Do we want DAP sympathiser or UMNO puppet...

 

Former PAS Perak menteri besar Nizar Jamaluddin has struck back at his party chief for asking members to choose between “DAP sympathisers” and party loyalists, asking if they are being asked to choose “Umno puppets” instead.

“Umno is now at its weakest when (former PM) Dr Mahathir Mohamad and Deputy Prime Minister Muhyiddin Yassin, as well as the PM’s brother, has been criticising Najib Razak.

“However, there are still those who would call for Najib to stay,” said Nizar, alluding to PAS president Abdul Hadi Awang’s call for Najib not to step down amidst Mahathir’s calls to do so.

“If that is the case, I could say, do we want a president who is a puppet of DAP or a puppet of Umno?” said Nizar to applause from the audience at a forum last night at the Kuala Lumpur Selangor Chinese Assembly Hall (KLSCAH) in the capital city.

Warring factions

Yesterday Hadi drew a line between the two warring factions in the party calling one party loyalists, and the other “DAP sympathisers”, asking party members to choose.

The lead up to this year's party leadership elections has seen the fiercest and perhaps ugliest infighting between the conservative ulama faction and the party's progressives in years.

The latter, who have been vocal in their support for the Pakatan Rakyat coalition with DAP and PKR, has been the target of a smear campaign that saw them called traitors, lackeys and parasites, for their allegiance to the opposition coalition, and for criticising party leaders.

Nizar who is also a former Perak menteri besar asked PAS members to rally behind Ahmad Awang (photo), who he said has more credibility than Hadi as a leader and ulama (religious leader).

"Hadi can speak Arabic, Ahmad too. But Ahmad can converse in English, while Hadi can't. We need leaders who are respected by the party and country. And with the new leadership who will celebrate Pakatan, we will destroy the myth that only Umno can lead the Malays," he said.

PAS party polls have always centred around two big factions, the ulama and the professionals or 'Erdogans'.

Nizar who is standing to retain his central working committee seat, lost his Kampar division chief post last month. He claimed it was the result of "party insiders" who slandered him worse than Umno did during the general election.

He said he was called "anti-ulama" as he was seen very critical of PAS current leadership.

"Is it true that the professionals wanted to topple the ulama even when I myself thought that without the ulama to counter the problems brought by Umno, PAS would fail.

"The real ulama can save the party as they have knowledge and wisdom to do so. Today I was accused to be anti-ulama and trying to topple the president.

"But in the meetings, if I criticise, it does not mean I do not love the person, I just love the party more," he said. - mk

 Mat Sabu sindir Hadi mahu bawa PAS keluar Pakatan...

Krisis dua pucuk pimpinan utama PAS dilihat semakin meruncing menjelang pemilihan parti itu awal Jun ini, dengan Timbalan Presiden Mohamad Sabu semakin lantang mengkritik kepimpinan presiden Datuk Seri Abdul Hadi Awang.

Mohamad atau lebih dikenali Mat Sabu yang akan mempertahankan jawatannya pada Muktamar Tahunan PAS 2015, mempertikaikan kegagalan Hadi menawan Terengganu, selain menyindir tindakan presiden PAS itu yang mahu keluar Pakatan Rakyat (PR).

"Pidatonya begitu hebat, ceramahnya, kuliahnya di Rusila , kereta 'parking' berbatu, jadi macam pekan hari bila Tok Guru Abdul Hadi beri kuliah, tapi bila pilihan raya umum (tetap) tak boleh ambil Terengganu (daripada Barisan Nasional (BN)).

"(Sehinggalah pada) tahun 1999 kita berpakat dengan PKR, dapatlah kita memerintah Terengganu. Ertinya kita ambil Terengganu pun melalui pakatan. Bagaimana nak kuasa? Kita kena berpakat," katanya pada ceramah isu semasa PAS malam tadi.

Turut hadir pada ceramah itu ialah Ahmad Awang yang akan menentang Abdul Hadi bagi jawatan presiden pada pemilihan PAS nanti.

Hadi sebelum ini dilaporkan berkata beliau akan membawa PAS keluar daripada PR jika DAP mencetuskan provokasi ke atas parti itu selepas tidak bersetuju dengan usaha parti Islam itu untuk melaksanakan hudud di Kelantan.

Ramai pemerhati politik melihat pemilihan PAS pada muktamar tahunan pada 4 hingga 6 Jun itu nanti sebagai pertembungan antara golongan ulama dan bukan ulama atau "Erdogan".

Mohamad yang dilihat pemerhati politik sebagai pro kepada PR, turut memberikan contoh senario di Kelantan sekitar 80-an ketika Datuk Nik Abdul Aziz Nik Mat memimpin PAS Kelantan, tapi gagal memerintah negeri itu kerana tidak bergabung dengan parti lain.

"Bila lahir parti Semangat 46. PAS berpakat dengan Semangat 46 (untuk) lawan Umno dan kita menang semua kerusi Dewan Undangan Negeri (DUN) dan Parlimen (di Kelantan).

"Ertinya sehebat-hebat Nik Aziz, dalam hal pilihan raya umum, (tetap) tak boleh ambil Kelantan (dari BN) melainkan bila tahaluf (bekerjasama) dengan Semangat 46. Ertinya dalam politik ini kita pakat, undi banyak, kita berpecah, undi  kurang," katanya.

Sementara itu, Ahmad ketika ditemui pemberita berkata beliau akan terus mengekalkan PAS dalam PR jika dipilih menerajui parti itu nanti. – tmi

Mat Sabu hits out at Hadi over Pakatan exit plan...

PAS deputy president Mohamad Sabu, or Mat Sabu, has intensified his attacks on the leadership of PAS president Datuk Seri Abdul Hadi Awang.

He cited Hadi's failure to capture Terengganu and sneered at his plan to take PAS out of opposition coalition, Pakatan Rakyat (PR).

"He (Hadi) is a great speaker. In Rusila (Marang), people flock to listen to Hadi but we still failed to capture Terengganu in the general election.

"In 1999, we joined up with PKR and only then managed to rule Terengganu," he said at a talk in Tumpat yesterday.

Also present was Ahmad Awang who will go against Hadi for the PAS president's post.

Hadi said he would take PAS out of PR if DAP continued to provoke the party after a disagreement over a plan to implement hudud in Kelantan.

Many political observers see the PAS elections from June 4 to 6 as a contest between the ulama (scholars) and Erdogan (professionals) groups.

Meanwhile, Ahmad told reporters he would continue to retain PAS in PR if elected to lead the party. – Bernama, May 30, 2015. - tmi


Ahli PAS bebas pilih 'kata dua' Hadi...

Menjelang Muktamar Tahunan PAS di Kuala Selangor Khamis ini, Datuk Seri Abdul Hadi Awang tampil mengemukakan formula mudah untuk perwakilan membuat pilihan pelbagai jawatan yang dipertandingkan.

Bagi Abdul Hadi, calon yang bertanding dalam muktamar kali ini terbahagi kepada dua, iaitu yang ingin mengikut telunjuk DAP atau  sebaliknya.

Sambil menyatakan perwakilan "bebas" membuat pilihan, bekas Menteri Besar Terangganu selama satu penggal itu berkata, barisan calon yang menawarkan diri untuk diundi perwakilan kali ini tidak lagi boleh dibahagikan kepada kumpulan ulama dan bukan ulama.

Memetik laporan Harakahdaily, Abdul Hadi berkata, kedua-dua kumpulan mempunyai ulama.

"Cuma satunya yang DAP hendak, satunya DAP tak nak... pilihlah," katanya.

Muktamar kali ini dianggap antara yang paling panas pernah dialami PAS sejak ia ditubuhkan pada 1951.

Berlaku pertembungan di antara kumpulan dikenali sebagai proulama yang semakin jelas  menjarakkan diri dengan gabungan Pakatan Rakyat.

