Razak Baginda acquitted and discharged............

The High Court has acquitted and discharged political analyst Abdul Razak Abdullah Baginda, 48, on a charge of abetting in the murder of his estranged Mongolian lover Altantuya Shaariibuu in a long and sensational trial that had hogged the limelight since middle of last year.

Judge Datuk Mohd Zaki Md Yasin, who ruled that the prosecution had failed to make out a prima facie case against Abdul Razak, however ordered Chief Inspector Azilah Hadri and Corporal Sirul Azhar Umar to enter their defence for the murder of the Mongolian woman, who had an affair with Abdul Razak.

Mohd Zaki set Nov 10 for Azilah, 32, and Sirul Azhar, 36, who are members of the elite Special Action Squad (UTK), to make their defence.

Both men opted to testify under oath in making their defence. They could choose to give a statement from the dock or to not say anything.

The two policemen, who have always had their heads hooded with their clothes except when in the court room, are charged with murdering Altantuya, then 28, at a location between lots 12843 and 16735 in the Mukim of Bukit Raja here between 10 pm on OCt 19 and 1 am on Oct 20 2006.

Abdul Razak, who is the executive director of the Malaysia Strategic Research Centre, had been charged with abetting in the murder in the Federal Territory of Kuala Lumpur between 9.54 am on Oct 18 and 9.45 am on Oct 19 2006.

The charges carry the death penalty upon conviction.

The murder trial started on June 4 last year and the court sat for 151 days to hear the testimonies of 84 prosecution witnesses. Her murder was described as gruesome as her body was blown up with explosives, and during the trial, the murder scene was visited.

--------------------

But, the question remains unrequited as who ordered Azilah and Sirul to bump off Altantuya in such gruesome manner? Did Azilah and Sirul acted on their own accords......obviously NOPE! sure enough the 'arahan' comes from someone who has an interest in this case. Anyway, if they did it what was the motif?

As Leslie Lau said," But for his close friend Najib, this will be a bitter sweet moment. His friend is acquitted, but the acquittal will almost certainly give rise to more allegations against him."

Now Azilah and Sirul will face the gallows if convicted. Do you think these two guys will let the law takes its course or will they bear it all and bring down all those involved.........

An emergency motion on mega projects from Anwar.....

Opposition Leader Anwar Ibrahim has filed an emergency motion in Parliament today seeking a royal commission to probe into three controversial projects.

The three projects are the RM11.31bil high speed broadband project, the RM4.26bil purchase of the Bank Internasional Indonesia by Maybank and the RM1.7bil procurement of 12 units of the Eurocopter Cougar EC 725 helicopters.

Dewan Speaker Pandikar Amin Mulia will decide tomorrow if the emergency motion will be accepted and debated in the House.

In his motion, Anwar said that Najib, as the finance minister, had approved the broadband project in haste and at a high cost on Sept 16.

Similarly he added that Najib had on Sept 30 approved the purchase of Bank International Indonesia through Maybank, adding that it was a waste of the nation's funds as the shares were over-priced. And he claimed that the helicopter deal - which the government has now put off - was made in a dubious manner.

"Although the Prime Minister Abdullah Badawi had on Oct 28 announced that the government had decided to postpone the purchase, it had not removed people's doubt over the earlier decision to purchase the Eurocopter helicopters," he said in the motion.

Latest..........

Dewan Rakyat Speaker Pandikar Amin Mulia postponed to Monday his decision on the emergency motion by Opposition Leader Anwar Ibrahim to form a royal commission to probe three controversial 'mega projects'.

Pandikar said today the motion was received by the speaker’s office via fax only after 10am yesterday and therefore did not fulfill the Parliamentary Standing Order 18 (1) which requires the motion to be filed 24 hours before being tabled.

Well they will give all kind of excuses to deny any opposition's motion.............

When Valuecap has value, why need EPF's 5 billion ringgit...........

Valuecap, which was set up in 2002 to add liquidity and volume to the market, has met these objectives, according to Second Finance Minister Nor Mohamed Yakcop, whose brainchild it was. And it has been reported that since its inception to September 2007, Valuecap has paid out a total of RM135 million in dividends.

A check with the registrar of companies shows that it is in the black and has assets of RM7.5 billion. So Valuecap has some value. What’s not surprising is that despite the announcement of the RM5 billion infusion, the market continues to be in the doldrums, reflecting the weak sentiment about economic conditions as a whole.

The gomen wants to inject RM5 billion into Valuecap Sdn Bhd to “invest” in the stock market. This money is supposed to be borrowed from the EPF (your retirement money). This is the same EPF that has lent RM3 billion to the Bakun Dam developer.

Valuecap is a fund management firm established in 2002 to invest in the stock market. It is jointly owned by:

a. Khazanah Nasional Bhd, the government’s investment arm,
b. Permodalan Nasional Bhd, and
c. Retirement Fund (Incorporated) or KWAP, a statutory body established on 1 March 2007 under the Retirement Fund Act 2007 (which replaces the repealed Pensions Trust Fund Act 1991). KWAP was set up to assist the Federal Government in funding its liability of pension payouts.

