Nizar - MB Perak yang sah..........

Mahkamah Tinggi Kuala Lumpur mengumumkan Datuk Seri Mohamad Nizar Jamaluddin sebagai menteri besar sah Perak setelah digugurkan jawatan tersebut awal bulan lalu.

Dalam penghakimannya, hakim Abdul Aziz Abd Rahim berkata seseorang menteri besar hanya boleh dipecat melalui undi tidak percaya di DUN, seperti kes Stephen Kalong Ningkan.

Hakim menambah, dalam kes pelucutan Mohamad Nizar, tiada persidangan dewan diadakan untuk meluluskan usul sedemikian.

Mengulas kemenangannya, menteri besar Pakatan Rakyat itu berkata beliau akan menghadap Sultan Perak berhubung penghakiman mahkamah tersebut.

The High Court here ruled rule on Monday that Datuk Seri Mohammad Nizar Jamaluddin is the rightful Perak Mentri Besar, and not Barisan Nasional’s Datuk Seri Dr Zambry Abdul Kadir. In an immediate response, Zambry said he would apply for a stay pending appeal. This was rejected by the court. Zambry's lawyer Cecil Abraham's application for a stay of proceedings pending an appeal was also rejected by the court.

He also ordered Zambry and his exco members to vacate the office as soon as possible.

In his ruling, Justice Abdul Aziz Abd Rahim said that a new mentri besar could not be appointed as the office had not been vacated. He said a mentri besar can only be dismissed by a vote of no confidence, and upheld the Stephen Kalong Ningkan ruling. He noted that the Perak State Legislative did not hold a vote of no confidence.

Nizar is expected to seek an audience with the Sultan of Perak, Sultan Azlan Shah, to get his consent to dissolve the Assembly and call for fresh state elections.

The decision is now set to bring about more uncertainty in the state.

No wonder,Najib Razak was so kind enough to offer help to PR to resolve the crisis in Perak.

Probably its too late........ So will the DUN be dissolve or BN will pressure on to stay in power?

One must not forget that BN still have the upper hand with regards to the state assembly. While the court has not recognised Zambry's appointment as MB, the appointment of new state assembly speaker R Ganesan is still valid. In view of this, Ganesan could call for an emergency sitting where a motion of no-confidence would be moved against Mohammad Nizar. With its '28 + 3' BN as opposed to Pakatan's 28, BN should have no problem in pushing the motion through.

    SS Perak tak tidur malam...panazz pungkog !! Semua keputusan MB Haram BN for te past 96 days is VOID..including the appointment of Ganasss son as Speaker Haram.

    So the ball back to Sultan Perak.

    Tuanku, pls decide fairly, pastu kita pi makan kat kedai MB Haram tuh..teh tarik rendek mamak !!