Satu kumpulan lagi ialah beraliran sederhana - kebanyakannya disokong golongan profesional.

Abdul Hadi sendiri berdepan dengan bekas Yang Dipertua Persatuan Ulama Malaysia, Ahmad Awang.

Berdasarkan kenyataan Abdul Hadi disiarkan Harakahdaily, secara tidak langsung Ahmad dilabelnya sebagai ulama yang mengikut telunjuk DAP.

Ahli Parlimen Marang itu berkata, jika ada mana-mana parti lain - termasuk DAP - yang mempunyai  pandangan mengenai PAS dan mahu  kehendaknya diikuti, terpulang kepada ahli  PAS sendiri untuk membuat keputusan.

"Terpulang kepada ahli-ahli PAS hendak pilih. Hendak ikut dasar dia atau hendak ikut DAP,” tegasnya kepada media di Marang, Terengganu, semalam.- mk

PAS president Abdul Hadi Awang has told party members to choose between dyed-in-the-wool party leaders or those who are DAP sympathisers in the party polls next week.

"It is up to PAS members whether they want to liberate themselves and follow their own policies or to follow DAP's dictates," he was quoted as saying by Harakahdaily in his stronghold of Marang, Terengganu yesterday.

He said certain quarters were out to influence how PAS should conduct its business.

"There are other parties such as DAP, which have their views about PAS, these other parties including DAP want to demand (PAS to act) like this and like that," he said.

When asked about the the clash between the ulama (religious scholars) and professionals in PAS, Hadi brushed this aside, stating that it is instead a contest between groups that are supported and opposed by DAP.

"The issue of ulama does not arise as both sides have ulama.

"It is just one side is supported by DAP and another side is not supported by DAP... so make a choice.

"I want to give a chance to PAS members to choose whether we want to side with ourselves or with DAP.

Perhaps there are leaders who are endorsed by DAP and are of the same opinion with DAP," he said.

The election for PAS central leadership will take place on the first day of its three-day muktamar, on June 4.- mk

 

Sikap pasukan polis yang tidak mengambil peduli konsep kedaulatan undang-undang merupakan antara sebab kematian dalam tahanan, kata bekas ketua hakim negara, Tun Mohamed Dzaiddin Abdullah hari ini.

Dzaiddin, yang mengetuai Suruhanjaya Siasatan Diraja mengenai peranan dan tanggungjawab Polis Diraja Malaysia (PDRM) yang mencadangkan penubuhan Suruhanjaya Bebas Aduan dan Salah Laku Polis (IPCMC), menyifatkan perkara itu sebagai punca asas sambil menekankan keperluan mengkaji budaya yang diamalkan pasukan polis.

"Bagi memahami mengapa wujud kematian dalam tahanan polis, kita perlu mengkaji suasana dalaman PRDM dahulu," katanya ketika menyampaikan ucaptama di sebuah forum mengenai akauntabiliti polis di Kuala Lumpur hari ini.

"Sekarang ini, di kalangan PDRM wujud sikap tidak peduli terhadap kedaulatan undang-undang, dengan tidak menghiraukan hak asasi manusia. Dan bagi membincangkan budaya ini, seseorang perlu bermula daripada akar umbi, iaitu di bahagian asas sikap sedemikian dilahirkan."


Johor police today denied claims of foul play in the death of S Shahshikumar, insisting that the prisoner had hanged himself to death. "No foul play, he hanged himself in the prison cell," Johor police chief Rusli Ahmad told Malaysiakini today when contacted.

Rusli said this was based on a post-mortem conducted on 22-year-old Shahshikumar, whose death was only notified to his family a day after his death last Friday. "The body was post-mortemed on May 22. Police have submitted the investigation papers to the deputy public prosecutor for further action," added Rusli. He said the case has been classified as "sudden death".


Shahshikumar was serving a 10-year jail sentence for stealing rice and sardine.

Daripada tahun 200 sehingga 2014, sejumlah 261 kematian dalam tahanan dilaporkan, iaitu purata satu kematian sebulan.

Suruhanjaya diraja yang dipengerusikan Dzaiddin 10 tahun dahulu menyenaraikan 125 cadangan, termasuk penubuhan IPCMC bagi melawan salah guna kuasa polis.

Cadangan itu bagaimanapun dibantah hebat oleh polis, dan sebaliknya Suruhanjaya Integriti Agensi Penguatkuasaan yang dilihat tidak sekuat IPCMC, ditubuhkan.

Pengkritik berkata penubuhan suruhanjaya integriti itu tidak mengubah keadaan dan kematian tahanan terus berlaku walapun membabitkan kes berprofil tinggi. — f/bk

Anwar sakit...

Anwar Ibrahim dijangka akan dimasukkan ke Hospital Kuala Lumpur pada Selasa ini susulan kemerosotan kesihatannya, dan keluarganya menuntut diberikan kebenaran menemuinya sepanjang waktu itu, kata anak sulungnya, Nurul Izzah.

Menurut naib presiden PKR itu, Anwar berulang kali memohon mendapatkan rawatan perubatan namun permintaannya itu lewat dipenuhi kerajaan.

Ahli Parlimen Sungai Petani, Datuk Johari Abdul menuntut Menteri Dalam Negeri Datuk Seri Ahmad Zahid Hamidi memberikan jaminan Anwar dibenarkan berada di hospital sehingga keadaannya pulih.

"Kegagalan kerajaan memenuhi tuntutan ini merupakan sebuah pencabulan hak asasi Anwar untuk mendapatkan rawatan perubatan yang adil dan saksama," katanya pada sidang media di Ibu Pejabat PKR di Petaling Jaya hari ini.

"Walaupun kita dapat maklumat penjara akan membenarkan Anwar membuat rawatan, tapi kita akan tunggu dan lihat," kata Johari.

Ketua Whip Parlimen PKR itu berkata, pihaknya mendapat tahu keadaan Anwar lebih dari dua minggu.

"Sebenarnya kita dapat maklumat tentang keadaan Anwar agak lama. Cuma kita dimaklumkan tindakan sedang diambil, sedang ini kita nak tahu 2 hari ke, 3 hari ke.

"Tidak perlulah sampai kita terpaksa buat sidang media. Banduan ada hak-hak dia seperti termaktub dalam undang-undang," katanya.

Sementara itu, pada sidang media sama, anak perempuan Anwar, Nurul Nuha berkata, bapanya kehilangan 6kg berat badan sejak dipenjara selama 110 hari lalu.

Nurul Nuha turut berkata, terdapat simptom kesan darah dalam sampel najis Anwar yang memerlukan pemeriksaan perubatan secara lebih dekat.

"Beliau juga direkodkan mempunyai tekanan darah yang tidak menentu, dan bacaannya setinggi 163/108 walaupun sedang menjalani rawatan perubatan," katanya.

Selain itu, Anwar juga dilaporkan mempunyai kecederaan teruk di bahu kanan dalam kejadian setahun lepas, dan masih meletakkan pemimpin pembangkang itu dalam keadaan kesakitan dan memerlukan rawatan pemeriksaan MRI termasuk kemungkinan pembedahan untuk pulih sepenuhnya.

"Kami mendapat maklumat ayah berulang kali membuat permintaan untuk rawatan perubatan dan kemasukan ke hospital.

"Amat dikesali atas kelewatan kerajaan dalam memenuhi permintaan ini, sehinggakan permintaan mudah untuk menjalani pemeriksaan MRI ke atas bahunya juga tidak diendahkan untuk beberapa minggu," katanya.

Menurut Nurul Nuha, pihaknya juga dimaklumkan Anwar dilawati oleh doktor-doktor yang dihantar Kementerian Kesihatan yang kini sedang memerhatikan keadaan kesihatannya.