Valuecap has an asset of 7.5 billion and about RM4.9 billion worth of investment in 70 listed companies and the company which has assets of well over RM7.5 billion had paid out a total of RM135 million in dividends since Sept 2007. These companies are from a variety of segments and include the YTL Group, the IJM group, Malayan Banking Bhd, Hong Leong Bank Bhd, Public Bank Bhd, Tenaga Nasional Bhd, Malaysian Oxygen Bhd, Amway (M) Holdings Bhd and PLUS Expressways Bhd. The list also shows that Valuecap has interest in Real Estate Investment Trusts (REIT) such as Axis REIT and Quill Capital Trust REIT.

Why EPF money??

1.The plan is to inject RM5 billion to Valuecap Sdn Bhd to invest in undervalued companies and the rest of the money on other assets.

2.What worries the shareholders, you and me is the lack of transparency because suddenly Najib has asked the Employee Provident Fund(EPF) to loan the government RM5 billion for this purpose.

3.It seems that everything is done in secrecy with no trace of where the RM5 billion goes to.

4. When our stock market conditions are so volatile do you think its good to use public money like EPF? Why can’t Khazanah, PNB and KWAP tap into other sources of funds?

5.What kind of return can the EPF expect to get from its loan to Valuecap and how does that expected return compare with more stable, less risky investments? The EPF is better off investing the money themselves.

6.Do we still need a gomen that robs peoples saving instead of using their own saving for their business? Imagine the billions they have wasted on mega projects and luxury life of their elite members? Rumours has it that his brother's bank is in the red and need a bailout.......

Why are we still ignorant about the strange things going in our country and still supporting villains who plunder national wealth.? Is EPF money the govt's money or workers' money saved for future retirement..?

Whats more strange is why borrow 5 million from EPF if Valuecap could make great profit by investing undervalued stocks?

Whats more strange is why borrow 5 million from EPF when the gomen says "Ekonomi kita tidak terjejas ,Malaysia tidak berada dalam krisis kewangan "?

Anwar says he is running out of options for the takeover......

Anwar's options to take power diminishing.......

Opposition leader Anwar Ibrahim, who has missed several deadlines to unseat the government, says he is running out of options to replace the ruling coalition.

Seven months after reducing the Barisan Nasional"s majority in Parliament in the March general election, he has failed to get BN lawmakers to cross over to the opposition and to table a vote of no confidence in Parliament in Prime Minister Abdullah Ahmad Badawi.

The premier's response was to accelerate a power handover to his deputy Najib Razak, according to Bloomberg.

"I'm not saying we have no options left, but I'm saying it's getting to be much more difficult," Anwar said in an interview with Bloomberg yesterday.

His three-party Pakatan Rakyat coalition remains confident it can woo the 30 BN MPs it needs to form a majority in Parliament after taking control of 5 of 13 states in the March elections, he said.

Anwar's assessment, the most pessimistic since the election, suggests the transfer of power to Najib will be smooth, removing the uncertainty that has contributed to a 37 per cent decline in the benchmark stock index this year, the report said.

"It's only right for Anwar to clarify Pakatan's stand to the public," regarding their diminishing options, Bloomberg quoted Tricia Yeoh, director of the Centre for Public Policy Studies, an independent research institute in Kuala Lumpur, as saying. "They should focus on administering the five states well and strengthening the bonds within the parties. This will demonstrate that they can be a formidable alternative federal government."

Anwar failed to meet his Sept 16 deadline to oust Abdullah, timed to coincide with the anniversary of the founding of Malaysia. He was also unable to persuade the prime minister to recall Parliament for a confidence vote or even meet with Abdullah to discuss a change of government.

According to Bloomberg, Anwar said he was exploring other options for a takeover that would be "peaceful and orderly" and adhere to the constitution, without elaborating.

Abdullah, 68, agreed this month to hand over power to Najib in March. Previously the transition had been planned for June 2010, three years before the next general election must be held.

In a separate interview, Bloomberg quoted former Prime Minister Dr.Mahathir Mohamad as saying that "the opposition wants Abdullah to carry on, because they believe if he leads the party in the next election, their chances would be enhanced".

Dr Mahathir, the nation's longest-serving leader, handpicked Abdullah as his successor, a decision he said he now regrets.

Anwar returned to Parliament in a by-election on Aug 26. He was fired as deputy prime minister by Dr Mahathir in 1998 and jailed on charges of having illegal sex with a man and abuse of power. The sodomy conviction was overturned in 2004.

Anwar is currently facing similar sex charges after a 23-year-old former male aide filed a complaint with police.

"They don't have a case. That I know for a fact," Anwar told Bloomberg. "What they want to do is to embarrass me."

Rais Yatim - Umno members look for money and not for good leaders........

Rais Yatim said he had been asked to pay for votes in the upcoming contest for top posts, and warned that money politics would destroy the party.

Rais, who is Foreign Minister said "the majority" of Umno members were more interested in making money out of the election than in voting for the right person.

"The majority of Umno people want to look for money and not for good leaders," said Rais, a member of Umno's Supreme Council who is vying for the vice-presidency.

"We have been approached under the cloak of assistance and cloak of contribution. (But) I'm not a player so you don't see my marks going up very high. If you want to be a good player, you have to say yes (to vote-buying)," he told reporters.

Rais, who has been with Umno for over 33 years, said the problem of money politics within the ruling party should be eradicated or it "will surely kill the party."

Umno, which has ruled Malaysia since independence, is holding meetings to nominate candidates for party posts after suffering major losses in polls this year. It will hold party elections next March.

