal De Grande Instance in Paris.

The inquiry revolves around the RM7.3 billion deal to purchase two Scorpene submarines with DCNS and Spainish Navantia in 2002.

Nurul later told reporters that it was “disappointing” that MPs were not given a chance to debate the matter.

Also present was Sungai Petani MP Johari Abdul who demanded that the Malaysian Anti-Corruption Commission (MACC) investigate the matter.

“How can they [Terasasi] have information of specification on the submarine?… Don’t wait for us to make a police report,” he said.

He also said that even the Maltese Parliament was discussing the Scorpene scandal, and hinted at Malaysia’s reluctance to do so.

In Malta Today news portal, the Maltese Parliament was told that the French-owned Malta-based financial consultancy Gifen was being investigated by French officials over commission allegations involving Perimekar Sdn Bhd, once owned by Abdul Razak.- FMT



Emergency motion on defence papers sale rejected

The emergency motion for the Defence Ministry to answer allegations of the sale of confidential documents related to the Scorpene submarines to a French defence company has been denied.

NONEThe parliamentary speaker today rejected Lembah Pantai MP Nurul Izzah Anwar (left) filed the motion last Thursday under Standing Orders 18(11).

The motion comes after Joseph Breham, the French lawyer for human rights movements Suaram, revealed on May 30 in its corruption case against French shipbuilder DCNS, that a French company had paid 36 million euro (RM142 million) to Terasasi (Hong Kong) Ltd.


It is alleged that the sum was for a copy of the Malaysian Navy’s evaluation of the submarines contract.

Penang Umno fails in RM30mil suit against Lim Guan Eng & Emergency motion on sale of defence papers rejected by Parliment...



 The Kuala Lumpur High Court has struck out a RM30 million defamation suit filed by Penang Umno chairperson Zainal Abidin Osman against Chief Minister Lim Guan Eng and three others.

Justice Amelia Tee Hong Geok Abdullah made the decision in chambers this morning.

Jagdeep Singh Deo, representing Lim, told reporters that the judge agreed with a preliminary objection filed by lead counsel Karpal Singh, who had argued that Zainal had no locus standi to initiate the case.


NONEIn a submission in May, Karpal had said that Zainal was not declared and registered by the Registrar of Societies (ROS) as a public officer who could initiate the suit.

Zainal Abidin (left), 52, had filed the suit on Oct 24 last year against the four defendants for having allegedly linked Umno with the demonstrations in Komtar and on Penang Bridge, as well as an arson attempt on the DAP's state headquarters last year.
 

He had also named PKR president Wan Azizah Wan Ismail, party organ Keadilan Daily publisher Segmen Fleksibel Sdn Bhd and its chief news editor Fazallah Pit.

In the written judgement, Justice Tee said the court was of the view that the plaintiff was not authorised to commence the action on behalf of Umno Penang state liaison committee as he is not the public officer registered by the ROS, for the purpose of suing on behalf of the state liaison committee.

"The court agrees with the preliminary objections as taken by the defendants. The court hereby rules that the plaintiff has no locus standi to commence this suit.

"As such, the court herewith orders that the plaintiff's suit against the defendants be struck off with costs be taxed unless otherwise agreed between the parties," she said.

In an immediate reaction, Lim and Wan Azizah described the ruling today as an "unexpected sweet victory".

"The unexpected victory not only belongs to me, but most importantly to our fight for freedom of press, especially on the right of reply.

"This is also a sweet victory for the people who stand firm on justice and freedom," the DAP secretary-general told reporters outside the court.


Lim (right) said the arson attack could have been a backlash on Umno's sensationalist criticism over the call for prayer ban.

Umno had given Lim time to apologise and withdraw his statement but he had refused to do so.-  malaysiakini

Mahkamah Tinggi Kuala Lumpur menolak saman fitnah RM30 juta yang difailkan oleh Pengerusi Umno negeri itu, Datuk Zainal Abidin Osman terhadap Ketua Menteri, Lim Guan Eng dan tiga yang lain.

Hakim Amelia Tee Hong Geok Abdullah membuat keputusan itu dalam kamar pagi ini.


NONEPeguam Jardeep Singh, yang mewakili Lim, memberitahu pemberita bahawa hakim bersetuju dengan bantahan awal yang difailkan oleh peguam utama Karpal Singh, yang berhujah bahawa Zainal (kiri) tidak mempunyai locus standi untuk berbuat demikian.

Dalam berhujah Karpal Singh berkata Zainal Abidin tidak mempunyai locus standi (kepentingan mencukupi) untuk memulakan saman terhadap defendan dan perbicaraan harus dihentikan kerana sepatutnya pegawai awam atau ahli, didaftarkan sebagai pihak yang boleh menyaman dengan Pendaftar Pertubuhan (ROS).

Zainal Abidin memfail saman itu pada 24 Oktober 2011, dengan menamakan Lim yang juga Setiausaha DAP, PKR selaku pemilik laman berita elektronik Keadilan Daily, dan akhbar Suara Keadilan, Segmen Fleksibel Sdn Bhd yang merupakan syarikat penerbitan Keadilan Daily dan Suara Keadilan, serta ketua penyuntingnya, Fazallah Pit sebagai defendan. 

Mereka didakwa mengaitkan Umno dengan itu demonstrasi di Komtar dan pada Jambatan Pulau Pinang, serta cubaan membakar ibu pejabat negeri DAP tahun lepas.- malaysiakini