"Bagaimanapun kami dimaklumkan oleh peguam, yang menemuinya dalam tempoh 2 hari lepas, beliau akan dimasukkan ke Hospital Kuala Lumpur pada Selasa, 2 Jun hadapan untuk pemeriksaan, pemerhatian dan rawatan perubatan," kata Nurul Nuha.

Johari turut berkata, kelewatan Putrajaya itu akan menambahkan pandangan negatif kepada kerajaan.

"Tidak nampak elok apabila kerajaan lambat bertindak, rakyat jelata melihat apa yang tidak kena dengan kerajaan hari ini apabila orang yang dipenjarakan memerlukan rawatan.

"Amat menyedihkan tindakan ini amat-amat lambat. Ini menimbulkan tanda tanya kepada kita. Apa sebenarnya yang berlaku kepada pihak penjara dan Kementerian Dalam Negeri. Lama sangat, apa masalahnya ini," katanya.

Sementara itu, peguam Anwar, R. Sivarasa berkata, sekiranya dibiarkan berterusan, dikhuatiri tahap kesihatannya akan menurun.

"Kalau keadaan berterusan, beliau akan menghadapi penurunan tahap kesihatan yang serius.

"Apabila saya jumpa Anwar pada Khamis, beliau kata dapat pengesahan akan dihantar ke hospital, semalam apabila pasukan peguam Latheefa Koya dan N. Surendran bertemu beliau, itu adalah tarikhnya pada waktu itu," katanya.

Anwar kini sedang menjalani hukuman penjara selama 5 tahun di Penjara Sungai Buloh selepas Mahkamah Persekutuan menyabitkan beliau dengan kesalahan meliwat bekas pembantunya Mohd Saiful Bukhari Azlan.

Beliau juga kehilangan kelayakan sebagai ahli Parlimen Permatang Pauh dan jawatan ketua pembangkang di Parlimen.

Kerusi Parlimen Permatang Pauh kini disandang isterinya, yang juga Presiden PKR Datuk Seri Dr Wan Azizah Wan Ismail, selepas memenangi pilihan raya kecil (PRK) kawasan tersebut bulan lalu.

Kemenangan itu sekaligus menyaksikan Dr Wan Azizah dilantik menggantikan Anwar sebagai ketua pembangkang. – tmi

Ailing Anwar to be hospitalised after delays...

Jailed former opposition leader Anwar Ibrahim will finally be hospitalised at Hospital Kuala Lumpur (HKL) next Tuesday after long delays by the Prisons Department to requests for proper medical attention.
 
"We were informed two days ago that he will be admitted to Hospital Kuala Lumpur on Tuesday, June 2, for check up, observation and medical treatment," said PKR's Sungai Petani MP Johari Abdul at a press conference today.
 
Also present at the press conference at PKR's headquarters in Petaling Jaya were Anwar's daughters Lembah Pentai MP Nurul Izzah, Nurul Nuha and Nurul Hana.

Johari said Anwar's admission to hospital comes amid his erratic blood pressure as well as the presence of blood in his stool.

The PKR whip said Anwar has lost six kilogrammes since starting his prison sentence in February.

"More detailed medical checks are required on his (Anwar's) stool sample which has blood in it.

"Maybe his intestines are bleeding or perhaps it is the food, we don't know," said Johari.

He added that Anwar's blood pressure was also as high as 163/108 even though he is already on medication.

Basic human right

Furthermore, Johari said Anwar is also suffering discomfort from an old injury on his right shoulder and had been requesting for a magnetic resonance imaging (MRI) scan.

"The government's delay by several weeks to fulfil a simple request for an MRI scan on his shoulder is regrettable," he said.

Johari, together with Anwar's daughters, also appealed to Home Minister Ahmad Zahid Hamidi to see to Anwar's medical needs and to allow him to remain in hospital for as long as necessary.

"Any failure by the government to fulfil this would be a violation of Anwar's human rights for access to medical treatment," said Johari. - mk

Putrajaya slow in allowing treatment for sick Anwar

Kemelut 1MDB terus menghantui rakyat dengan jalan keluar yang masih kabur dan berliku-liku. Sama ada syarikat pelaburan itu mampu dipulihkan atau sebaliknya, yang nyata beban hutang RM42 bilion tetap menjadi tanggungan rakyat.

Selain hutang yang tinggi dan wang RM27 bilion tidak dapat dijelaskan ke mana perginya, setelah penyiasatan mencari kebenaran memasuki fasa audit oleh Ketua Audit Negara dan pendengaran di depan Jawatankuasa Kira-Kira Wang Negara atau PAC, isu pembohongan nampaknya mula mengambil tempat ketika ini seolah-olah untuk melindungi cacat-cela 1MDB.

Bermula dengan jawapan berbeza Najib Razak di Parlimen mengenai kedudukan wang USD1.103 bilion yang dibawa balik daripada Pulau Cayman ke Singapura, Najib selaku Menteri Kewangan ditaktif ramai telah melakukan perbuatan bohong dan memberi kenyataan tidak benar mengenainya.

Ramai yang garu kepala dengan jawapan berbeza Najib yang memiliki paling ramai pegawai dan penasihat sehingga keliru sama ada wang tunai, aset atau unit yang dipindahka dan disimpan di Singapura itu. Yang lain pula bimbang jika sebenarnya tidak ada apa-apa yang dibawa balik daripada Pulau Cayman.

Lebih mengelirukan sebelum itu CEO 1MDB bersungguh-sungguh mengesahkan kedudukan wang di Singapura dengan menyatakan beliau telah melihat penyatanya.

Tidak saja rakyat yang menilai jawapan berbeza Najib sebagai suatu pembohongan, malah bekas Perdana Menteri, Tun Mahathir Mohamad menganggap perbuatan itu sebagai jenayah di bawah Seksyen 218, Kanun Acara Jenayah yang boleh dipenjara sehingga tiga tahun.

Mengenai misteri ke mana perginya RM27 bilion milik 1MDB di sebaliknya hutangnya berjumlah RM42 bilion, kenyataan Najib menyatakan ianya tidak hilang tetapi tersimpan sebahagiannya dalam nilai tanah TRX dan Bandar Malaysia, juga boleh ditakrif sebagai berbohong kerana ianya dinilai berdasarkan harga semasanya ketika ini sedangkan ia dibeli daripada kerajaan dengan harga yang amat-amat rendah.

Bermakna, sehingga ini ke mana menyelinapnya wang RM27 bilion itu masih lagi tidak diberikan jawapan yang sebenarnya.

Apabila terdedah kemudian mengenai fasal 117 dalam M&A 1MDB iaitu satu peruntukan khas yang memerlukan kebenaran bertulis daripada Perdana Menteri bagi sebarang urusniaga syarikat pelaburan itu, sekali lagi Najib didapati telah berbohong dan tidak bercakap benar.

Ini berikutan kenyataan daripada Pejabat Perdana Menteri sebelum ini yang mengatakan Najib tidak terlibat dalam urusan harian 1MDB, sebaliknya memberitahu syarikat itu diurus oleh satu pasukan profesional dan berpengalaman.

Tetapi dengan adanya peruntukan khas dalam fasal 117 itu, bagaimanakan untuk mengelakkan daripada tanggapan Najib tidak tahu apa-apa mengenai perjalanan harian1MDB?

Tidakkah Najib juga berbohong dalam hal ini?

Ketika Arul Kanda Kandasamy, CEO 1MDB dijadual mengadap PAC pada 26 Mei lalu dan beliau tidak dapat menghadirinya, sekali lagi unsur-unsur pembohongan terdedah.

Arul membeli alasan tidak dapat hadir kerana notis yang diterimanya adalah pada 21 Mei dan beliau sudah pun mempunyai jadual di luar negara pada 26 Mei itu.

Bagaimanapun, dengan penjelasan Nur Jazlan, Pengerusi PAC bahawa mereka menghantar surat kepada Kementerian Kewangan mengenai pemakluman jadual pendengaran itu seawal 6 Mei lagi, jelas ada permainan "membeli masa" dalam hal ini.