"If Umno cannot curb this practice, Umno's future is done for because this has been (talked about) for the past two decades and it has not been curbed," he said.

In July, Umno asked the country's anti-corruption agency to help it battle vote-buying ahead of the heated battle for top leadership positions in the party.

Rais has only garnered five nominations of the 19 needed to contest in the party polls.

source:Daily Express, Sabah

-----------------------

Even at "cawangan level" money changed hands in thousands. UMNO members who can effort to depart with such an amount, no matter whether he is a good or bad leader he will be "ketua cawangan" in the end.

This money culture cultivated by UMNO will never end. Remember how money played an important part that denied Mahathir from being a "perwakilan" for his Bahagian? For that matter, the candidate that obtains the highest number of nominations doesnt mean he will be guaranteed of victory, coz, during the AGM millions of RM will be floating around in vote buying.

So Mukhriz, beware, though you might obtained the highest number of nominations for Ketua Pemuda, the so called underdog SIL might edge you for the post, by the power of the RINGGIT.

Lets money politics destroy UMNO for good..........

Thats where you(Ku Li) can come in...........

Ku Li kau fikir-fikirlah sendiri.............

'Arrest Khairy under ISA',says MCA Youth..........

A MCA Youth delegate today called on the authorities to detain Umno Youth deputy chief Khairy Jamaluddin under the Internal Security Act (ISA) for making racist remarks. He also wanted the security law to be invoked against suspended Umno Penang leader Ahmad Ismail who courted controversy recently by describing the Chinese in Malaysia as squatters.

Perak delegate Ting Tai Fook (right) made the call during the debates at the MCA Youth annual general meeting held at the party headquarters in Kuala Lumpur. Khairy was among the invited VIPs present.Ting took Khairy, who is also the son-in-law of Prime Minister Abdullah Ahmad Badawi, to task over his remarks concerning the ratio of the bumiputera and non-bumiputera quota on scholarships. He said such remarks were not only condoned by the Umno leadership but also paved the way for Ahmad to make similar offensive remarks. At this juncture, Ting said the ISA should not be used against civilians as seen in a crackdown last month.

“If we want to use ISA, let’s use ISA against these few people first [...] I also believe Khairy, this irresponsible leader will be defeated badly in the coming Umno Youth chief elections,” he said to applause from the delegates.

Way to go MCA....not only Khairy,Mahathir,Najib & a few more UMNO leaders too should be held under ISA for their racist remarks. Hope your wish comes true.........

Meanwhile Mahathir has called on Umno to toss out Abdullah's sycophants entirely from the party leadership or face the prospect of losing hold of the gomen.

“If Najib's gomen is to be different from that of Abdullah, then Abdullah ass-kissers must not be in” he stressed. But both Najib and Pat Lah has a common urge......make money as much as you can. Read here.

Solicitor General's findings implicate AG so says Kit Siang........

DAP stalwart Lim Kit Siang claimed that the findings of a probe by Solicitor-General Datuk Idrus Harun "implicate" Attorney-General (AG) Tan Sri Abdul Gani Patail and "confirm allegations" that Abdul Gani had fabricated evidence during the probe into Datuk Seri Anwar Ibrahim’s infamous ‘black eye’ incident 10 years ago.

Quoting "sources" during the debate on Budget 2009 in the Dewan Rakyat today, Lim said: "I have come to know that the solicitor-general found the AG guilty of abusing his power to fabricate evidence against Permatang Pauh (Anwar) and Gani should resign now," said Lim, adding thate there should be no delay in announcing the findings.

In July, Anwar said in a police report that Abdul Gani and Inspector-General of Police Tan Sri Musa Hassan, who was the investigating officer for the case 10 years ago, had fabricated evidence relating to the case. Lim said the probe by the solicitor-general was launched following this. Musa filed a defamation suit against Anwar after the report was lodged, and Abdul Gani threatened to do the same.

Last week, during Anwar’s sodomy trial at the Kuala Lumpur sessions court, his lawyer, Sulaiman Abdullah read out a document in court over why Abdul Gani should not be involved in any aspect of the case. The prosecution team had applied to transfer the case to the High Court but the defence argued on the validity of the transfer certificate that was signed by Abdul Gani.

The document read by Sulaiman contained claims by Datuk Mat Zain Ibrahim, the investigating officer into the black eye incident. Mat Zain, who retired from the force in 2001, had also been named in Anwar’s police report in June as having collaborated with Musa and Abdul Gani to fabricate the evidence.

Following this, Mat Zain filed a RM30 million defamation suit against Anwar and the document read in court by Sulaiman was from this suit.In the document, Mat Zian stated that Abdul Gani, then a senior DPP, had tampered with evidence, delayed investigations and concealed facts from the then AG, the late Mohtar Abdullah.

During today's debate, Lim also asked for the setting up of a Royal Commission of Enquiry to probe into the allegations on the involvement of Deputy Prime Minister Datuk Seri Najib Abdul Razak in the murder of Mongolian Altantuya Shaariibuu in October 2006.

The gomen's logic of paying more for less............

Another scandal appears to be hovering over the Defence Ministry and this time it concerns the purchase of helicopters to replace the armed forces' aging and accident-prone fleet of Nuri aircraft. The issue was highlighted in two letters last week - dated Oct 7 and 9 respectively - addressed to former defence minister Najib Abdul Razak, who is also deputy prime minister and finance minister.

