Polis sedang menyiasat penganjur perhimpunan Janji Demokrasi di kawasan Dataran Merdeka di Kuala Lumpur malam tadi yang menarik kira-kira 10,000 orang.

Mengesahkan perkara itu, Ketua Jabatan Siasatan Jenayah Kuala Lumpur jenayah siasatan Datuk Ku Chin Wah berkata siasatan itu dibuat di bawah Akta Perhimpunan Aman 2012.

Dalam mesej teks kepada Malaysiakini, beliau berkata, pihak polis akan terus menyiasat mereka di bawah Akta tersebut.

Malam tadi, Ketua Polis Daerah Dang Wangi ACP Zainuddin Ahmad berkata polis akan "menyiasat kemudian" sama ada pengerusi bersama BERSIH, Datuk A Samad Said telah melanggar undang-undang dengan membaca sajak.

Pak Samad yang merupakan Sasterawan Negara, membaca sajaknya 'Janji Demokras' di dataran di luar ibupejabat Dewan Bandaraya Kuala Lumpur yang terletak kurang 500 meter dari Dataran Merdeka.

Walaupun telah mengisytiharkan perhimpunan itu haram di saat-saat akhir, tetapi tiada tangkapan terhadap ribuan orang ramai yang membanjiri kawasan itu dengan berpakaian kuning pada malam ambang Hari Kebangsaan.

Police probing Janji Demokrasi organisers...

Police are investigating the organisers of the Janji Demokrasi rally at the Dataran Merdeka area in Kuala Lumpur yesterday that attracted about 10,000 people.

Confirming this, Kuala Lumpur criminal investigations department chief Ku Chin Wah said the probe is under the Peaceful Assembly Act 2012. 

"We will continue to investigate them under the Act," he said in a text message to Malaysiakini.

Last night, Dang Wangi OCPD Zainuddin Ahmad said police would "investigate later" if Bersih's co-chairperson A Samad Said had broken the law by reciting a poem.

No mass arrests

Despite declaring the rally illegal at the last minute, mass arrests did not take place on the thousands who thronged the area in yellow shirts on the eve of National Day.

However, police detained two people who were allegedly caught lighting fireworks.

At 2.15pm yesterday, Janji Demokrasi organising committee member Maria Chin Abdullah received a letter from the police informing her that the rally was declared illegal.

The letter cited the organisers’ failure to give police advance notice of the rally and failure to obtain permission from the venue owner, Kuala Lumpur City Hall (DBKL) as the reasons.

The two conditions are required under Section 9(1) and Section 11 of the Peaceful Assembly Act 2012 respectively.

The rally was meant to remind the government of unfulfilled promises for clean and fair elections.

Its name plays on the government's official theme for the national day celebrations, ‘Janji Ditepati' (promises fulfilled), which is also the BN’s election campaign slogan.

Pak Samad probe ‘arbitrary’

Meanwhile in an immediate reaction, PKR vice-president N Surendren called upon Prime Minister Najib Razak to drop all criminal investigations against Samad and the organisers of the Janji Demokrasi peaceful rally.

"The police decision to commence criminal proceedings against our national laureate is arbitrary, unconstitutional and a gross abuse of police powers.

“In reading poetry in a public place, Samad Said was exercising his fundamental rights of freedom of speech and assembly under Article 10 of the federal constitution," he said.

The PKR veep alleged that Samad was targeted because of his consistent public criticism of the ruling coalition, and said the police force was being used to suppress political dissent and intimidate civil society.

"This probe is clearly politically motivated and in breach of the rakyat's basic rights under Article 10 of the federal constitution," said the lawyer.- malaysiakini

 Ban or no ban the Yellow shirts swamp Dataran...

The Merdeka Day eve countdown this year at Dataran Merdeka will see two activist groups join revellers, but the police are adamant they be kept at bay.

Gabungan Janji, a coalition of 47 NGOs, wants to converge at the northern-most point of Dataran Merdeka in yellow to pressure the government to fulfil its promises of electoral reform.

The police have declared Gabungan Janji's planned gathering will be illegal. 

Another group aims to hold a short demonstration along Jalan Sultan to pressure the government to preserve heritage buildings earmarked to make way for the MRT project.

About 25km away in Shah Alam, the Selangor government is hosting its own countdown event at Dataran Kemerdekaan. 

The crowd at Jalan Sultan are expected to join Gabungan Janji at about 10pm.

LIVE REPORTS

9pm - Dataran Merdeka - People are begin to trickle in, gathering in front of the iconic Sultan Abdul Samad building. There is a slight drizzle, possibly keeping others at bay.

Ironically, a Kuala Lumpur City Hall sign at both ends ofthe Sultan Abdul Samad building reads: "This area is closed to all activity". 

9.05pm - Jalan Sultan - A crowd is building up near the Gospel Hall Church. Speakers advocating for the preservation of buildings along Jalan Sultan are addressing supporters. 