Mengapa surat PAC bertarikh 6 Mei kepada Kementerian Kewangan tetapi hanya disampaikan kepada 1MDB pada 21 Mei? 

Persoalan lebih penting berdasarkan konsep pertanggungjawaban ialah siapa Menteri Kewangan dan adakah kelewatan itu dalam pengetahuan Najib dan para pegawainya?

The 1MDB scandal has produced one lie after another in recent days, political analyst Shahbudin Husin alleges in his latest blog posting.

“It would be interesting to see how the Auditor-General and the Public Accounts Committee (PAC) deals with them,” he remarks.

“The people continue to be haunted by these lies,” he says. “Whether the company can be salvaged or otherwise, the fact remains that the public will have to shoulder its RM42 billion debt burden. That’s the talk wherever the people gather in public and in private.”

Shahbudin wonders whether new lies will emerge in the coming days. “As the late P Ramlee would say, ‘Berapa banyak bohong, daa?’ (How many more lies, man?)”

He recalls the recent moment of high drama when 1MDB Chief Arul Kanda Kandasamy and the company’s first CEO, Shahrol Halmi, said they could not attend the bipartisan Public Accounts Committee’s hearing on the company.

“Strangely,” he says, “it was Prime Minister Najib Abdul Razak who acted as spokesman for the missing duo by pledging that they would not run away and would in fact turn up for the hearing once a new date was set. Is he their public relations officer?

“It appears like they were buying time with all their explanations. Shahrol even asked for a month’s delay in the hearing on the grounds that he needed time to prepare himself.”

Arul Kanda, he observes, made much of being informed late although PAC Chairman Nur Jazlan confirmed that the Finance Ministry had been given ample notice.

“Then, the story emerged that the Finance Ministry informed 1MDB late and by that time Arul Kanda and Shahrol had made travel arrangements as they were supposed to be overseas on important assignments.”

But it appears that Arul Kanda was in town and not overseas at all, says Shahbudin. “He was seen having dinner with Barisan Nasional Backbenchers Club Chairman Shahrir Samad.

“Petaling Jaya Utara MP Tony Pua has already demanded that Arul Kanda and Shahrol produce their air tickets to prove that they were overseas.”

It has been estimated by various parties, including former prime minister Mahathir Mohamad that at least RM27 billion of 1MDB money cannot be accounted for, Shahbudin notes.

He says Najib’s explanation on the RM27 billion was the only one the people have at the moment. “It doesn’t make much sense either,” he adds. “Najib claims the money was not missing but was in the form of assets in the land bank at Sungei Besi (500 acres) and in the 70 acres in the Tun Razak Exchange (TRX) in Kuala Lumpur.”

The lands were bought very cheaply from the government and comes nowhere near RM27 billion even after revaluation, he notes. “Najib not only continues to repeat the story on the monies not being missing, and the lies on the land value, he has also been found lying repeatedly on the matter of the USD1.103 billion purportedly transferred from the Cayman Islands to BSI Bank in Singapore.

“It seems that Najib, surrounded by so many experts, has been confused by the difference between cash, assets and units.”

Shahbudin says no one seems any wiser as to what these “units” in Singapore are and what their total value is.

“We are no nearer to unravelling the mystery of the missing billions,” he adds. - fmt

Arul, Shahrir, Paul Stadlen In "Up To Something" Meeting...

Arul Kanda said he could not attend the PAC because he was travelling. Here he is late at night (last nite?) meeting Shahrir Samad in a hotel in town.

What was this late night meeting about? Arul's mornings, afternoons, evenings and nights are filled with closing the huge gaping holes in 1MDB and the continuous bungles by the PM over the scandal. 

I bet he did not meet Shahrir Samad to talk about the Rohingya problem. Shahrir Samad is chairman of the BN Back Benchers club. 

More importantly Shahrir hails from Johor - the same state which Nur Jazlan comes from. Nur Jazlan is of course the chairman of the PAC which Arul Kanda has been avoiding.  

So were they talking about the Rohingyas ?

Was this a "coaching" session? If they want to know this point about the Rohingyas, this is how they must frame the question. If they want to know how the Rohingyas went undeteced, then they should not raise that other point. Bla bla bla.

Alhamdulillah selepas 1 minggu, kutipan kempen ‪#‎tutup1MDB‬ ‪#‎kembalikanwangrakyat‬ telah melepasi RM10,000. Banyak askar-askar upahan Umno yang menyerang saya kononnya ini mengambil dana secara haram kerana NOW didaftarkan di bawah Akta Syarikat.

Berikut adalah penjelasan saya:

1) Akta Syarikat tidak menghalang sesuatu entiti yang didaftarkan beroperasi bagi tujuan bukan keuntungan. Banyak rumah amal, rumah kebajikan, NGO dan lain-lain beroperasi dengan pendaftaran di bawah Akta Syarikat

2) Banyak entiti bukan keuntungan seperti ini memilih untuk mendaftar di bawah Akta Syarikat dan bukan Pendaftar Pertubuhan kerana tidak mahu terdedah kepada pelbagai karenah yang boleh memangsakan entiti di bawah Pendaftar Pertubuhan, seperti ugutan mengharamkan DAP apabila badan itu dilihat tidak selari dengan Umno/Barisan Nasional

3) Akta BAFIA yang disebut Ramesh Rao tidak wujud lagi dan sudah dihapuskan. Akta AMLA yang disebut juga tidak berkaitan dengan kutipan derma seperti ini

4) Ada satu undang-undang yang mencegah orang ramai tanpa lesen mengutip deposit seperti mana bank atau firma pelaburan dilesenkan mengutip deposit. Peruntukan undang-undang itu khusus bagi tujuan pelaburan iaitu mengutip wang tanpa lesen kononnya untuk memberi keuntungan kepada pelabur (contoh skim cepat kaya). Peruntukan itu tidak terpakai bagi kutipan derma terbuka seperti ini

5) Tindakan mengutip derma oleh entiti yang didaftarkan di bawah Akta Syarikat tidak menyalahi undang-undang dan biasa dibuat. Contohnya, media-media Umno seperti Utusan, TV3 dan lain-lain sering melancarkan tabung memohon derma dari rakyat. Ini sama sahaja dengan tabung #tutup1MDB yang dilancarkan NOW

6) NOW menguruskan dana ini secara telus dengan mengumumkan kutipan setiap hari dan tujuan kutipan itu dibuat. Apabila pembayaran dibuat, NOW juga akan mengumumkan kepada siapa bayaran itu dibuat. Tidak timbul soal penyelewengan

7) Ini tindakan murahan oleh Umno kononnya untuk mengalihkan perhatian dari skandal RM42 bilion 1MDB dan GST. Lalu dibayarnya aktivis upahan ini untuk membuat bising untuk menutup kemarahan rakyat

Let Najib stay in order to stop Zahid inching the PM post...

For Zahid's sake, M'sians must support Najib...

This is not an endorsement of Najib Abdul Razak's leadership. This is a warning of what the future might hold should the current prime minister be ousted from power.

Even if federal power has to be placed in an opposition bloc riddled with flaws and infighting, so be it.

Anything is better than the prospect of Ahmad Zahid Hamidi inching closer to the prime minister post.

For this reason, and this reason alone, Najib should remain as prime minister until the next general election.

And hopefully, former premier Dr Mahathir Mohamad's prediction of defeat for Umno would come true.

As it stands now, should Najib be forced to step down, he would be replaced by current number two Muhyiddin Yassin.

The deputy prime minister position would then require a candidate and topping the list is Zahid, the current home minister.

Like it or not, Zahid is the most popular of the three Umno vice-presidents, which includes the more sensible Shafie Apdal and Hishammuddin Hussein, who is Najib's cousin.