In a five-page letter obtained by Malaysiakini, Mentari Services Sdn Bhd chairperson Capt (rtd) Zahar Hashim outlined several discrepancies and questioned the legitimacy of the deal to buy a dozen of choppers from German-French firm Eurocopter. Among others, he stated in another letter on Oct 9 - which bore corrections to the prices stated in the first letter - that the government could have purchased same number of helicopters and save almost RM1.5 billion.

"(With) the price offered by Eurocopter for 12 units of Cougar EC-725 worth (an estimated of) RM2.3I7 billion, the government could purchase 30 Kazan-M172 (from Kelowna Flightcraft Ltd) which fulfills almost all the specifications required by the armed forces," he said.

He said the offer from Kelowna for a dozen of similar choppers was RM898 million.

"The difference in the price offered by Eurocopter and the price offered by Kelowna Flightcraft Ltd is RM1.419 billion."

Zahar's Mentari Services is believed to be representing Canadian-based Kelowna Flightcraft - one of the three companies which had unsuccessfully bid for the multi-billion ringgit contract. The other two companies which lost out to Eurocopter in clinching the contract were British-Italian's AgustaWestland and American-owned Sikorsky, the manufacturer of the famous Black Hawk copters.

In the first letter, Zahar had quoted the statements made by Prime Minister Abdullah Ahmad Badawi, who took over the defence portfolio on Sept 17, regarding this matter. Among others, the premier was quoted by the New Straits Times as saying: "We have signed the Letter of Intent (LOI) with Eurocopter. Mindef (Defence Ministry) has taken into consideration its needs and Eurocopter presented the best option among all the bidders."

Meanwhile, the Star quoted Abdullah as stating that the ministry had considered all the necessary specifications in the helicopters before making the decision. The deal was signed two days before Najib swapped portfolios with Abdullah.

Najib gave PM 'inaccurate report'

However, Zahar said these statements did not reflect the reality of the situation based on the information his company and other bidders had received from ministry sources.

"We believe that you (Najib) had provided Abdullah with an inaccurate report," he wrote.

"We have been made to understand that the evaluation process had not been completed but suddenly an order was given by a certain quarter for the LOI to be issued to Eurocopter.

"The LOI was signed by a mid-ranking official in the ministry and was dated Sept 15 - two days before you moved from the Defence Ministry to the Finance Ministry," he added.

Zahar questioned the manner the deal was hastily sealed.

He said, according to his sources, only the evaluation of the tender documents submitted by the respective bidders had been completed.

"Physical evaluations such as inspecting the premises and factories of the bidders and conducting test flights were not carried out because permission from the upper echelon of the defence and finance ministries have not been obtained.

"Physical evaluation is more important than documentary evaluation and the personnel involved are surprised to find out that the LOI was issued without any physical evaluation," he added.

In the letter, Zahar also mentioned that a former chief secretary of the Defence Ministry and a former deputy chief secretary of the Finance Ministry found the issuance of the LOI to be 'rather extraordinary'.

"According to them, normally a LOI is issued upon the completion of an overall evaluation and after a committee comprising representatives from the two ministries reach a consensus that the product is the best under the allocated budget.

"They also found it 'amazing' that a government servant with the status of division secretary and not someone who was at least a deputy chief secretary had inked the LOI for a contract worth more than RM2 billion," decried Zahar.

What was more 'extraordinary', Zahar claimed, was the 'quick' decision by Najib, with or without the knowledge of the prime minister, to have the contract documents prepared immediately so that the government could sign it.

Based on the information received, he said the four suppliers including Eurocopter had offered aircraft that 'fully or almost fully' met the specifications stipulated by the ministry.

Not interested in test flights

"We do not know if representatives from (bidders) Eurocopter and AgustaWestland were called in by the evaluation team for negotiations and to provide further explanations regarding their offers, but the representatives of Kelowna and Sikorsky were never contacted at all.

"The offer to you (Najib) from our company to prepare a Kazan MI-172 to be used and tested by the armed forces for six months for free did not attract you. The offer by Sikorsky for a test flight of their S-92 helicopter was also not entertained," he said.

"The manner in which the Cougar EC-725 (right) was chosen creates doubt if the ministry, under your stewardship, was truly serious, clean and trustworthy in its move to evaluate all the offers from the bidders or is there a possibility that the evaluation process was merely a gimmick while (you) had already planned from the onset to purchase the Cougar EC-725 for specific reasons.

"If looked at logically, it does not make sense for the ministry to decide to purchase a helicopter worth almost RM200 million per unit without meeting the sales representatives and conducting test flights.

"Even a person who intends to buy a car worth RM1 million would ask the salesman many questions and do a test drive of two or three different brands before choosing the one which is most suitable," he noted.

Zahar also said that under the prevailing economic conditions and with the government calling on the people to be careful with their spending, it was ironic that the government opted to purchase an expensive helicopter when there were cheaper alternatives available.

"How many development projects beneficial to the people would have to be sacrificed because of this wastage?" he asked.

Zahar also pointed out that it would be costlier to maintain the Eurocopter aircraft as opposed to the Russian-made Kazan MI-172 (left).