9.15pm - Jalan Sultan - Led by a lion dance troupe including two ‘lions’ and drums, the procession along Jalan Sultan has kicked off and there appears to be no attempts by the police to stop them.

Instead, a few dozen police and People’s Volunteer Corps (Rela) personnel helped to direct traffic.

 9.30pm - Shah Alam - Some 500 people are trickling into Dataran Kemerdekaan for the Selangor state government Merdeka Day eve event.

9.40pm - Dataran Merdeka - The number of revellers are swelling at Dataran Merdeka. Another group is seen near the Jalan Tuanku Abdul Rahman-Jalan Tun Perak junction trumpeting away on their vuvuzelas. 

9.45pm - Jalan Sultan - The crowd has now swelled to about 1,000 people. They chanted “Save Jalan Sultan” along the procession and formed a 500m human chain in single file from Lok Ann Hotel to the site of the former Klang Bus Station which was recently demolished.

After reading their declaration again and singing Negaraku, organisers announced the end of the event and asked everyone to disperse.

However, many lingered on as the crowd dispersed slowly. Even as of 10pm, many are still on the streets with crowds spontaneously breaking into songs such as ‘Rasa Sayang’, or shouting for others to go to Dataran Merdeka.


10.45pm - Dataran Merdeka - An estimated 5,000 people are in Dataran Merdeka for the Federal Government organised countdown.

A stone's throw away, a multi-ethnic crowd of thousands more in yellow shirts are gathered near the northern-most police cordon and are trumpeting away on their vuvuzelas. 

11.05pm - Shah Alam - Menteri Besar Khalid Ibrahim recites Osman Awang’s poetry titled Merdeka to a crowd of 2,000 at Dataran Kemerdekaan.

He then shouts “Merdeka” three times and the crowd reciprocates. 

11.30pm - Dataran Merdeka -  The yellow shirt, led by Bersih 2.0 co-chairperson A Samad Said and Bersih secretariat member Maria Chin Abdullah, move away from Dataran Merdeka. 

They regroup at an open area south adjacent to Kuala Lumpur City Hall headquarters to hear A Samad recite a poem. 

11.45pm - Dataran Merdeka - It is now a 15-minute wait before the clock strikes midnight and the countdown will begin. 

The federal government's theme song Janji Ditepati is heard from Dataran Merdeka. 

Some yellow shirts belt out the same as well, changing the lyrics to Janji Dicapati. 

12am - Dataran Merdeka - The yellow shirts sing Negaraku at the stroke of midnight. Some left to enjoy the fireworks while others are dispersing in a cheerful mood. 

12.20am - Dataran Merdeka - A Samad Said declares the Janji Demokrasi gathering a success but is unable to estimate a crowd figure. Malaysiakini journalists estimates that the yellow shirts number at 10,000. 

“When I reached Dataran Merdeka, I found that the number (of yellow shirts) were beyond expectations. I was pleased to notice that they were mostly youths. This is important.

“This reflects the fact that they are aware that this is their era and their hands cause a regime change. I hope this happens,” he said.

After the countdown, A Samad and several Pakatan Rakyat leaders led a portion of the crowd on a short march towards Bandaraya LRT station before dispersing.
 
12.30am - Dataran Merdeka -  Dang Wangi district police chief Zainuddin Ahmad told reporters that no untoward incidents were reported.

“We’ll investigate later (for any violations),” he said when asked about the yellow shirts.

He confirmed that two youths were arrested for setting off fireworks. It is unsure if the youths were part of the yellow shirts.

He said a total of 205 police personnel were at Dataran Merdeka to monitor proceedings.- malaysiakini

Polis menetapkan perhimpunan "Janji Demokrasi" di Dataran Merdeka malam ini bertentangan dengan undang-undang negara.

Anggota jawantankuasa penganjur Maria Chin Abdullah ketika dihubungi mengesahkan bahawa Ketua Polis Daerah Dang Wangi Zainuddin Ahmad mengirimkan surat rasmi memaklumkan perkara itu kepadanya.

Alasan yang diberikan kepada penganjur:

(1) Gagal memberi pemberitahuan bawah Seksyen 9(1) Akta Perhimpunan Aman 2012 kepada ketua polis daerah Dang Wangi.

(2) Gagal memperoleh persetujuan daripada pemunya tempat perhimpunan, iaitu Dataran Merdeka bawah Seksyen 11 Akta Perhimpunan Aman 2012.

(3) Akan menggugat persiapan yang dibuat untuk menyambut hari kemerdekaan pada 31 Ogos.

Sementara itu, polis Bukit Aman turut memuatkan pesan di Facebook supaya orang ramai yang berkumpul di Dataran untuk meraikan ambang merdeka mematuhi undang-undang dan menjaga tingkah laku.- malaysiakini

Police declare tonight's Janji Demokrasi rally illegal...

The police have announced that the Janji Demokrasi gathering tonight is against the law.