Mahathir might not live long enough to see the damage which could be inflicted by a Muhyiddin-Zahid combination.

Then again, it is often said while a politician thinks of the next election, a statesman thinks of the next generation.

Mahathir is not a statesman and has never given much thought about the next generation, apart from the political future of his son.

All that matters to him is for Umno to survive the next general election, by hook or by crook and someone like Zahid fits the bill.

The home minister is someone who has often showed that he would not hesitate to pull all the stops to maintain status quo.

Najib might do the unthinkable

Muhyiddin, on the other hand, has often been criticised as a racist given his "Malay first, Malaysian second" stand.

He is someone who has shown little interest in becoming prime minister. Previously, there were even rumours that he might retire.

Muhyiddin is perhaps being forced by certain quarters in Umno to take over the baton from Najib at least on a temporary basis until after the next general election.

Following which, he could pass the torch to Zahid.

Zahid has little to show for himself in terms of credentials, being someone who rose up the ranks in Umno by fashioning himself as an ultra Malay, nothing more, nothing less.

He was once a close ally of Anwar Ibrahim, but then switched camps when it became obvious that backing the axed deputy premier could prove to be costly to his political ambitions.

History has shown that leaders who lack cerebral substance would resort to might and fear to continue their rule.

Then again, Najib too might do the unthinkable as suggested by A Kadir Jasin, a close associate of Mahathir, which is to replace Muhyiddin with Zahid as deputy premier.

Since the FBI letter scandal, Zahid's robust image among Umno members has been riddled with holes and left him at the mercy of the prime minister.

Following that, Zahid has been singing praises of Najib, which does not come as a surprise given his track-record of switching sides.

So to prevent the possibility of Zahid climbing the ladder either way, Malaysians must stop calling for Najib's head to roll.

This is the predicament of Malaysians - for doing so could be a case of jumping from the frying pan into the fire. - mk

GST untuk selamatkan gomen, kata Dr M...

Bekas perdana menteri Tun Dr Mahathir Mohamad berkata kerajaan memperkenalkan Cukai Barangan dan Perkhidmatan (GST) bagi menampung beban hutangnya.

Katanya, hutang ini ditanggung melalui syarikat seperti 1Malaysia Development Berhad dan Pembinaan PFI Sdn Bhd.

"Sudah tentulah usaha seperti 1MDB dan Pembinaan PFI hanya menyebabkan hutang yang tidak dapat ditanggung.

"Apabila syarikat ini mengalami kerugian, beban kewangan kerajaan akan meningkat.

"Dengan memperkenalkan GST, kerajaan sebenarnya meminta orang ramai, termasuk yang tidak sepatutnya dikenakan cukai pendapatan untuk menyelamatkan kerajaan,” katanya.

Mahathir menyatakan demikian dalam tulisan terbaru di blognya, chedet.cc hari ini.

Kedua-dua 1MDB dan Pembinaan PFI dimiliki oleh Kementerian Kewangan dan masing-masing menanggung hutang RM42 bilion dan RM27 bilion.

Mahathir berkata kerajaan tidak perlu memperkenalkan GST jika ia mampu mengurus kewangannya dengan baik.

Jadi miskin untuk memperkaya kerajaan

“Kerajaan boleh mengelak dari mengenakan cukai tambahan ini ke atas rakyat jika ia mengurangkan kosnya.

"Menaikkan gaji tanpa peningkatkan produktiviti, menambah jumlah hari cuti, mengganti cuti pada hujung minggu, menetapkan gaji minimum yang tinggi, membazir wang pada kemewahan...

“Semua ini meningkatkan perbelanjaan kerajaan dan meningkatkan defisit,” katanya.

Tambahnya, langkah yang lebih baik adalah mendidik dan melatih pekerja untuk pekerjaan dengan gaji lebih tinggi.

Mahathir juga menjawab rungutan kerajaan ke atas peniaga yang menaikkan harga barangan walau perniagaan tersebut tidak dikenakan GST.

"Walaupun apa yang (pengguna) beli tidak dikenakan GST, pemborong yang membekal barangan kepada penjual terpaksa menaikkan harga kerana mereka perlu membayar GST.

"Penjual terpaksa menampung kos tinggi dengan mengenakan harga lebih tinggi kepada pelanggan mereka. Akhirnya, rakyat yang terpaksa menanggung kos GST,” kata Mahathir.

Tambahnya, pelaksanaan GST itu akhirnya akan mengurangkan kuasa beli pengguna.

"Dalam kata lain, mereka menjadi lebih miskin demi memperkayakan kerajaan,” katanya lagi. - mk

Najib ketika menjawab soalan MP PJU Tony Pua diParlimen menjelaskan wang 1MDB yang disimpan diCaymen Island telah dipindahkan ke BSI S'pore dlm bentuk tunai... selepas itu PMO mengeluarkan kenyataan 'membetulkan kenyataan Najib bahawa simpanan sebanyak RM3.6 billion BUKAN dlm bentuk tunai tapi dokumen dan disebut 'Unit'..dan apa yg dibaca oleh Najib diParlimen berdasarkan info yg dibekalkan oleh 1MDB . 

BSI bank of Switzerland telah menyatakan dokumen (penyatan kewangan) cawangannya di S'pore adalah palsu dan bukan dikeluarkan oleh mana mana cawangan BSI. Maka jelaslah kenyataan bertulis yang kedua oleh Najib kepada Parlimen bahawa yang disimpan adalah dokumen juga tidak benar.

BSI bank telah lapur kepada Monetary Authority of Singapore (MAS – Penguasa Kewangan Singapura) bahawa tidak ada wang 1MDB yang disimpan dengannya. MAS melapur maklumat ini kepada Bank Negara. Ini jelas dari pengakuan bahawa kononnya lapuran ini tertakluk kepada protokol kerahsiaan antarabangsa (Egmont principles of information exchange) dan kehendak kerahsiaan di bawah seksyen 10 AMLA. Dari kenyataan ini adalah jelas bahawa Bank Negara telah terima lapuran Monetary Authority Singapore dan siasatan hendaklah dijalankan...

Sarawak Report terus persoal jawapan Arul...

Laman web pemberi maklumat, Sarawak Report, kini mahu presiden 1Malaysia Development Bhd (1MDB) Arul Kanda Kandasamy menjelaskan transaksi firma itu dengan Good Star Limited, sebuah syarikat yang dikuasai ahli perniagaan Low Taek Jho, selepas beliau menafikan memberikan kenyataan palsu kepada Bank Negara hari ini.

Dalam satu kenyataan, Sarawak Report berkata, ia mempunyai bukti yang penyata bank palsu digunakan bagi menyokong dakwaan yang terdapat wang tunai di dalam akaun dana pelaburan negara itu di dalam Bank BSI Singapura.

Putrajaya berkata baru-baru ini, wang yang ditebus dari Kepulauan Cayman sebenarnya aset dalam bentuk dolar Amerika Syarikat di Bank BSI.

"Memandangkan Kandasamy sekarang bersedia menjawab beberapa butiran periferal berhubung laporan kami, mungkin beliau juga akan tampil dengan penjelasan dan penerangan mengenai fakta penting perkara itu, iaitu kenapa 1MDB membayar AS$1.6 bilion kepada Good Star Limited?" soal Sarawak Report.

Laman itu juga menuduh Arul, yang juga pengarah eksekutif kumpulan 1MDB, menghantar melalui faks penyata bank palsu kepada Bank BSI di Singapura.

"Jika Encik Kandasamy tidak melaporkan perkara ini kepada Bank Negara, mengapa dia tidak melaporkannya?" soal Sarawak Report.

Terdahulu hari ini, Arul berkata Sarawak Report berbohong mengenai 1MDB membekalkan "maklumat palsu dan dakwaan tidak berasas langsung" mengenai penyata bank syarikat itu.