"As far as we know only the French armed forces own Cougar EC-725 (14 units) and this is not surprising because France has an interest in EADS, the parent company of Eurocopter," he said, adding that the European nation could afford such expensive aircraft in its arsenal.

On the other hand, he said 12,000 Kazan MI-172 of various versions have been sold and are used by 60 countries while two of the older units have been used by the Malaysian Fire and Rescue Department since 1988.

'Penny wise, pound foolish'

The retired army captain also urged government leaders to be prudent when spending the taxpayers' money.

"In the issue of purchasing cars, the federal government had been very calculative. Apparently, Proton Perdana was sufficient for cabinet ministers and state executive councillors so there was no need to buy Mercedes Benz (as what happened in Terengganu recently).

"The manner and attitude of the government in spending public money could be described by the adage, 'penny wise, pound foolish'," he said.

Apart from this, Zahar also revealed that his company was made to understand that the Connecticut-based Sikorsky had voiced its disappointment to the United States ambassador in Malaysia over the manner in which the government handled the tender process.

"The foreign and local business communities have the perception that the political situation in our country is in chaos and the awarding of projects and contracts are not done in a transparent or clean manner.

"After having personally witnessed how the contract to replace the Nuri helicopters was handled, it is hard not to believe the allegations that the hundreds of millions in acquisition for the ministry under your leadership are questionable. Let not the disease spread to the Finance Ministry (now under Najib) and cause a financial tsunami for the nation," he said.

In the last paragraph of his hard-hitting letter, Zahar posed a question to the deputy premier: "If the tender evaluation process was only a comparison of brochures and tender documents, why was there a need to make it compulsory for the bidders to deposit a bank draft worth RM1 million to the government?"

Najib had called off a press conference scheduled last night and did not meet with journalists in Parliament this morning. However, Najib told journalists later that he would providing an explanation on the matter in Parliament.

Zahar also sent copies of his letters to Abdullah and the Anti-Corruption Agency.

Return of Mahathirism and the making of Rosmahism.............

Former de facto Law Minister Datuk Zaid Ibrahim says Datuk Seri Najib Razak’s impending rise to become Umno president and Prime Minister marks the return of “Mahathirism”.

Tun Dr Mahathir Mohamad, he said, will become Malaysia’s “de facto PM”, standing behind Najib.

He said the fall of Prime Minister Datuk Seri Abdullah Ahmad Badawi is a result of Dr Mahathir prevailing.

Zaid, who resigned recently from Abdullah's Cabinet in protest against the use of the Internal Security Act, said he did not expect Najib to continue Abdullah's reform agenda once he takes over.

"Legal and constitutional reforms make you less powerful, more accountable and less able to use the privileges of power.

"Why would someone trained and schooled by Dr Mahathir introduce reforms. Have you heard Najib speak of reforms?” he told The Malaysian Insider.

Zaid said he expects Najib's administration to be more authoritarian with more controls and restrictions compared to that of Abdullah's.

Abdullah, he said, believed in reforms, but "he did not have the stomach" to push through the change needed.

Mahathir chastised Pat Lah for being a weak leader. Mahathir quits UMNO coz he couldnt bear the sight of Pat Lah.He thought that UMNO members will follow him in droves, but UMNO diehards just wont accept Mahathir's rationale for leaving.

Muhyiddin 'pujuk' Mahathir to return to UMNO. Sensing that Pat Lah's imminent removal,Mahathir agreed in toto to be back in UMNO but not until Pat Lah is gone.Muhyiddin is teaming up with Najib and is aiming for the deputy post.So you can see how cunning the trio works - Mahathir,Najib and Muyiddin?

Pat Lah has promised to transfer power in March 2009 but only to whoever wins the UMNO presidency. Here's where Mahathir comes into play and he must make sure that Najib wins if Mahathir wants to push his ideas in the new gomen. Initially, Mahathir supported Ku Li for UMNO presidency but Mahathir knows too well that Ku Li will never get enough nominations. The best thing Mahathir can do is to openly supports Najib.

Najib is only a follower and never a leader. Najib can be the PM but Rosmah and Mahathir will be the decision makers. Who will be the de facto PM - Mahathir or Rosmah? and while Mahathirism has return,Rosmahism is an added dimension.......

Malaysia still needs a change of gomen.............

Anwar Ibrahim emphatically reiterated his stand that there must be a change of government for Malaysia to progress. He noted that a change of leadership in Umno would have no effect. "The problem is the system," he told reporters at the lobby of the Jalan Duta court complex when commenting on yesterday's Barisan Nasional supreme council meeting in which Prime Minister Datuk Seri Abdullah Ahmad Badawi announced his decision not to defend his presidency in the upcoming Umno elections.

It has been the norm for the leader of Umno to hold the position of prime minister. Abdullah's decision not to contest means he will be stepping down also as prime minister, paving the way for the next elected president to take over if BN remains in power. Abdullah pledged to complete his promised reforms before leaving office next March. Anwar was sceptical, however, of the outgoing prime minister, and expressed doubts that he would be able to fulfil in the next five months what he failed to do in the past five years.

"Are we expected to believe that he can?" he asked. "If he does, well and good; good for him and good for the country," he quipped.

Asked if he thought Datuk Seri Najib Razak, who is tipped to take over the reins, would be able to effect positive change in the government's policies on issues such as the independence of the judiciary and economic management, he answered in the negative.