Organising committee member Maria Chin Abdullah, when contacted, confirmed that Dang Wangi district police chief Zainuddin Ahmad sent her an official letter about an hour ago.

"I received the letter around 2.15pm by hand. A few policemen came," she told Malaysiakini.

Regardless, she said Gabungan Janji, a coalition of 47 NGOs, would still go to Dataran Merdeka despite the letter.

In case the rally’s participants are barred from entering the historic field, she said the committee would then ask people to “celebrate where they are.”

“This is a Merdeka celebration, people can celebrate it anywhere in town. We hope that they will wear yellow.

“We just want to celebrate Merdeka, but the police are making it difficult,” she said.

The letter said that the rally is illegal because the organisers have failed to give Zainuddin advance notice of the rally and for failing to obtain permission from the venue’s owner, Kuala Lumpur City Hall.

Both conditions are required under Section 9(1) and Section 11 of the Public Assembly Act 2012, respectively.

In addition, Zainuddin wrote that the rally would affect the preparations for tomorrow morning’s Merdeka Day celebrations.

Participants reminded of do’s and dont’s

However, Maria rebutted, insisting that the rally would not disturb the official Merdeka celebrations.

"We are not there to disturb the official Merdeka celebration. That's why we chose (the) fountain which is very, very far from the celebration," she said.

Following the receipt of the letter, Gabungan Janji’s Facebook page issued a notice informing would-be participants of the letter and reminded them of several do’s and don’ts.

These are: No banners or placards; no provocation; no loudspeakers; do not approach RTM’s broadcasting equipment and for participants to follow the organiser’s instructions.

The rally, meant to remind the government of unfulfilled promises for clean and fair elections, was slated to be held on the northern corner of Dataran Merdeka, at 10pm today, but was later changed to 11pm.

Its name is a play of the government’s official theme for the national day celebrations, ‘Janji Ditepati’ (Promises Delivered).

On the field nearby, an officially-sanctioned countdown is to take place while parades are also scheduled for tomorrow morning in the same area.

Meanwhile, Preserving Jalan Sultan and Jalan Bukit Bintang Committee chairperson Stanley Yong told Malaysiakini that as of 4pm, he has yet to receive any letter from the police and its plans tonight will continue.

The committee intends to hold a march to Dataran Merdeka from Gospel Hall church, near Jalan Sultan, at 8.30pm tonight to pressure the government to preserve the street from the effects of construction works for the MRT project.- malaysiakini

Lavish prizes used to garner Merdeka Day support...

Although availability of public seats inside Stadium Nasional for the federal government’s National Day celebration is uncertain, the ability to score lucky draw numbers for the mammoth event seems more probable.

According to a post on the 55 Tahun Merdeka, Janji Ditepati Facebook page, in order to stand a chance to win many of the lucrative prizes, one merely has to collect a red card from the local Information Department branch.

When contacted, the ministry’s Public Relations Department spokesperson Jasminawati Jamin confirmed that the website is authentic.

The 55 Tahun Merdeka, Janji Ditepati Facebook page indicated that the top prize offered is the pride of the current Proton fleet - the Preve.

Also up for grabs are four motorcycles manufactured by another local automotive brand, Modenas.

But oddly enough, the other prizes does not have the same nationalistic flavour.

These foreign makes include a Chevrolet Cruze, a Vespa scooter, 50 Huawei tablet computers, 10 fixie bicycles and three Blackberry smartphones.

Stranger still, another prize consist of two return tickets to London - the capital of the very country from which Malaya gained independence 55 years ago.

Final prize line-up

The range of prizes is different from what was promised during a technical briefing by the Information Department yesterday.

The ministry's Selangor Culture and Arts Department director Ghazali Bidin told reporters yesterday that prizes also included an Apple iPhone 4S and the company’s latest iPads.

Jasminawati explained that this is because the information presented yesterday was preliminary, and the prizes listed on the Facebook page is the final prize line-up.

Ghazali also explained that the lucky draw event and other entertainment activities will kick off after 10.30pm tomorrow night when Prime Minister Najib Abdul Razak is scheduled to hold a walkabout-cum-meet-and-greet with people outside the stadium.

He said that this was to discourage the crowd inside the stadium from leaving and causing congestion outside.

According to the Information Department, those outside will be able to follow the proceedings by huddling in tents laid out in the stadium carpark.

According to the seating arrangement plan shown to the media on Monday, all the seats have been allocated to VIPs, BN component party members, civil servants, schoolchildren and other specially-picked groups, leaving no room for members of the public.

However, the Information Department has been on an aggressive drive - including sending phone text messages - to encourage people to attend the event.- malaysiakini

Folks gather not in a group but a single file and walk round and round the Dataran during the count down to M. Day. All in yellow. All in silence. Can they call this illegal? We can call it 'Walking for Freedom'. Until we have Fair and Free Elections. I'm sure Malaysians can think up many ways to skin BN and not let them dictate how we celebrate Merdeka.