"Ini satu pembohongan. Saya tidak pernah memberi sebarang kenyataan begitu kepada Bank Negara. Untuk menyatakan sebaliknya adalah terang-terangan palsu dan tidak betul, begitu juga apa-apa dakwaan yang berdasarkan premis ini." 

Katanya, 1MDB bekerjasama dengan pihak berkuasa berhubung akaunnya dan memberi jaminan, siasatan yang dijalankan akan memberi jawapan kepada soalan mengenai urus niaga dan hutang syarikat milik Kementerian Kewangan itu. – tmi

Whistle-blower site grills 1MDB’s Arul further after denial...

Whistleblower site, Sarawak Report, now wants 1Malaysia Development Bhd's (1MDB) president Arul Kanda Kandasamy to explain the firm's transaction with Good Star Limited, a company controlled by businessman Low Taek Jho, after he denied furnishing a false statement to Bank Negara today.

In a statement, Sarawak Report said it has evidence that a false bank statement was used to support claims that there was cash in the state investment arm's account in BSI Bank Singapore.

Putrajaya had said recently that the money redeemed from the Cayman Islands are actually assets in US dollars in BSI Bank.

"Now that Mr Kandasamy is willing to address some of the peripheral details on our reporting perhaps he would also come forward with clarifications and explanations on the key facts of the matter, which is why did 1MDB pay US$1.6 billion to Good Star Limited?" asked Sarawak Report.

The site also accused Arul Kanda, who is also 1MDB's group executive director, of faxing the false bank statement to BSI Bank in Singapore.

"If Mr Kandasamy did not report this to Bank Negara, why did he not report it?" asked Sarawak Report.

Earlier today, Arul Kanda said Sarawak Report is lying about 1MDB by providing "false information and direct unfounded allegations" about the debt-laden strategic investor's bank statements.

"This is a lie. I have never provided any such statement to Bank Negara. To state otherwise is blatantly false and incorrect, as are any allegations that are based on this premise."

He added that 1MDB's cooperation with authorities over its accounts and assured that the investigations will provide answers to questions about its business dealings and debts. – tmi

6 petua untuk Najib kekal kuasa...

Walaupun pelbagai asakan, Perdana Menteri Datuk Seri Najib telah mengisytiharkan akan berkhidmat setelah tamat tempoh.

Bagaimanapun, persoalannya dapatkan beliau bertahan hingga ke akhir?

  1. Rombakan kabinet harus dilakukan dengan mengetepikan “unsur tidak mesra” seperti timbalannya sendiri Tan Sri Muhyiddin Yassin dan Menteri Pembangunan Luar Bandar Dan Wilayah Datuk Seri Shafie Apdal.
     
  2. Lantik Menteri Dalam Negeri Datuk Seri Zahid Hamidi sebagai timbalan perdana menteri dan meletakkan Kementerian Kewangan bawah sepupunya Datuk Seri  Hishammuddin Hussein yang kini mengawal Kementerian Pertahanan. Zahid juga boleh diberi portfolio kementerian  Hishammuddin sekarang.
     
  3. Ambil alih Kementerian Dalam Negeri supaya darurat boleh diisytihar dengan lebih mudah jika berlaku undi tidak percaya di Parlimen.
     
  4. Upah penulis surat layang “berwibawa: untuk memburuk-burukkan Tun Dr Mahathir Mohamad, dengan ketua umum PKR Datuk Seri Anwar Ibrahim menyumbang kata pengantarnya. Ini, kata Kadir, boleh ditukar dengan ganjaran beberapa hari keluar penjara.
     
  5. Gantikan Peguam Negara Tan Sri Abdul Gani Patail dengan peguam Umno Datuk Mohd Hafarizan Harun.
     
  6. Hilangkan beban hutang 1MDB dengan meminta ahli perniagaan Jho Low menguruskan penjualan syarikat pelaburan negara itu kepada sahabat-sahabat Arabnya.
 Menulis dalam blognya hari ini, Kadir berkata Najib mesti bertindak sekarang susulan pendedahan bahawa simpanan 1MDB di Singapura bukan dalam bentuk tunai seperti dijelaskan awal dalam jawapan bertulis parlimen.

Katanya, pindaan jawapan itu, kepada simpanan dalam bentuk “unit” boleh menyebabkan prosiding ala pemakzulan (penyingkiran) terhadapnya dibuat.

“Ingat pemakzulan terhadap presiden Indonesia  Abdurrahman Wahid pada 2001? Tetapi bawah undang-undang kita, tiada peruntukan pemakzulan oleh Parlimen.

“Dewan bagaimanapun boleh meluluskan usul tidak percaya,” katanya. - mk


Najib Goes On The Offensive...

Najib in his latest reply, he among other things, debunked the claim that 1MDB is in financial crisis. He said the strategic investment company of the Ministry of Finance (MoF) has assets worth RM51 billion. He accused Dr Mahathir of manipulating the truth. (Read here)

But the public are more likely to be interested in Dr Mahathir’s poser concerning the possibility of the Prime Minister having lied to Parliament.

The question whether Mohd Najib has misled the Parliament on 1MDB’s so-called US$1.03 billion deposits in Singapore has the potential of creating a messy legal issue for the PM.

His attempts to distance himself from 1MDB has been effectively thwarted when Malay Mail Online revealed that according to Clause 117 of the Memorandum and Articles of Association (M&A) of the Terengganu Investment the Authority (TIA), the predecessor to 1MDB, inked on 27 February 2009, places absolute powers over the company’s decisions in the hands of the Prime Minister.

It states, among other things that the Prime Minister’s written approval is needed on any financial commitment (including investment), restructuring or any other matter which was likely to affect the guarantee given by the Federal Government of Malaysia for the benefit of the company, national interest, national security or any policy of the Federal Government of Malaysia.

Dr Mahathir immediately penned a comment in his blog to restate his earlier assertions that Mohd Najib is responsible for 1MDB.



In Nigeria, Najib would be impeached

In a more robust democracy, including Indonesia and Nigeria (YES Indonesia and Nigeria), Mohd Najib would have been referred to the ethnics committee and may even face impeachment proceedings.

Remember the impeachment of Indonesian President Abdurrahman Wahid in 2001? But under our law, there is no provision for impeachment by the Parliament. The House can, however, pass a vote of no confidence.

An ex-magistrate said the fact that the PM subsequently corrected his statement does not absolve him from blame. It is relevant only in mitigation.

Initially Mohd Najib said the deposits in Singapore were cash. He reinforced this in an interview aired by TV3 on April 10, when he said: “Time will determine but at a certain time, the money will be brought back to Malaysia.”

Then the deposits became asset certificates and finally, according to second Finance Minister, Ahmad Husni Hazadlah, they were “units”.

In the meantime Umno is in disarray and who is running the country we don’t know. It could be on autopilot but will crash at some point of time when it runs out of juice.

We don’t anymore know who is what in the Umno Supreme Council, the state liaison committees, the divisions and branches.

All that we know is the most of the Supreme Council members have their lips sealed while the palms of the division chiefs have been sufficiently greased. But an Umno veteran who received the visit of several deputy divisional chiefs said these people are angry and demoralised.

The expose that 1MDB’s business dealings require the consent of the prime minister also put his defamation suits against critics, including DAP Petaling Jaya Utara MP, Tony Pua and PKR Pandan MP Rafizi Ramli as well as the portal Media Rakyat in jeopardy. His wife, Rosmah Mansor is also suing.

I had, from the outset, maintained that it was unwise for the PM to sue his adversaries. He should fight them in the political arena instead of the courtroom. Anwar Ibrahim went to jail for corruption (abuse of power) in 1999 when he made a police report against a year-old “surat layang” by businesswoman Umi Hafilda.



The PM’s Options - 6 steps Najib must take to stay in power...

Having declared that he would not give up because of one man (read Dr Mahathir) and that he has the support of Umno, the PM must to a couple of things to further entrench himself.