"With Najib... the answer is categorically no," he emphasised. "Change must happen. A change in the leadership of the BN will have no effect," he added. Anwar was in court today for a hearing on the Sodomy II charge.

Meanwhile the court hearing of Anwar's case was adjourned to Oct 31 to accommodate Anwar’s presence in Parliament when it reconvenes on Monday. Read here.

The in-coming PM Najib Tun Razak today called on the people to reject any form of unruly behaviour towards the country’s leaders.Najib said the gomen did not want such behaviour to become a norm because it could undermine unity and security of the country.

Hellooooo.....Mr. Najib the PM 'to be'...... do you condone these behaviour................

or this.........

The race for UMNO's no 2 position is getting overcrowded now. Today the "I No Speak Ingglish" guy too has entered the race, saying "I am offering myself for the party because the position is vacant," Well, probably he thinks he can make more dough being in that position.

Muhyiddin should go for broke and challenge Najib for the top post. While Ku Li should not waste his time thinking how to garner 60 nominations but instead team up with Pakatan Rakyat to form the next gomen...............

Pat Lah to quit in March 2009...............

Abdullah Ahmad Badawi will step down as PM and Umno president in March next year, ending days of intense speculation on his decision.

Here is Pat Lah's full statement:

1. I have been in public service for over 45 years. I have served this country as a civil servant, and as an elected representative of the people. I have served as a member of government and feel blessed to serve in the highest office in the land. I have seen this country grow from a small, poor nation into the modern, prosperous Malaysia that we live in today.

2. Despite our successful track record, for the past few years I have firmly believed that our nation is standing at an historic crossroads. We must reform some elements of our nation, we must evolve and mature, or we risk losing all that we have gained in over 50 years. Throughout this time of reform and transformation, we Malaysians need to be united now more than ever before.

3. In all my years of service, I have always been guided by my conscience. I have always placed the interests of the nation above all else. It is with this in mind that I announce I will not stand for the Presidency of Umno. I do not want a divided party and governing coalition, but one that is united and harmonious. A united Barisan Nasional is vital in order for the country to face the global challenges ahead and for Malaysia to become a fully developed nation, with prosperity and fairness for all.

4. My current term as President of Umno ends in March next year. There are several initiatives I intend to see through before I leave office. These initiatives are important because they are necessary to move our country forward. These initiatives are needed to regain our country's competitiveness. They are necessary to enable our nation and our society to face the challenges that the world has in store for us. I ask all Malaysians to unite and join me in working towards making Malaysia a better place.

5. First, our institutions need to be reformed and strengthened.

• The judiciary needs to enhance its stature and credibility in the eyes of the public. Before I end my term, I will table a Parliamentary Bill to establish a Judicial Appointments Commission. Such a Commission will propose judicial appointments in a transparent and merit-based manner.
• We also need a strong and effective anti-corruption body that can combat the cancer of corruption without fear or favour. Before the end of the year, I will table a Parliamentary Bill to establish the Malaysian Anti-Corruption Commission, with greater powers of investigation and enforcement. The Commission's oversight structure has been modelled after the successful ICAC in Hong Kong.
• I also intend to complete the establishment of a Special Complaints Commission to enhance the integrity and effectiveness of enforcement agencies.

6. Second, I have long spoken about the need to ensure that the fruits of growth are more equitably distributed. In the recent Budget, I explained the government's commitment to strengthening and enlarging the Social Safety Net. We will speed up work on this front to help poor and disadvantaged Malaysians, regardless of background, race or religion. I will also work to ensure that tangible results can begin to be enjoyed in Iskandar, as well as the development corridor initiatives around the country.

7. Third, I would like to see the Government and BN renew their commitment towards building a united and harmonious nation. Society has seen an alarming decline in inter-racial and inter-religious relations. Various issues have cropped up which threaten to tear the very fabric of Malaysian life. We need to tackle these issues head-on, through dialogue; deal with the issues constructively and even-handedly; ensure greater clarity and certainty for the people; and focus on the points that unite us, rather than the points that divide us. For this reason, I will convene a BN Convention early next year. This is a long-term effort that I hope to kick-start and continue to contribute towards.

8. I fully intend to see through my mission, and I am sure that my successor will carry on this agenda. I want to hand over to my successor a Malaysia that is capable of weathering the challenges of a dangerous global economy, a Malaysia not of rich and poor, of young and old or of the city or the kampong, not of south and north, and not of one religion or another but of unity and harmony. This is not the time for infighting and narrow politics but for greatness, unity and cooperation.

----------------

When asked,who is your successor?

Pat Lah replied, "I hope it is Najib. Why do I say hope? Najib has to stand for Umno elections first. Once he wins the elections and becomes party president then we will discuss about it (the power transfer)".

Asked to comment on Najib Tun Razak as the possible PM, Mahathir said he was not impressed with Najib's performance as deputy prime minister now. Mahathir described Najib as an incompetent deputy prime minister because the latter did not have his own stand and was always following Abdullah's advice, hence Najib needed to change when taking over the helm later. On the possible candidate for Najib's deputy, Mahathir said it should be Muhyiddin Yassin, adding that the other current contenders for the post of Umno deputy president were only "jokers".

I tend to agree with Mahathir here and I couldnt care less if Najib is PM,though. I hope Najib will be defeated in UMNO's party election in March 2009.