He should immediately (1)reshuffle the Cabinet to exclude Deputy Prime Minister, Muhyiddin Mohd Yassin, for being a pain in the rear, and possibly Sabahan Shafie Apdal.

In Muhyiddin’s place he should put (2)Ahmad Zahid Hamidi. The PM many want to rid himself of the 1MDB burden by passing the MoF job to Hishammuddin Hussein. Hishammuddin’s seat at Defence Ministry can be assumed by Ahmad Zahid.

Mohd Najib may want to take charge of the (3)Home Ministry. The portfolio is essential just in case he is thinking of declaring an emergency should Muhyiddin or Tengku Razaleigh Hamzah launch a vote of no confidence against him in Parliament.

Attack on Dr Mahathir should be made more vicious. (4)Writers of the calibre of late Khalid Jafri (who wrote the notorious “50 Dalil”) should be engaged to expose Dr Mahathir man and his supporters.

I am sure there are Chinese, Indian and even Malay businessmen who are willing to sponsor the project. To make it even more sensational, Anwar Ibrahim could be tempted to endorse it via a preface. I am sure that can be arranged if the latter is given a few days to rest and recreate at, say, the HUKM.

The PM has to replace the Attorney General, (5)Abdul Gani Patail, who appears to be on a losing streak. Also he has been on extension for far too long. The safest bet for the PM is to nominate someone he knows well and trust like the senior Umno lawyer Mohd Hafarizam bin Harun.

He could fulfil the “ultimatum” by the Umno Supreme for the 1MDB crisis to be solved by June 31 by commissioning (6)Jho Low to be middleman once again.

Jho Low should able to convince his Arab friends from PetroSaudi and elsewhere in the Gulf to underwrite 1MDB’s debts although this would mean that 1MDB’s assets including government land that it bought cheaply and the IPPs that it bought above market Price would fall into foreign hands. This could be the strategic aim of 1MDB. 

By the way, Felda Global Ventures’ share on Bursa Malaysia fell to RM1.92 yesterday and comes June, the settlers’ cooperative, Koperasi Permodalan Felda (KPF) will have to declare its half yearly dividend, which in the past had been above 10%. - a.kadir jasin

Dr.M - 1MDB terlibat dengan 'money laundering' kah...


1. Apabila jawapan kepada soalan yang ditujukan kepada Perdana Menteri atau Menteri oleh ahli Parlimen walaupun jawapan itu disediakan oleh pegawai, tetapi yang bertanggungjawab ialah menteri kementerian berkenaan. Dialah yang akan memikul beban kesalahan jika ini berlaku. Walaupun prosiding dalam Parlimen diberi kekebalan melalui undang-undang, tetapi jika jawapan tidak berasas kepada kebenaran, ia tetap tidak benar dan tidak lagi kebal apabila jawapan itu disiar untuk pengetahuan umum tanpa dinafi.

2. Pegawai-pegawai yang menyediakan jawapan tidak kebal. Mereka masih bertanggungjawab terhadap isi kandungan jawapan. Jika didapati mereka tidak tentukan jawapan yang disediakan oleh mereka berasas kepada kebenaran, kerana tidak berasas kepada maklumat dan bukti yang sahih, mereka boleh dituduh sengaja mencuba melindungi menteri kerana menyembunyikan kebenaran. Dengan perkataan lain menteri masih boleh dituduh membohong dan pegawai juga akan dituduh bersama.

3. Menteri lebih bertanggungjawab kerana dikehendaki menyemak dan menentukan jawapan yang dibuat atas namanya adalah benar.

4. Perdana Menteri telah jelaskan bahawa wang sebanyak USD 1 billion tidak dibawa balik ke Malaysia kerana Bank Negara akan menganggu urusan keluar masuk wang yang lebih dari 50 juta.

5. Setahu saya bank-bank telah diarah menyoal urusan yang lebih dari RM50,000/-. Jika urusan tidak ada kaitan dengan “money laundering”, iaitu yang didapati secara haram, ia tidak jadi masalah.

6. Soalnya apakah 1MDB dengan pengetahuan penasihatnya terlibat dengan money laundering, sehingga wang dari Cayman Islands terpaksa disimpan di Singapura.

7. Singapura juga memeriksa dengan teliti wang yang masuk-keluar negara itu bagi mengelak jenayah money laundering. Apakah 1MDB tidak tahu akan peraturan Monetary Authority of Singapore (MAS)?

8. Atau apakah tujuan sebenar ialah untuk membohong berkenaan penyimpanan wang ini di Singapura, iaitu sebenarnya tidak ada wang yang disimpan di sana, bahawa wang sebanyak lebih satu billion U.S. dollar sudah hilang.

9. Jika tidak dapat dibuktikan wang ini ada di Singapura, maka sekali lagi, pegawai dan menteri bersalah kerana membohong.

10. Berkenaan dengan Bank Negara enggan memberi maklumat berkenaan dengan laporan kepadanya oleh MAS Singapura, jika ini didapati melindungi pembohongan berkenaan wang 1MDB yang dikatakan berada di Singapura, ini juga merupa satu jenayah dibawah undang-undang jenayah negara.

11. Sesuatu yang aneh dan salah ialah keengganan jabatan-jabatan Kerajaan yang bertanggungjawab mengambil tindakan berkenaan dengan dakwaan yang telah dibuat dan laporan polis berkenaan kehilangan wang 1MDB, syarikat milik Kerajaan. Sebaliknya orang yang membuat laporan polis telah dimufliskan, rumahnya dirampas dan siasatan dibuat keatasnya kononnya dia terlibat dengan membiayai gerakan keganasan dan money laundering.

12. Ada pemberita akhbar yang ditangkap kononnya kerana bersalah di bawah Akta Hasutan dan kemudian dibebas kerana tidak ada kesalahan yang dilakukan oleh mereka.

13. Saya sendiri biasa digeledah oleh jabatan hasil dalam negeri semasa memiliki klinik perubatan. Saya terpaksa bayar cukai tambahan kerana segala penjelasan saya tidak diterima. Dijelaskan kepada saya jika saya bawa kes ke mahkamah, besar kemungkinan saya didenda tiga kali ganda. Siasatan ke atas saya dibuat kerana sangkaan bahawa sebagai doctor awam saya tentu kaya dan tidak bayar cukai sepenuhnya.

14. Pegawai-pegawai Kerajaan yang hidup lebih mewah dari pendapatan mereka biasanya disiasat oleh jabatan (board) hasil dalam negeri. Tetapi apabila Menteri atau orang awam tertentu diketahui hidup terlalu mewah, siasatan tidak dibuat. Sebaliknya orang yang membuat laporan polis berkenaan perkara tertentu disiasat.

15. Amatlah menyedihkan apabila ternampak ada pilihkasih dalam siasatan jenayah. Hari ini Malaysia sudah disenaraikan sebagai antara 10 negara yang rasuah berleluasa.

16. Rakyat Malaysia tertakluk kepada undang-undang yang sama. Janganlah hendaknya ada pilihkasih dan diskriminasi dalam menguatkuasa undang-undang. - chedet

Dr M: 1MDB S'pore sling a bid to dodge tax man...

Continuing the diatribe, Dr Mahathir Mohamad has asked if 1MDB was involved in money laundering, with the knowledge of its advisor - Prime Minister Najib Abdul Razak.

The former premier questioned if this prompted the money from Cayman Islands to be kept in Singapore.

"Singapore scrutinises all money coming in and going out of the country to prevent money laundering.

"Doesn't 1MDB know about the Monetary Authority of Singapore (MAS) rules? " he asked in his blog post.

Mahathir was responding to Najib's Parliamentary written reply that the US$1.103 billion (RM4 billion) was kept in Singapore instead of Malaysia as Bank Negara would scrutinise all transactions valued at more than RM50 million [See image at end of article].