Muhyiddin should challenge Najib for UMNO's presidency not for the no.2 post, and I cant imagine what will happen to our country when 'penyamun' like Ali Rustam becoming DPM? However,I hope Ku Li will be triumphant in the end to be UMNO's president and leader of the opposition when the new gomen(PR) comes into power soon.

On thing for sure is that Pat Lah never say he will give the Premiership on a silver platter, not even to Najib...... so if they want it, they gonna fight for it, and lets enjoy the show gang!.......

cheers.

Perbicaraan Anwar - Kes Pindah Mahkamah Di Tangguh Lagi......

Prosecution’s bid to transfer case to High Court is puzzling.......

Datuk Seri Anwar Ibrahim's lawyer today argued in court against the involvement of the Attorney-General in the politician's sodomy trial, saying that the two men had a "bad relationship and unresolved matters".

Lawyer Sulaiman Abdullah told Sessions judge S.M.Komathy Suppiah: "Based on past records and events, it is abundantly clear that DSAI (Datuk Seri Anwar Ibrahim) and the AG have a bad relationship and unresolved matter, which require further investigations.

"There exists a reasoned perception that the AG has an "axe to grind" against DSAI."

Sulaiman said Prime Minister Datuk Seri Abdullah Ahmad Badawi had publicly stated that the AG Tan Sri Abdul Gani Patail would not be involved in respect of this case against Anwar.

"At the last mention on Sept 10, it was conceeded by the prosecution that this was their position as well. Given this, it has given rise to a legitimate expectation (in favour of DSAI and the member of the public) that the AG indeed would have no role to play in the conduct of the prosecution against Anwar."

He said on Aug 7, when Anwar was first charged in court, Solicitor-General Datuk Idrus Harun led the prosecution team. "This was consistent with the position that the AG had been disqualified from handling the case."

"However, on Sept 10, the AG's hand (his signature on the transfer certificate dated Sept 9) in the case became evident. The honourable Solicitor-General no longer led the prosecution team," said Sulaiman.

He said before the AG signed the transfer certificate, the AG must apply his mind to the facts of the case and consider the reasons justifying a transfer, and that this is not a mechanical process whereby the AG purely "rubber-stamps" or endorses the certificate.

He said in a situation where there is a conflict of interest or real danger or suspicion or likelihood of bias, the AG is automatically disqualified from making decision to transfer the case. He said Anwar had lodged a complaint against the AG and that the AG had threatened Anwar with a civil suit.

(In his affidavit of Sept 22, 2008, Anwar said he lodged a police report against Gani on July 1, 2008 and that Gani had filed a letter of demand dated July 11, 2008.)

Sulaiman said the PM's representation has not been revoked or contradicted and continues.

"It is therefore surprising that the AG has stepped into the arena (from which, he has been barred) by signing the transfer certificate."

He submitted that the court should reject the transfer certificate so as to uphold Anwar's expectation that the AG would not be involved in the case.

"Without the involvement of the AG, no transfer certificate may be signed validly. The certificate dated Sept 9 is null and void," said Sulaiman.

Earlier in the morning when the trial started, judge Komathy ruled that her court has the discretion to hear submissions on the defence objection questioning the validity of the certificate produced by the prosecution to transfer Anwar's case to the High Court.

She rejected ae preliminary objection by the prosecution which contended that it was mandatory for the Sessions Court, under Section 418A (3) of the Criminal Procedure Code, to transfer the case to the High Court once the transfer certificate had been issued by the prosecution.

She made the decision based on four cases, including the corruption case of former Sawit Kinabalu Group managing director Datuk Wasli Mohamad Said where it was held that the Sessions Court had the jurisdiction to determine the validity of the transfer certificate in question.

She also denied the application by Datuk Mohamed Yusof Zainal Abiden, head of the prosecution unit in the Attorney-General's Chambers, for a stay of execution of her decision pending the prosecution's filing for revision at the High Court.

However, Komathy granted the prosecution's application for the AG and Solicitor-General to file affidavits to support its (prosecution) submission on the defence objection. The submission by Sulaiman continues today (Wednesday). The prosecution will also submit today.

Anwar, 60, is charged with voluntarily committing carnal intercourse against the order of nature with his former aide, Mohamad Saiful Bukhari Azlan, 23, at Unit 11-5-1, Desa Damansara Condominium, Jalan Setiakasih, Bukit Damansara between 3.01pm and 4.30pm on June 26.

---------------

PM Pat Lah had said before that in no uncertain terms AG Abdul Ghani Patail should not be involved in any way in the case. But,by signing the transfer order the AG had blatantly shows disrespect on Pat Lah's order and now he is directly involved in this case.

Before delivering her ruling today, Judge Komathy had turned towards lead prosecutor Mohd Yusof and dropped a remark puzzling those in court.

"Do I look nervous? I am," she said, without elaborating.

Why was she nervous? Could it be that she knew that she had to face the consequence latter?

Judge Komathy had made her initial ruling that she has the jurisdiction to hear the defence team's argument against the transfer of the case, but her dilemma isnt over yet.

Will there be a repercussion and would the honourable judge earn the wrath of the 'warlords' who walk the corridors of power? Judge Komathy could even be transferred because of the unfavorable decision. Is that what she meant by the phrase "do I look nervous? I am".

Read here, here, here and here.

For now this is a psychological victory for Anwar.........