However, Mahathir said banks intervening in such transactions would not be an issue if the transaction was legitimate and not money laundering.

Malaysiakini has contacted 1MDB on the matter and is awaiting response.

Mahathir had zoomed in on the 1MDB's US$1.103 billion after the government issued confusing explanations on the status of the funds.

Ministers check written replies

1MDB had said the money was redeemed in cash from Cayman Islands after an aborted deal with PetroSaudi and later kept in BSI Singapore.

This was also reiterated by Najib in a parliamentary written reply on March 10 but later changed his answer on May 20 that they were in the form of assets.

This became even more baffling when Finance Minister II Husni Hanadzlah clarified the assets were in "units" but refused to explain what he meant.

Mahathir had accused Najib of lying and committing criminal wrongdoing to cover up the matter.

In the blog posting today, Mahathir reiterated this, stating that even though the written reply was prepared by government officials, the minister is ultimately responsible for checking them.

"Government officers which prepare the answers are not immune (to prosecution). They are responsible for the answers.

"If it is found that the answer prepared by them are not based on the truth and valid evidence, they can be prosecuted for attempting to protect the minister by hiding the truth.

"In other words, the minister can be charged for lying the government ministers can be charged together," he said. - mk


Mahathir warns BNM against 1MDB cover-up...

Former prime minister Dr Mahathir Mohamad has warned Bank Negara against covering up for debt-ridden 1MDB.

Mahathir said doing so would expose the central bank to criminal prosecution.

He was responding to Bank Negara governor Zeti Akhtar Aziz (photo) who on Tuesday confirmed receiving reports from the Monetary Authority of Singapore (MAS) on 1MDB but refused to divulge details.

"On Bank Negara's refusal to give information about the report made by MAS in Singapore, if it is found to be shielding lies about 1MDB's cash which is said to be in Singapore, it is also a crime under the country's criminal law," he said in a blog posting today.

The report is over 1MDB's alleged deposit of US$1.103 billion in BSI Singapore, which is now the subject of confusion.

Malaysiakini has contacted Bank Negara on the matter and is awaiting response.

Cash, assets or units?

Prime Minister Najib Abdul Razak in Parliamentary writen reply on March 10 said the amount had been fully redeemed in the form of cash from the Cayman Islands and is now kept at BSI Bank Limited Singapore.

However, on May 20, Najib, who is also Finance Minister, changed his answer on the matter, stating there is no cash in BSI Singapore, but merely "assets in US dollars".

This became even more baffling when Finance Minister II Husni Hanadzlah clarified the assets were in fact in the form of "units" but refused to explain what he meant by that.

Bank Negara has remained mummed to date, insisting that it cannot comment on individual entities.

Mahathir said he is puzzled by the refusal of government authorities to act on what he said is the "disappearance" of 1MDB's funds.

"Instead, those who made police report (against 1MDB) is made a bankrupt," said Mahathir, in reference to sacked Batu Kawan Umno division vice chairperson Khairuddin Abu Hassan. - mk

Dr M: Doktor disiasat, menteri mewah terlepas...

Tun Dr Mahathir Mohamad membangkitkan dakwaan pilih kasih terhadap pihak didakwa hidup mewah di negara ini.

Katanya beliau sendiri pernah digeledah oleh Lembaga Hasil Dalam Negeri (LHDN) kerana mempunyai klinik dan dianggap kaya sebagai seorang doktor serta tidak membayar cukai sepenuhnya.

Begitu juga apabila pegawai kerajaan yang hidup mewah melebihi pendapatan biasanya disiasat.

“Tetapi apabila menteri atau orang awam tertentu diketahui hidup terlalu mewah, siasatan tidak dibuat.

“Sebaliknya orang yang membuat laporan polis berkenaan perkara tertentu disiasat,” kata Mahathir.

“Amatlah menyedihkan apabila ternampak ada pilih kasih dalam siasatan jenayah.”

Beliau justeru menegaskan bahawa setiap rakyat Malaysia tertakluk pada undang-undang sama dan negara ini sudah disenaraikan sebagai antara 10 negara yang rasuah berleluasa.|

Mahathir membangkitkan perkara itu ketika mengulas keengganan jabatan kerajaan bertanggungjawab bertindak terhadap dakwaan kehilangan wang 1MDB, syarikat pelaburan negara cetusan ilham Perdana Menteri Datuk Seri Najib Razak.

Sebaliknya, kata Mahathir, pihak yang membuat laporan polis dimufliskan, rumah dirampas dan disiasat kononnya membiayai gerakan keganasan dan penggubahan wang haram.

Bukan itu sahaja, kata Mahathir, pemberita juga ditangkap bawah Akta Hasutan dan kemudian dibebas kerana mereka sebenarnya tidak melakukan sebarang kesalahan.- mk

Rizalman tak berseluar serang Tania...



Rizalman dituduh tak berseluar serang Tania...

Bekas atase Malaysia ke New Zealand Muhammad Rizalman Ismail turut dituduh membuat serangan sumbang dengan menyentuh Tania Billingsley(pic.bawah) dalam keadaan tidak berseluar.

Dalam pertuduhan alternatif ditawarkan terhadap Rizalman di Mahkamah Tinggi Wellington, dia didakwa bertindak demikian di dalam bilik tidur Billingsley.

Rizalman, 39, berdepan dua pertuduhan utama.

Menurut butiran lanjut diperoleh Malaysiakini, bekas diplomat itu boleh dijatuhi hukuman maksimum tujuh tahun penjara.

Rizalman juga dituduh menceroboh rumah Billingsley dan menyerangnya dengan niat mengadakan pencabulan seksual.

Untuk dua pertuduhan utama itu, dia berdepan hukuman maksimum 10 tahun penjara untuk tiap kesalahan.

Perintah kediaman terhad

Rizalman pada 21 Novemver lalu dilapor mengaku tidak bersalah atas tuduhan serangan seksual dan pecah rumah dan minta dibicarakan.

Dia diekstradisi ke New Zealand untuk menghadapi tuduhan selepas kemelut diplomatik yang menyebabkan dia meninggalkan negara itu pada 22 Mei dengan kekebalan diplomatik.

Menurut laporan media, dia ketika itu telah menyerahkan pasport dan diletakkan bawah perintah berkurung bermula 7 malam hingga 7 pagi serta dilarang menghubungi pengadu.

Dia juga dihalang memasuki satu lorong di kota tersebut dan dua lagi kawasan di Wellington.

Rizalman didakwa menyerang Billingsley di kediaman wanita itu pada 9 Mei tahun lalu di ibu negara New Zealand. - mk



Rizalman caught with pants down, allegedly...

Muhammad Rizalman Ismail, Malaysia's former attaché to New Zealand was literally caught with his pants down when he was charged with indecent assault by touching Tania Billingsley in her bedroom while not wearing his lower clothing.

This is an alternative charge offered to the 39-year-old Rizalman at the Wellington High Court, besides two other main charges.

The details of the new charge was made available to Malaysiakini.

The former diplomat is staring at a maximum jail sentence of seven years if convicted.

Rizalman (photo) was also charged with burglary by having entered into Billingsley home, and for assaulting her with the intent to commit sexual violation.

For the two charges mentioned above, he is facing a maximum of 10 years in jail for each charge.




Created a diplomatic uproar

Rizalman created a diplomatic uproar when he was charged in May last year.

Instead of having him remain to face charges, the Malaysian allowed him to return home to be with his family.

News of him missing from New Zealand created an uproar and the incident was hotly-debated in the New Zealand Parliament and caused some problems to Prime Minister John Key.

Rizalman was then handed to the New Zealand authorities, with two Malaysian military officers accompanying him on a flight from Kuala Lumpur last October.

Following that he was charged again on Monday when he claimed trial at the High Court on the new alternative charge.

Rizalman's hearing is expected to commence in November with a pre-trial case management set in August.- mk