Malaysia Today is accessible to others, MCMC official testifies in RPK's sedition trial.........

The sedition trial of blogger Raja Petra Kamarudin kicked off today with the defence pointing out that several entries in his news portal Malaysia-Today.net were posted during his Sept 12 detention under the Internal Security Act (ISA).

Raja Petra's counsel, J. Chandra, pointed this out during the cross-examination of the prosecution's first witness, Malaysian Communications and Multimedia Commission deputy director Harme Mohamed, at the sessions court here.

Harme, who was called as an expert witness, said it could be possible for someone to have access to the news portal to post the article titled 'Let's send the Altantuya murderers to hell' on April 25 under Raja Petra's byline without his consent or knowledge.

Chandra first asked Harme whether he was aware Raja Petra has been under remand since Sept 12, to which Harme replied in the affirmative.

Chandra: There have since been postings on No Holds Barred (a section in Malaysia-Today)?

Harme
: Yes.

Chandra: There were several postings with the RPK byline. Do you agree?
Harme: Yes.

Chandra: He has been under the ISA and bylines have been coming out under his name. Who is doing the postings?

Harme
: Somebody else.

Chandra: Would you then agree that there are others who have access to the website?

Harme
: Yes.

Chandra had earlier tried to establish that it would have been impossible for Raja Petra to monitor all traffic on Malaysia-Today.net.

Harme agreed with Chandra that a posting of an article could be done by anyone having access to username or password for Malaysia-Today. He also agreed that Malaysia-Today is accessible worldwide at any time of the day or week and that the owner would not be able to fully monitor web traffic.

When he took the stand, Harme gave a four-hour "lecture" on the workings of emails, websites, Internet service providers, Wikipedia, web-hosters and blogs during the examination-in-chief by deputy public prosecutor Farhan Read.

He explained that all one needed to access a website as an administrator was the administrator's user name and password.

This point was brought up again in the cross-examination.

To a question by Chandra, Harme agreed that to access a particular website, the administrator has his own user name and password, and that the information could be shared by other people.

Chandra: So, when you see a posting on a blog or website, you do not know who could have posted it, anyone could have access to the user name and password. Do you agree?

Harme
: Yes.

During the cross-examination session by RPK's counsel J Chandra, it was also revealed that Harme, is a Malaysia Today reader since 2007 and browsed through the contents to the website at least once a week.

To Chandra's suggestions, on his impression on the web portal, he answered positively that the contents of the website "condones corruption, denounce money-politics, denounce ethnic polarisation, advocates transparency, accountability and justice".

Raja Petra, who arrived in court to the cheers of more than 60 supporters, including DAP veteran Lim Kit Siang and Selangor state executive councillor Ronnie Liu, said he was looking forward to the abolition of the ISA and other laws restrictive of freedom.

"I dream of the day the government will be brought down, and we will abolish all draconian laws," said Raja Petra, who cited the Official Secrets Act, the Printing and Presses Act and the Sedition Act as well as the ISA as "draconian laws".

The sedition trial, which is being presided over by Justice Rozina Ayob, is set to go on through this week over Raja Petra's article entitled 'Let's send the Altantuya murderers to hell' posted on Malaysia-Today on April 25.

He was charged on May 6 with committing the offence at his house on Jalan BRP 5/5, Bukit Rahman Putra in Sungai Buloh on April 25. If convicted, he can be fined a maximum of RM5,000 or jailed up to three years or both under Section 4(1)(c) of the Act.

After he was charged, Raja Petra was served with a two-year detention order under the ISA on Sept 22 and is now detained at the Kamunting detention camp in Perak.

Zaid sees 'no future in Umno' ..............

The former de facto law minister who quit in protest over recent Internal Security Act (ISA) arrests has criticised his own party, Umno, for contributing to racial tension in Malaysia.

Datuk Zaid Ibrahim, who is rumoured to be thinking of leaving the ruling party, blamed a 'culture of fear' for the country's race relation problems. He said that 'those with political power' had left race relations a sensitive issue even after 50 years of independence.

'When we face an issue, we cannot discuss it, we cannot debate it. We only use fear or we take to the streets. That is not the way things are done in a mature society,' he said.

The former minister in the Prime Minister's Department aired his views in an interview with the Chinese-language Sin Chew Daily, his most extensive since he resigned over recent arrests under the ISA.The interview also came soon after Mr Zaid wrote an open letter to Prime Minister Abdullah Badawi arguing for the Act to be repealed. In it, he accused his party of using race politics to win support.

'Umno feels that it is a party needed by the Malays. Umno leaders keep telling the Malays that they are constantly in danger and therefore need Umno,' he was quoted as saying by online news portal The Malaysian Insider.

'They always feel that only they know what is good for the Malays.'

Calling for more open debate on race issues, he said it was no longer necessary for 'one party to represent one race' anymore.

Mr Zaid himself has been at the centre of speculation that he would leave Umno for the opposition. He did not comment on this in the Sin Chew Daily interview, but appeared to hint at it when speaking to the New Straits Times.

'I have given 20 years of my political life (to Umno) and I have got into a lot of difficulties because of my views, and not that I was disloyal,' he was quoted as saying.

'I have been suspended from the party for nothing and the latest, disqualified from running for (the Kota Baru) division election.

'So what do you want me to do if you are in my position?'
